FISCAL YEARS 2012-13 THROUGH 2016-17 CITY MANAGER
RECOMMENDED ACTION:
Adopt Resolution No. 2013-079 approving administrative amendments to the Carlsbad
TransNet Local Street Improvement Program of Projects for Fiscal Years 2012-13 through 2016-17.
ITEM EXPLANATION:
The 2012 Regional Transportation Improvement Program (RTIP) is a program of proposed highway,
arterial, transit, and bikeway projects for Fiscal Years 2012-13 through 2016-17. The San Diego
Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt
the RTIP every two years. The RTIP can be revised, as needed, on a quarterly basis during the two
year period between the adoption of the 2012 RTIP and the subsequent 2014 RTIP. SANDAG is
currently processing Amendment No. 5 to the 2012 RTIP.
Three administrative amendments to the Carlsbad Program of Projects relating to the TransNet Local
source of funding are required at this time. TransNet Local funds are programmed for a variety of
projects including bridge improvement, roadway improvement and roadway maintenance projects.
The administrative amendments will adjust the funding source of the local matching funds for two
bridge railing projects along Carlsbad Boulevard. The bridges are located across the warm water
outfall channel from the Encina power station and over the railroad just south of State Street. The
administrative amendments will also reprogram remaining funds from a completed project to the
ongoing Pavement Management Program.
The amendments to the Carlsbad Program of Projects will then be incorporated into the 2012 RTIP
as amended and assembled by SANDAG which is then submitted to the State.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA
Guidelines Section 15276 - which states that CEQA does not apply to the development or adoption
of regional transportation improvement programs; however, individual projects developed pursuant to
these programs shall remain subject to CEQA.
FISCAL IMPACT:
The city is proposing two types of administrative amendments during Amendment No. 5 ofthe 2012
RTIP:
1. Funding source changes
2. Fund transfers. The table on the following page outlines the proposed funding source
changes.

2. TransNet-L (Cash) is TransNet Local funding that has been distributed from SANDAG to the City and Is referred to as Cash.
3. TransNet-LSI is TransNet Local System Improvement funding.
The funding source changes represent adjustments from the Fiscal Year 2011-12 TransNet audit.
These changes will allow the City to draw down funds from SANDAG as needed and in compliance
with SANDAG Board Policy No. 31, Rule #17, Section IV. The table below outlines the proposed fund
transfers.

The fund transfer from Project 3557 represents the transfer of a closed project's remaining balance.
Additionally, the funding source is being changed from TransNet-L(Cash) to TransNet-LSI. The
funding source change will allow the City to draw down funds from SANDAG as needed and in
compliance with SANDAG Board Policy No. 31, Rule #17, Section IV.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING ADMINISTRATIVE
AMENDMENTS TO THE CARLSBAD TRANSNET LOCAL
4 STREET IMPROVEMENT PROGRAM OF PROJECTS FOR
FISCAL YEARS 2012-13 THROUGH 2016-17.

6 WHEREAS, on November 4, 2004, the voters of San Diego County approved the
7 San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
8 Extension Ordinance); and
9 WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
10 Regional Transportation Commission, shall approve a multi-year program of projects submitted
11 by local jurisdictions identifying those transportation projects eligible to use transportation sales
12 tax (TransNet) funds; and
13 WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
14 improvement revenues for Fiscal Years 2012-13 through 2016-17; and
15 WHEREAS, the City of Carlsbad has held a clearly noticed public meeting with an
1^ agenda item that clearly identified the proposed list of projects prior to approval of the projects
1^ by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension
1^ Ordinance and Rule 7 ofthe SANDAG Board Policy 31.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:
21 1. That the above recitations are true and correct.
22 2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds
shall be spent on maintenance related projects.
3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet
revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this

1 requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the
2 City of Carlsbad's public hearing process.
3 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
4 Carlsbad certifies that the required minimum annual level of local discretionary funds to be
5 expended for street and road purposes will be met throughout the 5-year period consistent with
6 the most recent Maintenance of Effort Requirements adopted by SANDAG.
7 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
8 Carlsbad certifies that it will extract $2,000, plus all applicable annual increases, from the private
9 sector for each newly constructed residential housing unit in the City of Carlsbad to comply with
10 the provisions of the Regional Transportation Congestion Improvement Program (RTCIP).
11 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of
12 Carlsbad certifies that is has established a separate Transportation Improvement Account for
13 TransNet Revenue with interest earned expended only for those purposes for which the funds
14 were allocated.
15 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of
1^ Carlsbad certifies that each project of $250,000 or more will be clearly designated during
^ ^ construction with TransNet project funding identification signs.
1^ 8. That the City of Carlsbad does hereby certify that all other applicable provisions of
the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met.
20 9 That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG,
the San Diego County Regional Transportation Commission, and all officers and employees
thereof against all causes of action or claims related to local TransNet funded projects.
