DEPT. 20.488 3/22/11 CA REVISE CARLSBAD MUNICIPAL CODE, CHAPTER 10.40 TO RESTRICT PARKING OF OVERSIZED VEHICLES ON CARLSBAD BLVD. DEPT. DIRECTOR CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Adopt Ordinance No. CS-120 to prohibit the parking of oversized vehicles on the west side of Carlsbad Boulevard from Redwood Avenue to Cherry Avenue from Memorial Day to Labor Day. ITEM EXPLANATION: At its meeting of Tuesday, March 8, 2011, the City Council introduced this ordinance including the operative date language which stated: "The provisions of this ordinance shall become operative on its effective date and continue for one year and thereafter shall become permanent unless the City Council repeals or replaces it with a successor ordinance." The attached ordinance includes this language, represents its intention in this matter. FISCAL IMPACT: The Council should satisfy itself that this Minor administrative costs are necessary to implement changes to the Carlsbad Municipal Code by revising CMC section 10.40. Approximately eight (8) parking restriction signs will need to be installed on Carlsbad Blvd. and will cost approximately $1,200. Sufficient funds are available in the streets division budget. ENVIRONMENTAL IMPACT: The proposed action to modify parking restrictions does not qualify as a "project" under the California Environmental Quality Act (CEQA) per State CEQA guidelines section 15378 as it does not result in a direct or reasonable foreseeable indirect physical change in the environment. CS-120 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.40 OF THE CARLSBAD MUNICIPAL CODE TO PROHIBIT PARKING OF OVERSIZED VEHICLES ON A PORTION OF CARLSBAD BOULEVARD NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows: SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended with the addition of section 10.40.041 (g) as follows: "10.40.041 Parking restricted on certain parts of Carlsbad Boulevard. (g) Parking of oversized vehicles is prohibited on the west side of Carlsbad Boulevard between Redwood Avenue and Cherry Avenue from Memorial Day to Labor Day. For the purposes of this section only, "oversized vehicles" shall mean any vehicle that exceeds: 1. Seven (7) feet in height, as measured from the street and including any item affixed to the top of the vehicle: or 2. Twenty-two (22) feet in length, as measured from bumper to bumper and including an trailered attachment: or 3. Seven (7) feet in width. Any extension(s) caused by accessories attached to the side(s) of such a vehicle, not including vehicle mirrors, shall be considered part of the measured width." -1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in a publication of general circulation in the City of Carlsbad within fifteen days after adoption. Notwithstanding the preceding, this ordinance shall not be effective until approved by the California Coastal Commission. OPERATIVE DATE: The provisions of this ordinance shall become operative on its effective date and continue for one-year and thereafter shall become permanent unless the City Council repeals or replaces it with a successor ordinance. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on the 8th day of March 2011, and thereafter. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 22nd day of March 2011, by the following vote to wit: AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard.
