RECOMMENDED ACTION:
Adopt Resolution No. 2011-032 accepting bids, authorizing the appropriation of funds, and
awarding a contract for the installation of audible pedestrian and countdown pedestrian signals at
twenty-one signalized intersections, Project No. 6321-1.
ITEM EXPLANATION:
On July 13, 2010, the City Council approved the bid package for the installation of audible pedestrian
and countdown pedestrian signals at twenty-one locations and directed the City Clerk to advertise for
construction bids. On December 7, 2010, the following four (4) sealed bids were received.

The second low bidder, Republic ITS, sent a letter to staff on December 10, 2010, protesting the
award of the contract to the apparent low bidder, Traffic Development Services. In the letter, Republic
ITS claims that the countdown pedestrian signals furnished by Traffic Development Services
(manufactured by Dialight) would not meet project specifications. Although our current technical
specifications for countdown pedestrian signals were based on specifications supplied by General
Electric, it was not staff's intention to restrict countdown pedestrian signals to General Electric
products only. Based on staffs evaluation of the Dialight Uniform Appearance Countdown Pedestrian
Signal specifications, as submitted by the apparent low bidder, it is staff's professional opinion that the
differences between the Dialight product and our current specifications are minor in nature and that
the Dialight product should be accepted as equal. As specified in Section 4-1.6 of the contract, the
"Contractor may supply any of the materials specified or offer an equivalent. The Engineer shall
determine whether the material offered is equivalent to that specified."
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15301(c) - minor alteration of existing facilities involving negligible or no
expansion.

FISCAL IMPACT:
On June 26, 2009 SANDAG's Board of Directors awarded $150,660 in Transportation Development
Act/TransNet (TDA/TransNet) funding for this project. Per the Grant Agreement, the TDA/TransNet
funds will be disbursed by SANDAG on a reimbursement basis as eligible project expenditures are
made.
The current status of the project is shown below.

The engineer's estimate for construction was $150,660. Additional funds are being requested
because construction bids came in higher than anticipated. The construction cost breakdown is as a
follows:

Funds in the amount of $150,660 related to the TDA/TransNet award have been previously
appropriated from the TDA Fund. Expenditures up to $150,660 will be reimbursable under the
TDA/TransNet Grant Agreement. However, appropriations from the TDA Fund can only occur if an
equal amount of TDA revenues have been secured from SANDAG. Since the grant award totaled
$150,660, and additional grant monies are not available, the additional appropriation for this project
requires an alternate funding source. Gas Tax funds are eligible to use towards this project.
Therefore, an additional appropriation of $31,811 in Gas Tax funds is requested to complete the
project. There are sufficient Gas Tax funds for the requested appropriation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS, AUTHORIZING
THE APPROPRIATION OF FUNDS, AND AWARDING A
CONTRACT FOR THE INSTALLATION OF AUDIBLE
PEDESTRIAN AND COUNTDOWN PEDESTRIAN SIGNALS AT
TWENTY-ONE SIGNALIZED INTERSECTIONS, PROJECT NO.
6321-1
WHEREAS, the City Council has determined it necessary, desirable and in the public
interest to install audible pedestrian and countdown pedestrian signals at twenty-one existing
signalized intersections; and
WHEREAS, four (4) sealed bids were received on December 7, 2010 for the project; and
WHEREAS, the Grant Agreement with SANDAG for the $150,660 grant requires the city
to pay for the materials and installation costs of the project upfront; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Traffic Development Services in the amount of $152,059; and
WHEREAS, Traffic Development Services proposed an alternative countdown
pedestrian signal manufacturer and the Transportation Department has determined that the
proposed countdown pedestrian signal equipment is equal to the specified countdown pedestrian
signal equipment; and
WHEREAS, all project costs up to $150,660 are reimbursable; and
WHEREAS, additional funds in the amount of $31,811 are needed in order to complete
the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the low bid submitted by Traffic Development Services in the amount of
$152,059 is hereby accepted and the Mayor is hereby authorized to execute a

1 contract on behalf of the City for the installation of audible pedestrian and
2 countdown pedestrian signals at twenty-one existing signalized intersections;
3 3. That the Finance Director is authorized to appropriate $31,811 from the Gas Tax
4 Fund to Project No. 6321-1 for the installation of audible pedestrian and
countdown pedestrian signals at twenty-one existing signalized intersections;
6 4. That the City Manager is hereby authorized to approve construction change
7 orders up to $15,206 for Project No. 6321-1.
