RECOMMENDED ACTION:
Adopt Resolution No. 2013-114 accepting bids and awarding the contract to S&B Engineering
Inc. and appropriation of funds for the MUTCD Street Name Sign Replacement Program, Project No.
6035.
ITEM EXPLANATION:
On July 24, 2012, through Resolution Number 2012-187, Agenda Bill 20,973, Council approved the
plans and specifications and authorized the advertisement for bids for the MUTCD Street Name Sign
Replacement Program, Project No. 6035. On February 7, 2013, six (6) sealed bids were received,
opened and witnessed for the construction of the project.

After city staff completed a review of the bids for compliance with the contract documents, it was
determined that the bid submitted by the apparent low bidder. Sign Excellence, was non-responsive.
The bid was deemed non-responsive because it did not include a valid bidder's bond as required by
California law. On March 6, 2013 staff notified Sign Excellence and S&B Engineering of staffs intent to
recommend rejection of the bid provided by Sign Excellence and award of the contract to S&B
Engineering.
The Engineer's estimate for this project was $578,000. All bid documents submitted by S&B
Engineering, Inc. have been reviewed by staff and were found to be in order. Staff recommends
awarding the construction contract to S&B Engineering, Inc. in the amount of $637,659.00.

ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines
Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and similar
facilities involving negligible or no expansion.
FISCAL IMPACT:
Table 1 shows the current status of the MUTCD Street Name Sign Replacement Program.

The total estimated project cost is shown in Table 2.

The city appropriated $485,000 for this project through the Capital Improvement Program based on an
estimated construction cost for replacing all ground mounted street name signs, Schedule "A" of the
subject contract.
Schedule "B" was included as a bid item in the contract to allow the city the option to replace the
remaining signal mounted internally illuminated street name signs at the same time that the ground
mounted street name signs are replaced.

Staff recommends appropriating an additional $271,187 to the project and awarding the contract,
Schedule "A" and Schedule "B", for the construction of the MUTCD Street Name Sign Replacement
Program, Project No. 6035. Sufficient funds are available in the Gas Tax Fund for this appropriation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
THE CONTRACT TO S&B ENGINEERING INC., AND
4 APPROPRIATION OF FUNDS FOR THE MUTCD STREET
NAME SIGN REPLACEMENT PROGRAM, PROJECT NO. 6035.

6 WHEREAS, the City Council of the City of Carlsbad, California, has determined it
7 necessary, desirable, and in the public interest to construct the MUTCD Street Name Sign
8 Replacement Program, Project No. 6035;
9 WHEREAS, on July 24, 2012, the City Council of the City of Carlsbad, through
10 Resolution No. 2012-187, approved the plans and authorized to advertise for bids to construct the
11 MUTCD Street Name Sign Replacement Program, Project No. 6035; and
12 WHEREAS, six (6) sealed bids were received on February 7, 2013, by the City of
13 Carlsbad for the construction of said project; and
14 WHEREAS, the lowest bidder. Sign Excellence, did not present a valid bid bond as
15 required by law; and
16 WHEREAS, the lowest responsive bid was submitted by S&B Engineering, Inc. in the
17 amount of $637,659; and
18 WHEREAS, additional funding for in the amount of $271,187 is needed to cover all
19 project costs; and
20 WHEREAS, sufficient funding for said project is available in the Gas Tax Fund.
21 WHEREAS, Section 3.28.040 (c)(5) of the Carlsbad Municipal Code authorizes the City
22 Manager to approve change orders in the amount equal to the contingency set at the time of
23 project award.
24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
25 California, as follows:
26 1 • That the above recitations are true and correct.

2. That the low bid by Sign Excellence is rejected as it was not accompanied by a
valid Bid Bond.
3. That the low bid of $637,659 submitted by S&B Engineering, Inc. for the
construction of the MUTCD Street Name Sign Replacement Program, Project No. 6035, is
accepted and the Mayor is hereby authorized to execute a contract with S&B Engineering, Inc. for
said project
4. That the City Manager is hereby authorized to approve construction change
orders up to $63,766.
5. That the Administrative Services Director is authorized to appropriate $271,187
from the Gas Tax Fund towards the MUTCD Street Name Sign Replacement Program, Project No.
6035.
6. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The City Manager may grant reasonable extensions of time.
