HR EXTEND MEMORANDUM OF UNDERSTANDING WITH THE CARLSBAD POLICE MANAGEMENT ASSOCLiTION (CPMA) RECOMMENDED ACTION: Adopt Resolution No?^l?l^1approving a side letter with the Carlsbad Police Management Association (CPMA) that extends the term of the current Memorandum of Understanding (MOU) between the City of Carlsbad and the CPMA to November 30, 2012. ITEM EXPLANATION: On December 13, 2011, the City Council approved a Memorandum of Understanding with the CPMA with a term that would expire on June 30, 2012. At the request of the City, in March 2012 the CPMA agreed to open discussions regarding an extension of the contract term. Representatives of the City and the CPOA have reached agreement on the following amendment to the current MOU: Article 2 shall be replaced with the following: ARTICLE 2. TERM AND RENEGOTIATION 2.1 The term of this Memorandum shall commence on December 13, 2011, and shall continue until November 30, 2012. 2.2 Negotiations for a successor Memorandum shall begin by an exchange of written proposals in approximately August, 2012. These changes are memorialized in a side letter which is attached as Exhibit 2. All other tenns and conditions of the existing MOU shall remain in full force and effect. FISCAL IMPACT: There is no fiscal impact associated with this action. ENVIRONMENTAL IMPACT: The proposed action does not qualify as a "project" under the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15378 as it does not result in a direct or reasonably foreseeable indirect physical change in the environment. APPROVING A SIDE LETTER ^ REGARDING AN AMENDMENT TO THE MOU BETWEEN THE CITY AND THE CARLSBAD POLICE MANAGEMENT ASSOCIATION (CPMA) WHEREAS, representatives of management and the Carlsbad Police Officers' Association have met and conferred in good faith pursuant to the Meyers-Millias-Brown Act regarding wages and other terms and conditions of employment; and WHEREAS, said representatives have reached agreement which they desire to IQ submit to the City Council for consideration and approval; and 11 WHEREAS, the City Council has determined it to be in the public interest to 12 accept such an agreement in the form of a side letter dated June 12, marked Exhibit 2 and incorporated by reference herein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. WOOD, City Clerk (SEAL) 20 %T * 21 22 23 24 25 26 27 28 SIDE LETTER AGREEMENT TO THE DECEMBER 13, 2011 - JUNE 30,2012 MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD POLICE MANAGEMENT ASSOCIATION EFFECTIVE: UPON CITY COUNCIL APPROVAL This side letter memorializes an agreement reached between the City of Carlsbad ("City") and the Carlsbad Police Management Association ("CPMA"), to reflect agreed upon amendments to the December 13, 2011 - June 30, 2012 Memorandum of Understanding ("MOU") entered into between the City and CPMA. All other terms and conditions of the existing MOU shall remain in full force and effect. The changes are as follows: Article 2 shall be replaced with the following: ARTICLE 2.
