RECOMMENDED ACTION:
Adopt Resolufion No.^^22l^,^appoinfing Jane Mobaldi as the interim City Attorney.
ITEM EXPLANATION:
The City Attorney has announced his refirement effective December 31, 2012 and will not be
further returning to his office. In the interim it is recommended that Assistant City Attorney Jane
Mobaldi be appointed until a successor City Attorney is appointed.
FISCAL IMPACT:
The fiscal impact for this acfion is unknown. The salary for the interim City Attorney will not be
modified until fuilher resolufion of the City Council.
ENVIRONMENTAL IMPACT:
The proposed acfion does not qualify as a "project" under the California Environmental
Quality Act (CEQA) per State CEQA Guidelines Secfion 15378 as it does not result in a
direct or reasonably foreseeable indirect physical change in the environment.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPOINTING AN INTERIM
3 CITY ATTORNEY
WHEREAS, THE City Attorney has announced his intention to refire as of
6 December 31, 2012; and
7 WHEREAS, he will not return to the work place; and
8 WHEREAS, Assistant City Attorney Jane Mobaldi has the skills, knowledge and
^ ability to serve as the interim City Attorney until a successor City Attorney is appointed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

Carlsbad, California, as follows:

1. That the above recitations are true and correct.

j4 2. That Jane Mobaldi is appointed interim City Attorney until a successor City
15 Attorney is appointed.
16 3. Her bi-weekly salary shall not be modified until further resolufion of the City
Council.
