RECOMMENDED ACTION: Tliat the City Council ADOPT Resolution No 2011-287 APPROVING a Major Review Permit Extension (RP 94-05x6) to the Farmer's Market which occurs in the public parking lot located mid- block on the east side of Roosevelt Street between Carlsbad Village Drive and Grand Avenue in Land Use District 1 of the Village Review (VR) Zone. The request is to extend the expiration date of the Major Review Permit for the Wednesday and Saturday Farmer's Market to September 19, 2014. ITEM EXPLANATION: On September 27, 1994, the Housing and Redevelopment Commission approved, with the unanimous recommendation of the Design Review Board, a Major Redevelopment Permit to allow a Farmer's Market in the Village Redevelopment Area. An additional day, Saturday, was added to the weekly Farmer's Market in May of 2005. The latest amendment to the Farmer's Market permit was approved on December 16, 2008, where the Housing and Redevelopment Commission granted final approval to 1) amend the hours of the Saturday Farmers Market from 9am to 1pm, to 1pm to 5pm; 2) extend the expiration date of the permit for the Saturday Farmer's Market from September 18, 2008 to September 19, 2011; and, 3) to add a condition requiring a 2:1 ratio of certified agricultural product booths to non-certified product and informational booths for both markets. After visiting the market the past three years, staff has observed that the Farmer's Market is generally in compliance with the conditions of the permit. The Carlsbad Village Business Association (CVBA) is the official sponsor of the Farmer's Market event. The Farmer's Market has been held in the mid-block public parking lot on Roosevelt Street for over 17 years. The CVBA's Christy Johnson, the current Farmer's Market Manager, will continue to manage both Farmer's Market events and monitor compliance with existing and proposed conditions. Staff is recommending approval to extend the expiration date of the Major Review Permit to September 19, 2014. FISCAL IMPACT: It is anticipated that the proposed project will have a positive fiscal impact in terms of increased sales tax both within the Farmer's Market and the Village Area in general as more customers visit the local businesses. The Planning Director has subsequently made a determination that the proposed project is exempt under CEQA Section 15061 as the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Location Map 4 ^ CITY COUNCIL RESOLUTION NO. 2011-287 ^ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, APPROVING A MAJOR REVIEW PERMIT EXTENSION (RP 94-05X6) TO EXTEND THE EXPIRATION DATE OF THE PERMIT BY THREE YEARS FOR THE WEDNESDAY AND SATURDAY FARMER'S MARKET HELD IN THE 5 PUBLIC PARKING LOT AT 2930 ROOSEVELT STREET IN DISTRICT 1 OF THE VILLAGE REVIEW ZONE. 6 APPLICANT: CARLSBAD VILLAGE ASSOCIATION 7 CASE NO: RP 94-05X6 8 WHEREAS, on September 27, 1994, the Housing and Redevelopment ^ Commission of the City of Carlsbad held a duly noticed public hearing and approved a Major Redevelopment Permit RP 94-05 to allow a Wednesday Farmer's Market in the 11 public parking lot located mid-block on the east side of Roosevelt Street, west of the 12 alley, between Carlsbad Village Drive and Grand Avenue; and ^4 WHEREAS, on May 10, 2005, the Housing and Redevelopment Commission of 15 the City of Carlsbad approved a Saturday Farmer's Market; and through subsequent 16 amendments to Major Redevelopment Permit RP 94-05, had extended the term of the Village Farmer's Market on several occasions with the current expiration date for the Wednesday market set at September 19, 2011 and the Saturday market set at September 19, 2008 WHEREAS, on September 19, 2006, the Housing and Redevelopment Commission of the City of Carlsbad did, adopt Resolution No. 427 amending said Major 23 Redevelopment Permit RP 94-05 to allow open cooking vendors and two (2) additional 24 non-produce vendors during the Wednesday and Saturday Farmer's Market; and 25 WHEREAS, on December 16, 2008, the Housing and Redevelopment Oft Commission of the City of Carlsbad did amend Major Redevelopment Permit RP 94-05 27 to revise the hours of the Saturday Farmer's Market from 9:00 AM -1:00 PM to 28 " 18 19 20 21 22 10 11 12 13 14 18 19 20 21 22 1:00 PM - 5:00 PM, to modify the required ratio of certified agricultural product and informational booths, and to extend the expiration date of the Redevelopment Permit for the Saturday market to September 19, 2011; and WHEREAS, the applicant has filed an application to extend the expiration date of 1 2 3 4 5 g Major Review Permit RP 94-04X6 to September 19, 2014; and 7 WHEREAS, the City Council of the City of Carlsbad, on the date of this 8 resolution, did hold a duly noticed public hearing as prescribed by law to consider said ^ permit extension request and heard all persons interested in or opposed to an extension of Major Review Permit RP 94-05X6; and WHEREAS, as a result of an environmental review of the subject project conducted pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the City of 15 Carlsbad, the project was found to be categorically exempt from the requirement for 16 preparation of environmental documents pursuant to Section 15061 of the State CEQA Guidelines, as the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the foregoing recitations are true and correct. 23 2. That based on the evidence presented at the public hearing. City Council hereby APPROVES an additional three (3) year extension of Major Review 24 Permit RP 94-05X6 for the Wednesday and Saturday Village Farmer's Markets, based on the following findings and subject to the following 25 conditions: GENERAL AND VILLAGE MASTER PLAN CONSISTENCY FINDINGS: 26 27 1. The City Council finds that the subject project has been found to be exempt from 28 environmental review pursuant to Section 15061 of the State CEQA Guidelines as CC RESO NO. 2011-287 the activity is covered by the general rule that CEQA applies only to projects which 2 have the potential for causing a significant effect on the environment. 2. The project remains consistent with the land use plan, development standards, 3 design guidelines and other applicable regulations set forth within the Village Master Plan and Design Manual. 25 26 27 28 CONDITIONS: 1. The City Council does hereby APPROVE a three (3) year extension of Major Review Permit RP 94-05X6 for the Wednesday and Saturday Village Farmer's Market. The 7 permit shall be extended three (3) years from the date of the most recent permit expiration which is September 19, 2011. The new expiration date for the permit 8 shall be September 19, 2014. ^ 2.
