CLERK CITY MGR. /rT^ RECOMMENDED ACTION: Adopt Resolution No. 201'^-fi-'^o appointing a qualified candidate and registered voter of Carlsbad to the office of City Clerk to fill a temn expiring in November, 2014. ITEM EXPLANATION: A vacancy in the office of City Clerk was created by the election of the former City Clerk to a posifion on the City Council, effective, December 11, 2012. The vacated term expires in November, 2014. In accordance with state law and Carlsbad Municipal Code Section 2.08.032, qualified candidates must meet the following requirements: • Must be at least 18 years of age, reside within the corporate limits of the City of Carlsbad, and be registered to vote in the City of Carlsbad at the time the application is issued; and • Must have obtained the designation of Certified Municipal Clerk (CMC) from the International Institute of Municipal Clerks; or • Must possess a bachelor's degree from an accredited college or university and have 2 years of full-time, salaried experience in either business or public administration. Qualifications of the candidates have been reviewed and verified by staff as shown on Exhibit 1 In accordance with local and state law, the City Council must either appoint a successor to fill the unexpired term or call for a special election within 60 days after the commencement of the vacancy. (Carlsbad Municipal Code Section 2.04.030 and California Government Code Section 36512) The person appointed by the City Council to fill the vacancy will serve the remainder of the tenn of the former City Clerk, until a successor is certified to take office. Januzzi Yes No Yes Yes Exhibit 2 1 RESOLUTION NO^ 2013-030 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPOINTING A 3 RESIDENT AND REGISTERED VOTER TO FILL THE UNEXPIRED TERM OF CITY CLERK. 4 5 6 WHEREAS, a vacancy in the office of City Cleric was created by the election of 7 the former City Cleric to a position on the City Council, effective December 11, 2012; and 8 WHEREAS, the vacant term expires in November, 2014; and ^ WHEREAS, any person holding the office of City Cleric must be a resident and registered voter of Carisbad and hold either Certification from the International Institute of Municipal Clerks, or a Bachelor's degree and a minimum of two years of work experience in either business or public administration; and WHEREAS, Carisbad Municipal Code Section 2.04.030 requires that the City Council must either appoint a qualified candidate and registered voter of the City of 10 11 12 13 14 15 Carisbad to fill the vacancy or call for a special election within sixty days; and 17 WHEREAS, the City Council has decided to fill the vacancy by appointment; and 18 WHEREAS, the appointee will serve the balance of the unexpired temn of the former City Clerk until a successor is elected at the regular Municipal Election to be held on November 4, 2014. NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Carisbad, California, as follows: 1.
