RECOMMENDED ACTION:
Adopt Resolution No. 2012-216 approving Amendment No. 9 to extend and amend the
agreement with Bureau Veritas North America, Inc., for the El Camino Real Widening between
Tamarack Avenue and Chestnut Avenue, Project No. 3957.
ITEM EXPLANATION:
Project design tasks outlined in the agreement for the engineering services for the widening of El
Camino Real between Tamarack Avenue and Chestnut Avenue have been completed. Due to
changes in the project scope, storm water regulations, environmental updates, property acquisition,
utility undergrounding, and additional retaining wall design, additional engineering services are
required to complete the improvement plans for design. This amendment would include engineering
services to prepare improvement plans for bidding purposes. Environmental updates and right-of-way
acquisition are currently unden^^ay.
ENVIRONMENTAL IMPACT:
A Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program were prepared for
the El Camino Real Road Widening project (CDP 07-22/HDP 07-02/SUP 07-04/HMP 07-08). The
Notice of Intent (NOI) to adopt a Mitigated Negative Declaration was published in the newspaper
November 1, 2007, and sent to the County Clerk's Office for a 30-day public review (October 30, 2007
- November 30, 2007). One comment letter was received during the 30-day review period. The MND
was approved by the Planning Commission on June 3, 2009 in compliance with the California
Environmental Quality Act (CEQA) Guidelines Section 15074.
FISCAL IMPACT:
Table 1 shows the current status of the El Camino Real Widening Improvements.

The total cost of Amendment No. 9 is $149,280, which brings the total of contract value to $1,057,129.
Sufficient funds are available for this amendment without requiring additional appropriations. This
project is funded with Traffic Impact Fees and TransNet and sufficient funds have been appropriated
through the Capital Improvement Program.

6 WHEREAS, the City Council of the City of Carlsbad, California, has determined it
7 necessary and in the public interest to improve El Camino Real between Tamarack Avenue and
8 Chestnut Avenue, Project No. 3957; and
9 WHEREAS, it is in the best interest of the City to extend and amend the agreement with
Bureau Veritas for an additional two (2) year term to allow for the completion of all engineering
services; and
WHEREAS, City staff and Bureau Veritas have negotiated fees in an amount not-to-exceed
$149,280 to provide additional engineering sen/ices for the project, as described in this Amendment
No. 9 to professional services agreement; and
WHEREAS, funds have been appropriated in the Capital Improvement Program from the
15 TransNet and Traffic Impact Fee and there are sufficient funds appropriated for Project No. 3957.

This Amendment No. 9 is entered into and effective as of the day of
2012, extending and amending the agreement dated
November 18, 2005 (the "Agreement") by and between the City of Carlsbad, a municipal
corporation, ("City"), and Bureau Veritas North America, Inc., a Delaware corporation,
("Contractor") (collectively, the "Parties") for professional engineering sen/ices for the widening
of El Camino Real between Tamarack Avenue and Chestnut Avenue.
RECITALS
A. On April 14, 2006, the Parties executed Amendment No. 1 to the Agreement to
perform focused surveys for the Califomia Gnatcatcher, Least Bell's Vireo, and Rare Plants; and
B. On January 31, 2007, the Parties executed an Assignment and Assumption
Agreement for Professional Engineering Services by and between the City of Carlsbad,
a political subdivision of the State of Califomia ("City"), Benyman & Henigar, Inc., a California
corporation ("Assignor"), and Bureau Veritas North America, Inc., a Delaware corporation
("Assignee"); and
C. On March 19, 2007, the Parties executed Amendment No. 2 to the Agreement to
extend the Agreement for one (1) year and to amend the scope of work to perfonn additional
alternative analysis, improved the preferred project, perform Monarch butterfly sun/eys, and
perform additional environmental sen/ices; and
D. On August 7, 2007, the Parties executed Amendment No. 3 to the Agreement to
perform analysis and prepare the applications forthe Coastal Development Pennit, Special Use
Pemfiit, and Hillside Development Permit; and
E. On September 12, 2007 the Parties executed Amendment No. 4 to the
Agreement to extend the agreement for a period of one (1) year; and
F. On September 17, 2008 the Parties executed Amendment No. 5 to the
Agreement to extend the agreement for a period of one (1) year and to amend the agreement to
perform additional design and environmental analysis; and
G. On June 30, 2009, The Parties executed Amendment No. 6 to the Agreement to
amend the agreement to perfomi additional design, geotechnical, and water quality analysis and
provide additional project management and coordination; and
H. On December 2, 2009, the Parties executed Amendment No. 7 to the Agreement
to extend the agreement for a period of one (1) year; and
I. On March 9, 2011, the Parties executed Amendment No. 8 to the Agreement to
extend the agreement for a period of two (2) years; and
J. The Parties desire to alter the Agreement's scope of work to include additional
engineering services including updating plans to meet new stomn water requirements and
incorporating utility undergrounding; and

K. The Parties desire to extend the agreement for a period of two (2) years; and
L. The Parties have negotiated and agreed to a supplemental scope of work and
fee schedule, which is attached to and incorporated in by this reference as Exhibit "A", Scope of
Services and Fee.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein. City and Contractor agree as follows:
1. In addition to those sen/ices contained in the Agreement, as may have been
amended from time to time. Contractor will provide those sen/ices described in Exhibit "A". With
this Amendment, the total Agreement amount shall not exceed one million fifty seven one
hundred twenty nine dollars ($1,057,129).
2. City will pay Contractor for all work associated with those sen/ices described in
Exhibit "A" on a time and materials basis not-to-exceed one hundred forty nine thousand two
hundred eighty dollars ($149,280). Contractor will provide City, on a monthly basis, copies of
invoices sufficiently detailed to include hours performed, hourly rates, and related activities and
costs for approval by City.
3. Contractor will complete all work described in Exhibit "A" by November 18,2014.
4. All other provisions of the Agreement, as may have been amended from time to
time, will remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor pursuant to the
Agreement, as may have been amended from time to time, will include coverage for this
Amendment.

6. The individuals executing this Amendment and the instmments referenced in it

El Camino Real - Contract Change Order No. 9 - August 1, 2012
The following Contract Change Order addresses additional scope items for updating the plans to
include street light conduit and SDG&E design, update the drainage plan and WQTR reports,
additional retaining wall design (optional) and geotechnical work (optional) along the east side of El
Camino Real, and responses to new comments. Also provided are optional tasks for preparing a
new SWPPP which is compliant with the new general construction pemiit and traffic control for the
SDG&E construction.

Drainage & WQTR Study Update/Hydromodiflcation Exemption
The project will create more pervious area due to the conversion of
roadway to pervious median landscaping. Therefore, to qualify for a
hydromodification exemption, Bureau Veritas will revise the existing
condition drainage study to match key concentration points in the
proposed condition. An existing condition 2-year and 10-year hydrologic
analysis will be created to compare against the proposed condition
model.
Any stomi drain outfall resulting in a flow or velocity will be modified to
retain the peak flow such that flows and velocities are not increased. A
revised drainage study will be prepared showing calculations that the 2-
year through 10-year peak flows are not exceeded at any discharge
point. The approved design will be reflected on the plans, specifications
and estimate.
Filtena units will be replaced with a City prefened water quality
treatment altemative. In the superelevated area of the roadway only, the
median will be used to treat stomnwater from the west side which will
eliminate some of the water quality units. The median grading,
improvement, and landscape plans will be updated to be compliant with
bioretention requirements as mandated by the SUSMP.
Inigation lines leading to the Filtena units will be eliminated and an
altemative method of providing water quality treatment will be identified
in the median, where feasible.
The water quality technical report will be revised for the new water
quality treatment units and for the bioswale stomnwater treatment in the
median.

areas where a slope cannot be day lighted without significant impacts,
Bureau Veritas will select the appropriate regional standard wall to make
up the grade difference. Top of wall and top of footing elevations will be
incorporated into the plan view (no wall profile to be provided). Caltrans
style cable rails can be added at the top of wall for fall protection.
If this task is executed, Bureau Veritas will be responsible for making
the plan and profile adjustments to the plans, as outlined in Option 3,
and update the cost estimate at no cost to the City.

The City has indicated that there are new comments and changes to the
plan to be proposed. Since the comments have not been received, this
task will be a time and materials task to respond to the comments and
make corresponding changes to the plans. Prior to commencing the
wori^. Bureau Veritas will inform the City of the estimated cost to
adequately respond to the comments received and obtain approval to
proceed.

Geotechnical Analysis of Easterly Sidewalk for Slope Stebllization
i2El!2!!£!l The City has requested design to be revised by removing and
reconstructing the existing curb, gutter and sidewalk at a higher
elevation to remedy steep cross fall issues in the roadway. As an option,
geotechnical services will be provided to support the design for the
potential retaining wall needed on the east side of the El Camino Real
Widening project due to the raising of the curb, gutter and sidewalk. The
subject retaining wall is expected to be approximately 2 to 3 feet in
height and will be located along the east side of El Camino Real
approximately between Stations 496+00 (South end) to 529+50 (North
end) as shown on Sheets 7 through 17 of Drawing number 460-6 dated
December 2009. Scope of services will include:

Reviewing the engineering plans and maps provided to Ninyo
and Moore.
Performing a geologic field reconnaissance to observe site
conditions and to mark out proposed exploratory borings.
Meeting with Underground Sen/ice Alert (USA) for the clearance
of utilities. Available utility maps will be provided to Ninyo and
Moore prior to the start of our fieldwori^.
Preparation of traffic control plans and providing traffic control
during the field exploration. If traffic control and/or encroachment
pemriits are required by the City of Carisbad, it is assumed the
permit fees will be waived or paid by the City.
Perfomiing subsurface exploration consisting of the excavation,
logging and sampling of up to four borings to depths up to 15
feet (or refusal) in the area of proposed retaining wall. Soil
samples will be secured at selected Intervals and transported to
our laboratory for testing. The borings will be backfilled with the
soil cuttings in accordance with County of San Diego DEH
requirements.

6. Laboratory testing of selected samples to evaluate geotechnical
design parameters. Laboratory testing may include in-place
moisture content and dry density, particle gradation (sieve)
analysis, shear strength, expansion index, and soil corrosivity
(pH, resistivity, chloride content and sulfate content).
7. Compilation and analysis of the data obtained.
8. Preparation of a geotechnical evaluation report presenting
findings, conclusions and recommendations for design and
construction of the proposed retaining wall.
Assumptions:
• Pemiission for site access will be granted for our equipment and
personnel. Field exploration will be performed during normal
daylight hours.
• The cost for acquisition of traffic control permits and/or
encroachment permits from the City of Carisbad are not included
in the above estimated fee. If such permit fees are required for
performance of field wori<, it is assumed the permit fees will be
waived or paid by the City.
• Maps of existing utilities in the area of proposed grading will be
provided for review at the beginning of the work. If Underground
Sen/ice Alert (SA) cannot locate underground utilities at planned
boring locations, a geophysical utility locating service will be
retained for utility clearance and charged as an additional
service on a time-and-materials basis not to exceed $1,500.
Environmental consulting services (i.e. assessment of hazardous
materials, soil and groundwater contamination and analytical testing
services) are not included in this scope of services.
8 SWPPP Update (Optional)
Prepare the SWPPP to be in confomiance with the City's template will
include:
1. Notice of Intent (NOI)
2. The Risk Level assessment for the project will be determined per
the General Construction Permit's requirements.
3. Information regarding certifications, objectives ofthe SWPPP
and required notices will be provided.
4. A detailed project location, description and summary of site
conditions will be included in the report.
5. Water Pollution Control Drawings will be produced at the
conceptual level. The drawings will be included as part of the
SWPPP and will show the various site features.
6. A general construction schedule will be provided as part of the
SWPPP based on infonnation provided by the City.
7. A sediment assessment will be provided as part of the SWPPP.
8. BMP's will be selected and described in detail in the SWPPP.
9. Waste Management and Disposal will be addressed in the
SWPPP.
10. A Construction Site Monitoring Program (CSMP) will be included
in the SWPPP.

9 Traffic Control Plans for SDGE Design (Optional)
This amendment is required to facilitate traffic control plan design
changes associated with new SDG&E electrical undergrounding of
overhead utilities, along El Camino Real between Tamarack Avenue
and Chestnut Avenue. As an option. SDG&E's undergrounding work will
be included in the traffic control plan set for this project. The traffic
control required to accommodate the SDG&E undergrounding will
require modifications to four (4) sheets of the cunent traffic control plan
set and the preparation of two (2) additional sheets to accommodate a
lateral crossing at approximately Station 533+10.

Assumptions:
It is assumed this project will be completed within two (2) years of receiving the signed notice to
proceed.
Mylars of the final design will be provided as indicated under Task 032 in the original scope of wori<
for the project dated September 28, 2005. Due to the increased cost of mylars from the original
scope of woric, an additional $2,000 has been added to the fee estimate for ODC's for this project to
account for this change.
The 100% submittal will consist of the following items:
