RECOMMENDED ACTION:
Adopt Resolution No. 2012-239 accepting bids and award of contract to Burtech Pipeline Inc.
and appropriation of funds for the Terramar Sewer Lift Station and Force Main Replacement, Project
No. 5502.
ITEM EXPLANATION:
The project includes the construction of a new lift station and approximately 390 lineal feet of 6-inch
diameter force main, as well as rehabilitation of approximately 175 lineal feet of existing force main
with the installation of cured-in-place pipe (CIPP). The new lift station will be generally located at the
same site as the existing lift station. The upper section of the existing station will be removed, while
the lower, below grade portion of the existing structure and portions of existing pipelines will be
appropriately abandoned in place.
On June 12, 2012, through Resolution No. 2012-132, Agenda Bill No. 20,932, Council approved plans
and specifications and authorized the advertisement for bids for the Terramar Sewer Lift Station and
Force Main Replacement, Project No. 5502. On August 6, 2012, five (5) bids were received, opened,
and witnessed for the construction of this project. After staff completed a review of the bids for
compliance with the contract documents, it was determined that all five bidders were either non-
responsive in providing specifically required certification documents or did not provide sufficient
references of successful similar work experience, both required with the bid. All bids were rejected on
August 28, 2012, through Resolution No. 2012-213, Agenda Bill No. 20,988.
Staff subsequently re-advertised seeking new bids and on October 10, 2012 six (6) bids were
received for the construction of this project and are listed on the table below:

Staff has completed its review of all documents and finds that they are in order. Therefore, staff
recommends that Burtech Pipeline, Inc. be awarded the contract.
ENVIRONMENTAL IMPACT:
This project is exempt from California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15302(c) - replacement or reconstruction of an existing utility system on the same site
involving negligible or no expansion of capacity. A Notice of Exemption was filed with the San Diego
County Clerk on July 21, 2011.

The City appropriated $598,000 for this project through the Capital Innprovenrient Program
based on an estinnate for construction cost of $460,000. The original estimate did not
sufficiently account for features that were added to the electrical system and a more
extensive valve and bypass vault design included to improve reliability and
safety. Additionally, the deep excavation construction conditions in conjunction with a limited
working area contributed to a higher bid cost and third party inspections services also
contributed to the project cost. Staff is requesting that additional appropriation of $389,000
from the Sewer Replacement Fund be approved to provide for total project cost. Sufficient
funds are available in the Sewer Replacement Fund to provide for the additional cost of this
project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS, AWARD OF
CONTRACT TO BURTECH PIPELINE INC. AND
APPROPRIATION OF FUNDS FOR THE TERRAMAR SEWER
LIFT STATION AND FORCE MAIN REPLACEMENT,
PROJECT NO. 5502.
WHEREAS, on June 12, 2012, the City Council of the City of Carlsbad, through
Resolution 2012-132, approved the plans and specifications, and authorized to advertise for bids
for the Terramar Sewer Lift Station and Force Main Replacement, Project No. 5502; and
WHEREAS, five (5) sealed bids were received on August 6, 2012, for the construction of
said project; and
WHEREAS, all bids received on August 6, 2012 were rejected on August 28, 2012
through Resolution No. 2012-213; and
WHEREAS, staff subsequently re-advertised for bids and received six (6) sealed bids on
October 10, 2012 forthe construction of said project; and
WHEREAS; staff recommends the award of the construction contract to the lowest
responsive and responsible bid from Burtech Pipeline Inc. in the amount of $683,648; and
WHEREAS, with the said lowest bid, the total project cost of $987,344 exceeds current
appropriated funds of $598,000 for this project; and
WHEREAS, staff is requesting additional appropriation of funds from the Sewer
Replacement Fund to Project No. 5502 in the amount of $389,000 to complete this project; and
WHEREAS; Sufficient funds are available in the Sewer Replacement Fund to provide for
the additional cost of this project; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Finance Director is authorized to appropriate an additional $389,000
from the Sewer Replacement Fund, to Project No. 5502.

3. That the bid in the amount of $683,648 submitted by Burtech Pipeline, Inc., for
the construction of the Terramar Lift Station and Force Main Replacement, Project No. 5502 is
accepted and the Mayor is hereby authorized to execute a contract with Burtech Pipeline, Inc.
4. The City Manager is hereby authorized to approve construction change orders up
to $102,203.
5. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extensions of time.
