TRAN APPROVE THE CARLSBAD TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2012-13 THROUGH 2016-17 DEPT. DIRECTOR CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Adopt Resolution No. 2012-118 approving the Carisbad TransNet Local Street Improvement Program of Projects for Fiscal Years 2012-13 through 2016-17. ITEM EXPLANATION: The 2012 Regional Transportation Improvement Program (RTIP) is a program of proposed highway, arterial, transit, and bikeway projects for Fiscal Years 2012-13 through 2016-17. The San Diego Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt the RTIP every two years. Each member agency of SANDAG that desires to expend TransNet and/or certain Federal and State funds must approve a Program of Projects once every two years. In addition to projects with these funding sources, the Program of Projects also includes regionally significant capacity increasing projects regardless of the funding source. The Federal Metropolitan Planning and Air Quality Conformity Regulations also require inclusion of all regionally significant capacity increasing road projects for air quality emissions analysis. The approval process includes consideration of the City's Program of Projects at a public hearing and adoption of the attached Resolution. The adopted Resolution approving the Carisbad Program of Projects is due to SANDAG by June 30, 2012. The Carisbad Program of Projects is incorporated into the 2012 RTIP as assembled by SANDAG which is then submitted to the State. The proposed Carisbad Program of Projects for Fiscal Years 2012-13 through 2016-17, which is attached as Exhibit 1, includes projects with the following funding types: Federal - SAFETEA-LU (High Priority Project, HPP) Federal - Highway Bridge Program (HBP) SANDAG - TransNet Local Local - City funds Local - Private funds The Federal funding included in the Carisbad Program of Projects consists of $1,436,000 in Federal SAFETEA-LU, High Priority Project funds for Poinsettia Lane Reach E. The City of Carisbad is also programmed to receive Federal Highway Bridge Program (HBP) funding however it is programmed by Caltrans and therefore is not listed as a funding line item on the City of Carisbad Program of Projects. The Transnet funding will provide the local matching funds for the two bridge railing projects along Carisbad Boulevard. The bridges are located across the warm water outfall channel from the Encina power station and over the railroad just south of State Street. The TransNet funds are also programmed for roadway widening projects which are in progress as well as the ongoing Pavement Management Program. The Program of Projects also includes various capacity increasing roadway projects located along regionally significant arterials, regardless of the funding source. The projects in this category include various roadway segments and intersection improvements. The majority of these projects are funded by Local City of Carisbad funds such as Traffic Impact Fees and/or Local Private funds. The Program of Projects can be revised as needed on a quarteriy basis during the two year period between the adoption ofthe 2012 RTIP and the subsequent 2014 RTIP. ENVIRONMENTAL IMPACT: This activity is statutorily exempt from CEQA pursuant to State CEQA Guidelines, Section 15276, which states that CEQA does not apply to the adoption of regional transportation improvement programs. FISCAL IMPACT: Approving the RTIP is a requirement under State law for receiving TransNet, State and Federal funds. Approval of the RTIP ensures eligibility for funding and programs the funding for future obligation. Inclusion in the RTIP, however, is not a guarantee that projects will receive the stated funding. The amounts shown are the best available estimates of anticipated funding. In the event that funding falls short or is not available, the City Council is not obligated to proceed with a project just because it is included in the RTIP. EXHIBITS: 1. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of 22 Carisbad certifies that no more than 30 percent of its annual revenues from the TransNet funds 24 shall be spent on maintenance related projects. 25 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of 2Q Carisbad certifies that all new projects, or major reconstruction projects, funded by TransNet 27 revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this 28 WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension Ordinance); and WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the Regional Transportation Commission, shall approve a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds; and WHEREAS, the City of Carisbad was provided with an estimate of annual TransNet local improvement revenues for Fiscal Years 2012-13 through 2016-17; and WHEREAS, the City of Carisbad has held a clearly noticed public meeting with an agenda item that cleariy identified the proposed list of projects prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 ofthe SANDAG Board Policy 31. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad, California, as follows: 1. That the above recitations are true and correct. 1 requirement permitted under the Ordinance and proposed shall be cleariy noticed as part of the 2 City of Carisbad's public hearing process. 3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of 4 Carisbad certifies that the required minimum annual level of local discretionary funds to be 5 expended for street and road purposes will be met throughout the 5-year period consistent with 6 the most recent Maintenance of Effort Requirements adopted by SANDAG. 7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of 8 Carisbad certifies that it will extract $2,000, plus all applicable annual increases, from the private 9 sector for each newly constructed residential housing unit in the City of Carisbad to comply with 10 the provisions ofthe Regional Transportation Congestion Improvement Program (RTCIP). 11 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of 12 Carisbad certifies that is has established a separate Transportation Improvement Account for l'^ TransNet Revenue with interest earned expended only for those purposes for which the funds were allocated. 15 7. That the City of Carisbad agrees to indemnify, hold harmless and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to local TransNet funded projects. 10.
