TRANS ACCEPTANCE OF BIDS AND AWARD OF CONTRACT FOR CONSTRUCTION OF THE 2012 CONCRETE REPLACEMENT PROJECT NOS. 6013 & 6021 DEPT. DIRECTOR ^> CITY ATTORNEY '^^^ CITY MANAGER RECOMMENDED ACTION: Adopt Resolution No. 2012-057 accepting bids and awarding a contract for the construction of the 2012 Concrete Replacement Project Nos. 6013 and 6021. ITEM EXPLANATION: As part of the City's annual Concrete Replacement Program, staff has evaluated the concrete improvements in the public right-of-way and produced a list of 538 locations where concrete replacement is necessary. Curb, gutter, sidewalk, curb ramps, and driveway approaches need to be replaced because of deterioration, cracking, and uplifting. On January 10, 2012, City Council approved Resolution No. 2012-005, authorizing the advertisement for bids for construction of the 2012 Concrete Replacement Project Nos. 6013 and 6021. The engineer's estimate was $382,200. Eight (8) bids were received on February 22, 2012, which are summarized as follows: CONTRACTOR BID TOTAL 1. Portillo Concrete, Inc. $357,188 2. New Century Construction Inc. $530,025 Staff has completed its review of the contract documents and determined that Portillo Concrete, Inc. made a calculation error with regards to the extension total of the contractor's proposal of item #2. As stated in the Notice Inviting Bids, when there is a discrepancy between the unit price and the extension total, the unit price prevails. The extension total was recalculated and the total bid was revised. On February 24, 2012, Portillo Concrete verified that the error was in the extension total and the unit price of item #2 was accurate. The lowest bid total was Portillo Concrete, Inc. with $357,188.00. Therefore, staff recommends that Portillo Concrete, Inc. be awarded the contract. FISCAL IMPACT: The total cost for the 2012 Concrete Replacement Project is $446,485 as shown in the table below. 2012 CONCRETE REPLACEMENT PROJECT COSTS Construction Contract (Portillo Concrete, Inc.) $357,188 Construction Contingency (10%) $35,719 Inspection, Testing, and Construction Management (15%) $53,578 TOTAL COST $446,485 The Concrete Replacement Program (CIP No. 6013 and 6021) has sufficient GOC and Gas Tax funds available to compiete this project. Remaining appropriations will be used for future concrete replacement projects. Prevailing wages are not required for this contract. WHEREAS, the City Council of the City of Cadsbad. California, has determined it necessary, desirable, and in the public interest to replace damaged concrete; and WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(c); and WHEREAS, on January 10, 2012, the City Council approved contract documents and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental to the 2012 Concrete Replacement Project Nos. 6013 and 6021; and WHEREAS, eight (8) sealed bids were received on February 22. 2012 for the project; and WHEREAS, the lowest responsive, responsible bid for the project was submitted by Portillo Concrete. Inc. in the amount of $357,188; and WHEREAS, there are sufficient funds available in the Concrete Replacement Program (CIP Nos. 6013 and 6021) account for construction of the project. NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid submitted by Portillo Concrete, Inc. in the amount of $357,188 is hereby accepted and the Mayor is hereby authorized to execute the contract for the construction of the 2012 Concrete Replacement Project Nos 6013 and 6021, in accordance with the specifications and contract documents referred to herein. 3. That the City Manager is hereby authorized to approve construction change orders up to the contingency amount of $35,719 to Portillo Concrete, Inc. for the 2012 Concrete Replacement, Project Nos. 6013 and 6021. 4. That the award of this contract is contingent upon Portillo Concrete, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution.
