RECOMMENDED ACTION:
Adopt Ordinance No. CS-195. amending Chapter 1.20 of the Carlsbad Municipal Code
regarding regular and special City Council meetings and requirements for posting agendas.
ITEM EXPLANATION:
Ordinance No. CS-195 was introduced and first read at the City Council meeting held on
November 27, 2012. The second reading allows the City Council to adopt the ordinance which
will become effective thirty days after adoption. The City Clerk will have the ordinance
published within fifteen days, if adopted.
FISCAL IMPACT:
See AB #21,055 on file in the Office of the City Clerk.
ENVIRONMENTAL IMPACT:
The proposed amendments are exempt from environmental review pursuant to CEQA Section
15061(b)(3), which exempts project "where it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment." The
changes proposed by the project are primarily procedural in nature and are not substantial and
will not significantly affect existing development standards in the Subdivision Ordinance;
therefore, the project will not result in a significant effect on the environment. A Notice of
Exemption will be filed.

ORDINANCE NO. cs-195
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING CHAPTER 1.20 OF
THE CARLSBAD MUNICIPAL CODE REGARDING REGULAR
MEETINGS
NOW, THEREFORE, the City Council of the City of Carlsbad ordains as
follows:
SECTION 1: That section 1.20.010 of the Carlsbad Municipal Code is
amended to read as follows:
1.20.010 - Regular meetings.
The city council shall hold regular meetings on the dates and times specified by
resolution of the city council. If by reason of fire, flood or other emergency, it is
unsafe to meet in the council chambers, the meetings may be held for the duration
of the emergency at such other place as is designated by the mayor, or, if he
should fail to act, by three members of the city council. When the day for any
regular meeting falls on a legal holiday, such meeting shall be held at the same
hour and place on the next succeeding day not a holiday or such other time as
designated by the city council.
SECTION 2: That section 1.20.020 ofthe Carlsbad Municipal Code is
amended to read as follows:
1.20.020 - Special meetings.
Special meetings may be called at any time by the mayor or three members ofthe
city council by delivering personally or by mail, facsimile, or electronic mail, written
notice to each council member and to each local newspaper of general circulation,
radio or television station having filed written request for such notice. Such notice
must be delivered personally, or by mail, facsimile, or electronic mail, at least
twenty-four hours before the time of such meeting as specified in the notice. The
notice of the special meeting shall also be placed on the city's website. The call and
notice shall specify the time and place of the special meeting and the business to
be transacted. No other business shall be considered at such meetings. Such
written notice may be dispensed with as to any council member who at or prior to
the time the meeting convenes files with the city clerk a written waiver of notice.
Such waiver may be given by telegram, facsimile, or electronic mail. Such written
notice may also be dispensed with as to any council member who is actually

present at the time it convenes. The call and notice shall be posted at least twenty-
four hours prior to the special meeting on the council chambers door.
SECTION 3: That section 1.20.060(f) ofthe Carlsbad Municipal Code
is amended to read as follows:
1.20.060 - Council agenda.
(f) At least 72 hours before a regular meeting, the city clerk shall post an agenda
containing a brief general description of each item of business to be transacted or
discussed at the meeting, including items to be discussed in closed session. A brief
general description of an item generally need not exceed 20 words. The agenda
shall specify the time and location ofthe regular meeting and shall be posted at City
Hall and at the meeting place if not City Hall. The agenda shall also be placed on
the city's website. The city clerk shall prepare and file a signed declaration of the
time and place of posting and a certified copy of the posted agenda. Except as
provided in subsection (h) of this secfion no business shall be transacted or
discussed at the meefing on any item not appearing on the posted agenda. A
direction of the mayor with the consent of the council to refer a matter raised by a
member of the public to staff for a report or to place a matter on a future agenda
shall not constitute acfion.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adopfion; and the city clerk shall certify the adopfion of this ordinance and cause it to
be published at least once in a newspaper of general circulation in the City of
Carlsbad within fifteen days after its adoption.

INTRODUCED AND FIRST READ at a regular meefing ofthe Carlsbad City
Council on the 27*^ day of November, 2012, and thereafter
PASSED AND ADOPTED at a regular meefing of the City Council of the
City of Carlsbad on the 4^^ day of December, 2012, by the following vote, to wit:
AYES: Council Members Hall, Kulchin, Blackburn, Douglas and Packard.
NOES: None.
