RECOMMENDED ACTION:
To receive a follow up presentation from Police Department regarding animal advocacy.
ITEM EXPLANATION;
At the July 16 council workshop, Police Department staff and a representative from the County of San
Diego Department of Animal Services presented information on pet adoption and animal advocacy. The
presentation included an overview of the adoption, spay/neuter, vaccination, and licensing services
made available to community members via the City's contract with the County of San Diego Department
of Animal Services. In addition, staff discussed how the City of Carlsbad can support responsible pet
ownership. Finally, staff presented an overview of ordinances passed in other California cities banning
the retail sale of puppies.
This follow up presentation will include an overview of actions taken to-date as a result of council
direction to enhance the City's participation in adoption, spay/neuter, vaccination, and licensing events.
Additionally, staff will provide requested information to assist council in decision-making regarding
changing the number of dogs allowable by residents, and whether the City should introduce an
ordinance banning the retail sale of puppies.

Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment,
or a reasonably foreseeable indirect physical change in the environment, and therefore does not require

COUNCIL ACTION:
A minute motion by Council Member Blackburn was approved directing staff to develop a plan to allow the single existing
business in Carlsbad to continue commercial pet sales and prohibit the commercial pet sales by any new business. 3/2/0
A minute motion by Council Member Blackburn to amend the Carlsbad Municipal Code to permit residents to have a fourth
adult animal temporarily if the fourth animal is a foster animal failed.

Carlsbad Mayor and City Council,
I totally agree with the attached message from Melissa Genewich. I live in close quarters
with my neighbors and to allow additional animals in this neighborhood would be a
tremendous nuisance. We currently have cats that climb over our fence and defecate in our
planters, and dogs that wake us in the morning with their barking. Allowing more animals
would further decrease the enjoyment of our home.
Please do not increase the number of animals per household beyond what is already
allowed. Six animals is entirely too many within the city of Carlsbad!

Hello Mr. Mayor Matt Hall and City Council Members,
I understand that Council member Keith Blackburn Is yet again pushing
for a change in the city code that would allow for an increase in the
number of adult animals per household. I am astounded that this keeps
sneaking it's way onto your agenda. It would be irresponsible and a
detriment to our community to change this city code. I wish I could
attend the meeting on Tuesday morning, however with a preschooler at
home, I am unable to do so. I have copied just a few of our city
residents that feel the same way I do regarding this issue.
My next door neighbor used to run dog rescue out of her home (against
the current code) so I can say with confidence that passing this would be
a HUGE mistake for our city! As parents of two young children, we
spend numerous hours enjoying our backyard and would like to do so
without smelling animal waste, without having to listen to constant
barking, without dealing with an excessive amount of flies, and without
feeling potential concerns for our children's safety.
With the current code, we already experience nights filled with howling
and barking dogs and a neighbor with 3 adult dogs that provide our
wake up call regularly at 6:00am In the morning. Please don't help to
compound the problem. As avid walkers, we also spend quite a bit of
our time on our city sidewalks and streets. I can honestly say that
almost EVERY DAY we see animal waste on the sidewalks of old
Carlsbad...all around our neighborhoods. This waste ends up polluting
our creeks, waterways and the ocean that we all share and
enjoy! Increasing the number of animals allowable will only add to these
disappointing problems.
We are dog owners and lovers, however we feel strongly the current
domestic animal limits are fair and In such close proximity with our
neighbors, any number in excess of that presents health, safety, and
noise issues. Please fight for the sensible choice. We do not live in an
area that has multi-acre properties that would be suitable for an
excessive number of animals.

Recently information has been circulated that at the City Council Workshop, discussion was made concerning

enough for a house to enjoy the benefits of pet ownership without putting undue burden on their neighbors As
It currently stands, some of our neighbors have two dogs-two more than they can control. If two dogs left
outside create noise all day-what would 6 be like? Are residents going to be restricted to keeping their 6 dogs
mside 24/7? I have filed two complaints with the animal department about the aggressive nature of our
neighbors dogs (two large dogs getting loose and chasing down a mom and 6 year old was no picnic) Can you
imagine the outcome had it been 6 dogs? Very few people have the training and common sense necessary to
raise and control 6 dogs. Six dogs without proper guidance and responsible ownership can become a huge
danger to our kids and neighborhoods. For the record, I have one dog and am trying to adopt another. We are a
dog friendly family that recognizes the reward of having pets, but not to the detriment of the community.
Sometimes when I hear proposals such as this, that sound so outlandish for the community, I can only wonder
who city council is pandering to? Keep the code at 3-good for the community and good for neighbors.

Dear Mr. Blackburn,
I see that you have, yet again, pushed your agenda for the upcoming council meeting. For the past four years,
I have tried to elicit some response from you, other than your sneakily addressing this issue. The issue, to be
clear, is that of increasing the number of adult animals per Carlsbad residency from 3 to 6!
You have never contacted me directly. You have never answered my emails, or those of the other fine citizens
of this city. Other than robo- responses, just sent by the city!
I have appealed to the human side of you, siting child safety issues, concerns over potential loose packs of
dogs. No response.
I have highlighted pollution issues caused by animal waste and noise pollution. No response.
I have been an advocate for responsible pet ownership and civic pride. No response.
Your love of PIT BULLS has become more important than the HUMANS you are supposed to serve.
I am shocked and disappointed. I will continue to let people know what you have been trying to do to our
lovely Carlsbad. I hope that they, too will contact you with their concerns. I trust they will send this email to
other caring Carlsbad citizens. Perhaps some will even join me tomorrow morning at the Council meeting.

I wrote a letter to the council and reps a while ago concerning the 3 dog discussion and would like to reiterate
my stance. The current code allows for three dogs-more than enough for a house to enjoy the benefits of pet
ownership without putting undue burden on their neighbors. Allowing six dogs to reside in a neighborhood
home defies common sense, as this is not a rural community where we all sit on acres and acres of land. Are
residents going to be restricted to keeping their 6 dogs inside 24/7 to keep neighborhood free from the barking
of six dogs? How is the city going to enforce nuisance issues with a home with 6 dogs? Very few people have
the proper trainmg to raise and control 6 dogs and 6 dogs without proper guidance and responsible
ownership can become a huge danger to our kids and neighborhoods.
Sometimes when I hear proposals such as this, that sound so outlandish for the community, I can only wonder
who city council is pandering to? Keep the code at 3-good for the community and good for neighbors.

It was brought to my attention that the city only wants to increase the 3 dog rule to 4, with the 4th dog being a
"temporary" foster. That essentially makes the dog a Ml time resident and once it leaves I am certain the home
owner will waste not time in replacing dog with another foster. SO exactly how is the city going to define
temporary? One week, 1 month or until foster gets adopted??? Who will be enforcing this code? The reality of
this proposal is allow homeowners to have FOUR dogs and you still get a big fat NO fi-om me.

circumstance.
Carlsbad is not a rural community that has space and services for homes with large numbers of
dogs. We live close to our neighbors. Multiple dogs are a noise and safety issue! My daughter, and
many of her friends, walk to school. Play in the neighborhoods. Can you make any guarantees for
their comfort and safety? We already dodge many dog obstacles.
Our lovely beachside community is over run with dog waste on it's sidewalks. Storm drain pollution is
a real concern. Let alone the smell, flies, and germs the multiple dog waste brings.
As responsible dog lovers, we try to meet the needs of our pets and balance the common respect for
our neighbors. I have been dealing with a neighbor that continually ignores the codes and evades the
code enforcement on this very subject. How will you enforce future codes with such extreme
numbers? Honestly, who can truly care for 6 dogs in our neighborhoods. How fair is that to the
dogs? The Neighbors? The greater reputation of Carlsbad?
I trust you'll do whatever it takes to insure that Carlsbad does not become a place that considers 6
dogs per household a good idea.

Please do not increase the number of dogs an owner can have. Our yards are used as dog poop parks as it
is. Attending Carlsbad functions such as the Farmer's market make it difficult to navigate with the dogs
attending. Jazz in the park is supposedly dog free, not so. I have gone to each concert with dogs. Hike dogs
and I am a responsib le, thoughtful community member for 31 years. Three dogs is more than most people can

love to go where they are not allowed to go. That would be out of the yard and down the street trying to be curious
about everything new. Now get an aggressive dog out roaming around, maybe a pack of 6 dogs out roaming around
because if one can get, they all can get out. I know that not all dogs are aggressive, but it only takes a pack of dogs to
become more aggressive than usual. If you Increase the allowed adults dogs in a household, there Is a huge potential for
this to happen increasing the likeliness that it will happen.
Can you imagine a 6-8 year old walking to school and run into this? Maybe your kids or grandkids? There is no way that a
regular home owner will take every measure to ensure their dogs do not get out. Take a look at the measures a shelter
takes, this Is probably cost prohibited and not to mention the home owners knowledge to prepare the home for that
quantity of animals.
I have experienced firsthand with a code violator in Carlsbad who had 6-8 dogs most of them rescue dogs in her home.
The noise all the time was horrible, the smell from the back yard was horrible, and I can remember at least four times
the dogs got out and were roaming around the streets. 1 know that is just one person, think about it if you allowed more
dogs. We called code enforcement and she played the games to not get inspected at a time when she had all eight dogs.
Does Carlsbad want to take on the financial burden of more calls to code enforcement on a bunch of howling dogs? Or
inspections because the smell is so bad people can't enjoy their back yard because their neighbor has 6 dogs and the
smell is horrible? You know this will happen.
Seems like a simple thing to me.
Do the right thing "Keep our kids safe" and make it so people can enjoy living in Carlsbad.

Dear Mr. Mayor Hall,
I'm writing you today as a dog owner myself in concern with the recent discussion about raising the
legal limit of dogs per household. I feel the 3 dog per household now is more than enough. Raising
the legal limit to 6 seems a bit excessive.
My children walk to school, I'm concerned with their safety and not to mention the waste that
seems to be always left behind. The added noise in the neighborhood is also a big issue.
I love the city/community we live in and just want it to stay safe for my family. I want my beaches
and streets to stay clean and beautiful.

No more than 3 Dogs
To Whom it May Concern,
Please don't raise the current code to allow for more than 3 dogs.
Our home is near the beach. Everyone comes to walk their dog along the coast. Visiting friends already
comment on the amount of dogs and dog poop found along our beach front walkway.
We live close to our neighbors and every sound is heard. Our neighbor, three houses away, has two basset
hounds and they are noisy! The owners do a good job of monitoring the noise level, but I can't imagine them
havmg more than two!
I am concerned about people walking more than three dogs safely. Our girls are cautious of dogs. Owners tend
to think their dogs are friendly, but many people don't feel comfortable.
Our city doesn't need to spend more money monitoring more dogs.
