RECOMMENDED ACTION:
Adopt Resolution No. 2012-089 accepting bids and awarding the contract to Palm Engineering
Construcfion Company, Inc. forthe Northwest Quadrant Storm Drain Improvement Program, (Mountain
View/Pacific Avenue, Roosevelt Street/Beech Avenue to Laguna Drive, Madison Street/North of
Grand Avenue and Harrison Street South of Chinquapin Avenue), Project No. 6608.
ITEM EXPLANATION:
The Northwest Quadrant Storm Drain Improvement Program is a multi-year program to address non-
master drainage plan needs within the northwest quadrant of the City. Carisbad Operations and
Maintenance staff was inten/iewed regarding their field observafions and knowledge of drainage
issues throughout the northwest quadrant. Site locations were identified and prioritized based on
recommendations from field observations. The locations of the sites are shown in Exhibit 1 Location
Map. Their current status and current priority are shown in Exhibit 2.
This project consists of four discrete locafions:
• Mountain View at Pacific Avenue. Improvements at this location include construction of a
cross gutter and re-grading the street using an asphalt pavement grinding technique and
asphaltic concrete overiay to maintain positive drainage to existing downstream inlets.
• Madison Street north of Grand Avenue. This location has drainage issues related to low spots
in the pavement. The site has a myriad of shallow underground ufilities that preclude
construction of an underground gravity fiow storm drain that would tie into the existing storm
drain system in Grand Avenue. Improvements in this locafion include removal and
replacement of sidewalk and curb and gutter to achieve positive surface drainage. These
improvements require grinding and overiay of the existing street and a portion of a private
parking lot to maintain positive surface flows to the gutter.
• Roosevelt Street between Beech Avenue and Grand Avenue. The storm drain pipeline will be
extended from the current inlet to the south a length of 245 linear feet. Included in these
improvements is the installation of two curb inlets, a cleanout and connection to the existing
storm drain system.
• Harrison Street south of Chinquapin Avenue. Ponding water and surface flow of public
drainage into private property will be mitigated by installing curb and gutter and re-grading
the sidewalks and half the street over a length of approximately 475 feet. The existing
asphaltic concrete curb and gutter will be removed and replaced with a new structural
section, new concrete curb and gutter, addition of new sidewalk and asphalt pavement
grinding and an asphalt concrete pavement overiay ofthe street to achieve positive drainage.

On January 10, 2012, through Resolution Number 2012-003, Agenda Bill 20,771, Council approved
the plans and specifications and authorized the advertisement for bids for the Northwest Quadrant
Storm Drain Improvement Program, (Mountain View/Pacific Avenue, Roosevelt Street/Beech Avenue
to Laguna Drive, Madison Street/North of Grand Avenue and Harrison Street South of Chinquapin
Avenue), Project No. 6608. On March 14, 2012 ten (10) sealed bids were received, opened and
witnessed for the construction of the project.

The Engineer's esfimate for this project is $300,000. All bid documents submitted by Palm Engineering
Construction Company, Inc. have been reviewed by staff and were found to be in order. Staff recommends
awarding the construcfion contract to Palm Engineering Construcfion Company, Inc. in the amount of
$179,937.00
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
, Guidelines Secfion 15301(b) - minor alteration of existing facilities of public ufility services involving
negligible or no expansion and Secfion 15302(c) - replacement or reconstrucfion of exisfing ufility
systems and/or facilifies involving negligible or no expansion of capacity. The Planning Director filed a
Nofice of Exempfion on March 18, 2011.
FISCAL IMPACT:
Table 1 shows the current status ofthe Northwest Quadrant Storm Drain Improvement Program. More
specifically, the current status of the program shows the expenditures of previously completed storm
drain improvements and the funds available to complete the projects in Mountain View/Pacific
Avenue, Roosevelt Street/Beech Avenue to Laguna Drive, Madison Street/North of Grand Avenue
and Harrison Street South of Chinquapin Avenue.

The project is funded by both General Fund and Gas Tax Funds. These funding sources are not
subject to State or Federal restrictions regarding prevailing wage. Therefore, pursuant to Carisbad
Municipal Code Section 3.28.130, prevailing wages are not required for the construction of Northwest
Quadrant Storm Drain Improvement Program (Mountain View/Pacific Avenue, Roosevelt Street/Beech
Avenue to Laguna Drive, Madison Street/North of Grand Avenue and Harrison Street South of
Chinquapin Avenue), Project No. 6608.
Staff recommends awarding the contract to Palm Engineering Construcfion Company, Inc. for the
construction of Northwest Quadrant Storm Drain Improvement Program (Mountain View/Pacific
Avenue, Roosevelt Street/Beech Avenue to Laguna Drive, Madison Street/North of Grand Avenue
and Harrison Street South of Chinquapin Avenue), Project No. 6608 for storm drain improvements.

THE CONTRACT TO PALM ENGINEERING CONSTRUCTION
4 COMPANY, INC. FOR THE NORTHWEST QUADRANT STORM

^ WHEREAS, the City Council of the City of Carisbad, California, has determined it
9 necessary, desirable, and in the public interest to construct the Northwest Quadrant Storm Drain
10 Improvement Program (Mountain View/Pacific Avenue, Roosevelt Street/Beech Avenue to Laguna
11 Drive, Madison Street/North of Grand Avenue and Harrison Street South of Chinquapin Avenue),
12 Project No. 6608; and
13 WHEREAS, on January 10, 2012, the City Council of the City of Carlsbad, through
14 Resolufion No. 2012-003, had previously approved the plans and authorized to advertise for bids
15 to construct the Northwest Quadrant Storm Drain Improvement Program (Mountain View/Pacific
16 Avenue, Roosevelt Street/Beech Avenue to Laguna Drive, Madison Street/North of Grand Avenue
17 and Harrison Street South of Chinquapin Avenue), Project No. 6608; and
18 WHEREAS, ten (10) sealed bids were received on March 14, 2012, by the City of
19 Carisbad for the construction of said project; and
20 WHEREAS, the lowest responsive and responsible bid was submitted by Palm
21 Engineering Construcfion Company, Inc. in the amount of $179,937; and
22 WHEREAS, funding for said project has been appropriated from the General Fund and
23 Gas Tax Funds to cover all project costs and is sufficient; and
24 WHEREAS, Section 3.28.040 (c)(5) of the Carisbad Municipal Code authorizes the City
25 Manager to approve change orders in the amount equal to the contingency set at the time of
26 project award.
27 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
28 California, as follows:

1 1. That the above recitations are true and correct.
2 2. That the low bid of $179,937 submitted by Palm Engineering Construction
3 Company, Inc. for the construction of the Northwest Quadrant Storm Drain Improvement Program
4 (Mountain View/Pacific Avenue, Roosevelt Street/Beech Avenue to Laguna Drive, Madison
5 Street/North of Grand Avenue and Harrison Street South of Chinquapin Avenue), Project No.
6 6608, is accepted and the Mayor is hereby authorized to execute a contract with Palm Engineering
7 Construcfion Company, Inc. for said project
8 3. That the City Manager is hereby authorized to approve construction change
9 orders up to $40,000.
10 4. That the award of this contract is contingent upon the bidder submitting the
11 lowest responsible bid execufing the required contract and submitting the required bonds and
12 insurance policies, as described in the contract, within twenty (20) days of adoption of this
13 resolution. The City Manager may grant reasonable extensions of fime.
