RECOMMENDED ACTION:
Adopt Resolution 2013-038 authorizing the City Clerk to advertise and receive applications for
the position of City Treasurer and authorizing the Deputy City Treasurer to fulfill the duties of
the City Treasurer until the vacancy is filled by appointment or special election.
ITEM EXPLANATION:
Due to the resignation ofthe City Treasurer, Jim Comstock, effective January 30, 2013, there is
now a vacancy in office. The term of that office was due to expire in November 2014.
According to Carlsbad Municipal Code §2.04.030, the City Council may either appoint someone
to fill the position within 60 days of January 30, 2013, the effective date of the vacancy, or call a
special election to fill the vacancy. If the City Council elects to fill the position by appointment,
the person appointed by the City Council to fill the vacancy will serve the remainder of the term
of the former City Treasurer, until a successor is certified to take office. If a successor is not
appointed by March 31, 2013, the Council would be required by law to call a special election to
be held on the next regularly established election date not less than 114 days from the call of
the special election which would be June 3, 2014.
The proposed resolution is modeled after the process the City Council followed recently to fill
the vacant City Clerk position and would request applications from candidates interested in
serving as City Treasurer and schedule a date for public presentations by those candidates.
The City Council may then appoint one of those candidates as City Treasurer. Alternatively, the
City Council could give direction to staff to follow a different process. If no appointment is
made, the matter would go to a special election.
Carlsbad Municipal Code §2.08.022 sets forth the minimum qualifications for the City Treasurer
as follows:
"No person is eligible to become a candidate for the office of city treasurer unless, at the time
of the final filing date for election, he or she has a four-year college degree in finance or
business related field and four years of financial work experience."
The City Treasurer receives a salary of $1,070.00 per month plus an automobile allowance.

FISCAL IMPACT:
Adoption of this ordinance would allow the City Council to appoint a qualified applicant to the
position of City Treasurer and avoid the expense of holding a special election which is
estimated to cost between $400,000 and $500,000.
ENVIRONMENTAL IMPACT:
The requested action is not a "project" within the definition of California Code of Regulations.
Title 14. Chapter 3. Section 15378(a) since the action has no potential for resulting in either a
direct change in the environment or a reasonably foreseeable indirect change in the
environment.

7 WHEREAS, due to the resignation of City Treasurer Jim Comstock a

WHEREAS, the term of office in which said vacancy was created is due to
expire in November 2014;
WHEREAS, Carlsbad Municipal Code section 2.04.030 provides that the
City Council may appoint a City Treasurer to serve the remainder of the unexpired term
within 60 days of the effective date of the vacancy; and

17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
18 Carlsbad, California, as follows:

1. That the above recitations are true and correct.

2. That the City Clerk is authorized to advertise and receive applications for

the position of City Treasurer.
23 3. That qualified applicants for the position of City Treasurer shall be invited
24 to make a five minute presentation before the City Council on March 12. 2013.
25 4. That the Deputy City Treasurer is hereby authorized to perform any duties
normally performed by the City Treasurer until a City Treasurer is either appointed by

the City Council or elected in a special election and sworn into office.
