DIRECTORi^TD^-'" CITY ATTORNEY /£^^" CITY MANAGER (/S-— RECOMMENDED ACTION: That the City Council ADOPT Resolution No. 2011-249 APPROVING the final map for CT 06-27, Muroya, generally located north of Aviara Parkway, south of Corte Orchidia, east of Towee Lane and west of Black Rail Road. ITEM EXPLANATION: Land Development Engineering staff has completed checking the final map of CT 06-27, known as Muroya Subdivision. This subdivision is within Local Facilities Management Plan (LFMP) Zone 20 and is generally located north of Aviara Parkway, south of Corte Orchidia, east of Towee Lane and west of Black Rail Road. The project proposes a total of 5 lots. The project is comprised of 37 condominium units on one lot, one single family dwelling lot, two dedicated open space lots, and one private street lot. No further discretionary permits are required before building permits can be issued for this development. The final map conforms substantially with the tentative map as approved by Planning Commission on April 7, 2010 per PC Resolution No.6686. The final map also conforms to the General Plan, all the applicable requirements of the Municipal Code, City Standards, and Growth Management Plan. The property owner, Muroya Family Trust is requesting the recordation of said map on behalf of the developer, Taylor Morrison of California, LLC. ENVIRONMENTAL IMPACT: The approval of a final map is a ministerial process and is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section 19.040.070 A.1. a. FISCAL IMPACT: The property owner paid a plan check fee to cover the expense of plan checking and processing the final map for recording. All other processing and development impact fees required to be paid prior to final map approval have been paid. Additional processing and development impact fees will be paid, as required, if and when building permits are issued for this project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,18 California, as follows: 19 1. That the above recitations are true and correct. 20 2. That said final map known as CT 06-27, Muroya Subdivision, which is on file with 21 the City Engineer and is incorporated herein by reference, is accepted. op 3. That the city accepts the dedications shown on the final map. 23 4. That the City Clerk is authorized to sign the Certificate of Acceptance on the 24 final map. 25 5. That the City Clerk is authorized to cause the original final map to be recorded in 26 the Office of the County Recorder of San Diego County, State of California. 27 6. That the City Clerk is authorized to release the final map to First American Title Company for recording in the office of the County Recorder.Zo 2. 1 PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council 2 of the City of Carlsbad on the 25th day of October, 2011, by the following vote to wit: 3 ..
