RECOMMENDED ACTION:
Adopt Resolution No2013-036 setting the compensation structure for the Community
Development Commission and amend the Local Conflict of Interest Code to change references
from the Housing and Redevelopment Commission to the Community Development
Commission.
ITEM EXPLANATION:
With the passage of ABxl 26, effective June 27, 2012, all redevelopment agencies in the State
of California were dissolved and consequently the City of Carlsbad Redevelopment Agency is
no longer a legal entity. Likewise there is no longer a governing body known as the
Redevelopment Commission for the dissolved Redevelopment Agency.
At its January 29, 2013 meeting, the City Council adopted Ordinance No. CS-199 renaming the
Housing and Redevelopment Commission to the Community Development Commission and
amended Carlsbad Municipal Code sections referencing the Housing and Redevelopment
Commission accordingly. The Community Development Commission shall retain the functions
of the former Housing and Redevelopment Commission with regard to housing and acting upon
recommendations of the Housing Commission pursuant to Carlsbad Municipal Code Title 2,
Chapter 2.40.010. The Community Development Commission Board shall continue to be the
City Council Members. The compensation for the Community Development Commission will be
set at $75 per meeting for a maximum of two meetings per month (Health & Safety Code §
34130.5).
The Political Reform Act requires an amendment to the City's Local Conflict of Interest Code.
The amended local Conflict of Interest Code is attached and board members of the Community
Development Commission will report in all four categories.

FISCAL IMPACT:
There is a minor savings to the City in compensation to board members for meetings.
ENVIRONMENTAL IMPACT:
The proposed action does not qualify as a "project" under the Califomia Environmental
Quality Act (CEQA) per State CEQA Guidelines Section 15378 as it does not result in a
direct or reasonably foreseeable indirect physical change in the environment.

A RESOULTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SETTING THE COMPENSATION
STRUCTURE FOR THE COMMUNITY DEVELOPMENT
COMMISSION AND AMEND THE LOCAL CONFLICT OF
INTEREST CODE TO CHANGE REFERENCE FROM THE
HOUSING AND REDEVELOPMENT COMMISSION TO THE
COMMUNITY DEVELOPMENT COMMISSION
WHEREAS, the passage of ABx1 26 on June 27, 2012, dissolved all
redevelopment agencies in the State of California; and
WHEREAS, at its January 29, 2013 meeting, the City Council adopted
Ordinance CS-199 renaming the Housing and Redevelopment Commission to the
Community Development Commission; and
WHEREAS, the Community Development Commission shall retain the
functions of the former Housing and Redevelopment Commission with regard to
housing and acting upon recommendations of the Housing Commission pursuant to
CMC 2.40.010; and
WHEREAS, the Community Development Commission shall continue
to be the City Council Members and the compensation for its meetings will be set at
$75 per meeting for a maximum of two meetings a month pursuant to Health &
Safety Code §34130.5.
NOW, THEREFORE, the City Council of the City of Carlsbad ordains
as follows:
SECTION I: That the above recitations are true and correct.
SECTION ll: That the Housing and Redevelopment Commission is
hereby renamed the Community Development Commission which shall have the

same duties and perfonn the same functions as the former Housing and
Redevelopment Commission with regard to housing; and
SECTION til: That the City Council designates itself as the Community
Development Commission board members.
SECTION IV: Pursuant to Health & Safety Code § 34130.5, compensation
for the Community Development Commission will be set at $75 per meeting for a
maximum of two meetings per month; and
SECTION IV: The Local Conflict of Interest Code has been amended to
change references from the Housing and Redevelopment Commission to the
Community Development Commission.
