DEPT. 20,692 9/27/11 HNS SPECIAL EVENT GRANT REQUEST AGUA HEDIONDA LAGOON FOUNDATION DEPT. CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Consider the request from the Agua Hedionda Lagoon Foundation for Special Events Grant funding and adopt Resolution No. 2011-231 to approve the request at an amount not to exceed $5,000. ITEM EXPLANATION: The Agua Hedionda Lagoon Foundation is requesting a Special Event Grant from the City in the maximum allowed amount of $10,000 to assist in the first Kayak Regatta. The grant request is to cover the cost of required city services ($3,030) as well as provide a cash donation ($1,970) for the event. Agua Hedionda Lagoon Foundation's Kayak Regatta will be held on October 22, 2011 and is intended to serve as a first time community event and a fundraiser for the lagoon. Total eligible expenses for the event are estimated at approximately $11,000, with anticipated (non-city) revenues at approximately $5,800 which include entry fees and some cash donations. In May 2011, the City Council amended Council Policy 51 (Exhibit 2) redefining and clarifying the Community Activity Funding Program and Special Event Grants. Special event grants are intended to provide city funding for start up costs related to events with a citywide interest. By providing some financial assistance in the beginning years, it is expected that the programs gain community support through time and become self-sustaining. The criteria to receive a special event grant includes a condition that the grant shall not provide for 100% of the total event funding and the maximum grant shall not exceed $10,000; there must be funding from other non-city sources to finance the expenses of the event to be eligible for a grant. Hobie Cat Company, a recreational equipment business, is a title sponsor for the Kayak Regatta and has donated a prize for the event. No other sponsors were named at the time of grant submittal but the Foundation noted a couple of small cash grants. Staff is not recommending approval of the full grant request of $10,000 because it would nearly pay for 100% of the event costs, which is contrary to the criteria/conditions set forth in Council Policy 51. The amount noted would cover approximately 45% of the eligible expenses. If awarded a Special Event Grant, funds would be used for the following: neighborhood notification expenses, creation of a parking plan, public facilities, and various marketing tools. Organizations are eligible to receive grants of in-kind city assistance for city services/facilities for a maximum of five (5) years and direct cash assistance for a maximum of three (3) years. This program allows special event organizers to apply for grant funding for the special events at any time of the year. These requests are to be considered by the City Council and, if funded, the appropriation is typically funded directly from the City Council's General Fund contingency account. The event meets the special event definition because it is a "....noncommercial organized assemblage of fifty or more persons at a public beach, public park, public waterways, street, or sidewalk which is to gather for a common purpose under the direction and control of a person" as set forth in Chapter 8.12 of the Carlsbad Municipal Code. Visiting the lagoon is free to all residents and visitors; however to actively participate in the Kayak Regatta there is an entry fee/donation of $25 per individual. The Agua Hedionda Lagoon Foundation anticipates 200 participants for this first time event. According to municipal records, the Agua Hedionda Lagoon Foundation has never applied for a Special Event Grant; however they have previously received monies via Community Activity Grants. Attached, as Exhibit 3, is history of city funding received by the Agua Hedionda Lagoon Foundation. The Special Event Grant application is available as Exhibit 4 for City Council review. FISCAL IMPACT: Special Event Grants are discretionary; therefore the City Council may deny or approve the request. After an administrative review of the application, staff's recommendation is to award a Special Event Grant at a reduced amount of $5,000 to assist in the event start up costs. The proposed award will pay for all in-kind city services at $3,030 (Exhibit 5) as well as provide a direct cash donation of $1,970 to help off-set some of the event's costs. If the City Council chooses to fund this Special Event Grant Request, approval of the attached resolution will appropriate $5,000 from the City Council's General Fund contingency account for the Agua Hedionda Lagoon Foundation's Kayak Regatta. The City Council's General Fund contingency account was allocated $500,000 for FY 2011-12, with a specific provision of $50,000 for Special Events Grants. Currently, the City Council's General Fund contingency account carries a balance of $495,595, and the Special Events Grants provision holds a balance of $45,595. ENVIRONMENTAL IMPACT: California Environmental Quality Act (CEQA) Guidelines Section 15061(b) (4) states a project is exempt from CEQA if it is denied. However, if the City Council decides to fund the grant request, pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. This has included the allocation of funds to agencies that provide various programs that enrich Carlsbad residents and visitors, and/or assist in enhancing their quality of life. On January 18, 2011, the City Council reviewed its policy and approved some recommended revisions for its consideration at a regular Council meeting. To establish the process for distributing funds for community activities, including special events and support for winning teams. POLICY 1.It is the policy of the City of Carlsbad to allocate funds for "start-up costs" to initiate new programs/ ideas/organizations that provide for community activities or enhancements within Carlsbad. The program is not intended to fund ongoing services/programs. There are three (3) funding programs available under this Council policy: Community Activity Grants, Special Event Grants, and Winning Team Grants. A description of each program and its related eligibility criteria is provided below. 2. The Grant Funding shall have the following term limits per organization: a. b. c. Community Activity Grants: Organizations funded by the Community Activity Grant may receive annual grants for up to a maximum of three (3) years and then will be ineligible for grant funding for a minimum of two (2) years. After at least two (2) years, organizations can again apply for Community Activity Grant funding and receive a maximum of two (2) additional years of grant funding. An organization may not receive more than five (5) years of funding through this grant program, and no other city funding may be provided during the two (2) year hiatus. Special Event Grants: An organization may receive no more than one (1) special event grant per year, and may receive no more than three (3) years of grants which provide cash assistance. An organization may receive up to five (5) years of in-kind city assistance to pay for city services/facilities for special events. Winning Teams Grants: A team may receive up to three (3) years of grants to participate in a national championship competition as defined below. 3. The organization cannot receive money, or donated city services from other city sources (including CDBG) for the current fiscal year. 4. Community Activity Grants - Criteria and Process a. Such grants provide funding for enrichment programs for the community and/or for physical or other neighborhood enhancements within Carlsbad, with the exception that the following will not be eligible: 1) social service programs; 2) programs sponsored by educational institutions; and 3) a program that conflicts or is in competition with a city program. b. The City Council will annually determine the amount of funds to be budgeted for Community Activity Grants. This amount shall include the interest earned on the initial $1 million set-aside for said fund, but may also include additional general funds at the discretion of the Council. c. Once the budget is adopted by the Council interested groups will be notified of the application process to request said grants d. The application process will consist of the following: i. Completion of city application for funds. ii. Review by city staff and a Citizens' Advisory Committee.. iii. Recommendations submitted by Advisory Committee to City Council. iv. Action by City Council to approve, modify, or disapprove the request. e. The City Council will establish a review panel comprised of citizens and city staff to evaluate the applications, and make recommendations to the City Council. The review panel will be comprised of the following: one representative from each quadrant of the City, one member of the Senior Commission, the Library Board, and the Parks & Recreation Commission. f. The review panel will consider the provision of matching funds from other sources in evaluation of the applications. 5. Special Event Grants - Criteria and Process a. Such grants provide city funding for start up costs related to Special Events held within the City that have a citywide interest; and shall be available to a recognized 501(c)(3) non-profit organizations, or to an organized all-volunteer group on a reimbursement basis only. b. For the purposes of this grant, a "special event" shall be defined as set forth in Chapter 8.17 of the Carlsbad Municipal Code (Special Event Ordinance), with the exception that the following "special events" shall not be eligible for this grant: i. Events hosted by a commercial enterprise for profit and/or fundraiser purposes, ii. Regularly offered programs, activities or events. iii. Any event held for primarily a political or religious benefit or other similar purpose, which in the opinion of the City Attorney constitutes an unlawful use of public funds. c. Special fundraising events shall be eligible for funding provided the organization is all-volunteer, based in Carlsbad and provided further that funds are used only for direct costs of the event and no staff of the organization is paid for working the event, other than short-term consultants or contractors that are directly necessary for holding the event. d. Such grants can be requested any time of the year, and may not exceed $10,000 for a single grant. f. Such grants shall not provide for 100% of the total event funding; there must be funding from other non-city sources to finance the expenses of the event to be eligible for such grants. g. All approved grants will be funded from the City Council's contingency account. An annual appropriation maximum shall be set by the City Council at its discretion. h. The City Manager, or designee, is authorized to approve grants up to $5,000 following consultation with the Special Events Committee, and shall be authorized to appropriate said funds from the City Council's general fund contingency account. The City Council shall approve grants over $5,000. i. The application process will consist of the following: i. Completion of a permit application for the special event (if applicable). ii. Completion of a Special Event Grant supplemental application. iii. Administrative review and tentative approval of special event by special events committee (if applicable). iv. Allocation of funding by the City Council for said grants. v. Approval of grant by City Manager, or designee, if the grant is less than $5,000. vi. Approval of grant by City Council, if it exceeds $5,000. 6. Winning Teams Grants a. Such grants provide funding to youth teams to offset the cost of travel expenses to national championship competitions. To be eligible for these grants, the team(s) must advance through a series of competitive levels, earning the right to compete at a national or international level. Additional eligibility requirements are provided below. b. Such grants can be requested any time of the year. c. These requests will be funded from City Council's contingency account. d. Eligibility requirements are: i. The participants are all 18 years of age or under. The group or team is an organized non-profit corporation or unincorporated association. The request for funding must be made prior to the date of the national or international event, iv. At least 90% of the participants in the team or group are residents of Carlsbad. e. The application process will consist of the following: i. Written request to the Housing and Neighborhood Services Director. ii. Administrative review by the Housing and Neighborhood Services Director, or designee. iii. Consideration of the funding by the City Council. 7. This policy may be amended as necessary and appropriate by the City Council. It will be the first time the entire inner lagoon will be briefly available exclusively to passive kayaks and Stand Up Paddle Boards with no power boats. Enjoyment of passive vessels on the lagoon is growing steadily. The proceeds will go to the Agua Hedionda Lagoon Foundation which is a huge benefit to and enhancement of the community itself and whose mission is: • to preserve, restore and enhance the Agua Hedionda Lagoon and its wildlife, marsh, wetlands and watershed areas. • to protect sensitive land through acquisition or other means. • enhance public stewardship of the Lagoon through a broad spectrum of conservation, education and outreach activities. • The Foundation serves as an advocate for the Lagoon and strives to preserve its natural healthy ecosystem and habitat including wildlife and marine life, while at the same time balancing the need for public access, trails and recreational opportunities. The Foundation is a 501C(3) non-profit who is working very hard to accomplish this mission but we cannot do it without money and the proceeds will help keep this worthy organization viable. This event will increase a positive "sense of community" and awareness of our precious lagoon, the Agua Hedionda Lagoon Foundation and our beautiful city of Carlsbad. FINANCIAL CAPABILITIES/ BUDGET Since this is a first time event and our Special Event Application has just recently been submitted our "Budget" is fairly meager. We have Hobie as a Title Sponsor and they are providing a $1,600 Kayak for a prize and an in kind donation. We will rely on volunteers to do all the work involved. Our entry fees / donation of $25 dollars per participant and, hopefully, 200 participants equates to a modest $5,000 "profit". At this time we have no other funding but we will vigorously pursue additional sponsors and donations while the Special Events Permit is being approved. In this current economic downturn donations and grants are extra difficult to secure. We will have expenses for marketing, portable restrooms and perhaps some City Services. As the event becomes established in years to come, we have increased potential for more corporate sponsors and possible grants and increased tourism. This Carlsbad Special Event Grant is vital for defraying the "start up costs" and establishing this community activity to help fund the Agua Hedionda Lagoon Foundation's enhancement of the Carlsbad lifestyle. Funding schedule would be $5,000 upon final approval of the Special Event Permit and $5,000 as soon as possible before the event on October 22nd 2011. The near closure of our lagoon from 2000 through 2006 due to the presence of the genetically modified strain of Caulerpa taxifolia, and eventual success via eradication makes us unique in the world of coastal lagoons. The Agua Hedionda Lagoon Foundation, with city support, continues to celebrate this precedent and legacy. Our planned Regatta on October 22 is another effort in that regard, and would hugely benefit from the city approval of the pending Special Event grant. I personally and professionally support any effort that continues to put our lagoon on a sustainable track, including community events like the upcoming Regatta. Having visited a coastline that is ravaged by the reality of Caulerpa taxifolia (NSW, Australia, Nov 2008) and having spoken with that community; I can assure you that participation and assistance via a Special Event grant would be strongly welcomed by those community leaders vs. the current reality of no boating/no fishing and other recreatonal use limitations of their once prolific wetlands. My support for the lagoon includes: efforts as former Carlsbad city planning staff and designated liaison between the city and the Southern California Caulerpa Action Team from 2000-2006; served as Chairman for the Citizens Committee on the south shore Flower Fields (Summer 2006), president/chair of AHL Foundation from January 2006 to October 2009 and initiated Lagoon Day in Carlsbad in 2007, and; continuing member of Board of Directors since October 2009.
