RECOMMENDED ACTION: Adopt Resolution No. 2013-250 accepting bids and awarding the contract to TC Construction Company for construction ofthe 2013 Pavement Overlay Project No. 6001-13-OL. ITEM EXPLANATION: The 2013 Pavement Overlay Project is part of the City of Carlsbad's ongoing Pavement Management Program. This project will resurface a portion of El Camino Real and other residential streets by applying a rubberized asphalt concrete layer over the existing roadway. The streets were selected based on their age and the existing condition ofthe pavement surface. On September 23, 2013, twelve (12) sealed bids were received for the construction of this project as shown on the following table. CONTRAaOR TOTAL T.C. Staff has completed its review ofthe contract documents and has determined that they are in order. Staff recommends that TC Construction Company be awarded the contract. Construction Contract $748,744 Construction Contingency $100,000 Project Administration, Testing & Inspection $100,000 TOTAL ESTIMATED PROJEa COSTS $948,744 There are sufficient funds available to complete the 2013 Pavement Overlay Project, as shown above. The funds used on this project are Pavement Management Program funds which consist of non- jurisdictional fees (generated from trash haulers). Gas Tax funds, and TransNet-Local funds available for drawdown from SANDAG. Remaining Pavement Management Program funds will be used on future pavement rehabilitation and resurfacing projects. ENVIRONMENTAL IMPACT: The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. Street list. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2013-250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING THE CONTRACT TO TC CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE 2013 PAVEMENT OVERLAY PROJECT NO. 6001-13-OL WHEREAS, the City Council of Carlsbad, California has determined that it is necessary, desirable, and in the public's best interest to construct the 2013 Pavement Overlay Project No. 6001-13-OL; and WHEREAS, on June 18, 2013, the City Council ofthe City of Carlsbad approved plans for the construction ofthe 2013 Pavement Overlay Project No. 6001-13-OL; and WHEREAS, twelve (12) sealed bids were received on September 23, 2013 by the City of Carlsbad forthe construction ofthe 2013 Pavement Overlay Project No. 6001-13-OL; and WHEREAS, the lowest responsive and responsible bid to construct said project was submitted by TC Construction Company in the amount of $748,744; and WHEREAS, there are sufficient funds available in the Pavement Management Program to complete the project; and WHEREAS, subsection 3.28.040(C)(5) of the Carlsbad Municipal Code authorizes the City Manager to approve change orders in the amount equal to the contingency set at the time of project award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the low bid of $748,744 submitted by TC Construction Company for the construction ofthe 2013 Pavement Overlay Project No. 6001-13-OL is accepted and the Mayor is hereby authorized to execute a contract for this project. 3. That the City Manager is hereby authorized to approve construction change orders up to $100,000. 4. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
