RECOMMENDED ACTION:
Adopt Resolution No. 2012-241 accepting bids and awarding a contract for the construction of
the Lincoln St and Pine Ave Improvements Project No. 6002.
ITEM EXPLANATION:
As part of the city's Sidewalk/Street Construction Program, this project will make improvements to
Lincoln Street and Pine Avenue (see Location Map). The improvements will include construction of
sections of missing sidewalk, curb and gutter, and pedestrian ramps within the public right-of-way.
On July 10, 2012, City Council approved Resolution No. 2012-176, authorizing advertisement for bids
for construction of the Lincoln St and Pine Ave Improvements Project No. 6002. The engineer's
estimate was $220,000. Eleven (11) bids were received on September 20, 2012, which are
summarized as follows:

The lowest bid was submitted by Tri-Group Construction. Staff has completed its review of the bid
documents and has determined that Tri-Group Construction made a clerical error on bid item A-4.
The clerical error was corrected and the bid total was revised. Tri-Group Construction was contacted
and they are honoring their bid. Staff recommends that Tri-Group Construction be awarded the
contract.

ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and
similar facilities involving negligible or no expansion.
FISCAL IMPACT:
The total estimated cost of the project is $213,769.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
A CONTRACT FOR CONSTRUCTION OF THE LINCOLN ST
4 AND PINE AVE IMPROVEMENTS PROJECT NO. 6002.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to construct missing sidewalk, curb and gutter, and
pedestrian ramps in accordance with the city's ongoing Sidewalk/Street Construction Program;
and
WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA)
pursuant to CEQA Guidelines Section 15301(c); and
WHEREAS, on July 10, 2012, the City Council approved contract documents and
12 specifications for furnishing of all labor, materials, tools, equipment, transportation, and other
13 expenses necessary or incidental to the Lincoln St and Pine Ave Improvements Project No. 6002;
and
WHEREAS, eleven (11) sealed bids were received on September 20, 2012 for the
project; and
16 WHEREAS, the lowest responsive, responsible bid for the project was submitted by Tri-
17 Group Construction in the amount of $153,769; and
WHEREAS, there are sufficient funds available in the Sidewalk/Street Construction
Program (CIP No. 6002) account for construction ofthe project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
2^ California, as follows:
21 1. That the above recitations are true and correct.
22 2. That the bid submitted by Tri-Group Construction in the amount of $153,769 is
hereby accepted and the Mayor is hereby authorized to execute the contract for the construction
of the Lincoln St and Pine Ave Improvements Project No. 6002, in accordance with the
specifications and contract documents referred to herein.
25 3. That the City Manager is hereby authorized to approve construction change
25 orders up to the contingency amount of $30,000 to Tri-Group Construction for the Lincoln St and
Pine Ave Improvements Project No. 6002.
1 4. That the award of this contract is contingent upon Tri-Group Construction
2 executing the required contract and submitting the required bonds and insurance policies, as
described in the contract, within twenty (20) calendar days of adoption of this resolution. The City
Manager may grant reasonable extensions of time.
