DEPT. 21,429 11-19-13 PD AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REPEALING EXISTING CARLSBAD MUNICIPAL CODE CHAPTER 5.16, AND ENACTING NEW CHAPTER 5.16 REGULATING MASSAGE SERVICES DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Introduce Ordinance No. CS-234 of the City Council of the City of Carlsbad, California, repealing the existing Chapter 5.16 ofthe Carlsbad Municipal Code entitled (Massage Business, Massage Technicians and Holistic Health Practitioners) and enacting a new Chapter 5.16 entitled (Massage Services) ITEM EXPLANATION: In 2010 the City amended Section 5.16 of the Carlsbad Municipal Code to bring it into compliance with the provisions of State Senate Bill 731 which created a voluntary state- wide licensing scheme for massage practitioners and therapists. These new rules were codified in Business & Professions Code section 4600 et seq. and exempted those who obtain certificates from the state from certain local regulations of the massage practice. Since 2010, a number of technical and operational changes have created the need to further revise and amend numerous sections of Chapter 5.16. Rather than amend each section individually the Police Department, in conjunction with the City Attorney's Office, elected to revise the entire chapter and address all ofthe changes at one time. This proposed change to Chapter 5.16 eliminates licensing redundancy by abolishing local massage licensing requirements and relying solely upon the State of California licensing scheme for massage practitioners and therapists. Police Department staff believes that it is necessary to make these revisions to provide clearer guidelines for massage establishments and practitioners regarding licensing and operations, to provide for the orderly and consistent regulation of massage services, to enable consumers to identify legitimate massage workers and businesses, and additionally to establish minimum health and safety standards, thus protecting the public interest, health, safety and welfare of the city. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15738, this action does not constitute a "project" within the meaning of CEQA and therefore, does not require additional environmental review.
