RECOMMENDED ACTION:
Adopt Resolution No. 2011-210 accepting the contract for construction of the Leo Carrillo
Ranch Barn Restoration, Project No. 45051 as complete, and directing the City Clerk to record a
Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On August 24, 2010, the City of Carlsbad awarded a contract to Mark Sauer Construction, Inc. (MSC)
in the amount of $335,000 for the construction of the Leo Carrillo Ranch Barn Restoration,
Project No. 45051.
MSC substantially completed the contract on April 26, 2011, and completed the punch list on
July 7, 2011. City staff has inspected the work and found it to be satisfactory. Staff recommends
acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section
19.040.070 A. 1.a.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE LEO CARRILLO RANCH BARN
4 RESTORATION, PROJECT NO. 45051. AS COMPLETE.
5 WHEREAS, the construction of the Leo Carrillo Ranch Barn
6 Restoration, Project No. 45051, has been completed to the City's satisfaction by Mark Sauer
7 Construction, Inc. on July 7, 2011; and
8 WHEREAS, the formal project Notice of Completion has been prepared; and
9 WHEREAS, all project costs have been established to date.
10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
11 California, as follows:
12 1. That the above recitations are true and correct.
1 ^2. That the Leo Carrillo Ranch Barn Restoration, specifically identified as
14 Project No. 45051 is deemed complete and is hereby accepted by the City Council of the City of
15 Carlsbad.
16 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17 execute and record the Notice of Completion for the Leo Carrillo Ranch Barn Restoration,
18 Project No. 45051.
