Adopt Resolution No.
Engineering Contractors for construction of the 2011 Pavement Overlay Project No. 6001-11-OL.
ITEM EXPLANATION:
The 2011 Pavement Overlay Project is part of the City's ongoing Pavement Management Program.
This project will resurface Levante Street, Camino De Los Coches, Calle Timiteo, Normandy Lane,
and a portion of El Camino Real by applying a rubberized asphalt concrete layer over the existing
roadway. The streets were selected based on their age and the existing condition of the pavement
surface.
On September 8, 2011, eleven (11) sealed bids were received for the construction of this project as
shown on the following table.

The lowest responsive bidder, ATP General Engineering Contractors, submitted a bid in the amount of
$1,512,273. Staff has completed its review of the contract documents and has determined that they
are in order. Staff recommends that ATP General Engineering Contractors be awarded the contract.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15301(c) - minor alteration of existing facilities including streets, sidewalks,
gutters, and similar facilities involving negligible or no expansion.

Of the remaining Pavement Management Program balance of $9,036,471, $1,485,000 was previously
allocated for the 2011 Slurry Seal Project by City Council on July 12, 2011.
There are sufficient funds available to complete the 2011 Pavement Overlay Project. Staff has applied
for and received a rubberized asphalt concrete grant in the amount of $130,720 from California
Department of Resources Recycling and Recovery (CalRecycle). The Pavement Management Program
funds consist of Cal Recycle grant money, non-jurisdictional fees (generated from trash haulers),
TransNet-Local funds available for drawdown from SANDAG, and the remaining Proposition 1B funds
(provided by the State).
The project was advertised with prevailing wage requirements as it is partially funded with restricted
funds (Proposition 1B).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONTRACT TO ATP GENERAL ENGINEERING
4 CONTRACTORS FOR THE CONSTRUCTION OF THE 2011
PAVEMENT OVERLAY PROJECT NO. 6001-11-PL.

WHEREAS, the City Council of Carlsbad, California has determined that it is necessary,
6
desirable, and in the public's best interest to construct the 2011 Pavement Overlay Project No.
7
6001-11-OL; and

WHEREAS, on June 21st, 2011, the City Council of the City of Carlsbad approved plans
9 for the construction of the 2011 Pavement Overlay Project No. 6001-11-OL; and
10 WHEREAS, eleven (11) sealed bids were received on September 8, 2011 by the City of
11 Carlsbad for the construction of the 2011 Pavement Overlay Project No. 6001-11-OL; and
12 WHEREAS, the lowest responsive and responsible bid to construct said project was
13 submitted by ATP General Engineering Contractors in the amount of $1,512,273; and
14 WHEREAS, this project requires the payment of prevailing wages; and
WHEREAS, there are sufficient funds available in the Pavement Management Program15
to complete the project; and
16.
WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the
17
City Manager to approve change orders in the amount equal to the contingency set at the time of
18 • *project award.
19 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
20 California, as follows:
21 1. That the above recitations are true and correct.
22 2. That the low bid of $1,512,273 submitted by ATP General Engineering
23 Contractors for the construction of the 2011 Pavement Overlay Project No. 6001-11-OL is
24 accepted and the Mayor is hereby authorized to execute a contract for this project.
__ 3. That the City Manager is hereby authorized to approve construction change25
orders up to $150,000.

4. That the award of this contract is contingent upon the bidder submitting the

lowest responsible bid executing the required contract and submitting the required bonds and

Attached is the notice to proceed i'or this project with a start date of October 3, 2011 which is the beginning of the 80
calendar day work period. I am net aware of any extensions granted to the contractor to delay the start of the
project. I would be glad to respond to American Asphalt regarding their concerns. I sent this information to CM&I to
see if they have any additional infcrmation. Please let me know if this answers your concerns.

Subject: 2011 Slurry Seal Project
I noticed that this project awarded on July 12th, 2011 and I do not believe any work has taken place at this time. Being
the second bidder for this project I was curious as to what the delay might be in completing this project. We bid this
project accordingly to perform the work this year and it seems to be unfair if this contractor is allowed to postpone this
project until next year. That is exactly what they have tried to do on another project in the City of San Diego that bid in
March. Currently, they have not performed any work on that one as well b
counting working days.
