DEPT. HR CITY MGR. RECOMMENDED ACTION: 2013-053 Adopt Resolution No. " establishing interim compensation for the Deputy City Treasurer while she is acting City Treasurer. ITEM EXPLANATION: Due to the sudden resignation of the City Treasurer Jim Comstock on January 30, 2013, the City Council declared a vacancy and approved Resolution No. 2013-038 authorizing the Deputy City Treasurer to fulfill the duties of the City Treasurer until the vacancy is filled by appointment or special election. Sections 41006 and 41007 ofthe Government Code provide that the City Treasurer may appoint deputies, and that these deputies shall receive compensation as is provided by the legislative body. City employee Nancy Sullivan was initially appointed as Deputy City Treasurer in November 2004 by City Treasurer Jim Stanton, and the City Council confirmed her status as Deputy City Treasurer on July 27, 2010. Section 2.08.020 of the Carlsbad Municipal Code sets the compensation of the City Treasurer at $1,070 per month. Because Ms. Sullivan is currently performing duties normally performed by the City Treasurer, it is recommended that she receive compensation in an amount equivalent to the salary ofthe City Treasurer during the period of time that she is serving as the City Treasurer. It is proposed that the City Council approve this salary retroactive to the first day of the pay period that includes January 31, 2013 and be discontinued as ofthe date a new City Treasurer is sworn into office. FISCAL IMPACT: The cost ofthis temporary salary is estimated to be $2,470. Sufficient funds are available in the City Treasurer's budget to cover this expense and there is no net increase in cost to the City as offsetting savings are realized for the City Treasurer vacancy. ENVIRONMENTAL IMPACT: This amendment is not a "project" within the meaning of CEQA pursuant to Public Resources Code Section 21065 since it is not an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.
