RECOMMENDED ACTION:
Adopt Ordinance No. CS-157. authorizing an amendment to the Contract with the California
Public Employees Retirement System (CALPERS) to provide a 2nd tier retirement plan that
includes a 2% at Age 60 Retirement Benefit (Section 21353) and Three Year Final
Compensation Benefit (Section 20037) for employees entering membership for the first time
in a City of Carlsbad miscellaneous classification after the effective date of the amendment,
November 27, 2011.
ITEM EXPLANATION:
Ordinance No. CS-157 was introduced and first read at the City Council meeting held on
September 13, 2011, at which time the Resolution of Intention was adopted. CALPERS
regulations stipulate that the final ordinance cannot be adopted earlier than 20 days after the
adoption of the Resolution of Intention. Once the required time period has passed, the
second reading of the ordinance allows the City Council to adopt the ordinance which will
become effective thirty days after adoption. The City Clerk will have the ordinance published
within fifteen days after adoption.
FISCAL IMPACT:

ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15738, this
action does not constitute a "project" within the meaning of CEQA and therefore, does not
require additional environmental review.

CARLSBAD, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE
3 CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF
4 ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES'
RETIREMENT SYSTEM

WHEREAS, the City Council authorized the City to initiate an amendment of the
6
City's contract with CalPERS to provide a 2nd tier retirement plan that includes the 2% at
7
60 retirement benefit (Section 21353) and Three Year Final Compensation benefit8
(Section 20037) for employees entering membership for the first time in a City of
10 Carlsbad miscellaneous classification effective November 27, 2011.
11 NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows:
12 That an amendment to the contract between the City Council of the City of
13 Carlsbad and the Board of Administration of the California Public Employees'
14 Retirement System is hereby authorized, a copy of said amendment marked "Exhibit" to
Resolution No. 2011-214

The Mayor of the City of Carlsbad is hereby authorized, empowered, and
17
directed to execute said amendment ror and on behalf of said Agency.

This ordinance shall be effective thirty days after the date of its adoption; and the
20 City Clerk shall certify the adoption of this ordinance and cause it to be published at
21 least once in a newspaper of general circulation in the City of Carlsbad within fifteen
22 days after its adoption.

INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City
Council on the 13th day of September 2011, and thereafter.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad on the 11th day of October 2011, by the following vote, to wit:
AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard.
NOES: None.
ABSENT: None.
ABSTAIN: None.
