RECOMMENDED ACTION:
Adopt Resolution No. 2011-084 authorizing the City Manager, or designee, to execute in the
name of the City of Carlsbad all necessary forms for the application and management of grants
through the California Department of Resources, Recycling, and Recovery (CalRecycle) and
authorizing signature authority for all related documents, i.e. correspondence, reports, and
appropriation of funds.
ITEM EXPLANATION:
California's Department of Resources, Recycling, and Recovery (CalRecycle) brings together the
state's recycling and waste management programs and continues a tradition of environmental
stewardship. CalRecycle sets aside funds for local governments in the form of competitive and non-
competitive block grants to assist in managing various waste stream problem areas. These grants
are used for the creation and enhancement of solid waste programs aimed at specific waste stream
types. Notably, CalRecycle has historically disbursed grant funding to assist with used oil and used
beverage container management. The City of Carlsbad has applied for and received funding for both
of these grants in the past, and would like to continue utilizing these funds to supplement important
solid waste management programs.
With the City Council's approval, the Utilities Department will apply for, accept, and appropriate grant
funding through CalRecycle for a period of five (5) years from the date of approval. Funding will be
used to increase public education and outreach, improve the quality of solid waste services, and pay
for staff time in managing grant related activities.
Staff recommends the approval for the Utilities Department to apply for, accept, and appropriate grant
funding through CalRecycle for a period of five (5) years.
ENVIRONMENTAL IMPACT:
The approval for the Utilities Department to apply for, accept, and appropriate grant funding through
CalRecycle for a period of five (5) years is exempt from the requirements of CEQA pursuant to
Section 15268 of the State CEQA guidelines.

FISCAL IMPACT:
There are no matching fund requirements, therefore grant related activities will be completed using
grant monies as the sole funding source. If an activity is requested to extend beyond a grant term,
City Council approval shall be required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

MANAGER, OR DESIGNEE TO EXECUTE ALL NECESSARY
4 FORMS FOR GRANTS THROUGHT THE CALIFORNIA
DEPARTMENT OF RESOURCES, RECYCLING AND
5 RECOVERY FOR A PERIOD OF FIVE (5) YEARS.

WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of

Resources Recycling and Recovery (CalRecycle) to administer various Grant Programs in
8
furtherance of the State of California's (State) efforts to reduce, recycle and reuse solid waste
9
generated in the State thereby preserving landfill capacity and protecting public health and safety
10
and the environment; and
11
WHEREAS, Grant Application procedures require an Applicant's governing body to12
authorize by resolution its approval for submittal of the Grant Application(s), and the designation

by job title of the individual authorized to execute all grant documents on behalf of the City of14
Carlsbad; and15
WHEREAS, if awarded, the City of Carlsbad will enter into a Grant Agreement with16
CalRecycle for the implementation of said Grant(s).
WHEREAS, the City of Carlsbad is desirous in applying for these funds; and18
.Q NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,iy

21 1. That the above recitations are true and correct.
2. That the City Council authorizes the submittal of application(s) to CalRecycle for
22 all grants for which the City of Carlsbad is eligible.
3. That the authorization is effective for five (5) years from: May 4, 2011 through
23 May 4, 2016; time period not to exceed five (5) years from the date of adoption.
4. That the City Manager, or his/her designee is hereby authorized and empowered
24 to execute in the name of the City of Carlsbad all grant documents, including but
not limited to, applications, agreements, amendments and requests for payment,
25 necessary to secure grant funds and implement the approved grant project.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 10th day of May 2011, by the following vote to wit:
AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard.
