RECOMMENDED ACTION:
Adopt Resolution No. 2012-007 accepting bids and awarding the contract to Burtech Pipeline,
Inc. forthe construction ofthe Northwest Quadrant Storm Drain Improvement Program, Concrete Repair
Work, and Pavement Management Program, Project Nos. 6608, 6021, and 6001.
ITEM EXPLANATION:
The Northwest Quadrant Storm Drain Improvement Program is a multi-year program to address non-
master drainage plan needs within the northwest quadrant ofthe City. Site locations have been identified
and prioritized based on recommendations from field observations. The locations of the sites, status and
current priority are included in Exhibit 2. Four segments have been added to the program since project
inception.
One site consisting of two locations is included in this contract request as shown on Exhibit 1. Storm
drain improvements are proposed for Madison Street and Roosevelt Street between Carlsbad Village
Drive and Grand Avenue and include construction of 420 feet of 18" diameter reinforced concrete pipe,
56 feet of 12" diameter polyvinyl chloride pipe, four catch basins, and four cleanouts that connect to the
existing storm drain systems in Grand Avenue and Carlsbad Village Drive. In addition to drainage
improvements, and through the Concrete Repair Work project, the two midblock crossings will also be
reconstructed to improve street surface drainage and pedestrian circulation. These improvements will
meet current American Disabilities Act requirements. Upgrades to the irrigation systems and electrical
systems will also be accomplished with this contract through the Concrete Repair Work project. At the
completion of the storm drain improvements and concrete repairs, the two street segments will be
overlayed through the Pavement Management Program.
On May 10, 2011, through Resolution Number 2011-086, Agenda Bill 20,536, Council approved the
plans and specifications and authorized the advertisement for bids for the Northwest Quadrant Storm
Drain Improvement Program, Concrete Repair Work, and Pavement Management Program, Project Nos.
6608, 6021, and 6001. On June 15, 2011 four sealed bids were received, opened and witnessed forthe
construction ofthe project On July 12, 2011, through Resolution Number 2011-166, Agenda Bill 20,621,
Council rejected all bids because of bid irregularities. The project was rebid.
On December 14, 2011, seven (7) sealed bids were received, opened and witnessed for the construction
of this project as shown in the following Table 1.

The Engineer's estimate for this project is $420,000. All bid documents submitted by Burtech Pipeline, Inc.
have been reviewed by staff and were found to be in order. Staff recommends awarding the construction
contract to Burtech Pipeline, Inc. in the amount of $396,998.00
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no
expansion and Section 15302(c) - replacement or reconstruction of existing utility systems and/or facilities
involving negligible or no expansion of capacity. The Planning Director filed a Notice of Exemption on March
18, 2011.

Sufficient funds have been appropriated from the General Capital Construction Fund, Gas Tax Fund and
TransNet-Local Fund to fund this project. Annually, funds are added to these projects through the Capital
Improvement Program. This funding source is not subject to State or Federal restrictions regarding
prevailing wage. Therefore, pursuant to Carlsbad Municipal Code Section 3.28.130, prevailing wages are
not required for the construction of Northwest Quadrant Storm Drain Improvement Program, Concrete
Repair Work, and Pavement Management Program, Project Nos. 6608, 6021, and 6001.

RESOLUTION NO. 2012-007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AWARDING A
CONTRACT FOR THE NORTHWEST QUADRANT STORM
DRAIN IMPROVEMENT PROGRAM, CONCRETE REPAIR
WORK, AND PAVEMENT MANAGEMENT PROGRAM,
PROJECT NOS. 6608, 6021, and 6001.
WHEREAS, on May 10, 2011, the City Council of the City of Carlsbad, through
Resolution No. 2011-086, has previously approved the plans and authorized to advertize for bids
to construct the Northwest Quadrant Storm Drain Improvement Program, Concrete Repair Work,
and Pavement Management Program, Project Nos. 6608, 6021, and 6001; and
WHEREAS, seven (7) sealed bids were received on December 14, 2011, by the City of
Carlsbad for the construction of said project; and
WHEREAS, the lowest responsive and responsible bid was submitted by Burtech
Pipeline Company, Inc in the amount of $396,998; and
WHEREAS, funding for said project has been appropriated from the General Capital
Construction Fund, Gas Tax Fund and TransNet Fund to cover all project costs and is sufficient;
and
WHEREAS, Section 3.28.040 (c)(5) of the Carlsbad Municipal Code authorizes the City
Manager to approve change orders in the amount equal to the contingency set at the time of
project award.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the low bid of $396,998.00 submitted by Burtech Pipeline, Inc., for the
construction of the Northwest Quadrant Storm Drain Improvement Program, Concrete Repair
Work, and Pavement Management Program, Project Nos. 6608, 6021, and 6001, is accepted and
the Mayor is hereby authorized to execute a contract with Burtech Pipeline, Inc. for the Northwest

3. That the City Manager is hereby authorized to approve construction change
orders up to $95,000.
4. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extensions of time.
