DIRECTOR CITY ATTORNEY CITY MANAGER (>/—•- RECOMMENDED ACTION: Adopt Resolution No. 2011-098, authorizing the city clerk to advertise bids for the Lake Calavera Preserve EMP Grant Fencing, Project No. SS 09-01 (B). ITEM EXPLANATION: On July 21, 2009, city council accepted grant funding in the amount of $286,667 from the San Diego Association of Governments (SANDAG) TransNet Environmental Mitigation Program (EMP) Grant for the Lake Calavera Preserve Planning Area Access Control and Habitat Restoration Project (Project) located in the northeast quadrant of the city. Additionally, city council appropriated funds in Fiscal Year 2009/10 to the Carlsbad Habitat Management Program budget for the Project. The Project includes three primary components: five acres of habitat restoration; fencing and access control; and public outreach. Implementation of the public outreach and habitat restoration is underway. This contract would allow for installation of fencing and access control which will guide users to stay on designated trails, discourage access on decommissioned trails, and provide a deterrent to illegal dumping. The fencing material will consist of three strand wire fence and wood post and rail fencing. Staff estimates the cost for the construction of the fence project to be $188,206. The EMP grant will reimburse the city for construction costs in the amount of $111,667. The Habitat Management Program will provide previously appropriated matching funds in the amount of $76,539. The city's preserve manager, planning department, and parks and recreation department have coordinated the preparation of plans and specifications for the fencing project. Items included in this contract include the following: • Three strand smooth wire fencing along portions of the eastern, western, and southern boundaries of the Lake Calavera Mitigation Parcel (owned by the city) and in key areas along the southern boundary of the Carlsbad Highlands Ecological Preserve, owned by the California Department of Fish and Game (CDFG). • Post and rail fencing near the entrance to the preserve on Sky Haven Lane and Lake Boulevard as well as various locations within the Lake Calavera Preserve. • Installation of signs notifying the public of the importance of the habitat preserve. • Installation of an access gate acrdss a San Diego Gas & Electric easement. The city will be reimbursed a total of $111,667 for the Lake Calavera Preserve EMP Grant Fencing, Project No. SS 09-01 (B). A summary of the funding for this component of the Project is outlined below. The sources for matching funds for the fencing project include: the Carlsbad Habitat Management Program, the purchase of signs by Center for Natural Lands Management (CNLM), and in-kind services for installation of signs and the kiosk by CNLM and volunteers. CDFG will provide staff to coordinate the location of fencing on CDFG owned property. Project management and administrative tasks will be performed by staff of the parks and recreation department in consultation with the city's preserve steward and manager. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per state CEQA Guidelines Section 15303(e) - new construction of accessory structures including fences. A notice of exemption will be filed. EXHIBITS: 1. Plans and specifications for the Lake Calavera Preserve EMP Grant Fencing, Project No. SS 09-01 (B) on file at the parks and recreation department, 1 RESOLUTION NO. 2011-098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 2 CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THE LAKE CALAVERA PRESERVE 3 EMP GRANT FENCING, PROJECT No. SS 09-01 (B) 4 5 WHEREAS, the City of Carlsbad, California, was awarded a TransNet Environmental 6 Mitigation Program (EMP) Grant from the San Diego Association of Governments (SANDAG) for 7 the Lake Calavera Preserve Planning Area Access Control and Habitat Restoration Project; and 8 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 9 necessary, desirable, and in the public interest to provide fencing and access control within the 10 Lake Calavera Preserve area; and 11 WHEREAS, funds have been appropriated to the Fiscal Year 2009/10 City of Carlsbad 12 Habitat Management Program for the fencing and access control project; and 13 WHEREAS, EMP Grant funds in the amount of $111,667, and city funds in the amount 14 of $76,539, are available for the access control project; and 15 WHEREAS, the plans and specifications for furnishing of all labor, materials, tools, 16 equipment, transportation, and other expenses necessary or incidental to installation of fencing 17 and access control for the Lake Calavera Preserve EMP Grant Fencing, Project No. SS 09-01(6) 18 have been prepared and are on file in the Parks and Recreation Department of the City of 19 Carlsbad and are incorporated herein by reference. 20 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 21 California, as follows: 22 1. That the above recitations are true and correct. 23 2. That funds are available in the City of Carlsbad Habitat Management Program 24 Budget for reimbursement of the estimated costs of the fencing and access 25 control project at the Lake Calavera Preserve Area. 26 3. That funds have been awarded to the City of Carlsbad Parks and Recreation 27 Department from the SANDAG EMP Grant program for fencing and access 28 1 control for the Lake Calavera Preserve Area and such funds are available for the 2 project. 4. That the plans, specifications and contract documents for the Lake Calavera 4 Preserve EMP Grant Fencing, Project No. SS 09-01(8) are on file in the Parks 5 and Recreation Department of the City of Carlsbad and are hereby approved. 5. That the City Clerk of the City of Carlsbad is hereby authorized and directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the o Lake Calavera Preserve EMP Grant Fencing, Project No. SS 09-01(8) in 9 accordance with the plans, specifications, and contract documents referred to 10 herein.
