DEPT. 20.857 3/27/12 HNS Appointments to the Oversight Board for the Successor Agency to the Carlsbad Redevelopment Agency RECOMMENDED ACTION: Adopt City Council Resolution No. 2012-078 approving two appointments by the Mayor to the Oversight Board for the Successor Agency to the Carlsbad Redevelopment Agency. ITEM EXPLANATION: As a result of State legislation adopted in June, 2011, the Carisbad Redevelopment Agency was dissolved as of February 1, 2012. The City of Carisbad has been designated as the Successor Agency to the Carlsbad Redevelopment Agency an6 must implement required activities to close down the agency and ensure the payment of recognized obligations as soon as possible. The Health and Safety Code for the State of California was amended to establish rules and regulations for the dissolution of redevelopment agencies throughout the State of California. One of the required actions, per Health and Safety Code, Section 34179, is for each successor agency to have an Oversight Board appointed composed of seven members by May 1,2012. The membership for the Oversight Board for the Successor Agency to the Carlsbad Redevelopment Agency sJnaW be as follows: • One member appointed by the county board of supervisors. • One member appointed by the Mayor for the city that formed the redevelopment agency. • One member appointed by Tri-City Hospital, the largest special district • One member appointed by the county superintendent of education or Board • One member appointed by the Chancellor of the California Community • One member of the public appointed by the county board of supervisors • One member representing the employees of the former redevelopment agency appointed by the Mayor The Oversight Board may direct the staff of the successor agency to perfomn work in furtherance of the board's duties and responsibilities.. The successor agency shall pay for all of the costs of meetings of the board and may include such costs in its administrative budget. Oversight board members shall serve without compensation or reimbursement for expenses. The oversight board shall be deemed to be a local entity for purposes of the Ralph M. The board shall cease to exist when all of the indebtedness of the dissolved redevelopment agency has been repaid. The other agencies have made, or will soon make, their appointments to the Oversight Board. The Mayor is asked at this time to make two appointments to the Board, with at least one appointment representing the employees of the previous redevelopment agency. FISCAL IMPACT: The legislation for dissolution of California redevelopment agencies allow for a minimum of $250,000 in administrative allowance to be paid from tax increment funds. This funding will be used to implement the required activities to close down the agency and ensure payment of all recognized financial obligations, including any costs associated with activities of the Oversight Board. BOARD FOR THE SUCCESSOR AGENCY TO THE CARLSBAD REDEVELOPMENT AGENCY 5 6 WHEREAS, the State of California adopted legislation in June, 2011 that 7 dissolved all redevelopment agencies within the State as of February 1, 2012; and ^ WHEREAS, the City of Carisbad has been designated as the Successor Agency to the Carisbad Redevelopment Agency to implement all required activities to dissolve said Agency; and WHEREAS, per Health and Safety Code, Section 34179, an Oversight Board must be appointed to oversee the activities of the Successor Agency to the Carisbad Redevelopment Agency by May 1, 2012 and shall be composed of seven members as 9 10 11 12 13 14 25 set forth within the noted code; and 16 WHEREAS, the Mayor for the City of Carisbad may appoint two members to the 17 Oversight Board, one of which must be a member representing the employees of the 1^ former redevelopment agency, and desires to do so at this time. // // // // // // 19 20 21 22 23 24 25 26 // 27 // 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad, California, as follows: 1. That the above recitations are true and correct. 2.
