After receiving comments from the public, call for written protests to be filed with the City Cleric. 3. If protests represent less than a majority of the proposed assessment, introduce Ordinance No. CS-194 fomfiing the Carlsbad Golf Lodging Business Improvement District. If protests represent a majority of the proposed assessment, no further action should be taken for one year. ITEM EXPLANATION; Background: For almost 50 years the City of Carisbad financially supported community promotion and visitor services as a way to develop tourism and assist Carisbad visitors. Then in 2005, the City was approached by the Carlsbad Convention and Visitor's Bureau and Carlsbad hoteliers about the fomiation of a Carisbad Tourism Business Improvement District (CTBID) as allowed under the Parking and Business Improvement Area Law of 1989 (Streets and Highway Code section 36500 et seq.) The proposal to fomi the CTBID was based on the concept of collecting an assessment of $1.00 per room night from all hotel operators within the City to fund and support tourism promotion activities. The assessment would be passed through to the hotel guest as opposed to being paid directly from the hotel's operating revenues The levy would be imposed on all existing and future hotels. On November 15, 2006 the City Council adopted Ordinance No. NS-778, establishing the CTBID, and setting the boundaries, levy, and establishing an advisory board to provide oversight and recommendations to the City Council. The effective date for the CTBID was January 1,2006. In April of this year. Grand Pacific Palisades Hotel and the Carisbad Sheraton which are both part of Grand Pacific Resorts (GPR), proposed formation of a new voluntary business improvement district for Carisbad, to be called the Carlsbad Golf Lodging Business Improvement District (CGLBID). The purpose of the CGLBID would be to promote golf- related overnight stays at participating hotels in Carisbad. This district would be separate from the existing CTBID. CS-194 Page 2 Like the CTBID, the creation of CGLBID would be formed under Section 36500 of the California Streets and Highways Code (known as Parking and Business Improvement District Area Law of 1989). The GPR proposal was presented to Council at the July 10, 2012 Council meeting, and Council directed staff to bring back the Resolution of Intention (ROI), declaring the Council's intention to establish the CGLBID. CGLBID Proposal: The proposed CGLBID would be voluntary to lodging properties in the City of Carisbad. These properties would have until May 1 of each year to opt in to the district for the following fiscal year. Members that opt in would be assessed $2.00 per occupied room night to be paid to the city monthly through the current Transient Occupancy Tax collection process. The assessment would be passed through to the hotel guest as opposed to being paid directly from the hotel operating revenues. These funds would be used to promote golf-related overnight stays at participating hotels in Carisbad. Each assessed business would determine how to spend the funds collected by their respective property provided the expenditures are for an approved golf related expense. Reimbursement of these expenses would be made quarterly upon approval from the advisory board up to the amount collected per property minus a 4 percent administrative fee. Hotels requesting to opt in for the initial year of the district are the Grand Pacific Palisades, the Sheraton Carisbad and the Park Hyatt Aviara. It is estimated that these three properties will generate $330,000 in annual assessment revenue for the new district. On September 11, 2012, the City Council approved the Resolution of Intention (ROI), to declare their intention of establishing the Carisbad Golf Lodging Business Improvement District. On September 25, 2012, the City Council held a public meeting at which staff provided an overview of the CGLBID for the Council and public. No public comments were received at the meeting. CGLBID Formation Process: Public Hearing: On November 6, 2012, the City Council will hold a Public Hearing on the CGLBID. The purpose of the Public Hearing is for the City Council to take testimony of all interested persons for or against the establishment of the CGLBID, the extent of the areas for inclusion in the assessment, or the types of activities proposed for funding from the assessment. At the conclusion of the Public Hearing, a protest vote is conducted. A protest vote against the establishment of the CGLBID, the extent of the area, or the proposed activities must be in writing, and may only be accepted ifthe person signing is the business owner of record, or an authorized representative. If at the conclusion of the Public Hearing, there are protests by the owners of the businesses within the CGLBID that will pay fifty percent (50 percent) or more of the total assessments of the entire CGLBID, no further proceedings to create the CGLBID shall occur for a period of one-year from the date of the protest vote. If a majority of the written protests are related to a proposed activity of the CGLBID, the n that activity shall not be included in the CGLBID. If there are no protest votes in excess of the 50 percent requirement, then the City Council may create the CGLBID. CGLBID Advisorv Committee: The Parking and Business Improvement Area Law of 1989, requires an Advisory Board to be appointed by the City Council. The Council may act as its own Advisory Board, appoint an existing board, or select other individuals to serve in that Page 3 capacity. The CGLBID Advisory Board would be required to submit an annual report, which would include any proposed changes in the boundaries, assessment formula, estimated cost of conducting activities, the amount of surplus/deficit revenues to be carried over, contributions and other items of interest to the CGLBID for the upcoming year. The report may be approved as presented or amended by the City Council. Once the report has been approved for the upcoming year, the City Council adopts a resolution of intention to levy an annual assessment for the upcoming year. There is no need to conduct a public hearing if there is no proposed increase in assessments, for the upcoming year. (Streets and Highways Code § 36536(d). FISCAL IMPACT: The amount of revenue collected by the district will depend on the number of hotels that opt in to the district. Revenue estimates that include the hotels that have opted into the district for the initial year and include the Sheraton Carisbad, the Grand Pacific Palisades Hotel, and the Park Hyatt Aviara are $330,000. Administrative fees that would be paid to the city for collection and administration would be approximately $13,200 (4 percent). The remaining $316,800 would be available to the hotels to promote golf related overnight stays. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. CS-194 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ENACTING CHAPTER 3.38 OF THE CARLSBAD MUNICIPAL CODE ESTABLISHING THE CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT (CGLBID), FIXING THE BOUNDARIES THEREOF, PROVIDING FOR THE LEVY OF A BUSINESS ASSESSMENT TO BE PAID BY HOTEL BUSINESSES IN SUCH DISTRICT AND ESTABLISHING AN ADVISORY BOARD The City Council ofthe City of Carisbad ordains as follows: SECTION I: That Title 3 of the Carisbad Municipal Code is hereby amended by the addition of Chapter 3.38 that shall be known as the Carisbad Golf Lodging Business Improvement District Ordinance of the City of Carisbad to read as follows: CHAPTER 3.38 CARLSBAD GOLF LODGING BUSINESS IMPROVEMENT DISTRICT Sections: 3.38.010 - Definitions. 3.38.020 - Procedure and Findings. 3.38.030 - Establishing the Carisbad Golf Lodging Business Improvement District. 3.38.040 - Boundaries. 3.38.050 - Lew and Collection of Assessments. 3.38.055 - Refund of Assessments 3.38.060 - Ordering the Collection of Assessments. 3.38.070 - Use of Proceeds from Assessments. 3.38.080 - Penaltv for Nonpayment of Assessment. 3.38.090 - Assessments to be Used Within the District. 3.38.100 - Advisorv Board. 3.38.110-Severability. 3.38.010 - Definitions. This chapter is made and enacted pursuant to the provisions of the Parking and Business Improvement Area Law of 1989 (Sections 36500, et. seq., ofthe Streets and Highways Code) (the "law"). (a) On September 11, 2012, the City Council of the City of Carisbad adopted Resolution No. 2012-221 entitled, "A Resolution of Intention ofthe City Council of the City of Carisbad, California, Declaring the Intention ofthe City Council to Establish the Carisbad Golf Lodging Business Improvement District (CTBID), Fixing the Time and Place of a Public Meeting and Public Hearing Thereon and Giving Notice Thereof." (b) Said Resolution No. 2012-221 was published and copies thereof were duly mailed and posted, all as provided by said law and said Resolution No. 2012-221. (c) Pursuant to said Resolution No. 2012-221, a public meeting concerning the formation of said district was held before the City Council of the City of Carisbad on September 25, 2012 at six p.m. in the Council Chambers of the City Hall of the City of Carlsbad. (d) Pursuant to said Resolution No. 2012-221, a public hearing concerning the formation of said district was held before the City Council ofthe City of Carisbad on November 6, 2012 at six p.m. in the Council Chambers ofthe City Hall ofthe City of Carlsbad. (e) All written and oral protests made or filed were duly heard; evidence for and against the proposed action was received; a full, fair and complete hearing was granted and held. (f) The City Council determined that there was no majority protest within the meaning of Section 36525 of the law. (g) Following such hearing, the City Council hereby finds that the Carisbad hotels opting in to the district, in the opinion ofthe City Council, will be benefited by the expenditures of funds raised by the assessment or charges proposed to be levied hereunder. 3.38.030 - Establishing the Carlsbad Golf Lodging Business Improvement District. Pursuant to said law, the Carisbad Golf Lodging Business Improvement District (CGLBID) is hereby established in the City of Carlsbad as herein set forth and hotel businesses that elect to be part of the district established by this chapter shall be subject to any amendments made hereafter to said law or to other applicable laws. The initial members of the advisory board shall be set forth in a separate resolution adopted by the City Council. 3.38.040 - Boundaries. The boundaries of the CGLBID shall be the boundaries of the City of Carlsbad as shown on the attached map labeled Exhibit A and found on file in the City clerk's office. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3.38.050 - Lew and Collection of Assessments. The CGLBID members will include all lodging businesses within the City of Carisbad that have elected to be part of the district. Businesses may elect to participate in the district by submitting a written letter to the City requesting inclusion no later than May 1 for the following fiscal year. Once a lodging business has submitted a signed request to be included, the assessment shall be mandatory. Participating businesses will be listed in the annual report submitted to the City. The assessment shall be levied on these hotel businesses that have elected to be part of the district for that fiscal year, within the City of Carisbad based upon a flat fee of two dollars per occupied room per night for all transient occupancies as defined in Section 3.12.020(7) ofthe Carisbad Municipal Code. The amount of the assessment shall be separately stated from the amount of the rent and other taxes charged, and each transient shall receive a receipt for payment from the operator. The assessment will be collected monthly, based on two dollars per occupied room per night in revenues for the previous month. New hotel businesses within the boundaries ofthe district opening during the term of the district will receive notice of the opportunity to be included at least 30 days prior to the annual hearing. Assessments pursuant to the CGLBID shall not be included in gross room rental revenue for purpose of determining the amount of the transient occupancy tax. No assessment shall be imposed upon occupancies of any federal or state of California officer or employee when on official business nor on occupancies of any officer or employee of a foreign government who is exempt by reason of express provision of federal law or international treaty. 3.38.055 - Refund of Assessments. (a) When not othen/vise prohibited by law, the CGLBID Advisory Board may authorize a refund in any amount for assessment monies that were erroneously paid to or collected by, but not actually due to the CTBID at the time the funds were received, such as overpayments or duplicate payments. (b) A written request for refund, signed by the person paying the fee shall be filed with the City of Carisbad Finance Director (Finance Director) setting forth the facts and reasons which justify the request. (c) The Finance Director shall investigate the request and fonA^ard the request and his/her recommendation to the CGLBID Advisory Board. (d) The CGLBID Advisory Board shall make written findings that supports the authorization for refund and shall send to the City of Carisbad City Manager regular reports of assessments refunds exceeding ten thousand dollars. (e) Upon receipt of proper authorization, the Finance Director shall make the assessment refund. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (f) All requests for refund of assessments fees paid in error shall be made within one (1) year ofthe date in which the assessment payment made in error was posted to the CGLBID account. 3.38.060 - Ordering the collection of assessments. The City Council hereby levies and imposes and orders the collection of an additional assessment to be imposed upon persons occupying hotel business premises in the proposed district described above, which shall be calculated pursuant to Section 3.38.050 above. Such levy shall begin on January 1, 2013. 3.38.070 - Use of proceeds from assessments. The proceeds of the additional hotel business assessment shall be used to promote golf-related tourism within the boundaries ofthe CGLBID, as well as marketing related capital improvements such as golf-related signage, golf related equipment and to pay for related administrative costs. Funds remaining at the end of any CGLBID term may be used in subsequent years in which CGLBID assessments are levied as long as they are used consistent with the requirements of this section. The City Council ofthe City of Carisbad shall consider recommendations as to the use of said revenue made by the advisory board created by Section 3.38.100 of this chapter. 3.38.080 - Penaltv for nonpayment of assessment. Any hotel business that fails to remit any assessment imposed by this chapter within the time required shall pay a penalty often percent ofthe amount ofthe assessment in addition to the amount of the assessment. Any hotel business that fails to remit any delinquent remittance on or before a period of thirty days following the date on which the remittance first became delinquent shall pay a second delinquency penalty often percent ofthe amount ofthe assessment and the ten-percent penalty first imposed. In addition to the penalties imposed, any hotel business that fails to remit any assessment imposed by this chapter shall pay interest at the rate of one and one-half percent per month or fraction thereof on the amount of the assessment, exclusive of penalties, from the date on which the remittance first became delinquent until paid. 3.38.090 - Assessments to be used within the district. The improvements and activities to be provided in the CGLBID will be funded by the levy of the assessments. The revenue from the levy of assessments within the CTBID shall not be used to provide improvements or activities outside the CGLBID or for any purpose other than the purposes specified in the resolution of intention. 3.38.100 - Advisorv board. The advisory board for the district is hereby created pursuant to Section 36530 of the law. The initial members and the powers and duties ofthe advisory board shall 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 be set forth in a separate resolution adopted by the City Council. It shall be the purpose of the advisory board to make recommendations to the City Council on expenditures for the programs and activities of the CGLBID, to make recommendations for its annual budget to be approved by the City Council, and to provide end-of-year financial reports ofthe CGLBID operations as required by the City Council. The city attorney shall serve as the general counsel of the advisory board. 3.38.110 - Severabiiitv. If any section, subsection, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity ofthe remaining portions of the chapter. You are receiving this letter because your business is eligible to choose to be included in the proposed district. Participation in this new district is voluntarily, and will not impact the existing Carisbad Tourism Business Improvement District (TBID). However, you will be required to pay the assessments as explained below once you join and the district is approved. The proposed district would raise funds for golf-related marketing efforts to drive room night sales associated with overnight golf course visitation. The authorized expenditures would be limited to: joint web, radio, print and television marketing of hotels and golf courses; golf-related equipment specifically used to promote overnight visitation; promotional signage; and other items specifically designed to drive golf-related overnight stays and other golf-related expenditures approved by the City Council or the District Board. The new district would operate much like the current TBID, but would not impact the existing district. Businesses which voluntarily elect to participate in this new district would be assessed at a rate of $2.00 per occupied paid room per night, which may be passed on to the guest at the hotel's discretion. The assessment would be collected by the City and overseen by an advisory board including representatives from lodging and golf businesses. Voluntarily participating businesses would submit golf-marketing-related expenditures to the advisory board for review, which expenditures would ultimately be approved by the City Council. Businesses not participating in the district would not be eligible to participate in or benefit from the marketing programs. That is to say, the boundaries ofthe district will be city-wide but only those hotels that have elected to join will participate. The district will be implemented for a one-year term. Businesses voluntarily choosing to participate will be included for two years. Thereafter, the district must be renewed and businesses will have a chance to again voluntarily opt in or out should the district be renewed. The initial two years ofthe District are intended to be a pilot program; after two years the district assessment and parameters will be re-evaluated for effectiveness. Dated at Escondido, California On This 26*^ dav^eptember 2012 Jane Allshouse NORTH COUNTY TIMES Legal Advertising Carlsbad Golf Lodging Business Improvement District (CGLBID) Public Hearing November 6, 2012 CGLBID Hearing Process •Resolution of Intention - Sept 11, 2012 •Public Meeting – September 25, 2012 •Public Hearing – TONIGHT –Hold Hearing –Consider Protests –Introduce Ordinance • Adoption of Ordinance & Appoint Advisory Board– Nov 27, 2012 •Effective date of CGLBID – Jan 1, 2013 •First CGLBID payments due with TOT reports filed by the end of February 2013 2 Carlsbad Golf Lodging Business Improvement District •Special assessment used to promote golf related overnight stays in Carlsbad. – Lodging businesses voluntarily. –Assessment is going to be $2.00 per occupied room night. –Three member Advisory Board. –District pays for administrative costs - 4% of assessment collected. 3 Continued: CGLBID –Funds collected/distributed separately for each participating business. –Funds to be reimbursed to lodging businesses are based on eligible expenditures. –Reimbursement on a quarterly basis subject to Advisory Board approval. –Annual renewal/2 year pilot. –Funds remaining at end of year carry over to next year. 4 CGLBID Assessment Area •All hotels in City of Carlsbad were invited to join the district •Hotels requesting to opt in –Grand Pacific Palisades –Sheraton Carlsbad –Park Hyatt Aviara 5 CGLBID Advisory Board •Appointed by the City Council •Advises Council on all issues related to the CGLBID –Submits Annual Report to City Council –Submits Annual Budget to City Council –Proposes any changes to the boundaries, assessment formulae, activities, etc.… –General Oversight of the CGLBID operations CGLBID Public Hearing •Hold public hearing •Upon close of the public hearing, Council may revise the CGLBID as allowed by law •Call for written protests to be filed with the City Clerk •Direct Clerk to count protests and report CGLBID Public Hearing •If protests represent less than 50% of the total properties (based on annual assessment value) proceed with the CGLBID formation –Introduce ordinance forming the CGLBID •If protests represent 50% or more, halt the proceedings, and take no further action for a minimum of one year Carlsbad Golf Lodging Business Improvement District (CGLBID) - Public Hearing 9
