RECOMMENDED ACTION:
Adopt Ordinance No. CS-113. amending Section 21.05.030 of the Carlsbad Municipal Code
by an amendment to the Zoning Map to grant a zone change, ZC 09-07 from Planned Industrial
and Open Space to Planned Industrial/Office and Open Space, on property generally located
north of Palomar Airport Road, east and west of College Boulevard, and south of Faraday
Avenue within the boundaries of the Carlsbad Municipal Golf Course, in Local Facilities
Management Zones 5 and 8; and
Adopt Ordinace No. CS-114. adopting Specific Plan amendment SP 181(G), and repealing SP
199(B) on property generally located north of Palomar Airport Road, east and west of College
Boulevard, and south of Faraday Avenue within the boundaries of the Carlsbad Municipal Golf
Course, in Local Facilities Management Zones 5 and 8.
ITEM EXPLANATION:
Ordinance Nos. CS-113 and CS-114 were introduced and first read at the City Council
meeting held on November 30, 2010. The second reading allows the City Council to adopt the
ordinances which will become effective thirty days after adoption. The City Clerk will have the
ordinances published within fifteen days, if adopted. (Notwithstanding, the preceding.
Ordinance No. CS-113 shall not be effective until approved by the California Coastal
Commission.)
FISCAL IMPACT:
See AB #20,408 on file in the Office of the City Clerk.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15738, this
action does not constitute a "project" within the meaning of CEQA and therefore, does not
require additional environmental review.

10 The City Council of the City of Carlsbad, California, does hereby resolve as
follows:

SECTION I: That Section 21.050.30 of the Carlsbad Municipal Code, being the

zoning map, is amended as shown on the map marked Exhibit "ZC 09-07," dated September
15, 2010 attached hereto and made a part hereof.14
SECTION II: That the findings and conditions of the Planning Commission as set
forth in Planning Commission Resolution No. 6716 constitute the findings and conditions of the16
City Council.
EFFECTIVE DATE: This ordinance shall be effective no sooner than thirty days1 o
after its adoption but not until Local Coastal Program Amendment LCPA 09-06 is approved by
the California Coastal Commission, and the City Clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in a publication of general circulation in the
~~ City of Carlsbad within fifteen days after its adoption.

The City Council of the City of Carlsbad, California, does ordain as follows:

WHEREAS, the Carlsbad Airport Centre Specific Plan (SP 181) was originally
10
adopted by City Council Ordinance No. 9635 on August 3, 1982 and has since been amended
(SP 181(F)) and contains the uses, development standards and design guidelines for the
development of the Carlsbad Airport Centre property; and
WHEREAS, the College Business Park Specific Plan (SP 199) was originally

adopted by City Council Ordinance No. 9821 on November 12, 1986 and contains the uses,
development standards and design guidelines for the development of the College Business16
Park property; and
WHEREAS, the City Council of the City of Carlsbad has reviewed and18
considered Specific Plan Amendment SP 181(G) for the Carlsbad Airport Centre Specific Plan
and SP 199(B) for the repeal of the College Business Park Specific Plan; and
WHEREAS, after procedures in accordance with requirements of law, the City
-~ Council has determined that the public interest indicates that said Specific Plan Amendments
SP 181(G) and SP 199(B) be approved.
NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as
25 follows:
SECTION 1: That Specific Plan Amendment SP 181(G) and repeal of SP 199, on
27 file in the Planning Department, and incorporated herein by reference, are adopted. The

1 Carlsbad Airport Centre Specific Plan (SP 181(G)) shall constitute the development plan for the
2 Carlsbad Airport Centre property and all development within the plan area shall conform to the
3 plan. The property formerly included within the College Business Park Specific Plan shall be
4 subject to the development standards of the appropriate underlying zoning designation as shown
5 on the City's Zoning Map.
6 SECTION 2: That the Carlsbad Airport Centre Specific Plan (SP 181), as
7 amended to date, and further amended by Specific Plan Amendment SP 181(G), dated
8 September 15, 2010, is approved.
9 SECTION 3: That Specific Plan Amendment SP 181(G) is as shown on Exhibit
10 "SP181(G)".
11 SECTION 4: That the College Business Park Specific Plan SP 199 is repealed in
12 its entirety and no longer valid.
13 SECTION 5: That the findings and conditions of the Planning Commission in
14 Planning Commission Resolution No. 6718 shall constitute the findings and conditions of the
15 City Council.
