RECOMMENDED ACTION:
That the City Council hold a public hearing and ADOPT Resolution No. 2012-201 APPROVING Major
Review Permit RP 12-13 and Coastal Development Permit CDP 12-04 to allow all the demolition of all
existing structures on site and the construction of a new two-story athletic facility, press box with stadium
seating, maintenance building, and the installation of a new artificial turf field, field lights, two parking lots
and a new perimeter fence on the property located at 2605 Carlsbad Boulevard in Land Use District 9 of
the Village Review Zone and in Local Facilities Management Zone 1, and commonly known as the Army
and Navy Academy Athletic Facility, as recommended by the Planning Commission.
ITEM EXPLANATION:
The proposed project requires approval of a Major Review Permit because the property is located within
the Village Review (V-R) zone and involves new construction of a building with a building permit valuation
greater than $150,000. The project also requires approval of a Coastal Development Permit because the
project is located within the Village segment of the Coastal Zone. In accordance with Major Village Review
Permit procedures, the two items are being brought forward for final decision following a recommendation
(5-0, Commissioner Nygaard and Scully absent) by the Planning Commission on July 3, 2012.
In 2008, a Master Site Plan was approved for the Army and Navy Academy that is to be used as a guide for
future development. It is conceptual in nature and indicates the general location, amount and type of
development, potential access points, circulation and the proposed development scheme for the Army and
Navy Academy. The site is located in Planning Area E of the Master Site Plan, which calls for three phases
of development out of 20. The three phases include the removal of storage buildings and construction of a
south parking lot, the demolition of the existing athletic building and construction of a new athletic building
and north parking lot, and the construction of a new maintenance building and second south parking lot.
The applicant is proposing to construct a two-story, 27,349 square foot athletic facility consisting of a
gymnasium, wrestling room, locker rooms, trainer's room, lobby with concessions, staff offices, and a film
room. In addition, a new press box with adjoining exterior stadium seating, a maintenance building, ticket
booth and new parking lots are proposed for construction. The existing athletic field will be resurfaced with
artificial turf with field lights, dugouts, and a 20 foot high fence along the east property line to prevent balls
from flying over into the railroad right of way. A six foot tall wrought iron fence with stone capped columns is
proposed for the remainder of the property with the exception of a six foot tall retaining wall located along
the north property line.
The Army and Navy Academy Master Site Plan calls for the use of the Spanish Colonial Revival
architectural style to respect and conform to the existing buildings on site. The main athletic building,
maintenance building, press box, and ticket booth use white stucco as the building material, tile roofs,
arched openings throughout covered walkways, and recessed windows, which is consistent with the
Spanish Colonial Revival architectural style.
During the public hearing, the main issues of concern of the Planning Commission were the availability of
the parking lots to the public when they are not used by the school, improvement of the pedestrian

crossing, and the effect of the field lighting on nearby residents. Staff and the applicant were able to
address the Commission's concerns without any changes to the project's design or additional conditions
being added to the project. A full disclosure of the Planning Commission's actions and a complete project
description and staff analysis of the proposed project are included in the attached minutes and Planning
Commission staff report. The Planning Commission and Staff are recommending approval of the proposed
Conditional Use Permit.
Subsequent to the July 3, 2012 Planning Commission hearing, Vid Artukovic, the owner of the Scandia
Hotel, and the tenant (Katie Taylor of Taylor Real Estate), occupying the office building immediately north
of the field house building, appeared at the July 10, 2012 City Council meeting and spoke during the public
comment section of the agenda. Ms. Taylor stated that she never received notification about the Planning
Commission hearing until the day of the meeting. Mr. Artukovic and Ms. Taylor both expressed their
concerns about fencing, property lines, requested that a survey be performed. Ms. Taylor specifically
wanted to ensure the mural on the south side of the building she is located in, is still visible and that her
landscaping is preserved. The Army and Navy Academy, along with the representative Hofman Planning
and Engineering, have met privately with Mr. Artukovic and Ms. Taylor to resolve their issues with the
project. As a result of the meetings, the Army and Navy Academy has agreed to remove a retaining wall,
and instead, slope a portion of the parking lot. The configuration of the parking spaces and drive aisle will
not be effected by this change. Also, the Army and Navy Academy will cluster trees in the landscaped
portion of the parking lot adjacent to Ms. Taylor's office so that the mural on the south side of her building
will still be visible.
At the City Council meeting on July 24, 2012, Ms. Taylor spoke again during the public comment section of
the agenda regarding her concerns related to traffic and pedestrian safety. Staff has explained to Ms.
Taylor that a traffic study was not required for the project because there is no increase in Average Daily
Trips (ADT). However, a condition was initially placed on the project requiring the Academy to improve the
existing cross walk and associated improvements to pedestrian signal or beacon. No additional conditions
have been placed on the project due to Mr. Artukovic's and Ms. Taylor's concerns.
During public comment, a letter was distributed that was written by Eric Ginder, an attorney who represents
Ms. Uba Artukovic, the owner of the Scandia hotel, and Ms. Taylor of Taylor Place Real Estate. A copy of
the letter and a response from staff are attached for review.
While the changes described above resulted from discussions between the applicant and the adjacent
property owner subsequent to the Planning Commission hearing, they are very minor and immaterial, do
not materially change or significantly deviate from the project recommended by the Planning Commission,
and are of the nature and type that could be approved by staff as part of a consistency determination dunng
the construction plan stage.
FISCAL IMPACT:
All public infrastructure required for this project will be funded and/or constructed by the developer. No fiscal
impacts to the city have been identified.
ENVIRONMENTAL IMPACT:
The proposed project is exempt from environmental review pursuant to Section 15332 of the State CEQA
Guidelines as an in-fill development project on a site of less than five acres in an urbanized area that has
no habitat value and is served by adequate facilities. A Notice of Exemption will be filed upon approval of
the project.

10 WHEREAS, pursuant to the provisions of the Municipal Code, the Planning
11 Commission did, on July 3, 2012, hold a duly noticed public hearing as prescribed by law to
12 consider a Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04, and
13 adopted Planning Commission Resolutions No. 6899 and 6900, recommending approval of
14 Major Review Permit RP 12-13 and Coastal Development Permit CDP 12-04; and
1^ WHEREAS, the City Council of the City of Carlsbad, on the date of this
resolution, held a duly noticed public hearing to consider the recommendation of the Planning
Commission and heard all persons interested in or opposed to Major Review Permit RP 12-13
and Coastal Development Permit CDP 12-04; and
WHEREAS, as a result of an environmental review of the subject project
conducted pursuant to the Guidelines for Implementation of the California Environmental Quality
Act and the Environmental Protection Ordinance of the City of Carlsbad, the project was found
to be categorically exempt from the requirement for preparation of environmental documents
pursuant to Section 15332 of the State CEQA Guidelines as an in-fill development project on a
site of less than five acres in an urbanized area that has no habitat value and is served by
adequate facilities.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California as follows:

CDP 12-04 are approved and that the findings and conditions of the Planning Commission
2 contained in Resolutions No. 6899 and 6900 on file in the City Clerk's office and incorporated
herein by reference are the findings and conditions of the City Council with the addition of the
3 following condition:
4 In the event that another school or organization is using the Army and
Navy Academy's athletic facilities, the Army and Navy Academy shall
5 provide direction and campus maps indicating the location of parking lots
on campus, in order to lessen the parking impacts to the sun-ounding
6 neighborhood.
^ 3. That this action is final the date this resolution is adopted by the City
Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial
^ Review" shall apply:
^ "NOTICE TO APPLICANT"
The time within which judicial review of this decision must be sought is governed by Code of
Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by
Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review must be
filed in the appropriate court not later than the ninetieth day following the date on which this
decision becomes final; however, if within ten days after the decision becomes final a request
for the record is filed with a deposit in an amount sufficient to cover the estimated cost or
preparation of such record, the time within which such petifion may be filed in court is extended
to not later than the thirtieth day following the date on which the record is either personally
delivered or mailed to the party, or his attomey of record, if he has one. A written request for

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
13 B) That based on the evidence presented at the public hearing, the Planning
Commission RECOMMENDS APPROVAL of RP 12-13 - ARMY & NAVY
14 ACADEMY ATHLETIC FACILITY, based on the following findings and
J ^ subject to the following conditions:
16 Findings:
17 1. That the project is consistent with the Village Review Zone and the Village Master Plan
and Design Manual in that a private school and accessory facilities (athletic facility) is a
permitted use within District 9 of the Village Review Zone; the project also complies
19 with the development standards of the Village Master Plan and Design Manual as
discussed in the staff report. Furthermore, the project is consistent with the Village
20 Master Plan and Design manual in that the proposed project assists in satisfying goals and
objectives set forth for Land Use District 9 through the following actions: it stimulates
21 property improvements and new development in the Village by providing for new
22 development and rehabilitation of existing facilities; and it improves the physical
appearance of the Village Area by replacing outdated buildings with aesthetically
23 pleasing buildings that will be using a Spanish Colonial Revival architectural style along
with attractive landscaping.
2. The City Planner has determined that the project belongs to a class of projects that the
State Secretary for Resources has found do not have a significant impact on the
26 environment, and it is therefore categorically exempt from the requirement for
preparation of environmental documents pursuant to Section 15332 of the State CEQA
27 Guidelines as an infill development project. In making this determination, the
Planning Director has found that the exceptions listed in Section 15300.2 of the state
CEQA Guidelines do not apply to this project.

3. The Planning Commission finds that the project, as conditioned herein, is in
2 conformance with the Elements of the City's General Plan, based on the facts set forth in
the staff report dated July 3,2012 including, but not limited to the following:

The proposed project is consistent with the goals for the Village, as outlined
4 within the General Plan, because it provides accessory facilities (athletic facility
^ and maintenance building) in an appropriate location within the Village. This in
turn serves to enhance and maintain the Army/Navy Academy as it is the only
6 military boarding school in California. The project reinforces the pedestrian-
orientation desired for the downtown area because the school's proximity to the
7 Village provides the students and its employees an opportunity to walk to
shopping, recreation, and mass transit functions. With the project being close to
existing bus routes and mass transit, it will help to further the goal of providing
9 new economic development near transportation corridors. Furthermore, the
Army/Navy Academy assists in encouraging complementary uses in the Village
10 and adding diversity to the Village population that helps create and/or enhance a
^ ^ lively and interesting social environment.
j2 b. The existing streets can accommodate the estimated ADTs, and all required
public right-of-way has been, or will be dedicated, and has been, or will be
13 improved to serve the development. The pedestrian spaces and circulation have
been designed in relationship to the land use and available parking. Public
14 facilities have been, or will be constructed to serve the proposed project. The
project has been conditioned to develop and implement a program of "best
management practices" for the elimination and reduction of pollutants which
16 enter into and/or are transported within storm drainage facilities.

17 c. The proposed project will not have an adverse impact on any open space within
the surrounding area. The project is consistent with the Open Space
requirements for new development within the Village Area and the City's
j9 Landscape ManuaL
20 4. The project is consistent with the Citywide Facilities and Improvements Plan, the Local
Facilities Management Plan for Zone 1 and all City public facility policies and
21 ordinances. The project includes elements or has been conditioned to construct or
22 provide funding to ensure that all facilities and improvements regarding sewer collection
and treatment; water; drainage; circulation; fire; schools; parks and other recreational
23 facilities; libraries; government administrative facilities; and open space, related to the
project will be installed to serve new development prior to or concurrent with need.

a. The Public Facility fee is required to be paid by Council Policy No. 17 and will be
26 collected prior to the issuance of building permit.
27 b. All necessary public improvements have been provided or are required as conditions
of approval.

^ ^ That the project is consistent with the City's Landscape Manual and Water Efficient
2 Landscape Ordinance (Carlsbad Municipal Code Chapter 18.50).
3 6. The Planning Commission has reviewed each of the exactions imposed on the
Developer contained in this resolution, and hereby finds, in this case, that the exactions
4 are imposed to mitigate impacts caused by or reasonably related to the project, and the
extent and the degree of the exaction is in rough proportionality to the impact caused by
the project.

Conditions:
Note: Unless otherwise specified herein, all conditions shall be satisfied prior to the issuance of
building permits.

1. If any of the following conditions fail to occur; or if they are, by their terms, to be
10 implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained over time, if any such conditions fail to be so implemented
and maintained according to their terms, the City shall have the right to revoke or modify
j2 all approvals herein granted; deny or further condition issuance of all future building
permits; deny, revoke or further condition all certificates of occupancy issued under the
13 authority of approvals herein granted; record a notice of violation on the property title;
institute and prosecute litigation to compel their compliance with said conditions or seek
14 damages for their violation. No vested rights are gained by Developer or a successor in
J ^ interest by the City's approval of this Major Review Permit.
16 2. Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the Major Review Permit documents, as necessary to make them
17 intemally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
^ ^ different from this approval, shall require an amendment to this approval.

3. Developer shall comply with all applicable provisions of federal, state, and local laws and
20 regulations in effect at the time of building permit issuance.
21 4. If any condition for construction of any public improvements or facilities, or the payment
22 of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are
challenged, this approval shall be suspended as provided in Govemment Code Section
23 66020. If any such condition is determined to be invalid this approval shall be invalid
unless the City Council determines that the project without the condition complies with
24 all requirements of law.

Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold
26 harmless the City of Carlsbad, its council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims
27 and costs, including court costs and attomey's fees incurred by the City arising, directly
or indirectly, from (a) City's approval and issuance of this Major Review Permit, (b)
2^ City's approval or issuance of any permit or action, whether discretionary or non-
discretionary, in connection with the use contemplated herein, and (c)

Developer/Operator's installation and operation of the facility permitted hereby, including
2 without limitation, any and all liabilities arising from the emission by the facility of
electromagnetic fields or other energy waves or emissions. This obligation survives until
3 all legal proceedings have been concluded and continues even if the City's approval is not
validated.

^ 6. Developer shall submit to the Planning Division a reproducible 24" x 36", mylar copy of
the Major Review Permit reflecting the conditions approved by the final decision
6 making body.
7 7. Developer shall include, as part of the plans submitted for any permit plan check, a
^ reduced legible version of all approving resolution(s) in a 24" x 36" blueline drawing
format.

This project shall comply with all conditions and mitigation measures which are required
10 as part of the Zone 1 Local Facilities Management Plan and any amendments made to that
^ ^ Plan prior to the issuance of building permits.
j2 9. This approval is granted subject to the approval of CDP 12-04, and is subject to all
conditions contained in Planning Commission Resolutions No. for those other approvals
13 incorporated herein by reference.
14 10. This approval shall become null and void if building permits are not issued for this
15 project within 24 months from the date of project approval.
16 11- The Developer shall submit and obtain City Planner approval of a Final Landscape and
Irrigation Plan showing conformance with the approved Preliminary Landscape Plan and
17 the City's Landscape Manual. The Developer shall constmct and install all landscaping
as shown on the approved Final Plans, and maintain all landscaping in a healthy and
thriving condition, free from weeds, trash, and debris.

12. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the
20 landscape plan check process on file in the Planning Department and accompanied by the
project's building, improvement, and grading plans.

22 13. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy
#17, the License Tax on new constmction imposed by Carlsbad Municipal Code Section
23 5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by
Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable
24 Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such
taxes/fees shall be paid at issuance of building permit. If the taxes/fees are not paid, this
approval will not be consistent with the General Plan and shall become void.

14. All roof appurtenances, including air conditioners, shall be architecturally integrated and
27 concealed from view and the sound buffered from adjacent properties and streets, in
substance as provided in Building Department Policy No. 80-6, to the satisfaction of the
2^ Director of Community Development.

^ 15. Developer shall construct, install, and stripe not less than 63 parking spaces, as shown on
2 Exhibit I.

3 16. Prior to the issuance of the building permit. Developer shall submit to the City a Notice
of Restriction to be filed in the office of the County Recorder, subject to the satisfaction
of the City Planner, notifying all interested parties and successors in interest that the City
^ of Carlsbad has issued a Major Review Permit by Planning Commission Resolution No,
6899 on the real property owned by the Developer. Said Notice of Restriction shall note
6 the property description, location of the file containing complete project details and all
conditions of approval as well as any conditions or restrictions specified for inclusion in
7 the Notice of Restriction. The City Planner has the authority to execute and record an
g amendment to the notice which modifies or terminates said notice upon a showing of
good cause by the Developer or successor in interest.

17. The developer shall constmct trash receptacle and recycling areas as shown on the site
10 plan (Exhibit "F") with gates pursuant to the City Engineering Standards and Carlsbad
Municipal Code Chapter 21.105. Location of said receptacles shall be approved by the
City Planner. Enclosure shall be of similar colors and/or materials of the project and
12 subject to the satisfaction of the City Planner.

13 18. No outdoor storage of material shall occur onsite unless required by the Fire Chief
When so required, the Developer shall submit and obtain approval of the Fire Chief and
^4 the City Planner of an Outdoor Storage Plan, and thereafter comply with the approved
15 plan.
16 19. The developer shall submit and obtain City Planner approval of an exterior lighting plan

owner to give written consent to the city engineer for the annexation of the area shown
within the boundaries of the site plan into the existing City of Carlsbad Street Lighting
29 and Landscaping District No. 1 and/or to the formation or annexation into an additional
Street Lighting and Landscaping District. Said written consent shall be on a form

29. Based upon a review of the proposed grading and the grading quantities shown on the site
23 plan, a grading permit for this project is required. Developer shall prepare and submit
plans and technical studies/reports, for city engineer review, and shall pay all appHcable
24 grading plan review fees per the city's latest fee schedule.

30. Developer shall apply for and obtain a grading permit from the city engineer. Developer
26 shall pay all applicable grading permit fees per the city's latest fee schedule and shall post
security per City Code requirements.

31. This project requires off site grading. No grading for private improvements shall occur

Program for the City of Carlsbad Village Segment of the California Coastal Zone.
21 The proposed athletic facility, maintenance building and ball field is consistent with
the surrounding development of single-family residences and a mixed-use
development. The proposed development will not obstruct views of the coastline as
23 seen from public lands or the public right-of-way, nor otherwise damage the visual
beauty of the coastal zone. No agricultural uses currently exist on the site, nor are
24 there any sensitive resources located on the property. The project site is not located
in an area of known geologic instability of flood hazard. The site is located in close
25 proximity to the coast, but no public opportunities for coastal shoreline access are
25 available from the subject site. The site is not suited for water-oriented recreation
activities.

The proposal is in conformity with the public access and recreation policies of Chapter 3
28 of the Coastal Act in that the site is not located adjacent to the shore. Therefore, the

^ development will not interfere with the public's right to physical access to the sea
2 and the site is not suited for water-oriented recreation activities.
3 3. The project is consistent with the provisions of the Coastal Resource Protection Overlay
Zone (Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the
4 City's Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard
Urban Storm Water Mitigation Plan (SUSMP), and Jurisdictional Urban Runoff
Management Program (JURMP) to avoid increased urban mnoff, pollutants, and soil
5 erosion. No steep slopes or native vegetation is located on the subject property and the
site is not located in an area prone to landslides, or susceptible to accelerated erosion
7 floods, or liquefaction

Developer shall comply with all applicable provisions of federal, state, and local laws and

22 4. If any condition for constmction of any public improvements or facilities, or the payment
23 of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are
challenged, this approval shall be suspended as provided in Govemment Code Section
24 66020. If any such condition is determined to be invalid, this approval shall be invalid
unless the City Council determines that the project without the condition complies with
25 all requirements of law.

5. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold
27 harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, firom and against any and all liabilities, losses, damages, demands, claims
28 and costs, including court costs and attomey's fees incurred by the City arising, directiy
or indirectiy, firom (a) City's approval and issuance of this Coastal Development Permit,

as part of the Zone 1 Local Facilities Management Plan and any amendments made to that

adequate water service and sewer facilities, respectively, are available to the project at the

This approval is granted subject to the approval of RP 12-13, and is subject to all

16 10. The applicant shall apply for and be issued building permits for this project within two
(2) years of approval or this coastal development permit will expire unless extended per
17 Section 21.201.210 of the Zoning Ordinance.

20 12. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy

RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 6899 and 6900
RECOMMENDING APPROVAL of RP 12-13 and CDP 12-04 to the City Council based on
the findings and subject to the conditions contained therein.
II. INTRODUCTION
Pursuant to Section 21.35.080 of the Carlsbad Municipal Code, new constmction of a building
within the Village Review zone that has a building permit valuation greater than $150,000
requires approval of a Major Review Permit. The project also requires approval of a Coastal
Development Permit because the project is located in the Village segment of the Coastal Zone.
In accordance with Major Review Permit procedures, the two permits are being brought forward
for a recommendation by the Planning Commission and will be submitted for final approval by
the City Council. There are no unresolved issues and staffs recommendation of approval with
conditions is supported by the following analysis.
III. PROJECT DESCRIPTION AND BACKGROUND
The Army and Navy Academy was initially founded in 1910 as a private, non-profit military
school, and has been at its current location since 1936. The Academy's location on the coast
provides year round outdoor activities for students. The mission of the Army and Navy Academy
is to be the premier military college preparatory school in the United States and to attain
intemational recognition as a premier boarding school for young men. There are only eight other
comparable military academies in the United States today.
In 2008, the Housing and Redevelopment Commission approved a Master Site Plan for the Army
& Navy Academy that is to be used as a guide for future development. The Master Site Plan is
not a Master Plan per the municipal code, and does not contain its own development standards. It
is conceptual in nature and indicates the general location, amount and type of development,
potential access points, circulation and the proposed development scheme for the Army and

Navy Academy. The detailed design of individual buildings is to be reviewed at the time of
submittal to ensure conformance with development standards and the design criteria of the

The proposed project consists of a request for a Major Review Permit and Coastal Development
Permit to demolish an existing athletic facility and storage buildings, and constmct a 27,349
square foot athletic facility, press box with stadium seating, maintenance building, and the
installation of a new artificial turf field, lights and a new perimeter fence.

The project is located at 2605 CarlsbacJ Boulevard in District 9 of the Village Review zone as
shown on the attached location map. The subject property totals 220,430 square feet and
contains a multi-purpose field, bleachers, storage containers, and a 1,800 square foot athletic
facility with coach's offices and football locker rooms. All existing buildings are proposed to be
demolished. The site is bordered by the Scandia Hotel and real estate office to the north, the
main portion of the Army and Navy Academy and Ebb Tide Hotel to the west, several single-
family residences, the Califomia Parks Department office and Village by the Sea mixed-use
development to the south, and the railroad tracks to the east.
Proposed Constmction
The applicant is proposing to constmct a two-story, 27,349 square foot athletic facility consisting
of a gymnasium, wrestling room, locker rooms, trainer's room, lobby with concessions, staff
offices and a film room. In addition, a new press box with adjoining exterior stadium seating, a
maintenance building, ticket booth and new parking lots are proposed for constmction. The
existing athletic field will be resurfaced with artificial turf, with field lights, dugouts, and a 20
foot high fence along the east property line to prevent balls from flying over into the railroad
right of way. A six foot tall wrought iron fence with stone capped columns is proposed for the
remainder of the property with the exception of a six foot tall retaining wall located along the
north property line.
The Army and Navy Academy Master Site Plan calls for use of the Spanish Colonial Revival
architecture style unified by the use of arches, courtyards, form as mass, plain wall surfaces and
tile roofs. The main athletic building uses white stucco as the building material, tile roofs, arched
openings throughout covered walkways, and recessed windows. The maintenance building, press
box, and ticket booth continue the use of white stucco, tiled roofs, and covered archways making
all buildings on site consistent with the Spanish Colonial Revival architecture style.

exist onsite; and the development does not obstruct views of the coastline as seen from public
lands or public right-of-ways or otherwise damage the visual beauty of the Coastal Zone.
IV. ANALYSIS
The proposed project is subject to the following ordinances, standaTds, and policies:
A. Village (V) General Plan Land Use designation; and
B. Village Review Zone (CMC Chapter 21.35), District 9 (Village Master Plan and Design
Manual); and
C. Coastal Development Regulations for the Village Segment of the Local Coastal Program
(CMC Chapter 21.81 and Village Master Plan and Design Manual); and
D. Army and Navy Academy Master Site Plan; and
E. Growth Management.
The recommendation for approval of this project was developed by analyzing the project's
consistency with the applicable regulations and policies. The project's compliance with each of
the above regulations and policies is discussed in the sections below.
A. Village (V) General Plan Land Use designation
The Carlsbad General Plan includes the following goals for the Village: 1) a City which
preserves, enhances and maintains the Village as a place for living, working, shopping,
recreation, civic and cultural functions while retaining the Village atmosphere and pedestrian
scale; 2) a City which creates a distinct identity for the Village by encouraging activities that
traditionally locate in a pedestrian-oriented downtown area, including offices, restaurants, and
specialty shops; 3) a City which encourages new economic development in the Village and near
transportation corridors to retain and increase resident-serving uses; and 4) a City that
encourages a variety of complementary uses to generate pedestrian activity and create a lively,
interesting social environment and a profitable business setting.
The proposed project is consistent with the goals and objectives for the Village, as outlined
within the General Plan, because it enhances an existing civic and cultural use in an accepted
location within the Village as described in goal one. This in turn serves to enhance and maintain
the Army and Navy Academy as it is the only military boarding school in Califomia. The
project addresses goal two by reinforcing the pedestrian-orientation desired for the downtown
area because the school's proximity to the Village provides the students and its employees an
opportunity to walk to shopping, recreation, and mass transit functions. In relation to goal three,
with the project being close to existing bus routes and mass transit, it will help to further the goal
of providing new economic development near transportation corridors. Furthermore, the project
is consistent with goal four because the Army and Navy Academy assists in encouraging
complementary uses in the Village and adding diversity to the Village population that helps
create and/or enhance a more lively and interesting social environment.

B. Village Review Zone (CMC Chapter 21.35), District 9 (Village Master Plan and
Design Manual)
The proposed project meets the goals that have been identified in the Village Master Plan and
Design Manual by enhancing an existing civic and cultural use with the new constmction of a
private school athletic facility and replacement of an athletic field in the Village. A private
secondary school (and accessory uses) is considered a provisional use in the District 9.
Provisional uses are those which are permitted subject to discretionary approval. They are
approved based upon the findings that the use is consistent with the Village vision and goals
under specific conditions imposed by the permit. Uses in this category require special scmtiny
conceming location, size, and anticipated impact on adjacent uses. For the purposes of land use
policy within the Village, the term "provisional use" replaces the term "conditional use" which is
used within the Carlsbad Municipal Code. In 1995, with approval of the Village Master Plan and
Design Manual, a long range master plan for the Army and Navy Academy must have been
approved prior to the issuance of any permits for improvements and additions to existing
facilities. As mentioned previously, a Master Site Plan was approved in 2008. Therefore, the
proposed project is consistent with zoning requirements of District 9 of the Village Review
Zone. The specific development standards for new development within Land Use District 9 are
as follows:
Building Setbacks
The Village Master Plan and Design Manual set forth the standard for the front, rear and side
yard setbacks for the property. In Land Use District 9, the setback requirements are as noted
below:
Front: 5-20 feet.
Side: 5-10 feet.
Rear: 5-15 feet.
The top of the range shall be considered the desired standard for setback requirements. However,
a reduction in the standard to the minimum, or anywhere within the range, may be allowed if the
project warrants such reduction due to good project design and/or the provision of the projects
features which benefit the Village Area.
With the proposed project, the front yard setback is five feet. The north side has a setback of
five feet and the south side has a setback of ten feet. The rear yard has a 20 foot tall fence that
has a proposed five foot setback from the rear property line.
Due to a combination of field dimensions, building and landscaping enhancements, minimal
building frontages and massing, the project warrants a reduction in setback requirements. The
athletic field is the focus of the property, requiring all other ancillary stmctures to be located
around the perimeter of the field. Due to dimensions of the ball fields, the press box and athletic
building are setback five feet from the front and side property line.
Along the front yard setback is the press box, which has an attractively designed covered arcade
with a series of arches, in addition to a stair tower with two large arched openings. These two
structures combined make up 120 feet (20%) of the 588 foot street frontage along Carlsbad

Boulevard. The rear of the main athletic building sits along the north (side) yard setback with a
classic Spanish Colonial Revival fa9ade to match the fi-ont, field facing side of the building. A
twenty foot tall chain link fence is proposed along the east (rear) property line which will prevent
baseballs from flying within the railroad right-of-way and will make up for the smaller baseball
field dimensions. Red tmmpet vines will be planted along the fence to help screen and beautify
it.
Building Coverage
Commercial projects in Land Use District 9 may have up to 80-100% building coverage. This
amount of building coverage allows for more intense development in a downtown area,
encouraging a more pedestrian firiendly environment. For the proposed project, the athletic field
covers majority of the lot, leaving little room for actual building coverage. The building
coverage is 13.7%, which is consistent with the building coverage standard.
Building Height
The maximum building height limit for Land Use District 9 is 45 feet. The heights of the
proposed buildings are noted below:
Main athletic building: 45 feet 5 inches
Maintenance building: 18 feet 10 inches
Press box: 26 feet 9 inches
Ticket booth: 13 feet 1 inch
The main athletic building has decorative parapet that extends five inches above the height
allowance. Protmsions above the height allowance used as architectural features are permitted by
the Municipal Code (Chapter 21.46.020), if additional floor space is not created. Therefore, the
proposed building heights are in compliance with the standard set forth in the Village Master
Plan and Design Manual.
Roof Pitch
All projects in Land Use District 9 are required to have a 5:12 roof pitch on at least 50% of the
total roof stmcture. The roofs for the buildings on the proposed project incorporate a 5:12 pitch
on the entire roof stmcture, which ensures its compliance with the roof pitch development
standard.
Open Space
A minimum of 20% of the property must be maintained as open space. The open space must be
devoted to landscaped pedestrian amenities in accordance with the City of Carlsbad's Landscape
Manual, and, per the Village Master Plan and Design Manual, open space may be dedicated to
landscaped planters, open space pockets and/or connections, roof gardens, balconies, and/or
patios. Qualifled open space for the proposed project includes landscape areas and the athletic
turf field. The project provides for a total of 134,694 square feet of open space, which represents
61% of the site and is consistent with the open space standard.

Parking
The approved Master Site Plan establishes the total parking requirement for the site. A
modification to the parking requirement was approved as part of the Master Site Plan due to the
specialized nature of the site. The parking requirement for the site totals 171 parking spaces and
is based on a maximum school enrollment of 440 students and 116 employees. The site of the
proposed athletic facility is located in Planning Area E of the Master Site Plan, which calls for 63
parking spaces between the north and south lots. The north lot contains 13 parking spaces, and
the south lot contains 50 parking spaces, totaling 63 spaces, which is consistent with the
approved Master Site Plan.
C. Coastal Development Regulations for the Village Segment of the Local Coastal
Program (CMC Chapter 21.81 and Village Master Plan and Design Manual)
The site for the proposed project is located within the Village Segment of the Coastal Zone.
Consistency with the Village Local Coastal Program is required for this project. The Village
Master Plan and Design Manual function as the Local Coastal Program for the Village area.
Staff finds the proposed project to be consistent with the Village segment of the Local Coastal
Program in that views of the coastline, as seen from public lands or the public right-of-way, will
not be obstructed by the proposed project, nor otherwise damage the visual beauty of the coastal
zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located
on the property. The project site is not located in an area of known geologic instability of flood
hazard. Although the site is located in close proximity to the coast, no public opportunities for
coastal shoreline access are available from the public site. Furthermore, the site is also not suited
for water-oriented recreation activities.
D. Army and Navy Academy Master Site Plan
The purpose of the Army and Navy Academy Master Site Plan is to provide a guide for future
development of the private boarding school campus. The Master Site Plan is conceptual and
indicates the general location, amount and type of development, potential access points,
circulation and the development scheme for the school. The Academy has developed the
following goals to guide the development of the campus over time:
1. Provide facilities to help realize the Academy's mission.
2. All planning should build and sustain upon the Academy's reputation for excellence in
the civilian/military community.
3. The Academy campus should be designed so that administration, educational, residential,
support facilities, and other activities are within easy walking distance of each other.
4. The character of the Academy should be consistent with the surrounding community.
5. All planning should include design characteristics that will attract people to the
Academy.
6. The Academy should help conserve resources and minimize waste.
With the constmction of a new athletic facility, athletic pursuits will be better supported and
physical conditioning of students will be enhanced. This assists in achieving the Academy's core
mission of motivating young men to realize their full potential. The proposed athletic facility is

located within close walking distance to other facilities of the campus, supporting goal number
three. The Spanish Colonial Revival architecture style continues the existing theme and respects
the existing buildings on campus and surrounding community.
The athletic facility site is located in Plarming Area E of the Master Site Plan, which calls for
three separate phases (out of 20) of development. Phase 1 includes the removal of storage
buildings and constmction of a south parking lot. Phase 6 consists of the demolition of the
existing athletic building and constmction of a new athletic building and north parking lot, and
Phase 14 involves the constmction of a maintenance building and second south parking lot.
It has been acknowledged that development of the campus may not occur in the exact order of
the phases, but rather when funding becomes available. The proposed project is consistent with
the vision and phasing for Planning Area E of the Army and Navy Academy Master Site Plan.
E. Growth Management Regulations
The proposed project is located within Local Facilities Management Zone 1 in the northwest
quadrant of the city. The impacts on public facilities created by the project, and its compliance
with the adopted performance standards, are summarized in Table A below.

V. ENVIRONMENTAL REVIEW
The project qualifies as a CEQA Guidelines Section 15332 (In-Fill Development Projects) Class
32 Categorical Exemption. The project is consistent with the General Plan as well as with the
Zoning Ordinance, the project site is within the City limits, is less than 5 acres in size, and is
surrounded by urban uses; there is no evidence that the site has value as habitat for endangered,
rare, or threatened species; approval of the project will not result in significant effects relating to
traffic, noise, air quality, or water quality; and the site can be adequately served by all required
utilities and public services. The project is exempt from further environmental documentation
pursuant to Section 15332 of the State CEQA guidelines. A Notice ofExemption will be filed by
the City Planner upon final project approval.

ACTION: Motion by Commissioner Siekmann, and duly seconded, that the Planning
Commission adopt Planning Commission Resolution No. 6853 recommending
approval of Specific Plan Amendment 180(H) based on the findings and subject to
the conditions contained therein to include an amendment to Specific Plan 180
Section 4.33, No 3 to remove the word "xeriscape" from the clause.

Chairperson Schumacher closed the public hearing on Agenda Item 1 and asked Mr. Neu to introduce the
next item.
3- RP 12-13/CDP 12-04 - ARMY & NAVY ACADEMY ATHLETIC FACILITY - Request for
a recommendation of approval of a Major Review Permit and Coastal Development
Permit to allow for the demolition of all existing structures on site and the construction of
a new two-story athletic facility, press box with stadium seating, maintenance building,
and the installation of a new artificial turf field, lights and a new perimeter fence on the
property located at 2605 Carlsbad Boulevard in Land Use District 9 of the Village Review
Zone.
Mr. Neu introduced Agenda Item 3 and stated Assistant Planner Austin Silva would make the staff
presentation.
Chairperson Schumacher opened the public hearing on Agenda Item 3.
Mr. Silva gave a brief presentation and stated he would be available to answer any questions.
Chairperson Schumacher asked if there were any questions of Staff.
Commissioner Black asked if Staff had an image or photo simulation of the 20 foot tall fence on the east
side of the site. Mr. Silva stated directed the Commission's attention to the slide on the screen and noted
that only a portion of the fence was visible at the bottom of the slide. Mr. Silva stated that red trumpet
vines will be planted to provide screening.
Chairperson Schumacher asked if there were any further questions of Staff. Seeing none, he asked if the
applicant wished to make a presentation.
Bill Hofman, Hofman Planning and Engineering, 3156 Lionshead Ave, representing the applicant, gave a
brief presentation and stated he would be available to answer any questions. Mr. Hofman introduced
Brigadier General Bliss, who gave a brief presentation and stated he would be available to answer any
questions.
Chairperson Schumacher asked if there were any questions of the applicant.
Commissioner Siekmann asked if the attendance would be increasing with this new facility. General Bliss
stated yes. Commissioner Siekmann inquired about the pedestrian crossing on Carlsbad Boulevard. Mr.
Hofman stated a traffic signal is a condition of approval of this phase. Commissioner Siekmann asked if
they are going for LEED Certification with this phase. Mr. Hofman stated no.

Commissioner Black asked if the parking lot will be open to the public on days other than game days. Mr.
Hofman stated the lot will not be open to the public. There will be signs posted indicating no public
parking and if needed, chains will be installed.
Commissioner L'Heureux asked if there will be sufficient and convenient parking for games being held at
the facility. General Bliss stated parking will not be without its challenges. Mr. Hofman stated Beech
Avenue does allow parking. More parking will be added with future phases. Commissioner L'Heureux
asked how the lighting has been designed to have little impacts on the nearby residents. John Dodge,
architect for the project, stated the latest the lights will be on will be 10:00 p.m. Commissioner L'Heureux
asked how many night games the academy anticipates having at the facility. General Bliss stated it is
typically a maximum of 5 football games. He stated soccer games are played in the afternoon and
baseball games are played predominantly in the afternoon. Commissioner L'Heureux asked if there will
be any parades at night. General Bliss stated no.
Commissioner Siekmann asked about other businesses or schools using the facilities. General Bliss
stated it currently happens now as Tri City Christian uses the football field but the school is not that large.
Commissioner Siekmann asked if there are ever any events that happen concurrently. General Bliss
stated very rarely.
Commissioner Arnold asked if they have thought about constructing a pedestrian overpass. General
Bliss stated it is in a later phase; however the athletic facility and another building need to be constructed.
Chairperson Schumacher asked if there any were members of the audience who wished to speak on
Agenda Item 3.
Gary Nessim, 2987 Highland Drive, Carlsbad, stated the project is severely underparked. He feels the
site is perfect for an underground parking garage that could be used by the commuters and beach goers.
Mr. Nessim would like to see the item continued so the applicant can work with NCTD.
Chairperson Schumacher asked if there were any questions. Seeing none, he asked if there were any
other members of the audience who wished to speak on the item.
Mary Welch, resident on Beech Avenue, stated she has been looking forward to this project but is
concerned about the parking in the area. However the parking lot for the facility will make an
improvement. She stated that if additional public parking is provided on the property, there will be trash
everywhere.
Chairperson Schumacher asked if there were any questions. Seeing none, he asked if there were any
other members of the audience who wished to speak on the item.
Mr. Hofman stated the applicant met with the Mr. Nessim several years ago to discuss the idea of the
parking lot. The funding was not available and NCTD did not approve of the idea.
Commissioner L'Heureux asked about the timing of the conversations. Mr. Hofman stated the meeting
was about 4 years ago. General Bliss stated the economics do not work for the site. He is not in favor of
the idea. Commissioner L'Heureux commented that the parking lot on Beech Avenue should be chained
off so the public does not use it. Mr. Hofman stated they are agreeable to that request.
Chairperson Schumacher closed public testimony on Agenda Item 2.
Commissioner Siekmann asked about Condition No. 42. Clyde Wickham, Associate Engineer, stated that
the design could be a pedestrian signal or a crosswalk. Bryan Jones, Traffic Engineer, stated that it is
more likely that rectangular rapid flashing beacons would be required. Commissioner Siekmann asked
who makes the final decision. Mr. Jones stated Staff has been working with the security director for the
Academy to come up with a design.
Chairperson Schumacher asked about parking for the project. Mr. Silva stated that Planning Area E of
the Academy's Master Site Plan calls for 63 parking spaces and 63 parking spaces are provided with this
proposal.

Commissioner L'Heureux asked Staff about placing a chain across the entrance to the parking lot. Mr.
Silva stated that the parking lot is on the Academy's private property and therefore it will be the
responsibility of the Academy to place a device to prohibit public parking.
Commissioner Black asked Mr. Neu if it would be appropriate to place a condition to place a chain on the
parking lot. Mr. Neu stated it is within the Commission's discretion.
Chairperson Schumacher asked if there is an issue of not placing the condition. Mr. Neu stated that as
long as the access was not limited during times the facilities were being used it would not be in conflict
with city parking requirements.
Commissioner Siekmann stated the applicant was agreeable to leaving the project as is.
Commissioner Black felt that placing the condition does not hurt as the applicant is agreeable.
Commissioner L'Heureux concurred with Commissioner Black and asked if staff could work out the
condition.
Commissioner Arnold stated he is opposed to placing a condition on the project.
Chairperson Schumacher concurred with Commissioner Arnold.
DISCUSSION
Commissioner Arnold thanked the Army and Navy Academy for being a great neighbor and an asset to
the community. Regarding the parking garage, he stated one is needed in the Village; however it is unfair
to saddle the Academy with the cost of constructing a parking garage. Commissioner Arnold stated he
can support the project.
Commissioner L'Heureux also stated this is a great project. He stated the parking is an issue but the
Academy will take great steps to insure people attending the games can park in the lot or nearby.
Commissioner L'Heureux stated he can support the project.
Commissioner Black thanked Staff and the applicant on a great project. In regards to the parking, he
stated he trusts the Academy will handle any issues appropriately. Commissioner Black stated he can
support the project as presented.
Commissioner Siekmann stated she can also support the project. She stated she likes the idea of a
pedestrian activated crossing from the school to the field. Commissioner Siekmann stated she agrees
that the Village needs a parking garage but it would not be appropriate at this site.
Chairperson Schumacher also thanked Staff and feels it will be a tremendous improvement to the
downtown Village area. Parking is always an issue in the Village and he feels saddling the Academy with
the construction costs for a parking garage is out of character. He stated he can support the project.
MOTION
ACTION: Motion by Commissioner Siekmann, and duly seconded, that the Planning
Commission adopt Planning Commission Resolutions No. 6899 and 6900
recommending approval of RP 12-13 and CDP 12-04 to the City Council based on
the findings and subject to the conditions contained therein.

965 square foot retail use within an existing office/warehouse business within the
Planned Industrial zone on property located at 2717 Loker Avenue West, Suite B, in
Local Facilities Management Zone 5.
Mr. Neu introduced Agenda Item 4 and stated Principal Planner Chris DeCerbo would make the staff
presentation.
Commissioner Siekmann stated that because she was a former employee of the applicant, she needed to
recuse herself.
Chairperson Schumacher opened the public hearing on Agenda Item 4.
Mr. DeCerbo gave a brief presentation and stated he would be available to answer any questions.
Chairperson Schumacher acknowledged receipt of a letter from the applicant dated June 23 and asked if
there were any questions of Staff. Seeing none, he asked if the applicant wished to make a presentation.
Greg Gunther gave a brief presentation and stated he would be available to answer any questions.
Chairperson Schumacher asked if there were any questions of the applicant.
Commissioner Arnold asked how many staff members he has. Mr. Gunther stated 5 employees.
Commissioner Black asked about signage for the site. Mr. Gunther stated he has no intention of
changing the existing signs. Commissioner Black asked if it would be considered retail or wholesale if a
Carlsbad Police Officer were to come in for merchandise. Mr. Gunther stated it would be retail.
Chairperson Schumacher asked if there were any further questions of the applicant. Seeing none,
Chairperson Schumacher asked if there any were members of the audience who wished to speak on
Agenda Item 4. Seeing none, he opened and closed public testimony on the item.
DISCUSSION
Commissioner Arnold stated that while he can understand the concerns of the small business owner, he
cannot support the project. He further stated that the business does not serve the occupants of the
business park as required by the General Plan and zoning.
Commissioner L'Heureux stated that he has a difficult time trying to apply even two of the findings that
are necessary to approve a Conditional Use Permit therefore he has to deny the request.
Commissioner Black stated he is concerned with setting precedence with this project. He stated he has
to deny the request.
Chairperson Schumacher applauded the applicant in their interest in complying with rules. He concurred
with Commissioner Black in regards to setting precedence. Chairperson Schumacher commented that
ultimately the project is not congruent with the General Plan or the intent of the P-M Zone.

Dear Ms. Wood:
My office represents Ms. Uba Artukovic, the owner of the Scandia Hotel, and Ms. Katie
Taylor, owner of Taylor Place Real Estate, Inc., and Triad Properties. As you are likely aware, both
of my cUents own and operate businesses directly adjacent (north) of the Army Navy Academy's
athletic field; Ms. Artukovic also owns the land on which these businesses are situated. Please
accept this letter as my clients' foraial objection to the above-referenced project. Please take
whatever steps are necessary to place my clients' objections, as set forth more fully below, as
agenda-items for discussion when the Carlsbad City Counsel addresses this project at its August
28, 2012 meeting.
Agenda-Items:
1. Lack of Procedural Notice/Due Process
To begin with, I understand that the Carlsbad Planning Commission held a public hearing
regarding this project on July 3,2012. Ms. Taylor never received any notice of this hearing, nor did
she receive any actual notice of the project on several days after the hearing took place and,
apparently, the Planning Commission voted to approve the project. It is our contention that Ms.
Taylor is an individual to whom notice ofthe project and the July 3'** hearing was due and that the
lack of notice to her is procedural defect in project's approval process.
2. Lot-line dispute/Encroachment
Next, the project as approved by the Planning Commission appears to encroach upon Ms.
Artukovic's property based upon a survey that she obtained several years ago. This is of particular

concem to Ms. Artukovic, as the project, as approved by the Planning Commission, will result in
the loss of her handicapped parking. It is also a concem to Ms. Taylor as the wall and fence that
the Academy intends to build will obliterate an artistic mural on the side ofher building. As such,
unless these issues can be resolved between my clients and the Academy, I have advised Ms.
Artukovic to proceed with a quiet-title action and to seek an injunction to preserve the status-quo
until the Superior Court determines the proper boundary line separating Ms. Artukovic's property
from the Academy's property.
3. Loss of Business Revenue
Construction ofthe project will have significant impact upon my clients' businesses. It is
unlikely that Ms. Artukovik's customers will want to stay as guests of her hotel while major
construction is occuning directly next door. Furthermore, Ms. Taylor's real estate business
necessarily involves meeting with clientele at her office, which lacks air-conditioning. It is virtually
certain that construction will resuh is air bom dirt and dust that will coat the interior of Ms. Taylor's
offices. This will severely hinder Ms. Taylor's ability to operate her business and is likely to
negatively impact her income.
4. Issues not Fully Addressed or Vetted
Finally, my clients do not feel that the following issues have been adequately addressed and
vetted as part ofthe Planning Commission's approval ofthe project:
A. The project's effect upon the site drainage from the Academy's property onto Ms.
Artukovic's property;
B. Increased pedestrian traffic across Pacific Coast Highway from the Academy to the
new athletic field and the safety ofthe existing cross walk to handle the increased
pedestrian traffic needs;
C. Increased parking congestion. The Academy is adding only 63 parking spaces to
address the increased traffic that the new athletic field will generate. There is not
currently enough data to show that the increased parking will meet increased parking
needs so that parking congestion on Pacific Coast Highway is not negatively
impacted.
D. Increased building heights. The Academy's proj ect appears to be built upon fill soil
that will raise the foundation height of the new building significantly above the
natural grade.

Dear Mr. Eric Ginder:
You submitted a letter to be distributed during the Public Comment period at the City Council meeting
on July 24, 2012. In the letter, issues were raised regarding lack of procedural notice/due process, lot-
line dispute/encroachment, loss of business revenue, site drainage, increased pedestrian traffic,
increased parking congestion, and increased building heights.
The following are responses to the issues raised within your letter to the City Council.
1. Lack of procedural notice/due process: The noticing requirements for a Major Redevelopment
Permit and Coastal Development Permit require the city to notify property owners within a 600 foot
radius of the site and occupants within a 100 foot radius of the site. The required noticing was
completed, and both the property owner and tenant were included in the noticing. In addition, an
on-site project notice sign was posted on the property soon after the application for the project was
submitted.
2. Property line: Hofman Planning and Engineering had the property line surveyed and staked, which
was shown to the property owner (Uba Artukovic) and tenant (Katie Taylor) to demonstrate that the
project does not encroach into any of the adjacent properties or impact parking spaces.
Furthermore, there is concern regarding the mural being blocked from view on the south wall of Ms.
Taylor's office. The Army and Navy Academy, along with the representative Hofman Planning and
Engineering, have met privately with Ms. Artukovic and Ms. Taylor to resolve their issues with the
project. As a result of the meetings, the Army and Navy Academy has agreed to remove a retaining
wall, and instead, slope a portion ofthe parking lot. Also, the Army and Navy Academy will cluster
trees in the landscaped portion ofthe parking lot adjacent to Ms. Taylor's office so that the mural on
the south side of her building will still be visible.
3. Loss of business: It is understandable that there are concerns regarding the loss of business during
construction of the proposed athletic facility. However, the site is located in an urban area with
different land uses and it is acknowledged that there may be short term nuisance impacts from
nearby construction. Municipal Code Section 8.48.010 limits the hours of construction Monday
through Friday from 7 A.M. until dusk, Saturday from 8:00 A.M. to dusk, and no construction is
permitted on Sundays and holidays.
4. Drainage: Currently, the Army/Navy athletic field site drains towards the hotel property. The project
resolves this issue by keeping all drainage on site and directed towards an underground
treatment/storage facility. Most of the storm water will percolate on site. In a major storm event.

any overflow will be directed through a pipe that connects to an existing concrete storm drain box
east ofthe hotel on North County Transit District property.
The hotel drainage is now conveyed through a dirt swale along the common hotel/Army and Navy
property line crossing over into the Army and Navy side several times. This will be corrected by
building retaining walls and cleaning the drainage water before it leaves the hotel site. Also, the dirt
swale will be rebuilt to stay inside the hotel property. The part that won't have a retaining wall will
be landscaped and have a bio-swale to take a portion ofthe hotel drainage.
5. Increased pedestrian traffic: Although there is not an increase in students associated with the new
athletic facility, it is anticipated that more students and staff will be crossing Carisbad Boulevard to
use the facilities. As a result of this anticipated increase in use of the crosswalk, a condition has
been placed on the project requiring the Academy to improve the existing cross walk and associated
improvements to include a pedestrian signal or beacon.
6. Increased parking congestion: The previously approved Army and Navy Academy Master Site Plan
addresses parking, which is based upon the number of students and staff at the school. The Master
Site Plan designates separate planning areas, of which the subject property is designated as Planning
Area E. Planning Area E calls for 63 parking spaces between two parking lots on the north and south
ends of the property. The proposed project will be providing a total of 63 parking spaces between
both lots. Furthermore, the site is currently being used as a multi-purpose field, which is what it will
continue to be used as. The athletic building will have facilities such as a gymnasium, weight room,
and film room that will be used by students and staff, not requiring additional parking spaces as
there will be no increase in students and staff. Basketball games and wrestling matches are
activities that currently do not occur on site right now and will take place in the new facility.
However, these activities typically do not attract large crowds.
7. Increased fill heights: The maximum building height for the Land Use District 9 of the Village Review
Zone is 45 feet. Building height is limited to the vertical distance measured from "existing grade" or
"finished grade", whichever is lower, at all points along the "building coverage." The main athletic
building measures 45 feet 5 inches and has a decorative parapet that extends five inches above the
height allowance. Protrusions above the height allowance used as architectural features are
permitted by Municipal Code (Chapter 21.46.020), if additional floor space is not created.
Therefore, the proposed building heights are in compliance with the standard set forth.

NOTICE IS HEREBY GIVEN to you, because your interest may be
affected that the City Council of the City of Carlsbad will hold a
public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on Tuesday, August 28, 2012, to con-
sider approval of a Major Review Permit and Coastal Development Permit to
allow for the demolition of all existing structures on site and the construction of. a new two-story athletic facility, press box with stadium seating, maintenance
building, and the installation of a new artificial turf field, lights and a new pe-
rimeter fence on property generally located at 2605 Carlsbad Boulevard in Land Use District 9 of the Village Review Zone and more particularly descnbed
as:
Lots 153-170 and Lots 177-198 inclusive of Grandville Park No. 2 in the City of
Carlsbad, County of San Diego, State of California, according to parcel map
2037, filed in the Office of the County Recorder June 18,1927; and
Together with that portion of Cypress Avenue and Del Mar Avenue lying north-
easterly of the northeasterly right of way line of Coast Highway, also together
with that portion of the unnamed alley adjoining said lots 153-170 inclusive, on the northeast and lying southerly a line drawn radially from the northwest cor-
ner of lot 178, also together with all that portion of Sycamore Street, as all were
vacated and closed to public use by order of the Board of Supervisors, filed in
the Office of the County Recorder, April 13, 1933 in Book 207, Page 217 of
official records.
Whereas, on July 3, 2012 the City of Carlsbad Planning Commission voted 5-0
to recommend approval of a Major Review Permit and Coastal Development Permit to allow for the demolition of all existing structures on site and the con-
struction of a new two-story athletic facility, press box with stadium seating,
maintenance building, and the installation of a new artificial turf field, lights and a new perimeter fence on the property located at 2605 Carlsbad Boulevard in
Land Use District 9 of the Village Review Zone.
Those persons wishing to speak on this proposal are cordially invited to attend
the public hearing. Copies of the agenda bill will be available on and after

Dear Ms. Wood:
As the representative of the Army Navy Academy, I am writing this letter in response to
a letter trom Erie Gmder that was presented to you at your last City Council meeting
durmg the public comment period. The letter was presented to you by Katie Taylor a
tenant of the property just to the north of our proposed facility. Since we were not
present at the meeting and could not speak to the points contained in their letter this
letter has been written to address each of the points made.
Attached is the letter from Mr. Ginder with our responses inserted (labeled "AN
Response ). I would request that this letter be distributed to the City Council in their
agenda bills prior to the hearing. We will be in attendance at the City Council hearing
and we will be prepared to answer any questions and to address any concerns
