RECOMMENDED ACTION:
Adopt Resolution No. 2011-031 to authorize application for Flood Corridor Program Grant with
the State of California Department of Water Resources to construct Agua Hedionda Channel Dredge
and Environmental Mitigation Improvements, Project No. 3338
ITEM EXPLANATION:
Staff recommends the Council approve the appropriate resolution authorizing application, processing,
acceptance and fulfillment of the funding grant requirements of the California Department of Water
Resources Flood Corridor Program for FY 2010-2011 funding cycle.
On February 25, 2011, staff will be submitting an application for grant funding from the California
Department of Water Resources (DWR) Flood Corridor Program 2010-2011 funding cycle. The
application includes a funding request for the construction of the Agua Hedionda Channel Dredge and
Environmental Mitigation Improvements project. On December 14, 2010, through adoption of
Resolution No. 2010-269, Council approved a professional engineering and environmental services
agreement with AECOM, Incorporated of San Diego for final project and environmental mitigation
design, preparation of plans and specifications and environmental permit processing services for the
construction of the Agua Hedionda Channel Dredge project work including the construction of
adjacent offsite environmental mitigation improvements. The project benefits include flood protection
to public and private properties, water quality improvement, enhancement of wildlife habitat and
enhancement of water table recharge.
GRANT Application - In January 2010, the State DWR issued a new grant program referred to as the
Flood Corridor Program 2010-2011 Funding Cycle, with a submittal deadline of February 25, 2011.
Through the Flood Corridor Grant Program the DWR provides a grant up to 90 percent of the total
project cost. Funding is on a competitive basis for projects that provide flood protection through
primarily non-structural flood management solutions that serve to enhance and protect real property
while preserving sustainable agriculture and enhancing wildlife habitat in and near flood corridors
throughout the state. The current funding cycle is providing $75 million in grants with $50 million to be
applied statewide and $27.5 million going to the Central Valley.
ENVIRONMENTAL IMPACT:
The application for State funding grant does not constitute a "project" pursuant to State CEQA
Guidelines Section 15378(b) (4) and no environmental review is required.

FISCAL IMPACT:
The Agua Hedionda Channel Dredge project is currently funded through a combination of Planned Local
Drainage Area Fee funds ($4,298,069) and General Capital Construction (GCC) funds ($975,340). With
Council authorization, staff will submit a grant request of up to $975,000 for the project. If the City is
successful in obtaining State grant funding, some portion of the GCC funding may be returned to the
GCC Fund. Use of State grant funding triggers the need to pay prevailing wages which will require
preparation of new cost estimates that will be returned to Council if and when a State funding agreement
is brought forward to Council for approval.
EXHIBITS:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, TO APPROVE AND AUTHORIZE
SUBMITTAL OF APPLICATION FOR A FLOOD CORRIDOR
PROGRAM GRANT WITH THE STATE OF CALIFORNIA
DEPARTMENT OF WATER RESOURCES TO CONSTRUCT
AGUA HEDIONDA CHANNEL DREDGE AND ENVIRONMENTAL
MITIGATION IMPROVEMENTS, PROJECT NO. 3338
Agua Hedionda Channel Dredge project ("Project") work including the construction of adjacent
offsite environmental mitigation improvements; and,
WHEREAS, the Project benefits include flood protection to public and private properties,
water quality improvement, enhancement of wildlife habitat and enhancement of water table
recharge; and,
WHEREAS, up to a 90 percent total project cost grant is available from the State of
California Department of Water Resources (DWR) for allocation to local agencies in Fiscal Year18
2010-2011 to fund construction of Flood Protection Corridor projects; and,

WHEREAS, DPR has solicited applications from local agencies for the construction of
20
Flood Protection Corridor projects; and,
21 WHEREAS, pursuant to the above described program, an application may be submitted
22 to obtain a Flood Protection Corridor project grant for construction of the Project; and,
WHEREAS, approximately $2,700,000 in funding is currently available to provide the
matching local funding share; and,
WHEREAS, the DWR requires agencies to submit a Council Resolution authorizing
submittal of a project application, and the City Council will work with the DWR to meet established
deadlines for entering into a cooperative agreement, and supports the application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
3 1. That the above recitations are true and correct; and,
4 2. Certifies that City will have sufficient funds to operate and maintain the project
consistent with the land tenure requirements of the grant; and,
3. Certifies that it will comply with all provisions of Section 1771.5 of the California
Labor code; and,
4. Certifies that the project will comply with any laws and regulations including, but8
not limited to, the California Environmental Quality Act (CEQA), legal
9
requirements for building codes, health and safety codes, disabled access laws,
10
and, that prior to commencement of construction all applicable permits will have
11 been obtained; and,
12 5. That the Director of Property and Environmental Management is hereby
13 authorized to apply for State of California Department of Water Resources Flood
14 Corridor Program grant for 2010-2011 funding cycle, for the Agua Hedionda
15 Channel Dredge and Environmental Mitigation Project No. 3338.
16 6. That Council intends to accept the grant if awarded and authorizes the City
17 Manager, or designee, as agent to execute and submit all documents including,
18 but not limited to, applications, agreements, payment requests and so on, which
may be necessary for completion of the Project.
