RECOMMENDED ACTION:
Adopt Resolution No. 2011-175 accepting bids and awarding the contract to New Century
Construction, Inc. for the Corrugated Metal Pipe (CMP) Replacement Program - Holly Brae Lane/El
Camino Real, Highland Drive/James Drive and Mallorca Place, Project No. 6607.
ITEM EXPLANATION:
The CMP Replacement Program was established as a five-year program to replace, repair or
remediate deteriorated CMP storm drain systems throughout the City. The pipelines included in the
program were identified after City staff inspected the interior of the storm drain pipe and assessed the
condition of CMP pipelines. The program includes the replacement or remediation of 25 storm drain
pipelines. The program has had six pipelines systems added in the last year based on condition
assessments.
The Holly Brae Lane to El Camino Real project will construct a new curb inlet to replace an outdated
and unsafe inlet and install a cured-in-place liner into an existing deteriorated storm drain pipeline that
conveys runoff from Holly Brae Lane down to El Camino Real a distance of 420 feet. The Highland
Drive to James Drive project will construct a new standard inlet to replace an undersized non-
standard inlet and install 160 feet of cured-in-place liner into an existing deteriorated storm drain
pipeline from the new inlet to a catch basin. The project also includes the installation of a cleanout at
the junction of the pipeline to a larger pipeline in James Drive that will allow maintenance crews
access for routine cleaning and inspection. A pipeline added to the program in 2011, the Mallorca
Place project will install 155 feet of cured-in-place liner into a damaged pipeline that was discovered
during routine maintenance activities. During the bid period, 133 feet of cured-in-place liner for a
pipeline in Monroe Street at Alder Avenue was added to the project and program after crews
observed that the pipeline had deteriorated.

All bid documents submitted by New Century Construction, Inc. have been reviewed by staff and were
found to be in order. Staff recommends awarding the construction contract to New Century
Construction, Inc. in the amount of $151,615.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per state CEQA
Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving
negligible or no expansion.
FISCAL IMPACT:

An Engineer's Estimate of the construction cost for the CMP Replacement Program - Holly Brae
Lane/El Camino Real, Highland Drive/James Drive and Mallorca Place, was prepared by staff on
March 11, 2011, and totals $133,000. The estimate was increased during the bid period to $150,000
with the addition of 133 lineal feet of pipe lining. The total estimated construction cost is shown in
Table 2.

Sufficient funds have been appropriated from the Infrastructure Replacement Fund (IRF) to fund this
project. Annually, funds are added to the project through the Capital Improvement Program. This
funding source is not subject to State or Federal restrictions regarding prevailing wage. Therefore,
pursuant to Carlsbad Municipal Code Section 3.28.130, prevailing wages are not required for the
construction of CMP Replacement Program, Project No. 6607.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
„ CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND6 AWARDING A CONTRACT FOR CONSTRUCTION OF THE
CORRUGATED METAL PIPE REPLACEMENT PROGRAM -
4 HOLLY BRAE LANE/EL CAMINO REAL, HIGHLAND
DRIVE/JAMES DRIVE AND MALLORCA PLACE, PROJECT
5 NO. 6607.
6 WHEREAS, on May 10, 2011, the City Council of the City of Carlsbad approved plans
7 for construction of the Corrugated Metal Pipe Replacement Program - Holly Brae Lane/El Camino
8 Real, Highland Drive/James Drive and Mallorca Place, Project No. 6607; and
9 WHEREAS, three (3) sealed bids were received on June 21, 2011 by the City of
10 Carlsbad for the construction of said project; and
11 WHEREAS, the lowest responsive and responsible bid to construct said project was
12 submitted by New Century Construction, Inc., in the amount of $151,615; and
13 WHEREAS, there are sufficient funds available to complete the project; and
14 WHEREAS, subsection 3.28.040(C)(5) of the Carlsbad Municipal Code authorizes the
15 City Manager to approve change orders in the amount equal to the contingency set at the time of
16 project award.
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
18 California, as follows:
10 1. That the above recitations are true and correct.
20 3. That the low bid of $151,615 submitted by New Century Construction, for the
21 construction of the Corrugated Metal Pipe Replacement Program - Holly Brae Lane/El Camino
22 Real, Highland Drive/James Drive and Mallorca Place, Project No. 6607, is accepted and the
23 Mayor is hereby authorized to execute a contract with New Century Construction, Inc. for the
24 Corrugated Metal Pipe Replacement Program - Holly Brae Lane/El Camino Real, Highland
25 Drive/James Drive and Mallorca Place, Project No. 6607.
4. That the City Manager is hereby authorized to approve construction change
27 orders up to $30,000. ,, ,

1 5. That the award of this contract is contingent upon the bidder submitting the
2 lowest responsible bid executing the required contract and submitting the required bonds and
3 insurance policies, as described in the contract, within twenty (20) days of adoption of this
4 resolution. The City Manager may grant reasonable extensions of time.
