RECOMMENDED ACTION:
Adopt Resolution No. 2012-240 accepting bids and awarding a contract for the construction of
Palomar Airport Road and College Boulevard improvements, Project Nos. 6028 and 6029.
ITEM EXPLANATION:
The proposed improvements are located at the intersection of Palomar Airport Road and College
Boulevard. This project will install new storm drain facilities within the public right of way on College
Boulevard and Palomar Airport Road. Additionally, to improve traffic operation; the right turn only lane
on westbound Palomar Airport Road will be lengthened to accommodate drivers when making the
turning movement to northbound College Boulevard.
On August 28, 2012, City Council approved Resolution No. 2012-195, authorizing the advertisement
for bids for the Palomar Airport Road and College Boulevard improvements, Project Nos. 6028 and
6029. Six (6) sealed bids were received on October 9, 2012, which are summarized as follows:

A seventh bid was submitted by Blue Pacific Engineering & Construction, but was without a schedule
B, therefore staff is recommending that the bid be determined to be non-responsive. Staff has
completed its review of the contract documents and has determined that the lowest bid was Pal
General Engineering Inc. with $258,942. Staff recommends that Pal General Engineering Inc. be
awarded the contract.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and
similar facilities involving negligible or no expansion. A Notice of Exemption was filed with the San Diego
County Clerk on June 18, 2012.

FISCAL IMPACT:
The improvements for the intersection of Palomar Airport Road and College Boulevard have two
funding sources. Project No. 6028 is funded by the Traffic Impact Fee (TIF) program and is
appropriated for roadway improvements. Project No. 6029 is funded by the General Capital
Construction (GCC) program and is appropriated for the storm drain improvements. Both funding
sources are outlined in tables 1, 2, and 3 below.
Table 1 shows the current status of the Palomar Airport Road at College Boulevard improvements.

RESOLUTION NO. 2012-240
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
CONSTRUCTION CONTRACT FOR CONSTRUCTION OF
PALOMAR AIRPORT ROAD AND COLLEGE BOULEVARD
PROJECT NOS. 6028 AND 6029. \
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to repair the storm drain and enhance traffic
operations at the intersection of Palomar Airport Road and College Boulevard; and
WHEREAS, the project is exempt from the Califomia Environmental Quality Act (CEQA)
pursuant to CEQA Guidelines Section 15301(c); and
WHEREAS, on August 28, 2012, the City Council approved contract documents and
specifications for fumishing of ali labor, materials, tools, equipment, transportation, and other
expenses necessary or incidental to the Palomar Airport Road and College Boulevard
improvements, Project Nos. 6028 and 6029; and
WHEREAS, seven (7) sealed bids were received on October 9, 2012 for the project; and
WHEREAS, the bid submitted by Blue Pacific Engineering & Construction was missing
schedule B; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by Pal
General Engineering Inc. in the amount of $258,942; and
WHEREAS, there are sufficient funds available in the Traffic Impact Fee (TIF) and
General Capital Construction (GCC) programs (CIP Nos. 6028 and 6029) account for construction
of the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the bid submitted by Blue Pacific Engineering & Construction is non-
responsive.
2. That the bid submitted by Pal General Engineering Inc. in the amount of
$258,941.54 is hereby accepted and the Mayor is hereby authorized to execute the contract for
the construction of the Palomar Airport Road and College Boulevard improvements, Project Nos.
6028 and 6029, in accordance with the specifications and contract documents referred to herein.
1 3. That the City Manager is hereby authorized to approve construction change
2 orders up to the contingency amount of $38,841 to Pal General Engineering Inc.for the Palomar
3 Airport Road and College Boulevard improvements. Project Nos. 6028 and 6029.
4 4. That the aware of this contract is contingent upon Pal General Engineering Inc.
5 executing the required contract and submitting the required bonds and insurance policies, as
6 described in the contract, within twenty (20) calendar days of adoption of this resolution. The
7 City Manager may grant reasonable extensions of time.
