RECOMMENDED ACTION:
Introduce Ordinance No. CS-120 to prohibit the parking of oversized vehicles on the west side
of Carlsbad Boulevard from Redwood Avenue to Cherry Avenue.
ITEM EXPLANATION:
On the west side of Carlsbad Boulevard, from northerly of Tierra del Oro to Cherry Avenue, on-street
parallel parking is allowed between 5:00 a.m. and 11:00 p.m. or between 5:00 a.m. and 2:00 a.m. daily,
depending upon location. Complaints are occasionally received when numerous recreational vehicles
occupy the parking spaces available and thereby reduce the parking supply available for other vehicles.
Summer holidays, such as the July 4th holiday, often generate increased complaints about recreational
vehicle parking on Carlsbad Boulevard. Over the years, staff has received numerous requests to prohibit
recreational vehicles from parking in the beach areas during the summer months as well as many
correspondences that do not support the prohibition of recreational vehicle parking.
The City Council has previously discussed options to minimize or eliminate the parking of recreational
vehicles on Carlsbad Boulevard. On June 15, 2010, Council directed staff to propose an ordinance that
would restrict the parking of oversized vehicles on the west side of Carlsbad Boulevard from Redwood
Avenue and Cherry Avenue during the summer months between Memorial Day and Labor Day. The
proposed ordinance would prohibit the parking of vehicles that exceed any one of the following three
criteria:
(a) vehicles over 7' high (including any item fixed to the top of the vehicle)
(b) vehicles over 7' wide (including any trailered attachment)
(c) vehicles over 22' long (including any attached accessories)
ENVIRONMENTAL IMPACT:
The proposed action to modify parking restrictions does not qualify as a "project" under the California
Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15378 as it does not result in a
direct or reasonable foreseeable indirect physical change in the environment.
FISCAL IMPACT:
Minor administrative costs are necessary to implement changes to the Carlsbad Municipal Code by
revising CMC Section 10.40. Approximately eight (8) parking restriction signs will need to be installed on
Carlsbad Boulevard and will cost approximately $1,200. Sufficient funds are available in the Streets
Division budget.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 10, CHAPTER 10.40 OF THE CARLSBAD
MUNICIPAL CODE TO PROHIBIT PARKING OF
OVERSIZED VEHICLES ON A PORTION OF
CARLSBAD BOULEVARD
SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal
Code is amended with the addition of section 10.40.041 (g) as follows:
"10.40.041 Parking restricted on certain parts of Carlsbad
Boulevard.
(g) Parking of oversized vehicles is prohibited on the west side
of Carlsbad Boulevard between Redwood Avenue and Cherry
Avenue from Memorial Day to Labor Day.

EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption; and the city clerk shall certify the adoption of this ordinance and cause it
to be published at least once in a newspaper of general circulation in the City of
Carlsbad within fifteen days after its adoption.
OPERATIVE DATE: The provisions of this ordinance shall become
operative on its effective date and continue for one-year and thereafter shall become
permanent unless the City Council repeals or replaces it with a successor ordinance.

I am a Carlsbad Home owner for about 30 years and also an RV owner who uses the Carlsbad Beach facilities as much as
possible. I contribute more to the economy of Carlsbad that most people by paying the huge sales taxes and DMV fees
on my RV. The cost to fill up the RV along with what I usually spend on food every time I go to the beach is a major
contributor to the economy of the state of CA and of course to the city of Carlsbad.
Most of the problems with people in RV's is very minor and is usually only 2 to 3 people of happen to live in there RV on
a daily basis. So why do we decide to punish all RV homeowners because of this. I have heard many of the complaints
many times and they are usually the same. The surfers do not like to carry there surfboards across the street to surf or
the homeowners who live at the beach think they own it and do not want the RV's anywhere.
Do we also limit the City of Carlsbad Trucks, Fed Express Trucks,Ups Trucks and certain size vehicles which I have seen
many time at the Carlsbad Beaches also. Where do we stop from here.
It is such a very small per cent age of people who are complaining who think that they own the rights to where they live.
I presently have a next door neighbor which is in a very expensive neighborhood who lives there with their two small
children but there are 11 cars there and he has turned his house into a rental hotel. That means an additional 9 cars at
his resident including an additional two that he owns. Now this is really bad for anyone regardless where they live.
Can I get an ordinance passed that says only the people who own the house can park in the neighborhood. I am just
trying to make a point here.
Again this is just a very small group of people who think they own not just the piece of property they purchased but
anything that is within view of their home. Why do they have more rights than me when if I really want to I can easily
justify how I pay more taxes than them and contribute more to the Carlsbad economy than them.
This will be a sad day for Carlsbad City Council to cave in to the people who want to limit certain things that they do not
like at the expense of all other people.
What is the next thing we should do. Should we limit Lego land, factory outlet stores, restaurants to Carlsbad locals only
which is one of the major complaints I heard of why limit RV's from Carlsbad beaches to locals only.
Carlsbad is for everyone and for the majority of what the people want as opposed to a few people who live at the beach
and want to own the beach also.
I hope Carlsbad takes all options into consideration before caving in to a small group of people who want to make
decisions for the majority of people who live in Carlsbad

I am unable to attend tonight's city council meeting but did want my comments entered
into public record.
I am a twenty-six year resident of Carlsbad and would appreciate restricting oversized
vehicles on ALL of Carlsbad Blvd. South Carlsbad (Ponto's) suffers from the same
problem. RV's park all day, taking numerous spaces. They do not generate any tax
revenue as they bring in their supplies. They are not shopping or dining. At the end of
the day, they leave their trash for the city to dispose. If RV's want to spend a day at the
beach, they may do so at the campground. Between the campground and private
homes much of Carlsbad's beach access is unavailable. Please stop this abuse and pass
the ordinance, including All Carlsbad Blvd. With the development taking place in South
Carlsbad, parking will be even more difficult. Why pass an ordinance for only a portion
of the street when you will be forced to re-examine and include South Carlsbad at a later
date. Save taxpayers money and pass the ordinance for the entire street, now.

Hello,
I think that Carlsbad has done a great job making our city a vacation destination. Let's be sure that the
complaints of a few from the two or three weekends during the summer that is the cause of all this fuss, don't
put us in the same category as Del Mar. We don't even go there anymore because of all the rules and
regulations down there. Why bother. I teach English 5 days a week parked for about 90 minutes in my
Eurovan along the grass strip in question and walk my dog there every day. (yes I am one who cleans up after
his dog and if you want some revenue..how about passing a pick up after your dog or pay a $250 fine? I know
we are not enforcing the no driving while using the cell phone except every so often during speed trap
enforcement by accident near Tamarack.
Lets's not put up MORE signs with regulations on the boulevard.

Hello,
I am writing because I am unable to attend tonight's meeting due to the fact that I am traveling on business. I
have long been a proponent of limiting parking of oversized vehicles on Carlsbad Blvd. While I would like to
see this type of parking prohibited year around, I am happy to see that it is being considered for our busiest
tourism influx periods. There are several reasons why I am against allowing oversized vehicle parking:
1. It limits the number of normal vehicles that can park in the same space. Some of these vehicles are large
enough to take up 3 car lengths of parking space.
2. Since there are no time limitations on this type of parking, the owners arrive in the wee hours of the morning
at the beginning of holiday weekends and do not move for the duration of the weekend.
3. The owners of these vehicles bring their own food, supplies and other items, and there is no driving force to
spend money to impact our local economy, whereas other vehicles spend time at the beach and are more likely
to eat at our restaurants, stay at our local lodging facilities and shop at our local stores.
4. The RV parkers setup their canopies, lawn furniture and other items on the grass adjacent to the sidewalk,
often causing problems for pedestrians, those walking dogs and other individuals who may need to step off the
sidewalk to free it up for others to pass.
5. There are numerous local businesses that provide spaces for RV parking, and those vehicles should be using
our local businesses rather than being allowed to park free, not only taking up the parking space, but blocking
the view of the ocean for those driving past.
I am sorry that I am not able to attend tonight's meeting, but I am sure there are many other reasons that I have
not expressed. I hope the council will move ahead with the proposed ordinance in the best interest of our
citizens and those visiting our community.

The problem being addressed states that people with cars say they cannot get a place to park because RV owners come
early and stay all day.
Their "solution" is to ban RV parking in those areas and a majority of the city council appears to agree with the "squeaky
wheels".
This does not resolve the parking problem. It merely changes the persons affected from car owners to RV owners. The
parking problem is not the type of vehicle using the space, it's the lack of adequate space provided for people, especially
families, who are all entitled to enjoy reasonable access to the public beaches.
Carlsbad is depicted as an ideal area to come and enjoy the beaches and other assets in the area such as Legoland,
Museum of Making Music, Art Splash etc. While RV owners may not use hotels and restaurants as often as car
travelers, they certainly spend plenty every time they fill up or stock up and perhaps have more passengers attending
events. They also bring their own personal toilets, thus saving additional resources including water.
Please reconsider the idea of banning one group to accommodate another. The State parking lot at Tamarack now
charges and bans RV parking. If the parking facilities cannot be expanded, then it should indeed be on a "first come, first
served" basis until enough people convince the council to provide additional space for all of us taxpayers who want and
deserve to enjoy wholesome, family fun without additional charges and banishments.

I am a resident of Rancho Carlsbad Estates where I have my RV stored. Perhaps two to three times a year I like
to go to the beach area for the day with my RV. I see you are considering my favorite parking sites as illegal
for oversize vehicles. I am against this restriction. Most parking spots are filled by cars and not RV's. I usually
see on a nice day 3-4 RVs only.
Before you vote go there on a normal week day and see if there is a problem. I think there is not.

I am happy to hear that this matter is going to be discussed at tonight's City Council meeting, but I am
disturbed that this courtesy notice was just sent today, hours before the meeting.
My main concern, and comment, which I would like to be entered into the public record is the following:
I urge you to PLEASE revise the proposal to ban RV parking in downtown Carlsbad to include South Carlsbad at
Ponto Beach, south of the State Park Campground to La Costa Avenue. As a resident of the southwest quadrant of
Carlsbad, I do not feel that our concerns are being met. With the construction of, and soon to be built, luxury hotel at
Ponto in South Carlsbad there is no doubt in my mind that traffic and tourism to this quadrant will increase dramatically
and open the floodgates to even more RVs coming to Carlsbad. In addition, if you ban the RV parking on Carlsbad Blvd.
between Redwood and Cherry Avenues, the people who go there are just going to move south to the area mentioned
above. PLEASE revise the proposal to ban RV parking in South Carlsbad in the south end of the city.

I was very happy to read the article in the North County Times today

well as the^Ww^fmpeTparking that is blighting our neighborhoods in

be allowed along thf^$3$t from Cherry Street to Palomar Airport Road.

The accommodation there is better than most campgrounds on the
southern California coast with its unrivaled view and convenient
access to the beach and IT'S FREE. And the word is out, which is one
reason so many people choose to park their RVs along this stretch of
highway. Many of the RV owners feel an entitlement to park their
"rigs" from 5 AM until nightfall; it is not uncommon to see them set
up extended rigs with patio furniture and cones around their vehicles.
In my 12 years as a Carlsbad resident I have seen a steady increase in
the number of RVs using this cheap alternative to designated RV parks
and campgrounds. Limiting parking along this stretch of PCH is not
discriminatory. It ensures that many more people would have access to
recreation, which is the highest and best use for the beach in
Carlsbad. There are designated parks and campgrounds for motorhomes
and they should use them. Also, the fine for a RV parking violation
will need to be significantly higher than the cost of a campground
which is currently around $50.
Which brings up another point. Why would I pay to store my RV in a
designated storage facility when I can simply keep it in front of my
house, either on the street, on the driveway, or the front lawn. Other
cities have successfully implemented restrictions on RV parking within
city limits, recognizing that without them blight would occur. One
successful and fair compromise is to issue RV parking permits good for
up to a few days for special circumstances such as visiting relatives
or getting ready for a trip. The revenue from the cost of the permits
could help to enforce the code. I own a RV and I pay to store it.
However, I have neighbors who permanently store their RVs in the
street, and in the rare event that code enforcement makes them move
it, they simply drive it around the block and park it in the exact
same spot for years on end.
Is there a staff report on the City Council Workshop available for
review?
I would appreciate it if I could be notified of any upcoming
discussions or public meetings on this topic.

Subject: Proposed Over-sized Vehicle Ordinance
Hello,
I am writing because I am unable to attend tonight's meeting due to the fact that I am traveling on business. I
have long been a proponent of limiting parking of oversized vehicles on Carlsbad Blvd. While I would like to
see this type of parking prohibited year around, I am happy to see that it is being considered for our busiest
tourism influx periods. There are several reasons why I am against allowing oversized vehicle parking:
1. It limits the number of normal vehicles that can park in the same space. Some of these vehicles are large
enough to take up 3 car lengths of parking space.
2. Since there are no time limitations on this type of parking, the owners arrive in the wee hours of the morning
at the beginning of holiday weekends and do not move for the duration of the weekend.
3. The owners of these vehicles bring their own food, supplies and other items, and there is no driving force to
spend money to impact our local economy, whereas other vehicles spend time at the beach and are more likely
to eat at our restaurants, stay at our local lodging facilities and shop at our local stores.
4. The RV parkers setup their canopies, lawn furniture and other items on the grass adjacent to the sidewalk,
often causing problems for pedestrians, those walking dogs and other individuals who may need to step off the
sidewalk to free it up for others to pass.
5. There are numerous local businesses that provide spaces for RV parking, and those vehicles should be using
our local businesses rather than being allowed to park free, not only taking up the parking space, but blocking
the view of the ocean for those driving past.
I am sorry that I am not able to attend tonight's meeting, but I am sure there are many other reasons that I have
not expressed. I hope the council will move ahead with the proposed ordinance in the best interest of our
citizens and those visiting our community.

I would like to not only add my support for the item before Council this evening prohibiting
parking of large RV vehicles on Carlsbad Boulevard, but encourage you to consider an outright
ban on parking of large vehicles throughout the year. As an avid walker and observer of
activities on the subject promenade area, it is my opinion that the problem exists throughout
the year, and has been compounded since the State started charging for parking at the
Tamarack Beach parking
lot. Perhaps the State could accommodate these large vehicles for a
fee.
Let's not forget the beaches are a regional attraction that bring visitors, residents, and
seasonal tourists to our City. On it's face, it is unreasonable that a small minority of
users monopolize the available parking spaces, and make it difficult, or impossible, for
others to park and enjoy activities like walking, running, strolling, biking and the
general enjoyment of being by the sea.
I would urge the Mayor and Council to vote in favor of this item.

VEHCILES ON A PORTION OF CARLSBAD BLVD.
You have asked me whether or not this proposed restriction on parking of oversized vehicles
could be considered a "pilot program" and tried on a trial basis before it is made permanent.
That can be done. However, the ordinance would need to be amended to state that as follows:
"OPERATIVE DATE:
This ordinance shall be operative for one-year following its effective date and
after that date shall be of no further force and effect unless the City Council
amends or extends it prior to that time."
Alternatively, the operative date could extend beyond that time unless repealed by action of the
City Council. In that case, it would be appropriate to add the following provision for the
operative date:
"OPERATIVE DATE:
The provisions of this ordinance shall become operative on its effective date
and continue for one-year and thereafter shall become permanent unless the
City Council repeals or replaces it with a successor ordinance."
