RECOMMENDED ACTION:
That the City Council hold a public hearing and INTRODUCE City Council Ordinance No. cs-163
APPROVING a Zone Change from Residential Mobile Home Park (RMHP) to Open Space (OS) and
ADOPT City Council Resolution No. 2011-244 APPROVING an amendment to the Land Use
Element and the Open Space and Conservation Map from Residential Low-Medium (RLM) to Open
Space (OS) for a 3.49 acre remainder parcel (Lot 3 of CT 09-01) known as the Rancho Carlsbad Option
Parcel.
ITEM EXPLANATION:
On July 20, 2011, the Planning Commission, on a 6-0 vote (Chairperson L'Heureux absent),
recommended approval of a General Plan Amendment and Zone Change, from Residential Low Medium
(RLM) and Residential Mobile Home Park (RMHP) respectively, to Open Space (OS) for a 3.49 acre
remainder parcel of CT 09-01, known as the Rancho Carlsbad Option Parcel. The Rancho Carlsbad
Option Parcel is generally located between the Rancho Carlsbad Estates Community and the Robertson
Ranch Master Plan Community. These amendments would reflect the actual open space land uses and
ensure that the 3.49 parcel remain undeveloped as desired by the Rancho Carlsbad Estates Community.
Additional information detailing the proposal is contained in the staff report to the Planning Commission
dated July 20, 2011 attached to this Agenda Bill as Exhibit 5. At the Planning Commission hearing,
there was no public testimony and the minutes of the Planning Commission hearing are attached as
Exhibit 6.
FISCAL IMPACT:
There are no fiscal impacts from the proposed project.
ENVIRONMENTAL IMPACT:
The proposed amendments are exempt from environmental review pursuant to CEQA Section
15061(b)(3), which exempts projects "where it can be seen with certainty that there is no possibility that
the activity in question may have a significant effect on the environment." Changing the General Plan
Land Use and Zone designations, from Residential Low-Medium (RLM) and Residential Mobile Home
Park (RMHP) respectively, to Open Space (OS) will not result in a significant effect on the environment.

9 The City Council of the City of Carlsbad, California, does hereby resolve as
10 follows or ordain as follows:
11 SECTION I: That Section 21.050.30 of the Carlsbad Municipal Code, being the
12 zoning map, is amended as shown on the map marked Exhibit "ZC 10-01," dated July 20, 2011,
13 attached hereto and made a part hereof.
14 SECTION II: That the findings and conditions of the Planning Commission as set
15 forth in Planning Commission Resolution No. 6782 constitute the findings and conditions of the
16 City Council.
17 EFFECTIVE DATE: This ordinance shall be effective no sooner than thirty days
1 80 after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to
19 be published at least once in a publication of general circulation in the City of Carlsbad within
20 fifteen days after its adoption.

The City Council of the City of Carlsbad, California, does hereby resolve as

10 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
11 Commission did, on July 20, 2011, hold a duly noticed public hearing as prescribed by law to
12 consider the General Plan Amendment GPA 10-05, according to Exhibit "GPA 10-05" attached
13 to Planning Commission Resolution No. 6781 and incorporated herein by reference to change
1^ the General Plan Land Use designation from Residential Low Medium (RLM) to Open Space
15 (OS) on a 3.49 acre property and the Planning Commission adopted Planning Commission
1° Resolution No. 6781 recommending to the City Council that it be approved; and
17 WHEREAS, the City Council of the City of Carlsbad, on the llth day of
1 81 ° October , 2011, held a duly noticed public hearing to consider adoption of a General
19 Plan Amendment GPA 10-05; and
70 WHEREAS, at said public hearing, upon hearing and considering all testimony
21 and arguments, if any, of all persons desiring to be heard, the City Council considered all factors
2?relating to the adoption of a General Plan Amendment.
23 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City
24 of Carlsbad as follows:

1. That the above recitations are true and correct.

2. That the recommendation of the Planning Commission for the approval of
27 a General Plan Amendment (GPA 10-05) is adopted and approved, and that the findings and

1 conditions of the Planning Commission contained in Planning Commission Resolution No. 6781
on file with the City Clerk and incorporated herein by reference, are the findings and conditions
2 of the City Council.
3. That the application for a General Plan Amendment to change the Land
Use designation from Residential Low Medium (RLM) to Open Space (OS) on a 3.49 acre
4 property generally located north of Rancho Carlsbad Estates and Calavera Creek, south of
Cannon Road, east of Robertson Ranch PA 22, and west of Robertson Ranch PA 23F as
5 shown in Planning Commission Resolution No. 6781, is hereby accepted and approved, and
shall be effective no sooner than thirty days after its adoption..6
4. The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, "Time
Limits for Judicial Review" shall apply:

The time within which judicial review of this decision must be sought is governed
by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of
Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review
1 1 must be filed in the appropriate court not later than the ninetieth day following the date on which
this decision becomes final; however, if within ten days after the decision becomes final a
12 request for the record is filed with a deposit in an amount sufficient to cover the estimated cost
or preparation of such record, the time within which such petition may be filed in court is
13 extended to not later than the thirtieth day following the date on which the record is either
personally delivered or mailed to the party, or his attorney of record, if he has one. A written
14 request for the preparation of the record of the proceedings shall be filed with the City Clerk,

Option Parcel; and
20 WHEREAS, said verified application constitutes a request for a General Plan

Amendment as shown on Exhibit "GPA 10-05" dated July 20, 2011, attached hereto and on file

in the Carlsbad Planning Department, RANCHO CARLSBAD OPTION PARCEL - GPA 10-
24 05, as provided in Government Code Section 65350 et. seq. and Section 21.52.150 of the
25 Carlsbad Municipal Code; and
26 WHEREAS, the Planning Commission did, on July 20,2011, hold a duly noticed

9 RECOMMENDS APPROVAL of RANCHO CARLSBAD OPTION
PARCEL - GPA 10-05, based on the following findings:

The Planning Commission finds that the project is in conformance with the Elements of
the City's General Plan based on the facts set forth in the staff report dated July 20, 2011
13 including, but not limited to the following: that the proposed change in General Plan
Land Use designation from Residential Low-Medium (RLM) to Open Space (OS)
14 would reflect the actual land uses as all of the allowable residential density
originally allocated to this property was previously allocated to other planning areas
within the East Village of Robertson Ranch through the Master Plan process, and
would ensure that the 3.49 acre parcel remain undeveloped as desired by the
Rancho Carlsbad Estates Community. The proposed OS Land Use designation will
17 be consistent with the proposed OS Zone and the OS Land Use designation is
compatible with surrounding residential mobile home park, office and residential
18 uses.
2. The Planning Commission of the City of Carlsbad does hereby find:
20 The proposed amendments are exempt from environmental review pursuant to CEQA
21 Section 15061(b)(3), which exempts projects "where it can be seen with certainty that
there is no possibility that the activity in question may have a significant effect on the
22 environment." Changing the General Plan Land Use and Zone designations, from

25 3. The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
26 to mitigate impacts caused by or reasonably related to the project, and the extent and the
degree of the exaction is in rough proportionality to the impact caused by the project.

Conditions:
2 If any of the following conditions fail to occur, or if they are, by their terms, to be
3 implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted; deny or further condition issuance of all
, future building permits; deny, revoke, or further condition all certificates of occupancy
issued under the authority of approvals herein granted; record a notice of violation on the
5 property title; institute and prosecute litigation to compel their compliance with said
conditions or seek damages for their violation. No vested rights are gained by Developer
7 or a successor in interest by the City's approval of this General Plan Amendment.
o0 2. Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the General Plan Amendment documents, as necessary to make
them internally consistent and in conformity with the final action on the project.
10 Development shall occur substantially as shown on the approved Exhibits. Any proposed
development, different from this approval, shall require an amendment to this approval.

3. Developer shall comply with all applicable provisions of federal, state, and local laws and
regulations in effect at the time of building permit issuance.
13 4. If any condition for construction of any public improvements or facilities, or the payment
14 of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project
are challenged, this approval shall be suspended as provided in Government Code
Section 66020. If any such condition is determined to be invalid, this approval shall be
. , invalid unless the City Council determines that the project without the condition complies
with all requirements of law.

5. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold
18 harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
and costs, including court costs and attorney's fees incurred by the City arising, directly
2Q or indirectly, from (a) City's approval and issuance of this General Plan Amendment,
(b) City's approval or issuance of any permit or action, whether discretionary or
21 nondiscretionary, in connection with the use contemplated herein, and
(c) Developer/Operator's installation and operation of the facility permitted hereby,
22 including without limitation, any and all liabilities arising from the emission by the
facility of electromagnetic fields or other energy waves or emissions. This obligation
survives until all legal proceedings have been concluded and continues even if the City's
24 approval is not validated.
25 6. This approval is granted subject to the approval of ZC 10-01 and is subject to all
conditions contained in Planning Commission Resolution No. 6782 for this other
2" approval incorporated herein by reference.

27 relating to the Zone Change.
28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
2 B) That based on the evidence presented at the public hearing, the Commission
3 RECOMMENDS APPROVAL of RANCHO CARLSBAD OPTION
PARCEL - ZC 10-01, based on the following findings:

5 1. That the proposed Zone Change from Residential Mobile Home Park (RMHP) to
Open Space (OS) on the 3.49 acre site is consistent with the goals and policies of the
7 various elements of the General Plan, in that the proposed change in zone designation
from RMHP to OS would reflect the actual land uses and ensure that the 3.49 parcel
° remain undeveloped as desired by the Rancho Carlsbad Estates Community.
9 2. That the Zone Change will provide consistency between the General Plan and Zoning as
10 mandated by California State law and the City of Carlsbad General Plan Land Use
Element, in that the OS zone designation shown on Exhibit "ZC 10-01" attached
11 hereto, implements the General Plan Land Use designation of OS proposed on the
12 Site"
13 3. That the Zone Change is consistent with the public convenience, necessity, and general
welfare, and is consistent with sound planning principles in that proposed OS zone
14 designation is compatible with the adjacent existing and future residential mobile
home park, office and residential land uses.
1fi 4. The Planning Commission of the City of Carlsbad does hereby find:

I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 6781 and 6782
RECOMMENDING APPROVAL of a General Plan Amendment (GPA 10-05) and Zone
Change (ZC 10-01), based on the findings and subject to the conditions contained therein.
II. INTRODUCTION
This proposal is City-initiated and consists of a recommendation of approval for a General Plan
Amendment and Zone Change, from Residential Low-Medium (RLM) and Residential Mobile
Home Park (RMHP) respectively, to Open Space (OS) for a 3.49 acre parcel (Lot 3 of CT 09-01)
known as the Rancho Carlsbad Option Parcel. These amendments would reflect the actual land
uses and ensure that the 3.49 acre parcel remain undeveloped as desired by the Rancho Carlsbad
Estates Community.
III. PROJECT DESCRIPTION AND BACKGROUND
On December 16, 2009, the Planning Commission recommended approval of legislative and
discretionary permits for an office building and RV storage area within Robertson Ranch PA 22
and the adjacent option parcel. Concurrently with this recommendation, the Planning
Commission made a motion and voted (7-0 in favor) directing staff to consider a General Plan
Amendment and Zone Change, from Residential Low Medium (RLM) and Residential Mobile
Home Park (RMHP) respectively, to Open Space (OS) to the 3.49 acre remainder parcel of CT
09-01, known as the Rancho Carlsbad Option Parcel, The Rancho Carlsbad Option Parcel is
generally located between the Rancho Carlsbad Estates Community and the Robertson Ranch
Master Plan Community. These amendments would reflect the actual land uses and ensure that
the 3.49 remainder parcel remains undeveloped as desired by the Rancho Carlsbad Estates
Community and as represented to the Planning Commission.

On March 3, 2010, the Planning Commission adopted Planning Commission Resolution No.
6679 approving a Resolution of Intention (ROI 09-01) recommending that the City Council
direct the Planning Director to consider a General Plan Amendment (from RLM to Open Space)
and Zone Change (from RMHP to Open Space) for this property.
On November 9, 2010, the City Council adopted City Council Resolution No. 2010-252
directing the Planning Director to initiate a General Plan Amendment and Zone Change, from
RLM and RMHP respectively, to Open Space for the subject 3.49 acre parcel.
IV. ANALYSIS
Proposed Open Space (OS) General Plan Land Use designation and Open Space (OS)
Zoning designation
The property is being redesignated and rezoned from Residential Low-Medium (RLM) and
Residential Mobile Home Park (RMHP) respectively, to Open Space (OS). All of the allowable
residential density for the Rancho Carlsbad Option Parcel was previously allocated to planning
areas within the East Village of the Robertson Ranch Master Plan. Therefore, no additional
residential units can be constructed on the parcel. These amendments would reflect the actual
land uses and would ensure that the 3.49 acre parcel remain undeveloped as desired by the
Rancho Carlsbad Estates Community. These amendments will result in the proposed OS
General Plan Land Use designation and OS Zone for the property being consistent. The
proposed OS Land Use designation and OS Zone will also be compatible with surrounding
residential mobile home park, office and residential uses.
V. ENVIRONMENTAL REVIEW
The proposed amendments are exempt from environmental review pursuant to CEQA Section
15061(b)(3), which exempts projects "where it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment."
Changing the General Plan Land Use and Zone designations, from Residential Low-Medium
(RLM) and Residential Mobile Home Park (RMHP) respectively, to Open Space (OS) will not
result in a significant effect on the environment.

Commissioner Arnold asked what the potential uses will be for the open space. Mr. Fisher stated the
current plan is to leave it as is; however with the Open Space zoning there are certain uses that are
allowed, some by right, some will require a Conditional Use Permit.
Commissioner Black inquired about the property adjacent to this project and if that project approved for
that site has any intention of using this site in the future potentially for parking. Mr. Fisher stated an office
building has been approved for that property along with RV storage parking and the project meets the
parking requirement.
Mr. Neu stated the approved project was a three story office building. If a medical office were to be on
that site, it would require additional parking. Mr. Neu further stated once it becomes open space, it is
restricted to a limited list of uses included in the open space zone. If the open space was proposed to be
removed, it would have to be designated elsewhere.

Way, and west of Hilltop Street and within Local Facilities Management Zone 14.
