DIRECTOR CITY ATTORNEY CITY MANAGER ^ Yt^ RECOMMENDED ACTION: That the City Council hold a public heanng and INTRODUCE Ordinance No. CS-236 REPEALING Ordinance 9117 to rescind a Special Use Permit for the Woman's Club of Carlsbad on property located at 3320 Monroe Street, on the east side of Monroe Street between Basswood Avenue and Unda Lane and located in Local Facilities Management Zone 1. ITEM EXPLANATION; On October 2, 2013, the Planning Commission conducted a public heanng for the Woman's Club of CaHsbad project, which is located on the southeast corner of Basswood Avenue and Monroe Street in Local Facilities Management Zone 1. The Planning Commission adopted Planning Commission Resolution No. 7011 approving a Conditional Use Permit Amendment (CUP 8(A)) for the operation of the Woman's Club (5-0, Black and L'Heureux absent). The Planning Commission also adopted Planning Commission Resolution No. 7010 recommending that the City Council repeal Ordinance 9117 that granted a Special Use Permit for the Woman's Club of Carlsbad in 1961. The reference to the Special Use Permit is a typographical error. All of the other documents related to the original project refer to the project as a Conditional Use Permit. The Club is an existing non-conforming use and is regulated by the Conditional Use Permit (CUP 8(A)). Special Use Permits are used to implement the Scenic Preservation OveHay Zone (21.40) and the Floodplain Management Regulations (Chapter 21.210) ofthe CaHsbad Municipal Code. The Conditional Use Permit is the appropnate permit to allow uses which are not typically allowed in a specific zoning distnct by nght and include conditions of approval for compatibility purposes. That the requested use is necessary or desirable for the development of the community, and is in harmony with the various elements and objectives ofthe general plan, including, if applicable, the certified local coastal program, specific plan or master plan, in that it provides for a location for women (both young and older) to meet and socialize. The Club also performs a social need for the community and provides support and funds for neighborhood projects and other groups needing assistance. 2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located in that the new proposed conditions of approval will reduce the impacts to the neighborhood and will establish operational criteria that will enable the city to enforce the restrictions to assure compatibility. 3. That the site for the proposed conditional use is adequate in size and shape to accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other development features prescribed in this code and required by the City Planner, planning commission or city council, in order to integrate the use with other uses in the neighborhood, in that the required building setbacks are provided, adequate parking is provided in the rear of the property, the site has adequate landscaping, and the site is fenced. Additional public parking is available on the street. 4. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that Monroe Street is adequate in size and capacity to serve the Club. The site access is via two separate ingress and egress driveways that do not conflict with adjacent properties. 5. That the City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301 - Existing Facilities, ofthe State CEQA Guidelines and will not have any adverse significant impact on the environment. A Notice of Exemption will be filed with the County Clerk upon approval of this project. Conditions: 1. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of yiolation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Conditional Use Permit Amendment. 2. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Conditional Use Permit Amendment documents, as necessary to make them internally consistent and in conformity with the final action on the project. Any proposed development, different from this approval, shall require an amendment to this approval. 3. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. 4. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid, this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 5. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Conditional Use Permit Amendment, (b) City's approval or issuance of any permit or action, whether discretionary or nondiscretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even ifthe City's approval is not validated. 6. Prior to the issuance of a building permit, the Developer shall provide proof to the Building Division from the Carisbad Unified School District that this project has satisfied its obligation to provide school facilities. 7. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 8. Building permits will not be issued for this project unless the local agency providing water and sewer services to the project provides written certification to the City that adequate water service and sewer facilities, respectively, are available to the project at the time of the application for the building permit, and that water and sewer capacity and facilities will continue to be available until the time of occupancy. 9. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. Ifthe taxes/fees are not paid, this approval will not be consistent with the General Plan and shall become void. 10. Within six months of the project approval. Developer shall submit to the City a Notice of Restriction executed by the owner of the real property to be developed. Said notice is to be filed in the office ofthe County Recorder, subject to the satisfaction ofthe City Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Conditional Use Permit Amendment by Resolution No. 7011 on the property. Said Notice of Restriction PC RESO NO. 7011 -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The City Planner has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. 11. CUP 8(A) shall be reviewed by the City Planner annually to determine if all conditions of this permit have been met and that the use does not have a substantial negative effect on surrounding properties or the public health, safety and general welfare. A status report shall be prepared and presented to the Planning Commission at a public hearing one-year from project approval. The Planning Commission will consider at the public hearing when or if additional status reports shall occur. If the City Planner determines that: 1) the Conditional Use Permit was obtained by fraud or misrepresentation; or 2) the use for which such approval was granted is not being exercised; or 3) the Conditional Use Permit is being or recently has been exercised contrary to any of the terms or conditions of approval or the conditions of approval have not been met; or 4) the use for which such approval was granted has ceased to exist or has been suspended for one year or more; or 5) the use is in violation of any statute, ordinance, law or regulation; or 6) the use permitted by the Conditional Use Permit is being or has been so exercised as to be detrimental to the public health, safety or welfare or so as to constitute a nuisance, the City Planner shall recommend that the Planning Commission hold a public hearing and after providing the permittee the opportunity to be heard, the Planning Commission may revoke and terminate the Conditional Use Permit in whole or in part, reaffirm the Conditional Use Permit, modify the conditions or impose new conditions. 12. Uses permitted shall be limited to Woman's Club activities and private functions by invitation or by the sale of tickets to limit the number of participants. No events or dances that are open to the general public shall be held, except for vehicle parking related to Carisbad High School events and one annual rummage sale. 13. No smoking shall be permitted on the premises. 14. The Woman's Club shall establish a common phone number by which residents can call to address issues or concerns regarding use or noise complaints of the facility. The number shall be posted on the building as well as on the club's website. 15. Uses of the site shall be restricted as follows: A. Weekday events (Monday - Thursday) held for the Woman's Club or by private renters shall comply with the following: 1. Hours of operation shall be limited to between the hours of 8:00 AM to 9:00 PM. 2. No person shall remain on the premises after 10:00 PM. 3. II- PROJECT DESCRIPTION AND BACKGROUND Based upon complaints to the city from neighbors surrounding The Woman's Club of CaHsbad ("Club"), the city has initiated a Conditional Use Permit Amendment for the Club, located at 3320 Monroe Street, to establish additional operating restrictions for the use of the property and facility to ensure its compatibility with the surrounding single family residential neighborhood. The complaints include hours of operation, noise, use of amplified music, the use of the property by other parties, and the sale of alcohol. The city has received ongoing various complaints as to the operation of the Club over the years and there are effectively no restrictions on the existing Conditional Use Permit (excluding the prohibition on public dances). Table A below includes the General Plan designations, zoning and current land uses on the project site and surrounding properties. N/A In March of 1961, the City Council adopted Resolution of Intention No. 728 (see attachment 5) to modify the zoning ordinance to allow a Condition Use Permit for the Club with a restnction that there are no public dances. The Planning Commission, on Apnl 25, 1961, recommended approval of a Conditional Use Permit by Planning Commission Resolution No. 206 (Conditional Use Permit 8) for the Club (see attachment 8). The City Council approved Ordinance No. 9117 for the Special Use Permit (should have read Conditional Use Permit as all other documents) on June 6,1961. The Club was constructed in 1963. The surrounding single family homes were built in the mid to late 1960's and early 1970's. This application includes a request for a Planning Commission recommendation that the City Council rescind City Council Ordinance 9117 that approved the Special Use Permit for the Club. The Special Use Permit is a typographical error as all the other documents related to the project refer to the project as a Conditional Use permit. The Club is an existing non-conforming use and is regulated by the Conditional Use Permit (CUP 8). Special Use Permits are used to implement the Scenic Preservation OveHay Zone (21.40) and the Floodplain Management Regulations (Chapter 21.210) ofthe Carlsbad Municipal Code. The Conditional Use Permit is the appropnate permit to allow uses which are not typically allowed in a specific zoning district by right and include conditions of approval for compatibility purposes. The compatibility of the Club with the surrounding neighborhood has been a concern from the date of its original approval. The Planning Commission minutes of March 28, 1961 (see attachment 6) reflect the same concerns that exist today of the compatibility of the Club and the use (rental) of the facility for use other than the Club's pnmary functions. The Club's pnmary and own uses of the facility include luncheon and business meetings, exercise classes, an annual Club holiday party and Club fundraising events held and sponsored by the Club. The Club also uses the parking lot as a fundraising event by charging money for parking dunng football and graduation events at the CaHsbad High School located across the street. Over the Club's history, the Club has also rented the facility for a variety of uses which include: political club meetings, prayer groups, worship groups, community theater (youth), comedy shows, family celebrations and other vanous meetings, gatherings, and small parties. These events have resulted in excessive noise from people and music, late hours of operation, large gathenngs of people, security concerns and concerns over the use of alcohol on the premises. A neighborhood petition requesting the review of the Conditional Use Permit and other complaint letters is attached (attachment 14). Events held are by invitation or by ticket sales and have not been open to the general public, except for the charging of money for parking spaces for the high school events and an annual rummage sale. The rental income of the facility is one of the pnmary fund nsing opportunities for the Club. The Club consists of a 4,782 square foot single story structure with 2098 square feet of assembly area. The building is located on the front of the .92 acre site with an entrance driveway located in the southerly sideyard setback and an exit driveway located in the opposite northerly sideyard setback. There are 53 parking spaces in the back parking lot which include two light poles. The rear of the building has a 1,800 square foot outdoor patio area. The building has an interior office, bathrooms, commercial kitchen, storage room, and an open floor assembly area with a small stage. o o CUP 8(A) - THE WOMAN'S CLUB OF CARLSBAD October 2, 2013 Page3 III. ANALYSIS The proposed project is subject to the following plans, ordinances and standards: A. General Plan Land Use Element; B. Carisbad Municipal Code, Title 21, Chapter 42 - Conditional Use Permits; and C. Local Facilities Management Plan and Growth Management. The recommendation of approval to add operating conditions for this project was developed by analyzing the project's consistency with the applicable policies and regulations listed above. Therefore, this section will cover the project's compliance with each of the regulations listed above in the order in which they are presented. A. General Plan Although the Land Use Element does not specifically address "conditional uses," one of the overall implementation policies of the General Plan Land Use Element is to ensure that the review of future projects places a high pnority on the compatibility of adjacent land uses along the interface of different density (or use) categones. Special attention should be given to buffenng and transitional methods, especially, when reviewing properties where different land uses are involved. The Club is an existing non-conforming use that was permitted in 1961 just pnor to the development of the surrounding residential neighborhood. As viewed from the street, the single story building is not out of character with the surrounding neighborhood and is well landscaped. The site does have surrounding fencing built of vaned matenals including wood, chain link with slats/matting/vines and masonry block. However, based upon neighborhood complaints, the use, even with the existing surrounding fencing, is currently not compatible with the surrounding single family uses because of its operations. The proposed conditions of approval contained in the Conditional Use Permit amendment are proposed to ensure compatibility with the uses permitted in the zone and its surroundings. B. Conditional Use Permit The original Special Use Permit was approved by the City Council with very little restnction. This application is to add additional restnctions to assure compatibility with the neighborhood and to be able to enforce the restnctions if they are not followed. The Club has a vanety of uses that operate out of the facility. As noted in the project descnption, the rental ofthe facility is the primary means for income for the Club for its own operation and to fund their philanthropic endeavors. The rental of the facility is however also the primary reason for the neighborhood complaints. The Club is desirable for the development of the community as it provides for a location for women (of all ages) to meet and socialize. The Club also performs a social need for the community and provides support and funds for neighborhood projects and other groups. Attached to this report is a summary of Club activities (see attachment 11). More information on the Club can be found at their website womansclubofcaHsabd.com. With the addition of additional operational restnctions, the Club should not impose any detrimental impacts to other uses in the surrounding area. There have been complaints on the operation of the Club in the past and the existing Use Permit does not contain operational restnctions other than to preclude public dances. The new proposed conditions of approval listed in Planning Commission Resolution No. 7 "2- CUP 8(A) - THE WOMAN'S CLUB OF CARLSBAD October 2, 2013 Page4 7011 will reduce the impacts to the neighborhood and will establish operational critena that will enable the city to enforce the restrictions to assure compatibility. The Conditional Use Permit includes a list of the permitted uses allowed to operate on or within the facility. Only two of the uses are open to the general public (parking for high school events and one rummage sale). Otherwise, all other uses are restricted to Club members, by invitation only by the renter of the facility, or by the presale of tickets to a private event. The permit also includes operational restrictions such as; users of the facility, hours and days of operation, maximum occupancy, required attendance by a Club representative, restrictions on amplified and non-amplified music, entertainment, alcohol restrictions, and site limitations and use. With these conditions, the use would not be detnmental to the surrounding residential neighborhood. The site is adequate in size and shape to accommodate the Club in that the required building setbacks are provided, adequate parking is provided in the rear of the property, the site has adequate landscaping, and the site is fenced. Additional public parking is available on the street. Monroe Street is adequate in size and capacity to serve the Club. The site access is via two separate ingress and egress driveways that do not conflict with adjacent properties. C. Local Facilities Management Plan and Growth Management. The proposed project is located within Local Facilities Management Zone 1 in the northwest quadrant of the City. CHRISTIANSEN, 2479 Ocean St,, stated that she was sure all the Commissioners knew what a need they had for a clubhouse and whet efforts they had made to find a suitable location. The club members felt that rather than being a bad thing for the neighborhood, that they would enhance the area. They have worked for the community for many years and the club is many years old and a desirable organization for Carlsbad. The clubhouse will also be an advantage to other clubs of Carlsbad, She stated that they were cognizant of the fact that there was a petition protesting their request and they understood the petitioners feelings but clubs of this type have been given permission to build in residential areas all over California and she felt they should be given the conditional use permit without any restrictions at all, SOB FRAZEE, 3326 Monroe, stated that his property adjoins the subject property and this is a residential and also a new and developing area. It is not a residential sone where commercial property is creeping in. In the neighborhood, it is the consensus that the Woman's Club would be detrimental to the area. There would not be any objection to the Woman's Club meetings but they would find it necessary to rent the building out for other uses and it would be a commercial thirtg. There are three lots which adjoin this property and the property owners would take a great loss financially. There were some people who did not care to sign the petition but they also were not in favor of hav- ing the clubhouse in the neighborhood, MRS, CHRISTIANSEN stated in rebuttal that if they are granted the conditional use pennit, the clubhouse will face on Monroe, The back of the lot will be a parking lot and no one using the building would have late meetings so the neighboring property owners would not suffer. There could be buffer planting. There are many patio parties that create as much disturbance as anything that could go on at the clubhouse. She requested that the petition be granted due to the fact that they had looked all over Carlsbad for suitable property and had even asked the city to find them property which could be exchanged for the property they own in Holiday Park* The public hearing was closed at 8 P.M, MR. FRAZEE stated that private dances were no more quiet than public dances and that the building would be about 20 feet from his bedroom window. They did not feel that daytime meetings would be detrimental to the neighborhood. w (3 -3- MRS. CS. GR.^NGER, 3845 Skyline Drive, stated that she had told the ladies of the club about the restriction the City Council had placed on the conditional use permit and they had accepted it, however the club would have to lease the building to other organizations and individuals at night in order to maintain the clubhouse. When asked the status of their purchase of the property, Mrs. Christiansen stated that it was still in escrow and would remain there until the matter of the conditional use permit was settled. Mrs. Christiansen was also asked what their plans had been with the City on the property they own at Holiday Park and also if the city had purchased this property as yet, and she stated that the plan had been that the Woman's Club would have priority on the club- house for its meetings but the city could let it out to other clubs when they were not using it and that the city had not purchased this property from them. There was some discussion as to how many members there were in the club and how many of them lived in that area. It was also mentioned that the Commission had recommended thpt the City Council initiate?, a Resolution of Intention to amend the ordinance by allowing this conditional use permit. We have received your email of July 9,2013, with the written list of questions the City would like answered regarding the application made to amend our current Conditional Use Permit. By way of background first, the Woman's Club of Carlsbad (WCC) was incorporated in 1927 by the General Federation of Women's Clubs (GFWC), a national organization for women founded in the 1890s to support education, improve working conditions and reform other issues affecting women. The WCC's purpose back in 1927 was to provide philanthropic services to the residents of Carlsbad and nearby areas and also to promote and provide social activities for the local women. WCC is the oldest social organization in Carlsbad, but we are not just that. We are a group of dedicated women who give of their time, talents, energy and money for the betterment of our community. This past year alone, WCC awarded $5,500 in scholarships to Carlsbad women and made other monetary donations of over $13,000. Additionally, approximately $20,000 of in- kind, noncash, contributions were made while our members logged close to 1900 volunteer hours. Please see the attached summary of our Club's philanthropic activities. In 2012 the Junior Woman's Club of Carlsbad, a GFCW club chartered in 1975 by the WCC, a club that met in the evenings due to work commitments, decided to dissolve so the members could join the WCC and assist them in their efforts. WCC had been experiencing diminishing numbers of members for many years as membership in grass- roots charities seemed to be declining and with their members aging and/or passing away. WCC was experiencing losses in not only membership but revenue from fundraisers and rental activity and in 2010 was compelled to list the Clubhouse property for sale. Members ofthe community ralHed to save this Carlsbad icon from extinction, and a new rental chairwoman and clubhouse maintenance chairwoman breathed life back into the old building, fbdng it up and renting out the facility more often for meetings and events. Those efforts have resulted in WCC becoming profitable again and being able to contribute so much back to the community. 3320 Monroe Street, Carlsbad, CA 92008 You have asked the following questions: 1. Number of members: 65 members. 4. Any qualifications for membership: None, only that you be a woman. No exclusions based on age, race, religion or level of education. 5. Club rules and/or bylaws. See Attachment B. 6. Philanthropic work the club provides/performs. See Attachment C. 7. Sample rental agreement. (Also available in Spanish) See Attachment D. 8. Other users of the facility on a regular basis. See Attachment E. 9. Square footage of building: City building file indicates 4,782 square feet. A new WCC Board of Directors just took office in mid-June and were surprised and saddened to learn that some of our neighbors have been bothered by an increased level of noise from our Clubhouse. It seems that the common source of complaints has been Saturday night events involving amplified music. So far this year, the clubhouse has been rented for Saturday evening parties ten times. These events are not unsupervised teenagers running wild but are, rather, family celebrations (from babies to grandparents) rich in cultural significance, namely Quinceaneras and baptisms. Our "party" renters are limited to 150 guests, are now required to hire a security guard approved by WCC, and have alwavs been required to stop all music and amplified voices by 9:00 p.m. and to clear the premises and parking lot by 10:00 p.m. Our rental manager lives close to the Clubhouse and personally checks in on these renters to ensure these times are strictly followed. Because we have been wrongly accused of not adhering to these time restrictions, we have begun to keep records of these practices, including hourly decibel readings at various areas in the parking lot along the fence line. The Clubhouse was rented out on three Sundays in 2013: for a family graduation party, a preschool graduation and a fundraiser for Rett Syndrome. These groups, in keeping with our custom and practice, completed their events and vacated the Clubhouse premises by 10:00 p.m. The Rett Syndrome fundraiser prompted a complaint resulting in a visit from police before 7:30 p.m. due to a mariachi band on the patio. To attempt to decrease the noise escaping into the neighborhood, beginning this June, we've added extra indoor fans and have been more vigilant to keep the doors and windows closed along the east side of the Clubhouse during parties, which a neighborhood representative once admitted has helped. Deejays or bands are now instructed to turn down the bass on their sound systems. The Clubhouse facility is not only rented for parties. We provide a place for other nonprofit organizations, a political club and worship groups to gather. We are proud of the fact that we support the arts in Carlsbad by making our building available (at a greatly reduced rate) to the Carlsbad Community Theater for their youth group rehearsals. Students can easily walk from Carlsbad High School to their rehearsals and workshops. We recognize our Clubhouse is located, as it has been for the past 52 years, in a residential neighborhood, and we stand ready to make improvements and changes to our facility to be a good neighbor. We are collecting bids to install air conditioning and new windows on the east side of our building to minimize the noise emanating from the Clubhouse. We are certainly open to other suggestions and recommendations from City staff. We have been attempting in good faith since June 18* to meet with our neighbors to educate ourselves on their concerns and to institute some immediate measures to decrease the noise, but as of the date of this letter, our neighbors have been unavailable to meet, even when encouraged to do so by the City. It is our hope that the City can help us establish some ground rules that everyone, including the Woman's Club of Carlsbad, can live with. While we understand some neighbors' difficulty at times with occasional music or noise coming from our Clubhouse, we've been incorrectly accused and blamed for some transgressions for which we had no responsibility. We have also had complaints of innocuous things such as voices of people talking, playing, praying or enjoying a meal together. It is our belief that these are normal, everyday neighborhood occurrences and noises, and we should be held to no higher standard than a residential neighbor talking, eating or playing in their own backyard. We have attached letters from community supporters of WCC and from neighbors who are not bothered by our presence in the neighborhood, our club events and/or rental activities. Some neighbors are even concerned that they are being misrepresented by the group of residents who complain the loudest about the WCC. See Attachment F. This Club is a membeii^pf Palomar District, Califorma State, and General Federation of Woaa^n's Clubs. ARTICLE n Object The object of this non-profit corporation* shall be education, service and philanthropy, and in carrying out said object to acquire, own, and convey real and personal property but not for profit. ARTICLE III Membership Section 1. Members are encouraged to participate in projects and work activities of tiie club. Section 2. The application for membership shall be accompanied by the initiation fee ($10.00) and one year's dues. Upon application and payment of dues, any woman presenting a current membership card firom a General Federation of Women's Club is exempt from payment of initiation fee at the time of transfer into WCC. ARTICLE IV— Officers and Duties Section 1. The officers ofthis corporation shall be President(s), First Vice President (Dean), Second Vice President (Federation), Third Vice President (Ways & Means), Fourth Vice President (Rental Chainnan), Recording Secretary(s), Corresponding Secretary, Treasurer. ARTICLE rv— Officers and Duties (Continued) Section 2. All officers shall be elected for a term of two years. No member shall be elected President unless she has served at least one year as a member of the Board of a GFWC organization. No officer or director shall hold more than one office at a time. Term of office shall start upon installation, except Treasurer, whose office takes effect July 1st. Section 3. The President(s) should preside at all regular and special O meetings of the Club and meetings of the Board of Directors. She/They will have general supervision of the Club. Upon election of the Presidency, she/they may appoint the Parliamentarian, Auditor, Historian, Publicity, Entre Nous Newsletter Editor, Department Chairs, Luncheon Coordinator, and chairman-of all standing committees except the Nominating Committee. She/they shall appoint delegates to the Palomar District Federation. Section 4. The First Vice President shall be Dean of Chairman. In the absence of the President(s) or in case oi? her/their inability to act, the First Vice President shall assume her duties. Section 5. The Treasurer shall receive all Club funds and deposit same in such banks or insured savings and loan institutions as directed by ^ the Board of Directors. She shall disburse funds as directed by the Board of Directors. She-shall be Chairman of the Budget Committee. Section 6. The Recording Secretary(s) shall keep accurate minutes of all clubjneetings of the Club and ofthe Board of Directors. Section 7. The Corresponding Secretary shall attend to all correspondence ofthe Club. The three Directors shall be the Clubhouse Management Chairman, Chairman of the Past Presidents, and Membership Chairman. These officers and directors shall constitute the Board of Directors of the Club. ARTICLE V Board of Directors Section 1. The Board of Directors shall transact all Club business. Any expenditures not provided for in the budget and in excess of $500.00 must be authorized by a 2/3 majority of the Club members voting at a regular or special meeting of the Club. In the event of an emergency, a majority of the Board of Directors shall have the authority to approve an expenditure of more than $500.00. Section 2. The Board of Directors is empowered to hold, in trust, all real and personal property of the Club. The board may with special notification and 2/3 majority of ballots received by date designated on ballot, buy or sell real estate or borrow money as may be needed in emergencies. Section 3. The Board of Directors shall have the power to declare a vacancy, by 2/3 vote, if an appointed member or elected officer fails to perform her duties. Any vacancy occurring among elected officers shall be filled by the Board of Directors, except the office of President, which vacancy shall be filled by an election. Notice of the election shall be published in the Entre Nous. Section 4. The property of this corporation is irrevocably dedicated to charitable purposes and no part of the net income or asset of this corporation shall ever benefit any director, officer, or member thereof or to the benefit of any private person. Upon dissolution or winding up of the corporation, the assets remaining after payment or provision for payment of all debts and liabilities of this corporation shall be distributed to any nonprofit fund, foundation, or corporation which is organized and operated exclusively for charitable purposes and which has established its tax exempt status under Section 501c (3) of the Intemal Revenue Code. The $50,000 Helen AUman Nursing Scholarship Fund shall be treated as a separate entity to be donated to the Palomar School of Nursing. The interest from this Fund shall be used for annual nursing scholarships. The current Treasurer of the Woman's Club of Carlsbad shall be responsible for filing the dissolution papers to the IRS and the Franchise Tax Board of Califomia. ARTICLE VI- Sections and Standing Committees Section 1. Committees may be created or eliminated by the Board of Directors. Committees shall be govemed by a set of standing mles approved by the Board. Section 2. All monies eamed in the name of the Woman's Club of Carlsbad shall be deposited with the Treasurer. Requests for necessary expenditures shall be made to the Board of Directors and/or the general membership. ARTICLE VII Dues Section 1. The fiscal year shall be from July 1 to June 30. Section 2. The initiation fee shall be $10.00 Section 3. Membership dues shall be $40 per year. Dues shall be payable April 1. Dues notices shall be sent with the March issue of the Entre Nous. New members joining the Club after January 1 shall have dues applied to the coming year. Section 4. Honorary Life Members are exempt from payment of dues. Section 5. If dues are not paid by April 15, such members shall be removed from the membership roll. ARTICLE VIII Meetings Section 1. Club meetings shall be held in the daytime and evening of the second Wednesday of each month from September to June inclusive, unless otherwise directed by the Club Board of Directors Section 2. Special meetings may be called by the President(s) or on request of fifteen members at which meetings a 2/3 vote shall be necessary for a decision. Notices must state the purpose of the meeting and be sent out at least seven days prior to the meeting. O ARTICLE VIII Meetings (Continued) Section 3. A Quorum at both regular and special meetings shall consist of the majority of members present and eligible to vote. Section 4. The Board of Directors shall convene at the call of the President(s). A Board quorum shall consist of 2/3 of the Board members present. ARTICLE IX Elections Section 1. A Nominating Committee of five shall be elected by the Board of Directors at their meeting in March. No more than three of the Committee members shall be from the Board of Directors. This Committee shall present a slate of officers and directors at the Club meeting in April, at which time nominations may be made from the floor. The slate of officers shall be published in an Entre Nous preceding the Club meeting in April. All nominees must be made aware of the duties of the office and be willing to serve. Section 2. Election of officers shall be held in the Clubhouse at the regular Club meeting in May. Election shall be by ballot except if there should be one candidate for any office, and then it may be by voice vote. ARTICLE X Notices The Entre Nous shall be recognized as the media for all official notices. ARTICLE XI Amendments These Bylaws may be amended at any regular meeting of the Club by a 2/3 vote of the members present and voting, provided the proposed change has been published in the previous Entre Nous sent at least 10 days prior to the meeting. ARTICLE xn Rules of Order Robert's Rules of Order, Newly Revised, shall govem all meetings of the Club and Board so far as it is consistent with these Bylaws. ^These Bylaws revised February 2013). *The non-profit status of the Club is in accordance with the provision of Section No. 23701F of the Califomia Franchise Tax Laws and of Section 501c(3) ofthe Federal Intemal Revenue Code, GEN 8288 the Group Exemption Nxmiber. STANDING RULES 1. Chairman of each Federated Department shall be appointed by the Club President(s) as set up by the Federation. 2. Following the May election, the Budget Committee shall prepare and present to the Board of Directors a budget for its consideration and recommendation to the Club at the regular June meeting. The Budget Committee shall consist of the Treasurer as Chairman, Treasurer Elect, Immediate Past President, House Management Chairman, and one member-at- large elected by the Board of Directors, and the President as an ex-officio member. 3. Members must bring important financial matters, appeals for financial assistance and all business affecting the policies of the Club to the attention of president(s) and/or the Board of Directors before presenting them to the Club. 4. No hard liquor may be served on the Club premises. 5. The Woman's Club of Carlsbad may seek and share information on legislative measures but does not endorse partisan measures or persons. 6. No equipment belonging to the Woman's Club of Carlsbad shall be rented or loaned for use other than Club functions. 7. An Auditor shall audit books of the Treasurer annually and a report shall be made to the Board of Directors and the Club. The treasurer(s) shall arrange for an audit to be made at the close of the fiscal year. O o 8. The Parliamentarian shall be the advisor to the President and Chairman of the Bylaws Revision Committee. She shall give an opinion on points of procedure when referred to her. She shall attend Board Meetings without a vote, and other meetings, at the request of the President. She shall call the first meeting of the Nominating Committee, instmct them and preside in the election of a Chairman. The Bylaws Committee shall meet every Febmary to review the Bylaws and Standing Rules. 9. The House Rental Chairman schedules rentals, issues Rental Contracts and collects fees. This person shall notify the Treasurer of security deposit refunds. The Board of Directors shall review the rental schedule and contract at the July Board meeting. 10. There shall be a policy of "No Smoking" in the building at any time. (These Standing Rules ofthe Woman's Club of Carlsbad were revised February 2013. These revisions take effect June 2013.) 11. A potential member may attend one Club Meeting and lunch as a guest of the Club. 12. The President(s)-shall be a guest of the Club at the regular luncheon meetings-and the Club shall pay for luncheons of the President at the District conferences. 13. Merchandise of "opportunities" may not be offered for sale without approval of the Board of Directors. 14. The expenses (transportation, hotel, registration and two banquets) of the President or a selected delegate shall be paid to the State Convention. Other convention funds as set up in the budget shall be disbursed at the direction of the Board of Directors. 15. Yearbooks may be distributed to members at the discretion ofthe Board of Directors. Procedure books are the property ofthe Club and shall be updated and retumed to the Dean of Chairman at the end of the Club year. WOMAN'S CLUB OF CARLSBAD (WCC) PHILANTHROPIC PROJECTS EDUCATION PROJECTS Project Tide: COLLEGE SCHOLARfflPS j WCC gives monetary college scholarships to deserving girls graduating from Carlsbad High Schools. A committee of members reviews applications and selects the girls based on their commitment to community service, grade point average, extra-curricular activities and financial need. The WCC donates approximately $5,500.00 to these scholarships. Project Title: NURSING SCHOLARSfflPS WCC gives scholarship money in the amount of $2,000.00 to selected and deserving girls planning to attend Nursing School after High School graduation. Project Title: SCHOOL STAFF APPRECLVTION FOR CARLSBAD UNIFIED WCC members recognize Carlsbad Unified employees during the month of September by delivering baskets of treats with personalized messages for each ofthe 14 schools and the district office. Project Title: BUS PASSES FOR CVA Throughout the year, WCC members provide monthly bus passes for needy students at the Carlsbad Village Academy. Students are selected by school staff based on their desire and commitment to learn. Due to financial difficulties, these students are unable to purchase the needed bus passes in order to attend school regularly. Project Title: BOX TOPS FOR EDUCATION WCC members collect box tops (valued at lOcents each) from participating products and submit them to the local schools to help raise money for school related projects. Project Titie: CAMPBELL'S LABELS FOR EDUCATION WCC members collect UPC codes from soup labels and submit them to help raise money for school related projects Project Title: TEEN JACKETS FOR CARLSBAD VILLAGE ACADEMY WCC members collect and donate jackets for homeless and needy teens attending the local continuation high school, Carlsbad Village Academy (CVA) Project Title: EMERGENCY TEACHER ASSISTANCE WCC recently supported the family of a local teacher who unexpectedly passed away, leaving the family with financial needs. {Attanhment C1 Project Title: TWIN VISION BRAILLE PROGRAM WCC members collect books which are sent to the American Action Fund for Blind Children for Brailing. From there, the books are circulated by the Keimeth Jemigan Library for Blind Children and Adults. Money was also donated by the WCC for pre- Braille books. Project Titie: COMMUNITY LIBRARY SUPPORT It is the custom of the WCC to purchase and donate books to the Carlsbad and Oceanside libraries in memory of members who have passed away. HOME LIFE PROJECTS Project Titie: COMFORT PILLOWS FOR TRI-CITY HOSPITAL ONCOLOGY WCC recognizes Breast Cancer Awareness month by making Comfort Pillows for Oncology patients at Tri-City Hospital. The pillows are used by the patients following surgery. Approximately 100 pillows are made each year. Project Title: STITCHES FROM THE HEART WCC supports the Stitches From the Heart program by knitting and crocheting neonatal caps for newborn preemies. The caps are sent to newborn babies across the coimtry. Approximately 50 caps are made each year. Project Title: HAT BOX FOUNDATION WCC supports the Hat Box Foundation program by knitting and crocheting caps for local youth and adults with cancer. Project Titie: KIDS NEWS DAY FOR CHILDREN'S HOSPITAL WCC supports the San Diego Children's Hospital Auxiliary to raise money for their yearly "Kids News Day" campaign by selling a special edition of the Union Tribune newspaper. The profits go directly to the hospital to fund children's programs. Project Titie: THORPE FOUNDATION WALKATHON WCC members donate and help at a walkathon to raise money for local families whose children are faced with major medical issues. The funds help to pay medical expenses. Project Titie: LYON'S CLUB PRESCRIPTION GLASSES DONATIONS Club members collect used prescription glasses that are refurbished and donated to needy recipients. Project Title: MEALS ON WHEELS WCC members prepare and deliver monthly tray favors such as bookmarks, mini notepads and holiday favors for Meals on Wheels recipients. Project Title: CARLSBAD XMAS BUREAU GIFT & FOOD DRIVE WCC supports the Carlsbad Xmas Bureau holiday gift and food drive that supports local needy families. The club donates money to buy gifts and food. Project Titie: RONALD MCDONALD HOUSE PENNIES WCC members collect pennies at monthly meetings which are tumed over to Ronald McDonald House to support their causes. Project Title: DIMES FOR KIDS In support of the Soroptimist Club, WCC participates in the "Dimes for Kids" project to support their efforts for children. Project Title: PAINTED TURTLE CAMP WCC sews and assembles turtle pillows for the Painted Turtle Camp for terminally ill children located by Lake Isabella, CA. Members also make and donate afghans, blankets and aprons to the camp. Project Title: TEEN FUEL BAGS FOR CVA WCC donates nutritious breakfast and snack items to Carlsbad Village Academy students in need of a healthy start to their school day. Project Title: BASIC TOILETRIES FOR WRC AND STANDUP FOR KIDS Members collect and donate travel and regular sized toiletries and other essential grooming items to the Woman's Resource Center and StandUp For Kids. Project Titie: ELIZABETH HOSPICE WCC donates money to the Hospice Center which assists families of terminally ill patients so they can live their last days at home. Project Title: FAMILY RECOVERY CENTER WCC donates money to the FRC in Oceanside which assists women dealing with substance abuse issues. While women are in treatment and/or recovery, the center provides support to them and their families. ADVOCATES FOR CHILDREN PROJECTS Project Title: STANDUP FOR KIDS CLOTHING WCC members donate essential items for tiie StandUp for Kids Program in Oceanside, an organization that provides homeless teens aged 12 to 20 with hot meals, showers, help with homework etc. hi Project Titie: STANDUP FOR KIDS- MONTHLY MEALS WCC members prepare and deliver up to 60 complete dinners each month for the StandUp for Kids program for homeless teens in Oceanside. Project Titie: STANDUP FOR KIDS-HOLIDAY SUPPORT WCC donates approximately $600 to the StandUp for Kids program during the holidays for the center to purchase gifts and necessities for the homeless teens. Project Title: PAYING FORWARD- TEACHING GENEROSITY FOR FRC WCC worked with a local Montessori school to teach children the value of generosity by collecting baby items to donate to less fortunate families participating in the Family Recovery Center in Oceanside. PUBLIC ISSUES PROJECTS Project Titie: CELL PHONES FOR SOLDIERS WCC donates cell phones and phone cards through a program by AT&T called "Cell Phones for Soldiers" that helps soldiers stay in contact witii their families throughout their deployment. Project Titie: YMCA ARMED SERVICES SECRET SANTA WCC participates in the Secret Santa program at the Camp Pendleton YMCA Armed Services for junior enlisted military families of E5 and below ranks. WCC adopts a family and purchases gifts for each family member. Project Titie: THANKS FOR OUR FREEDOM FOR CAMP PENDLETON WCC participates in the Secret Santa program for "Thanks for Our Freedom" at Camp Pendleton for families witii deployed service members. Project Title: WOUNDED WARRIOR PROJECT WCC donates money to the Wounded Warrior Project which assists military personnel wounded in combat. The WRC is a center for women and families dealing with domestic violence. INTERNATIONAL OUTREACH PROJECT Project Title: CANCELLED STAMPS FOR HANDICAPPED CHILDREN WCC members collect and send thousands of cancelled stamps to Norway where tiiey are sold to stamp collectors. The monies from these sales are used to support handicapped children. ARTS PROJECTS Project Title: CHS ART CONTEST WCC sponsors an Art Talent contest to support the art program at Carlsbad High School. 40 to 50 students submit entries that are then judged by tiie WCC members. Three winners are selected and awarded a $100.00, $75.00, and $50.00 gift certificates to Michael's for art supplies. Last year members eamed a first place and 2 Blue Ribbon prizes. Project Titie: CARLSBAD COMMUNITY THEATER WCC owns their clubhouse and rents it out to local groups such as the Carlsbad Community Theater (CCT). The WCC in support of tiie community theater program leases tiie space to them at a much reduced rate, saving the CCT $22,000 in fees. Count children over 8 when counting your guests. Exceeding the occupancy limit is cause to refuse the retum of the security deposit. 2. A security guard or two will be required for parties extending past 6 pm and having music and/or dancing. The cost will be added on to the contracted amount and collected at the same time as the rent. 3. Since the Club is in a residential area, noise levels must be kept to a level of no more than 90 decibels. The renter is responsible for informing the band or DJ of this restriction. All music must be in the building. TTie music must stop by 9:00 pm. The renter agrees to observe all city and state laws pertaining to said property noise laws. 4. The Club must be vacated and completely locked up by 10:00 PM. 5. No hard liquor is allowed. Champagne, wine, or beer in glasses, cups, cans or keg are allowed. 6. The piano may be used if you notify the Rental Chairman of your intentions. 7. Smoking is permitted outside the building only. Cigarette butts must be disposed of properly and not left on thee ground. 8. The throwing of rice, bird seed, or confetti is not allowed in or aroimd the premises. 9. Tents on the patio or the parking lot must meet all fire, safety, and permit requirements. Bounce toys are not permitted. 10. Decorations must be removable without marring the surfaces. Blue painter's tape can be used and removed carefully. Glue, regular tapes, nails, staples, or other defacing materials may not be used by renters. Lit candles are not allowed. 11. The Club's chairs and tables may be used inside and on the patio. 12. Renters may use the small kitchen or the large kitchen if arrangements are made ahead of time. The dishwasher MAY NOT BE USED. 13. Renters must leave the club in the order it was found, including cleaning up debris and spills. Chairs and tables must be retumed to the proper storage area unless custodian service was paid for. The patio, front yard and parking lot must also be left clean. All appliances, heaters, and lights must be tumed off. Kitchen sink and counters need to be wiped down and all trash left in the dumpster. 14. The keys may be obtained the day of the rental and left in the top drawer of the foyer desk when you finish your event. The keys must be kept in the possession of the renter at all times. 15. The renter is responsible for all damage or loss, by whatever cause, during the period of rental or occupancy; or after the period of rental or occupancy if the premises are left unsecured in any manner. Any damage and/or breakage shall be deducted from the security deposit. The renter is also responsible for the behavior of all persons on the premises. 16. The Woman's Club of Carlsbad is not, and will not be responsible for any loss or damage to personal belongings of the renter or guests while they are on the premises, or to the belongings left on the premises after the event. 17. Liability insurance may be secured by the renter at the renter's expense. Payment of Fees 1. A $300.00 security/ damage deposit will be collected when this application/ agreement is signed. 2. The deposit is refundable only if the premises are left in satisfactory condition. The premises should be left as clean and undamaged as when it was rented to you. See page 4 for more detail. 3. The security/ damage deposit will be forfeited if there is a cancellation within 30 days prior to your time of occupancy or within 60 days prior to your occupancy if you have rented a Saturday. 4. If the police are called to the Club due to disturbance or noise while you are renting the Club, and the situation can not be resolved, your entire deposit will be forfeited. Please be considerate of our neighbors. 5. The reflind of your deposit will be processed within 10 working days after the event and is fully refundable if the club is left in good order, the occupancy limit is not exceeded, music stops at 9 pm and the club is vacated by 10 pm. 6. All checks should be made payable to the Woman's Club of Carlsbad. If the balance of the payment is made less than 30 days before the event, the payment must be in the form of a cashier's check, money order or cash. Leaving the Club in Good Condition 1. Leave the club house in the same condition you received it. 2. Anything you brought in must be removed when you leave the premises. 3. The tables must be wiped clean, and any spills or accidents cleaned up. Store tables and chairs neatly as directed. 4. Trash should be put in the containers provided. Place garbage bags into the dumpster outside the kitchen door near the exit gate. Be sure to collect the trash from the restrooms also. 5. Stove burners and the oven must be tumed off. Clean up any spills on the stove. The refrigerator must be left tumed off and empty. Remove any water that may have collected in the bottom of the refrigerator. Use the sponge to prop the door open. Wipe down the kitchen counters and sinks. 6. All trash or debris must be picked up from the patio, parking lot, and driveways. Check for paper, cups, cigarette butts, candy wrappers, food, drink cans, decorations and party favors. 7. Tum off all lights including the parking lot lights. Tum the two heaters down to the lowest setting before you leave. 8. Make sure all windows and doors are closed and locked. The two exit doors in the main room need to be pulled closed to lock. Lock the parking lot gates. 9. Chairs and tables must be left where you found them. Tables should be wiped down if the have been spilled on. STACK THE CHAIRS NEATLY. No more tiian SIX chairs in a stack. DO NOT STACK IN FRONT OF VERTICAL BLINDS, or in front of tiie two metal poles on either side of the sliding doors. 10. Supervise children in the clubhouse and outdoors. Don't allow them to play in the parking lot. CHILDREN SHOULD NOT BE ALLOWED to handle or operate tiie stage curtain, vertical blinds, or pocket doors due to the delicate nature of the items. 11. Watch the kids outdoors. Don't allow them to play or walk on the planted areas or in the bushes. They should not play "throwing games" with the gravel, rocks, candy, food, or plant material. Standing on the benches or block walls, and hanging or climbing on the hand rails are prohibited. Be aware there is lighting in some of the planted areas that are delicate and can be damaged easily. The club must be left in good condition or you will lose all of your security deposit. Double check to see that there is no litter, food, or spills left. Indemnification To the fullest extent pemiitted by law, the renter shall indemnify and hold harmless the Club and its Officers, Directors, employees, and members fi*om claims, demands, causes of actions and liabilities of every kind and nature what so ever arising out of or in connection v^th renters activities conducted under this agreement. This indemnification shall extend to claims occurring after this agreement is terminated as well while it is in force. The indemnity shall apply regardless of any active and/or passive negligent act, or omission of the Club. The indemnity set forth herein shall not be limited by insurance requirements or by any other provision of this agreement. I am a big supporter of the Woman's Club of Carlsbad and all of their philanthropic endeavors. A few years ago, when fhe club house was in danger of being sold due to lack of revenue, I became a liaison between the Woman's Club and the Carlsbad Junior Woman's Club. This resulted in the two clubs eventually merging, bringing in yoimger members which has enlivened the club, brought in rental revenue to keep fhe facility open for community events and enabled fhe club to donate more resources back to the community. As a Board of Tmstees member of the Carlsbad Unified School District, I know first hand about the philanthropic work the Woman's Club does for the children of our community, from college scholarships to bus passes and jackets to needy high school students. The Woman's Club of Carlsbad provides low-priced, ideally suited rehearsal space to CCT at their clubhouse on 3320 Monroe Street. CCT faced increasing challenges obtaining rehearsal and perfomnance space within Carlsbad. In recent years many theatre companies were fomned in North County but theatre space remained the same. Competition for those spaces was great. The loss of priority status with the Carisbad Cultural Arts Center, our original home, has resulted in the facility being dosed to our use since 2011. We are, in effect homeless. We often needed to book venues outside of Carisbad for rehearsals and performances. The Woman's Club of Carisbad Is a service organization committed to community improvement through charity and volunteer work. We were fortunate to find their clubhouse was available and have become long-term renters. Their $60 a day non-profit weekday rental rate provides a consistent, affordable rehearsal space for our theatre company compared to other facilities in Carisbad. For example, the current Carisbad School district rate is $45 per hour. The Carisbad Community Theatre's focus is youth programming. The Woman's Club of Carisbad provides a safe, contained facility, ideally located in a central Carisbad neighborhood, close to schools. The versatile WCC facility serves our rehearsal needs perfectly. The large main room has a wood floor for teaching dance. A grand piano is used for vocal training. Tine small curtained stage area is perfect for staging small youth performances in a homey, welcoming environment. The facility also includes ample off-street parking, updated restroom facilities and a carpeted lobby space for study breaks. These combined elements cannot be found in other rental facilities in the Carisbad area. A generous grant from the Carisbad Charitable Foundation allowed the CCT to establish the Showcase Company in 2012. These advanced musical theatre students, ages 10-16, rehearse at the Woman's Club every Tuesday and Thursday from 3:30pm - 5:30pm. Over the last year Showcase has performed at Holiday at the Rancho, Halloween on Elm, the Rotary Oktoberfest, the Carisbad Kiwanis Club and more. On Friday, May 17, 2013 we performed an original musical review "The Dorothy Effect" at the Woman's Club. This perfomnance was open to the public. Over 130 Carisbad community members attended. An additional yeariy grant from the City of Carisbad's Cultural Arts Office helps support CCTs general programming. Carisbad Community Theatre is an excellent steward ofthe facility and surrounding neighborhood. We follow all Woman's Club facility rental mles. We observe all city noise ordinances. The use of the Woman's Club facility is vital to the success of our year-round programming of shows and workshops providing education and entertainment for Carisbad residents. The Woman's Club will further modify its rules based on its review of the rules of the Garden Club in Rancho Santa Fe. I believe these voluntary changes will help reduce the frequency of complaints the City receives regarding activities occurring at the Woman's Club. However, after reviewing the history of this matter, I have come to the conclusion that it is time to put these rules in writing in the CUP. As you know, the existing CUP was the first one granted in the history of the City. It contained only one condition that public dances not be held on the premises. It was apparently granted on the representation that your clients would be good neighbors, their uses would not interfere with any of the adjacent uses of property, and that the development of such a facility would be of benefit to the entire community. The number of complaints contained in this file indicate that your clients have not consistently adhered to all of them. This indicates a need for more certainty in the conduct of your clients' affairs. It is my understanding that your client allows church services to be conducted at its facilities every Sunday afternoon. While churches are allowed in all zones in Carlsbad, they must obtain a CUP. (CMC §21.42.010(2)(A)). If your client wishes to continue this use, it must apply for an amendment to its existing CUP. I would like to point out that the measures taken by the club, back in 1995, in an attempt to resolve these issues have not been successful. The telephone provided by the Woman's Club is never answered, when calls are returned (if they are), we get the 90 decibel response. The issue is not the beginning or end time of these events ,it is the amplified noise level during these functions. I notice that this letter also addressed the used of the facilities for church and the need for a separate CUP. (CMC 21.42.010.(2)(A). I would like to point out that there are church functions held at the club. There is one that took place for several weeks during the summer. Beginning at sun down and ending somewhere between 11:00 and 11:30, with loud prayer and chanting, that kept several of us awake. Weekly church functions do continue. The club does seem to be in violation of compliance with the request made in 1995. These issues did not go away, they were ignored, and requests for compliance were disregarded by the woman's club. The City did not follow through to ensure that the development benefit and enhance the neighborhood, as was it's intent (according to Mr. Ball). The Carlsbad Woman's Club is definitely not a "good neighbor" The City Attorney gave the Woman's Club a deadline of February 1,1995, to comply with a request to apply for a new CUP or face an administrative revocation of the existing CUP. We request that the city once again, please pick up where it left off and this time follow through to a resolution. A new CUP is definitely in order. While we arc grateful for your efforts, I would like to clarify that the Carlsbad High noise/traffic/par king/litter concerns and the Carlsbad Woman's Club noise issues are two separate efforts, each worthy of their own Individual consideration. While they both impact our rights to peace and quiet as tax paying residents of Carlsbad, each has its own distinct set of stakeholders and should not be conflated under any circumstance. To do so dilutes the importance of each. I would appreciate it if in our dealings with the Woman's Club that we do not complicate matters by involving the Carlsbad High issues. Clearly, Valerie and the Woman's Club have no control or impact on the issues surrounding Carlsbad High, and I would hate to burden them with these concerns. What is at issue here and within the Woman's Club's control, however, is the noise and disruption impacting the residents surrounding the Club's Immediate area, as far as the noise travels. As a resident living immediately adjacent to the Club, I can tell you that events begin every weekend between 4-5 pm and usually end at 10pm, with the exception of a few religious events that tend to extend beyond that time, and wherc people congregate in the Club parking lot and continue their gatherings. Our largest concern is with the extremely loud music and the thumping bass sounds that last sometimes more than 6 hours every weekend, on most Saturdays and some Sundays. During these times, it is impossible to enjoy our homes or back yards with our families; conversations cannot be had, and our music or television is almost impossible to enjoy, without having to compete with the noise from these disruptive events. We have a resident at the corner of Basswood and Monroe that has expressed the same problem. The quality of life for families is at stake here, and I am hopeful that the City can understand how very important this is, and how it negatively impacts us. As a point of clarification, we contacted Valerie and Corrine Stciger, club president, via telephone and in person the weekend of October 13, 2012 and via email October 17, 2012,( I have attached a copy of this email) in an attempt to resolve this issue calmly and amicably. We explained our concerns, and even provided examples to help humanize the issue and gain her understanding. Several of my neighbor's elementary- and middle-school-aged children, for instance, must sleep with ear plugs on the nights when the music is particularly loud. Unfortunately, Corrine's response was: "90 decibels is what the City allows - we are being good neighbors. You have to do what you have to do to get along." Valerie came to my home Saturday evening and used a decibel measure. She determined that 90 decibels was an ok level of sound. From this and past interactions, it is abundantly clear to me that leadership at the Woman's Club is neither reasonable nor sensitive to the neighborhood's concerns, and it is for this reason that I do not believe that mediation is an effective use of our collective time or of valuable and already strained City resources. To be quite honest, it appears that we are being disregarded, disrespected, and our rights as tax paying citizens are being are blatantly abused. Our request is that the City find a way to resolve this issue in a meaningful and decisive manner. This is a residential area and not a commercial entertainment area. Simply put, if the 1961 guidelines do not apply or work in 2012, perhaps it is time to establish some more relevant and pertinent guidelines and codes that protect the rights of tax paying citizens. As you may be aware, this issue is unfortunately a persistent one that our neighborhood has been struggling with for many yeors now. This issue was once addressed and the past board members agreed to control the noise levels. I am in the process of gathering documentation that I will forward to you shortly documenting these past efforts, which include the engagement of a local attorney to aid in neighborhood efforts. Legal action and negative media attention is not our preferred course of action, but it is an option we will be forced to consider should our requests for support and action continue to be inadequately addressed. Dear Ms. Shine: As we have previously shared with the Women's Club, our office as well as the Police Department has received complaints from neighbors regarding the Women's Club facility and routine noise disturbances from various events. The complainants have indicated that their primary concern is related to the "loud music and thumping bass sounds" and related disruptions from parties at the Club nearly every weekend, with music playing until 10pm on the weekends, both Saturdays and Sundays. The Carlsbad Police Department has confirmed that its officers have responded to noise complaints related to the property. The complaints have continued during the past month regarding the noise levels at the facility, with concerns expressed that these disturbances are not appropriate for a residential neighborhood. It is my understanding that the Women's Club is rented to private parties for a variety of events, as well as the Club itself has a number of events at the facility. The rental revenue provides funding for projects and programs to benefit Carisbad residents and others, which is commendable. While we understand that the Women's Club does have a conditional use permit (CUP) to allow for operation ofthe Women's Club and that CUP does not prohibit use of the facilities by other parties, it is my hope by contacting you and sharing the distress that some of your neighbors are experiencing as a result of activities at the Club that you will be able to take some actions to address the noise concerns. The Women's Club has indicated that they do not allow the music and other noise to exceed 90 decibels, and that this is a reasonable noise level supported by the City of Carisbad. From a City perspective, I wanted to share with you that a 90 decibel level is not acceptable, and is much too loud for a residential area. I have not found any city records which indicate that this was identified as an acceptable noise level for the Women's Club. According to sound experts, prolonged noise at 85 decibels or higher can cause ^ong term hearing loss. For protection of public health, the Environmental Protection Agency has proposed the following acceptable noise levels for neighborhoods: during waking hours - 55dB and during sleeping hours 45dB. The City's Entertainment Ordinance regulating commercial facilities such as restaurants, bars, etc. indicates that noise levels outside the facility should not exceed 65dB. Although your permit currently has no noise level limits, it is my hope that you will agree to limit the noise levels to at least 65dB, and preferably lower it to 55dB during the week and on Sunday. The Conditional Use Permit for the Women's Club is subject to annual review by the Community and Economic Development (CED) Department, and can be returned tothe Planning Commission for review during a public hearing at any time based on resident complaints or other concerns regarding the operations ofthe facility. This is what has been requested by the complaining parties. Our office, however, is hoping to obtain a voluntary concession from the Women's Club on the noise levels to resolve this matter. Please let me know at your eariiest convenience ifthe Women's Club is willing to agree to accept lower noise levels in an effort to resolve this neighborhood dispute. If not, the CUP will be forwarded to CED for review and for Planning Commission action as deemed appropriate. I live at 3285 Monroe St. We have lived here since 1998. Since then we have experienced increased crime, noise, trash and traffic in our area. The noise and traffic of persons unknown to are area are our biggest concems. We are directly affected. The noise carries from not only the evening events but the church services in the moming. Please consider this, all week there are school activities, it is loud and dismptive to our peace, then on Saturday night there is an event at the Womens club till 10 pm, which may be early for some folks but as a RN on call who may have to get up in the middle of the night to respond it can be quite late. On Sunday moming we are again summoned awake by praise music from the church/Womens club. We have no time to enjoy our weekend, no way to escape the noise before the work/school week starts again. It can be exhausting! As citizens we have the right to peaceful enjoyment of our property and environment. Much of the activity that surrounds the use of the club is noise pollution. We ask that you limit the use of the club to quiet day time activity and keep our neighborhood peaceful. For nearly 85 years, the Woman's Club of Carisbad has worked to raise funds for worthy enterprises. The present recipients include Carisbad High School scholarships, Paiomar College nursing education, the Twin Vision book program for blind children, restoration of the Cleveland National Forest the Oz North County program for at- risk youth, the Armed Forces YMCA, and North County Humane Society. The Club's service work also includes making pillows and blankets for the Paul Newman Camp for seriously ill children; and collecting useful articles for distribution to various charities. At DEMCCO'S monthly meetings and annual fundraiser, the Club makes clear to us their rules of operation. Any event renter is given the same guidelines. The Woman's Club is committed to the principle of being a good neighbor. The Club moved into its present clubhouse property in the late 1950's, very soon after Carisbad High School across the street opened its doors. This is an active block on Monroe Street. Prospective home buyers and renters would clearly know that when they choose to live there. DEMCCO, as a long time Woman's Club renter, asks that the City's CUP review include an analysis of the financial hardships an amendment might entail. Mr. Lynch gave a brief presentation and stated he would be available to answer any questions. Chairperson Siekmann asked if there were any questions of Staff. Commissioner Segall asked for the definition of a passive use for the patio. Mr. Lynch stated it is staffs intention that it would be a use that would not include an active use which generates excessive noise. A passive use would be a use such as buffets or rummage sales. Staff does not want to see dancing, live entertainment or music on the patio. Commissioner Segall asked if there could be tables outside on the patio for a luncheon. Mr. Lynch stated that if it were in a passive manner where the guests were dining casually would be acceptable. Commissioner Schumacher asked for clarification on Condition No. 9 regarding amplified music and if it pertains to interior or exterior music. Mr. Lynch stated the condition is referring to the restriction of interior music as no music or amplified sound is allowed outside. Commissioner Segall asked for clarification regarding the number of events for during the week and weekend. Mr. Lynch stated that it was to help limit the amount of activities on the site. Commissioner Segall asked if Friday night is considered a weekend night. Mr. Lynch stated yes. Chairperson Siekmann asked if there were any further questions of Staff. Seeing none, she asked if the applicant wished to make a presentation. Ms. Gernandt state yes. Commissioner Scully inquired as to how many ongoing agreements are in place for the remainder of the year. Ms. Gernandt stated about 2 per month but since the start of this process with the City, they have limited the events to 1 per weekend. Commissioner Scully commented that according to the paperwork that the Woman's Club submitted, there will be approximately 43 events held on Saturdays during the year. Ms. Gernandt responded stating that was what was done in the past. Commissioner Scully asked if they are going to a maximum of events on 24 Saturdays. Ms. Gernandt stated that if the CUP states the club can have one event each weekend, they may or may not have an event during the weekend. Commissioner Anderson commented that because of the installation of the air conditioning and the new windows, the closing of the windows is voluntary. Ms. Gernandt stated that it is not voluntary. She further commented that signs have been posted to remind guests to keep the doors and windows closed and to keep voices low so as to help minimize noise impacts to the neighbors. Commissioner Anderson commented on guests turning off the music at 9:00 during the weekend but remaining on the site until 10:00. Ms. Gernandt stated those rules have been in place for some time. It allows guests time to end the events and clean up the site and vacate the premises. Commissioner Segall asked if there is a restriction on smoking. Ms. Gernandt stated smoking is not allowed inside the building; however there is not a restriction on smoking outside. Commissioner Segall asked if they are agreeable to the proposed conditions. Ms. Gernandt stated yes. Commissioner Scully commented that one of the conditions requires a Woman's Club representative on site during any events and what would happen if the scheduled person is not available or does not show. Ms. Gernandt stated that is something the Club will have to address. Commissioner Anderson asked about the decibel level of the music. Ms. Gernandt stated rather than limiting the decibel level, the solution was to limit sounds outside the building. Chairperson Siekmann asked if there were any further questions of the applicant. Seeing none, she asked if there were any members of the audience who wished to speak on the item. Chairperson Siekmann opened public testimony on Item No. 4. Lisa Rodman, 3824 Carlsbad Blvd., Carlsbad, commented that the Woman's Club is a very important part of the community and urged the Commission to approve the CUP. Maria Villasenor-Curry, 2036 Linda Lane, Carlsbad, read a statement into the record stating her concerns regarding the Woman's Club. Commissioner Segall asked how long she has lived in the neighborhood. Ms. Villasenor-Curry stated 17 years. Julie Peebles-Peterson, 2045 Linda Lane, Carlsbad, commented that she has been impacted by the noise level from events held at the Woman's Club. She requested that the CUP not allow amplified music. Commissioner Anderson asked if the noise has always been an issue. Ms. Peebles-Patterson stated that it has significantly worsened over the years. Terri Polley, 3285 Monroe Street, Carlsbad, stated she is concerned with the noise and increased strangers in the neighborhood as well as the serving of alcohol at the site. Ronnie Kozlowski, 3435 Ridgecrest Drive, Carlsbad, a member of the Woman's Club and also a neighbor, stated the noise and traffic have never been an issue for her or her neighborhood. Carol Law, 1601 Gascony, Encinitas, commented that the Club is not located in a typical R-1 neighborhood. 11 Planning Commission Minutes October 2,2013 Page 6 Chairperson Siekmann asked if there were any other members of the audience who wished to speak on the item. Seeing none, she asked the applicant to respond to the issues raised during public testimony. Ms. Gernandt commented there was a communication breakdown between the Club and the residents in the past. The Club recently tried to reach out the neighbors but the neighbors were unavailable or did not want to meet. Chairperson Siekmann asked if there were any questions. Commissioner Schumacher asked about communication with the neighborhood and if there is a published point of contact for any issues. Ms. Gernandt commented that with the new CUP, the club is required to post on the outside of the building the name of the person holding the event, the hours of operation, a contact person and a phone number. Commissioner Schumacher asked if the contact person will be the same person for each event Ms. Gernandt commented that she would like to institute a hotline number for the Club, which is not currently proposed with the new CUP. Commissioner Segall inquired about the sales of alcohol at the site. Ms. Gernandt stated that when there is a Woman's Club function, alcohol is not sold, but it can be served to guests. She commented that the comedy club does sell alcohol. A part of the new CUP states the members of the Woman's Club need to attend training in order to sen/e alcohol. Ms. Gernandt stated that alcohol is not sold to the public. Commissioner Segall asked Ms. Gernandt if the Woman's Club would be opposed to an additional condition about no smoking on the premises. Ms. Gernandt commented that that would be acceptable. Commissioner Anderson asked about the contact number. Ms. Gernandt stated that it was her understanding that there is a requirement for 2 numbers, one for the person holding the event and one for a representative of the Woman's Club. Commissioner Anderson asked if the security guards leave the premises at 9:00. Ms. Gernandt stated the guards stay onsite until 10:00. Chairperson Siekmann inquired about the comedy club and asked if it is a public invited event Ms. Gernandt stated the event is posted on a website, and tickets are sold to limit the number of participants to less than 150. Commissioner Anderson inquired about keeping a renter's deposit if the police are called during an event. Ms. Gernandt commented that it not currently being done but it can be instituted. Chairperson Siekmann closed public testimony on Agenda Item 4 and asked Staff to respond to any issues raised during public testimony. Mr. Lynch commented that, for information purposes, in order to properly mitigate a building for the bass that comes from amplified music is very cost prohibitive. Commissioner Schumacher asked if each renter brings in their own music system. Ms. Gernandt stated that the Woman's Club has its own amplified system that is used only for speaking. Generally, DJs do not want to use that system for music and bring in their own system. DISCUSSION Commissioner Segall thanked the Woman's Club for coming fonA/ard with recommendations for change and their attempts at trying to mitigate some of the neighbors' concerns. He stated that he is concerned with smoking on the site. Commissioner Segall commented that the term "passive" in Condition No. 13, item 7, needs to be clearly defined so as not to take away uses such as lunches on the patio. He further commented that he is concerned about the complaint process regarding the CUP regulations. Commissioner Scully commented that there is no doubt the Woman's Club provides great things to the community; however, she would like to see the amount of weekends reduced to once a month, twice a month at a maximum. She further stated she would like to see a time limit on the CUP, perhaps 2 years. Commissioner Scully stated she cannot approve the project as it is proposed. ||5 Planning Commission Minutes October 2,2013 Page 7 Commissioner Anderson stated her concurrence with Commissioner Scully. She commented that the site was originally intended to be a meeting hall, not a banquet hall. Commissioner Anderson would like to see a limit on the number of activities at the site. Commissioner Schumacher stated the changes are long overdue. He commented that he appreciates the applicant's proactive approach with the changes they have made so far. Commissioner Schumacher further commented that it is hard to know whether the new restrictions will be enough or too much. He stated that he likes some of the suggestions stated by his fellow Commissioners such as no smoking on the premises, a hotline number to someone in the club during events, and shortening the length of the CUP. Commissioner Schumacher commented that the underlying issue with the number of events at the site is the amplification of the music not necessarily the quantity of events. He also commented that he would not like to have complaints come in while the applicant is still working out some of the operational issues and have the CUP threatened. Chairperson Siekmann agrees with restricting smoking on the site. She feels the passive use issue will work itself out. She stated that including a time limit on the CUP of maybe one or two years is an excellent idea as it would allow some time to see if the changes are working. Chairperson Siekmann suggested that the Commission add a restriction on the number of events that can have amplified sound. She further stated that the policing of the site needs to be handled through the police. Chairperson Siekmann also stated that the issues regarding the sen/ing and sale of alcohol will be handled through the conditions. She stated that the idea of including a phone number or hotline is a great idea and should be included on any signs regarding upcoming events. The Commission discussed and voted on the following issues NO SMOKING ON PREMISES The Commission voted 5-0 to include a restriction of no smoking on the premises. TIMEFRAME The Commission voted 5-0 to include a one year status update with the subsequent review to be set at that time. WEEKENDS and AMPLIFIED EVENTS Commissioner Anderson proposed a restriction to limit amplified music to two weekend events per month. The Commission voted 2-3 (Schumacher, Segall, and Siekmann) and the motion failed. LIMIT OUTDOOR DINING TO DAYLIGHT HOURS Commissioner Anderson proposed limiting the outdoor dining to daylight hours only. The Commission vote 1-4 (Schumacher, Scully, Segall, and Siekmann) and the motion failed. PASSIVE EVENTS The Commission voted 4-1 (Anderson) to enhance the definition of "passive" as "Only passive uses of the patio, including outdoor dining, silent auctions and rummage sales, are permitted." HOTLINE NUMBER The Commission voted 5-0 to have the applicant establish a hotline number to go to a member of the Woman's Club and to be posted on the sign for events. Mr. Neu stated that situation could happen; however, in terms revoking or modifying the permit, it would have to come before the Commission. Commissioner Anderson suggested that it would be beneficial to add back into the rental agreement that the deposit would be forfeited if police were called and for it to be left to the discretion of the Woman's Club. Ms. Mobaldi commented that ordinarily the City does not want to dictate what goes into private agreements between parties. It is ultimately up to the Woman's Club as to how they comply with the conditions set forth in the CUP and how they get compliance from the people they have contracts with. TERM LIMITS The Commission voted 4-1 (Segall) to include a 5 year limit on the CUP.
