DIRECTOR (Jft CITY ATTORNEY T ^f\ ^ CITY MANAGER /•//—-- RECOMMENDED ACTION: Introduce Ordinance No. CS-144 repealing, in its entirety the current Carlsbad Municipal Code Chapter 10.08.080 which adopts by reference the Federal Highway Administration's (FHWA) Manual on Uniform Traffic Control Devices (MUTCD), 2003 Edition as amended by the MUTCD 2003 California Supplement. ITEM EXPLANATION: Carlsbad Municipal Code Chapter 10.08.080 is the current section that adopts by reference the Federal Highway Administration's (FHWA) Manual on Uniform Traffic Control Devices (MUTCD) 2003 Edition as amended by the MUTCD 2003 California Supplement. On January 21, 2010, the State of California Department of Transportation adopted the 2010 California MUTCD (FHWA's MUTCD 2003 Edition, including Revisions 1 and 2, as amended for use in California to govern design, placement, operation, maintenance, and uniformity of traffic control devices. Section 21400 of the California Vehicle Code and the Code of Federal Regulations Title 23 Section 655.603 mandates that only traffic control devices conforming to said Department of Transportation standards and specifications shall be placed on streets and highways. Carlsbad Municipal Code Section 10.08.080 has been superseded and should be repealed. No local agency adoption of the current standards and specifications is required. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065 this action does not constitute a "project" within the meaning of the CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require an environmental review. FISCAL IMPACT: None. EXHIBITS: 1. CS-144 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 11 12 13 21 22 23 24 25 26 27 CARLSBAD, CALIFORNIA, REPEALING TITLE 10, CHAPTER 10, SECTION 10.08.080, OF THE CARLSBAD MUNICIPAL CODE, ADOPTING THE FHWA MUTCD 2003 EDITION AS AMENDED BY THE MUTCD 2003 CALIFORNIA SUPPLEMENT. __ The City Council of the City of Carlsbad, California, hereby ordains as follows: That Title 10, Chapter 10, Section 10.08.080 of the Carlsbad Municipal Code is repealed in its entirety: Former Section 10.08.080 read: "10.08.080 - Manual on Uniform Traffic Control Devices. Pursuant to California Vehicle Code Section 21400, the Federal Highway Administration's (FHWA) Manual on Uniform Traffic Control Devices (MUTCD) 2003 Edition as amended by the MUTCD 2003 California Supplement replaces the Caltrans Traffic Manual and is hereby adopted by reference as the city manual for regulating and installing official traffic control devices."
