UTIL ACCEPTING BIDS AND AWARD OF CONTRACT TO CHARLES KING COMPANY, INC, FOR THE OCCIDENTAL INTERCEPTOR SEWER REHABILITATION, PROJECT NO. 5522 CITY MANAGER (^(/_^ RECOMMENDED ACTION: Adopt Resolution No. 2012-006 accepting bids and award of contract to Charles King Company, Inc. for the Occidental Interceptor Sewer Rehabilitation, Project No. 5522. ITEM EXPLANATION: The Occidental Interceptor Sewer includes approximately 2,500 lineal feet of pipeline between 39-inches and 48-inches in diameter with an alignment beginning adjacent to the north end of the Encina Water Pollution Control Facility (EWPCF), then running south in or parallel to Avenida Encinas, to its most upstream terminus near the entry to the NCTD Coaster Station where it intercepts flow from Leucadia Wastewater District (LWD), the City of Carlsbad and the City of Encinitas. The sewer was originally constructed in 1974 with portions ofthe alignment being improved over the years since. Ownership of the Occidental Interceptor Sewer is shared between three entities defined in the "Occidental- Carlsbad-Leucadia-Encinitas Agreement in Regard to Construction of Sewer Pipeline South from the Encina Water Pollution Control Facility", executed September 24, 1974 (Agreement). The Agreement specifies the ownership percentage for each owner and declares the City of Carlsbad the lead owner responsible for its maintenance and repair. The Agreement requires that both LWD and Encinitas pay the City of Carlsbad for the cost for maintenance and repair based on their ownership percentage. Specifically, ownership percentages are: Carlsbad 40.0%, LWD 40.3% and Encinitas 19.7%. Letters from LWD and the City of Encinitas agreeing to pay their fair shares are attached as Exhibit 3 and Exhibit 4, respectively. Inspection of this sewer has revealed the need to rehabilitate approximately 700 lineal feet of 39-inch diameter vitrified clay pipeline. The pipeline defects include cracked and broken sections of that pipe. Additionally, exposed concrete in the interior of the eight manholes has deteriorated due to a corrosive environment. Since the discovery of these defects, City staff has prepared plans for the sewer's repair. Both the pipe repair and manhole repair will be done by trenchless methods, minimizing the need for excavation and reducing surface impacts which would occur as a result of traditional methods requiring excavation. The pipeline will be rehabilitated with installation of a cured-in-place pipe (CIPP) liner, and the deteriorated manholes will be rehabilitated by removing the deteriorated concrete in the structures and installing high strength repair mortar, and then installing a new polyvinyl chloride (PVC) lining to protect the cementitious structures from future corrosion. City staff has corresponded with LWD and Encinitas throughout the investigative and design phases of this project and both are agreeable to the proposed rehabilitation methods. On October 11, 2011, through the adoption of Resolution No. 2011-242, the Carlsbad City Council approved plans and specifications, authorized the City Clerk to advertise to receive bids and appropriated funds forthe Occidental Interceptor Sewer Rehabilitation, Project No. 5522. SAK Construction 0 California O'Fallon, MO $966,655 The Engineer's Estimate for this project is $740,000. Staff has completed its review of all documents and finds that they are in order. Therefore, staff recommends that Charles King Company, Inc. be awarded the contract. ENVIRONMENTAL IMPACT: The City Planner has determined this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no expansion. FISCAL IMPACT: The City has appropriated a total of $849,000 from the Sewer Replacement Fund for the estimated cost of the project. Both LWD and Encinitas have paid Carisbad 50% of their portions of pre-bid projected project costs as agreed to in letters from each agency. The City will invoice LWD and Encinitas for their shares of the remaining project cost as progress payments are made on the project. The projected project cost and shared cost are shown on Table 1 and Table 2 below. WHEREAS, the Occidental Interceptor Sewer (Sewer) was originally constructed in 1974 under the Occidental-Carlsbad-Leucadia-Encinitas Agreement in Regard to Construction of Sewer Pipeline South from the Encina Water Pollution Control Facility (Agreement); and WHEREAS, allocation of ownership of the Sewer was provided in the Agreement in the following percentages: Leucadia Wastewater District (LWD) 40.3%; City of Carlsbad 40%, and City of Encinitas (Encinitas) 19.7%; and WHEREAS, the Agreement specifies that Carlsbad will manage the maintenance of the Sewer and Carlsbad will bill LWD for 40.3% and Encinitas for 19.7% ofthe total maintenance cost; and WHEREAS, inspection ofthe Sewer found defects in the pipeline and manholes in its alignment that are in need of repair; and WHEREAS, City staff has prepared plans and specifications for the repair of approximately 700 lineal feet of 39 inch diameter pipeline and the rehabilitation of eight manholes in the Sewer all as part ofthe Occidental Interceptor Sewer Rehabilitation (Project); and WHEREAS, on October 11, 2011, through the adoption of Resolution No. 2011-242, the Carlsbad City Council approved plans and specifications, authorized the City Clerk to advertise to receive bids and appropriated additional funds of $316,000 forthe Project; and WHEREAS, with said additional appropriation the total current appropriation for the project is $849,000; and WHEREAS, two (2) sealed bids were received on November 22, 2011, by the City of Carlsbad for the construction of the Project; and WHEREAS, the lowest responsive and responsible bid was submitted by Charles King Company, Inc. in the amount of $590,652; and WHEREAS, funds in the Sewer Replacement Fund are sufficient to complete said project; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City of Encinitas and the LWD have made payments to the City for 50% of their share of the projected project cost; and WHEREAS, the City will invoice LWD and Encinitas for their said percentages of the actual project cost throughout the construction phase, with final balances to be paid at the completion of the project; and WHEREAS, payments from LWD and Encinitas will be deposited into the Sewer Replacement Fund; and WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(b) - minor alteration of existing facilities of public utility sen/ices involving negligible or no expansion. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid in the amount of $590,652 submitted by Charles King Company, Inc., for the construction of the Occidental Interceptor Sewer Rehabilitation, Project No. 5522, is accepted and the Mayor is hereby authorized to execute a contract with Charles King Company, Inc., Inc. 3. The City Manager is hereby authorized to approve construction change orders up to $88,600. 4. The Finance Director is authorized to invoice LWD and Encinitas for their said percentages of the actual project cost throughout the construction phase, with final balances to be paid at the completion of the project. 5. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. Section 4, Dedication of Pipeline, of reference (a) states the following percentages of costs for maintenance, operation and repair of the Occidental Line: Leucadia - 40.3%, Encinitas - 19.7% and Carlsbad - 40%. The engineer's total project cost estimate; dated August 15, 2011; for the Occidental Line repair is $848,3/6. Therefore, the District's 40.3% share of that estimated cost is $341,895. The District agrees to provide 50% of our share or $170,948 to Carlsbad for initial project funding prior to award of the contract. Once the actual contract price is established, the District will provide incremental funding as progress payments are made on the project.
