DIRECTOR CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Adopt Ordinance No. CS-182. amending Chapter 19.04, to add section 19.04.215 to tlie Carisbad Municipai Code to require recordation of specified notices. Ordinance No. CS-182 was introduced and first read at tlie City Council meeting held on May 8, 2012. The second reading allows the City Council to adopt the ordinance which will beconne effective thirty days after adoption. The City Cleric's Office will have the ordinance published within fifteen days, if adopted. FISCAL IMPACT: See AB #20,892 on file in the Office of the City Cleric. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has not potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Ordinance No. CS-182 DEPARTMENT CONTACT: Karen Kundtz 760-434-2808 Karen.Kundtz(5)xarisbadca.gov FOR CITY CLERKS USE ONLY COUNCIL ACTION: APPROVED X CONTINUED TO DATE SPECIFIC • DENIED CONTINUED TO DATE UNKNOWN • CONTINUED • RETURNED TO STAFF • WITHDRAWN • OTHER-SEE MINUTES • AMENDED • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. cs-182 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CARLSBAD MUNICIPAL CODE CHAPTER 19.04 TO ADD SECTION 19.04.215 TO REQUIRE RECORDATION OF SPECIFIED NOTICES The City Council of the City of Carisbad ordains as follows: SECTION I: That section 19.04.215 is added to Carisbad Municipal Code Chapter 19.04 as follows: 19.04.215 ~ Recordation of Notices In order to place the public on notice of adverse environmental conditions which may impact property, recordation of the following notices on title to real property, as amended from time to time by the city attorney, may be required by the city as a condition of approval for land use entitlements; Notice Concerning Odor Environmental Impacts, Notice Concerning Railroad Environmental Impacts, Notice Concerning Proximity of the Commuter Rail Transit Station, Notice Concerning Aircraft Environmental Impacts, Notice of Multi-Impacts, Notice and Waiver Concerning Odor Environmental Impacts, Notice and Waiver Concerning Railroad Environmental Impacts, Notice and Waiver Concerning Proximity of a Planned or Existing Commuter Rail Transit Station, Notice and Waiver Concerning Proximity of the Planned or Existing Transportation Corridor(s), Notice and Waiver Concerning Aircraft Environmental Impacts, and Notice and Waiver Concerning Multi-Impacts. The county recorder shall accept for recordation on title to a real property any of the specified notices, as amended from time to time by the city attorney, provided the notices contain sufficient information and meet ail recording requirements. /// III III III III
