DEPT. 20,435 1/25/11 P&R EXECUTE AMENDMENT NO 1 TO MEMORANDUM OF UNDERSTANDING WITH SANDAG PROVIDING FINANCIAL SUPPORT TO THE SANDAG REGIONAL BEACH SAND PROJECT II (RBSP II) DEPT. DIRECTOR CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Adopt Resolution No. 2011-010 authorizing the Mayor to execute Amendment No 1 to the Memorandum of Understanding with the San Diego Association of Governments (SANDAG) supporting a Regional Beach Sand Project and committing to funding biological and shoreline monitoring, planning contingency as needed to fulfill permitting requirements, and construction management. ITEM EXPLANATION: In September 2001, SANDAG completed construction of the Regional Beach Sand Project (RBSP) which placed approximately 2.1 million cubic yards of clean, beach-quality sand on 12 eroded beaches from Imperial Beach to Oceanside. The $17.5 million RBSP was a first-of-its- kind regional pilot sand restoration project on the west coast that demonstrated the feasibility of beach replenishment in the San Diego region and confirmed the project's objective of replenishing the region's beaches without negatively impacting the environment. In October 2008, SANDAG began the preliminary planning activities associated with rebuilding the RBSP, known as RBSP II. The current tasks in Phase 1 include the preparation of final engineering plans, the preparation and certification of a project EIR/EIS, securing the required resource agency permits, and the development of the construction bid documents. RBSP II is projected to begin pumping sand onto the region's beaches in the spring of 2012. Sandag was awarded $19.5M in funding from the California Department of Boating and Waterways (DBW) covering approximately 85% of the estimated project cost for RBSP II. Subsequently, SANDAG requested each coastal city enter into a Memorandum of Understanding (MOU) committing to the funding of their proportional share of the remaining 15% of the project costs. On May 5, 2009 the Carlsbad City Council adopted Resolution No. 2009-084 executing an MOU partnering with SANDAG and participating coastal cities of San Diego county agreeing to a cost share allocation providing funding of the 15% local cost. Carlsbad's share was $41,936 which covers the costs for the current tasks in Phase 1. SANDAG is requesting the participating coastal cities approve Amendment No. 1 which provides a cost share for Phase 2 of the project which includes funds for biological and shoreline monitoring, planning contingency as needed to fulfill permitting requirements, and construction management. The project proposed to complete the preliminary engineering, environmental review documentation, resource agency permit applications, final design, and the preparation of construction documents. On February 13, 2007 the City Council approved the Agricultural Conversion Mitigation Fee Ad Hoc Citizens Committee's recommendation to provide $1,500,000 for the beach nourishment project. Staff is recommending that the requested $65,150 for Carlsbad's pro-rated share of the biological and shoreline monitoring, planning contingency as needed to fulfill permitting requirements, and construction management for RBSP II be funded from the ACMF already awarded to the Carlsbad Beach Nourishments Project. The City Council previously authorized $116,436 in ACMF - $74,500 for the preparation of a feasibility study, and $41,936 for Carlsbad's share of the costs for the current tasks in Phase 1 of the project. With the recommended $65,150 allocation in ACMF, a balance of $1,318,414 remains available for future phases of this project. ENVIRONMENTAL IMPACT: The proposed action to approve an MOU amendment is exempt from the California Environmental Quality Act (CEQA) by the general rule, as it can be seen with certainty that there is no possibility the activity in question may have a significant effect on the environment. SANDAG is acting as the lead agency for the beach sand project, which requires preparation and certification of a project EIR/EIS. SANDAG is expected to release the draft environmental document in early 2011. The requested funding allocation supports anticipated activities, such as biological and shoreline monitoring, that will be needed to carry out the project consistent with the analysis in the pending draft environmental document. Amendment 1 to Memorandum of Understanding #5001253 between San Diego Association of Governments and San Diego Region's Participating Coastal Jurisdictions regarding Regional Beach Sand Replenishment Project II. 1 RESOLUTION NO. 2011-010 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR TO 3 EXECUTE AMENDMENT NO. 1 TO THE MEMORANDUM OF UNDERSTANDING WITH THE SAN DIEGO ASSOCIATION OF 4 GOVERNMENTS (SANDAG) SUPPORTING A REGIONAL BEACH SAND PROJECT AND BIOLOGICAL AND SHORELINE 5 MONITORING, PLANNING CONTINGENCY AS NEEDED TO FULFILL PERMITTING REQUIREMENTS, AND CONSTRUCTION 6 MANAGEMENT. 7 WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary and in the public interest to execute Amendment No. 1 to the Memorandum of Understanding with the San Diego Association of Governments (SANDAG) supporting a Regional Beach Sand Project and committing funds for the preparation of biological and 12 shoreline monitoring, planning contingency as needed to fulfill permitting requirements, and 13 construction management; and 14 WHEREAS, the San Diego region implemented the 2001 Regional Beach Sand Project 15 placing approximately 2.1 million cubic yards of beach quality material from offshore sand sources on 12 critically eroded sections of the regions shoreline; and 17 WHEREAS, the region's coastal cities, including the Cities of Carlsbad, Encinitas, lg Imperial Beach, Oceanside, and Solana Beach have expressed an interest and desire to 19 implement another such project on a regional basis, as economies of scale and efficiencies 20 would likely result in a more productive and successful project; and 21 WHEREAS, a number of benefits, including recreational, economic, public safety, 22 protection of infrastructure, and increases in habitat would occur as the result of beach 23 nourishment; and 24 WHEREAS, SANDAG has taken the necessary steps to secure funding to support the 25 preparation of the necessary engineering and environmental documents for the next phases of 26 the Regional Beach Sand Project through the California Department of Boating and Waterways; 27 and 28 1 WHEREAS, the total estimated project cost of approximately $25 million includes an 2 estimated $172,355 in matching funds from the coastal cities in San Diego county for the 3 completion of biological and shoreline monitoring, planning contingency as needed to fulfill 4 permitting requirements, and construction management; and 5 WHEREAS, the SANDAG Board of Directors has approved an allocation methodology to 6 fairly apportion the matching funds from the coastal cities; and 7 WHEREAS, SANDAG requires a funding commitment from each coastal city prior to the 8 initiation of work for the biological and shoreline monitoring, planning contingency as needed to 9 fulfill permitting requirements, and construction management; and 10 WHEREAS, the City of Carlsbad's prorated share of the biological and shoreline 11 monitoring, planning contingency as needed to fulfill permitting requirements, and construction 12 management is $65,150; and 13 WHEREAS, on February 13, 2007, the City Council of the City of Carlsbad approved 14 funding for the Carlsbad Beach Nourishment Project, a stand-alone project of the Carlsbad 15 Beach Preservation Committee that would nourish beaches along the Carlsbad coastline 16 through the Agriculture Conversion Mitigation Fund; and 17 WHEREAS, on November 6, 2007 the City Council of the City of Carlsbad approved 1 8 Resolution No. 2007-288 recognizing SANDAG as the appropriate agency to coordinate the efforts of the coastal cities for the development of a regional beach nourishment project and 20 believed it was appropriate and beneficial to join the region-wide effort and implement the 21 Carlsbad Beach Nourishment Project as part of a regional, rather that local only project; and 22 WHEREAS, the City Council of the City of Carlsbad finds it is in the best interest of the 23 citizens of Carlsbad to join the regional efforts in the implementation of a region-wide beach 24 nourishment effort. 25 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 9/r California, as follows: 27 28 1 1.
