RECOMMENDED ACTION; To receive a presentation from representatives ofthe California Department of Transportation, San Diego Association of Governments and the California Coastal Commission regarding the North Coast Corridor Public Works Plan/Transportation and Resource Enhancement Program (PWP/TREP). ITEM EXPLANATION; Representatives from the California Department of Transportation, San Diego Association of Governments and the California Coastal Commission will give an update on the PWP/TREP and the future process relating to California Coastal Commission consideration ofthe PWP/TREP and associated Local Coastal Program Amendments. FISCAL IMPACT; None ENVIRONMENTAL IMPACT; Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. COUNCIL ACTION: APPROVED • CONTINUED TO DATE SPECIFIC • DENIED • CONTINUED TO DATE UNKNOWN • CONTINUED • RETURNED TO STAFF • WITHDRAWN • OTHER - SEE MINUTES AMENDED • REPORT RECEIVED March 7, 2012 North Coast Corridor Local Coast Program Amendments City of Carlsbad North Coast Corridor (NCC) Program Overview •Builds upon previously-adopted regional and city plans •Integrates significant transportation and coastal access improvements •Balances transportation, community and environment needs 2 A comprehensive and sustainable solution for the region that: •Implementation blueprint for the North Coast Corridor Program •Permitting document for 40-year, balanced plan to be considered by Coastal Commission •Includes over $300 million for resource and community enhancements •Represents 10 years of collaboration 3 What is the Public Works Plan (PWP)? 4 Your LCP is a key part of overall PWP approval •LCP is standard of review for the PWP •Collaborative process to resolve inconsistencies •Coastal process includes a federal and state review •For federal process LCP is used for guidance •Collaborative process to resolve inconsistencies Why: LCP Amendment Process 5 Provides the policy framework that: •Enables PWP project implementation •Ensures consistency, certainty, content and timeline •Identifies inconsistencies (examples include): Improvements would result in minor development encroachment in Environmentally Sensitive Habitat Areas (ESHA) Improvements would result in minor, unavoidable construction in the 100-year floodplain •Continues the partnership between Caltrans, SANDAG, city staff and the California Coastal Commission How: A narrowly focused project-specific overlay approach 6 •Regional implications provide for the use of the third party initiated amendment process •Caltrans and SANDAG to carry the workload burden with city input •Simplifies and consolidates the traditional project-by-project CDP approach •Cities will continue to have role in amendment process •NOID process allows further city review How: Third party initiated amendment The third party LCPA overlay approach provides several benefits: 7 Assurances for the City of Carlsbad Checks and balances for continued city involvement include: •Performance reporting •NOID noticing and hearing requirements •Phasing plan ensures balanced approach •Flexibility to adapt to changed circumstances 8 Tracks near Cannon Drive Batiquitos Lagoon 9 When: Your involvement over the next year
