DIRECTOR CITY ATTY. CITY MGR. RECOMMENDED ACTION: Introduce Ordinance No. Committee as a public meeting. CS-214 to remove references to the Traffic Safety Coordinating ITEM EXPLANATION; The Traffic Safety Coordinating Committee was established in 1983 to coordinate traffic safety issues with the appropriate city staff before making formal recommendations to the Traffic Safety Commission. As a committee formally described by the municipal code, it is subject to the provisions of the Brown Act. As the Transportation Department continues to explore ways to provide the best value of services to the people of Carlsbad, staff proposes to maximize staff efficiency by removing the public meeting requirements of the Traffic Safety Coordinating Committee and re-purposing the committee as a staff-level meeting as originally intended. The Traffic Safety Commission will continue to serve as the public forum in which matters of traffic safety can be discussed prior to items being taken to City Council. Since its inception in 1983, there has only been a single instance of a member of the general public ever attending the Traffic Safety Coordinating Committee. The City of Carlsbad Transportation Department Operational Assessment that was conducted by Baker Tilley Virchow Krause, LLP identified this proposed change as an opportunity to increase operational efficiency and reduce operational costs. The report recommends that the Traffic Safety Coordinating Committee be changed to a staff-only meeting and removing the public notification, recordation of minutes and other statutory requirements of a Brown Act meeting, thereby saving the city approximately 4 to 8 hours of staff time each month. FISCAL IMPACT: Changing the Traffic Safety Coordinating Committee to a staff-only meeting will eliminate approximately 4-8 hours of staff time currently required, which could be reallocated to higher priority work. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code Section 21065, removing references to the Traffic Safety Coordinating Committee as a public meeting does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. CS-214 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER 2.28 OF THE CARLSBAD MUNICIPAL CODE TO REMOVE REFERENCES TO THE TRAFFIC SAFETY COORDINATING COMMITTEE AS A PUBLIC MEETING WHEREAS, the City Council of the City of Carlsbad, California, hereby ordains as follows: That Title 2, Chapter 2.28 of the Carlsbad Municipal Code is amended by the revision of Chapter 2.28 to read as follows: "2.28.010-Created. A traffic safety commission for the city is created. 2.28.20 - Membership - Appointment - Terms. The traffic safety commission shall consist of five members appointed by the mayor and confirmed by the city council. Each member shall serve until their successor is duly appointed. The members shall serve staggered terms at least two years apart. In order to stagger the terms, upon the next appointment of commission members after the effective date of the ordinance from which this section derives, two members will be appointed for terms expiring two-years thereafter and three members will be appointed for terms expiring four-years thereafter. All subsequent appointments will be for four-year terms. Members of the commission may be removed by the mayor with the consent of the city council at any time. The transportation director shall be an ex officio member and serve as secretary to the commission. The ex officio member shall not be entitled to vote. 2.28.040 - Officers - Meetings - Reports - Conduct of meetings. The commission shall elect a chairman, a vice chairman, and such other officers as it deems desirable. The officers shall serve for a term of one year and until the election of successors. The commission shall hold meetings no less than once during each calendar month (provided agenda items exist), and shall send a report of each month's meeting to the city council. The commission may adopt its own rules and regulations. 2.28.050-Duties.
