RECOMMENDED ACTION:
City Council of the City of Cartsbad adopt Resolution No. 7013-144 to reimburse the Cartsbad
Municipal Water District (CMWD) for the actual costs for city project improvements for the Park Drive
Water Pipeline Replacement, Surface Improvements, Northwest Quadrant Storm Drain Program and
Concrete Repair Program, Project No's. 5030, 6608 and 6013.
Board of Directors of Carlsbad Municipal Water District adopt Resolution No. 1472 awarding
the contract for the Park Drive Water Pipeline Replacement, Surface Improvements, Northwest Quadrant
storm Drain Program and Concrete Repair Program, Project No's. 5030, 6608 and 6013.
ITEM EXPLANATION:
The project is located on Park Drive and extends from Adams Street to 200 feet southeriy of Cove Drive.
The project is the replacement of a potable water pipeline and roadway section that was damaged when
the potable water pipeline abruptly failed. Pipeline repairs include replacing the CMWD's existing 12-inch
diameter water pipeline in Park Drive. The City of Cartsbad's improvements include pavement repairs
requiring complete removal and replacement of the pavement section and the underlying subgrade,
construction of an 18-inch diameter storm drain pipeline, and sidewalk upgrades to bring the area into
compliance with the requirements of the Americans with Disabilities Act.
The water pipeline replacement and pavement repairs are funded through the Water-Capital
Replacement Program. The improvements made to the drainage system are funded by the Northwest
Quadrant Storm Drain Program. The sidewalk upgrades including pedestrian ramps are funded through
the Concrete Repair Program.
On January 8, 2013, the City Council adopted Resolution No. 2013-019 and the Board of Directors
adopted Resolution No. 1461, which approved the plans and specifications and authorized the
advertisement for bids for the Park Drive Water Pipeline Replacement, Surface Improvements,
Northwest Quadrant Storm Drain Program and Concrete Repair Program, Project No's. 5030, 6608 and
6013. Plans and Specifications are on file in the Engineering Division of the City of Cartsbad. On March 26,
2013, seven (7) sealed bids were received, opened and witnessed for the construction of this project as
shown in the following Table 1.

On April 23, 2013, Schilling Paradise, Inc. submitted a letter requesting to withdraw their bid because
they had bid an item incorrectly. Staff reviewed the bid documents and the support information
provided by the contractor and recommends that the Board not allow the bid to be withdrawn because:
• The error is not clerical in nature
• The CMWD was not informed of the error in the five (5) working day period provided by the Public
Contract Code.
staff recommends awarding the contract to the lowest responsive bidder. Schilling Paradise, Inc. for the
construction of Park Drive Water Pipeline Replacement, Surface Improvements, Northwest Quadrant
Storm Drain Program and Concrete Repair Program, Project No's. 5030, 6608 and 6013.
FISCAL IMPACT:
An Engineer's Estimate of the construction cost of Park Drive Water Pipeline Replacement, Surface
Improvements, Northwest Quadrant Storm Drain Program and Concrete Repair Program, Project No's.
5030, 6608 and 6013 was prepared by TY LIN on November 29, 2012, and totals $756,120. The
project's construction contract will be with CMWD. CMWD will be reimbursed by the City of Cartsbad
for the actual costs associated with the Northwest Quadrant Storm Drain Program and Concrete
Repair Program improvements. A summary of estimated construction costs and available funds is
shown in Table 2.

Sufficient funds have previously been appropriated from the Water - Capital Replacement and Gas Tax
Funds to fund this project. No additional appropriation is required.
CMWD's funding is subject to State restrictions regarding prevailing wage. Therefore, pursuant to
Carlsbad Municipal Code Section 3.28.130, prevailing wages are required for the construction of Park

and Concrete Repair Program, Project No's. 5030, 6608 and 6013.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15301(b) - minor alteration of existing facilities of public utility services involving negligible or no
expansion and Section 15302(c) - replacement or reconstruction of existing utility systems and/or
facilities involving negligible or no expansion of capacity.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, TO REIMBURSE THE CARLSBAD MUNICIPAL WATER
DISTRICT FOR THE ACTUAL COSTS FOR CITY PROJECT
IMPROVEMENTS FOR THE PARK DRIVE WATER PIPELINE
REPLACEMENT, SURFACE IMPROVEMENTS, NORTHWEST
QUADRANT STORM DRAIN PROGRAM AND CONCRETE REPAIR
PROGRAM. PROJECT NO'S. 5030. 6608 AND 6013.
WHEREAS, the City Council of the City of Carisbad, California, has determined it
necessary, desirable, and in the public interest to construct sidewalk, curb, gutter, storm drain
facilities, remove and replace potable water pipeline, and remove and replace damaged
pavement in Park Drive from Adams Street to 200 feet southerly of Cove Drive; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental of said project have been
prepared and are on file in the City of Carisbad and are incorporated by reference herein; and
WHEREAS, this project is exempt from environmental review per CEQA Section
15301(b) - minor alteration of existing facilities of public utility services involving negligible or no
expansion and Section 15302(c) - replacement or reconstruction of existing utility systems and/or
facilities involving negligible or no expansion of capacity; and
WHEREAS, the City of Carlsbad has agreed to reimburse the Cartsbad Municipal Water
District (CMWD) for the actual costs for city project improvements from the Northwest Quadrant
Storm Drain Program, Project No. 6608 and Concrete Repair Program, Project No. 6013; and
WHEREAS, on January 1, 2013, the City Council adopted Resolution No. 2013-019,
which approved the plans and specifications and authorized the advertisement for bids for the
Park Drive Water Pipeline Replacement, Surface Improvements, Northwest Quadrant Storm Drain
Program and Concrete Repair Program, Project No's. 5030, 6608 and 6013; and

WHEREAS, on March 26, 2013 seven (7) sealed bids were received, opened and
witnessed for the construction of this project; and
WHEREAS, the lowest responsive and responsible bid to construct said project was
submitted by Schilling Paradise, Inc. in the total amount of $789,617, which included $637,967 for
Project No. 5030, $96,285 for Project No. 6608, and $55,365 for Project No. 6013; and
WHEREAS, Section 3.28.040 (c)(5) of the Cartsbad Municipal Code authorizes the City
Manager to approve change orders for the City of Carlsbad's share of the total project cost in the
amount up to $30,000 for Project No. 6608, and $20,000 for Project No. 6013; and
WHEREAS, the CMWD will fund Project No. 5030 from the water replacement fund, and
the City of Carlsbad will fund Project No. 6608, and Project No. 6013 from the Gas Tax funds, and
there are sufficient funds available to complete the improvements for Project No. 6608 and
Project No. 6013.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications and contract documents on file in the City of
Carisbad are hereby approved.
3. That the Administrative Services Director is authorized to reimburse $96,285
from the Northwest Quadrant Storm Drain Program (Project No. 6608), and $55,365 from the
Concrete Repair Program (Project No. 6013) to the CMWD for the Park Drive Water Pipeline
Replacement and Surface Improvement Project (Project No. 5030).
4. That the Administrative Services Director is authorized to reimburse up to
$30,000 from the Northwest Quadrant Storm Drain Program (Project No. 6608) and up to $20,000

Executive Manager to approve change orders up to $100,000 for Project No. 5030; and
WHEREAS, sufficient funds exist in the Water-Capital Replacement fund for Project No.
5030, and the City of Carlsbad will reimburse CMWD for the costs associated with Project No.
6608, and Project No. 6013 from the Gas Tax funds.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of
the City of Cartsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $789,617 submitted by Shilling Paradise, Inc. for
the Park Drive Water Pipeline Replacement, Surface Improvements, Northwest Quadrant Storm
Drain Program and Concrete Repair Program, Project No's. 5030, 6608 and 6013 is accepted and
the President is hereby authorized to execute a contract with Schilling Paradise, Inc.
3. That the Executive Manager is hereby authorized to approve construction
change orders up to $100,000 for Project No. 5030.
4. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within twenty (20) days of adoption of this
resolution. The Executive Manager may grant reasonable extensions of time.
