PROJECT NO. 5502 CITY MANAGER w—' RECOMMENDED ACTION: Adopt Resolution No. 2012-213 rejecting all bids for the Terramar Sewer Lift Station and Force Main Replacement, Project No. 5502. ITEM EXPLANATION: On June 12, 2012, through Resolution No. 2012-132, Agenda Bill No. 20,932, Council approved plans and specifications and authorized the advertisement for bids for the Terramar Sewer Lift Station and Force Main Replacement, Project No. 5502. On August 6, 2012, five (5) bids were received, opened, and witnessed for the construction of this project from the contractors listed below: Contractor Name City/State 1) HTA Engineering and Construction, Inc. San Diego, CA 2) Schilling Paradise Corporation El Cajon, CA 3; HPS, Inc. Bakersfield, CA 4) Don Hubbard Contracting Company San Marcos, CA 5) Caliagua, Inc Chino, CA After staff completed a review of the bids for compliance with the contract documents, it was determined that all five bidders were either non-responsive in providing specifically required certification documents or did not provide sufficient references of successful similar work experience, both required with the bid. Staff therefore recommends it is desirable and in the public interest for the City to reject all bids in accordance to the provisions of the City's Municipal Code 3.28.080(A)(7)(c), whereby the Council at its discretion, may reject all bids presented. Following the rejection of the bids staff will re-advertise seeking new bids for this project. Staff will revise the Notice Inviting Bids emphasizing and clarifying experience requirements as well as providing references to required technical specification documents to be submitted with the bid. ENVIRONMENTAL IMPACT: This project is exempt from California Environmental Quality Act (CEQA) review pursuant to CEQA Guidelines section 15302(c) in that it is a replacement of an existing utility system on the same site involving negligible or no expansion of capacity. PROJECT NO. 5502. WHEREAS, on Jun 12, 2012, the City Council of the City of Carlsbad, through Resolution 2012-132, has previously approved the plans and specifications, and authorized to advertise for bids for the Terramar Sewer Lift Station and Force Main Replacement, Project No. 5502; and WHEREAS, five (5) sealed bids were received on August 6, 2012, for the construction of said project; and WHEREAS, staff hereby finds it necessary, desirable and in the public interest for the City to follow the provisions of the City's Municipal Code 3.28.080(A)(7)(c), whereby the Council at its discretion, may reject all bids presented. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That Council does hereby reject the five (5) bids received on August 6, 2012, for the Terramar Lift Station and Force Main Replacement, Project No. 5502, in accordance with the provisions of City Municipal Code 3.28.080(A)(7)(c). 3.
