ITEM EXPLANATION;
2013-280 approving amendments to the
The 2012 Regional Transportation Improvement Program (RTIP) is a program of proposed highway,
arterial, transit, and bikeway projects for Fiscal Years 2012-13 through 2016-17. The San DIego
Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt the
RTIP every two years. The RTIP can be amended, as needed, on a quarterly basis during the two year
period between the adoption ofthe 2012 RTIP and the subsequent 2014 RTIP. SANDAG is currently in
the process of preparing for Amendment No. 12 to the 2012 RTIP.
This action will amend the Carlsbad Program of Projects which will then be utilized to by SANDAG to
amend the 2012 RTIP as described above. The amendment will add two new projects so that the City of
Carlsbad can expend TransNet Local funds to implement the projects.
The first new project to be added to the Carlsbad Program of Projects is the ADA Improvement Program
as approved by the City Council as part of the adoption of the 2013-14 Capital Improvement Program
(CIP). As Included In the 2013-14 CIP this project Is programmed to receive $1,670,000 in TransNet Local
funds over the next 7 years.
The second new project to be added is the Regional Arterial Management System (RAMS). As part of
the RAMS program each agency throughout the region agreed to establish a common platform to allow
communication and the exchange of data through a regional communications network. This allows
individual agencies to leverage knowledge and support across the region and enables cooperative efforts
to create synchronized and coordinated signal timing plans. This enables smoother traffic flows across
jurisdictional boundaries including freeway access. This level of coordination via improvements in signal
timing have been documented to provide significant benefits to cities and citizens and are considered a
cost effective strategy for reducing traffic congestion and improving air quality. By adding this project
that the City will be able to continue using TransNet Local funds for the support and maintenance of the
Regional Arterial Management System (RAMS).

The regional cost sharing model, which allocates the total cost of $236,000, Is based on the participation
of the fourteen SANDAG member local agencies, Caltrans and SANDAG Itself The cost-sharing mode as
recommended by the San Diego Regional Traffic Engineers Council (SANTEC) and the City/County
Transportation Advisory Committee (CTAC) of SANDAG is based on a baseline cost of $5,000 per agency,
with the remaining regional costs prorated by the number of traffic signals operated by each agency. As
the regional agency with no traffic signals, SANDAG's share is 1/16 ofthe total cost, or $15,000. Based on
this methodology the City of Carlsbad's cost share for the current fiscal year is $11,700.
FISCAL IMPACT;
This amendment consists of the addition of two new projects to the City's program of projects and the
RTIP. The inclusion of projects on the RTIP Is a requirement under State Law for receiving TransNet,
State and Federal funds.
The addition ofthe ADA Improvement Program will enable the City to expend the TransNet Local funds
as programmed In the most recently adopted Capital Improvement Program. The addition of the
Regional Arterial Management System will enable the City to utilize TransNet Local funds to pay for the
City's share ofthe system for the current fiscal year.
ENVIRONMENTAL IMPACT;
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15276 - which states that CEQA does not apply to the development or adoption of regional
transportation improvement programs; however, individual projects developed pursuant to these
programs shall remain subject to CEQA.

^ WHEREAS, on November 4, 2004, the voters of San Diego County approved the
y San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
8 Extension Ordinance); and
WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
Regional Transportation Commission, shall approve a multi-year program of projects submitted
by local jurisdictions identifying those transportation projects eligible to use transportation
sales tax (TransNet) funds; and

14 WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
15 improvement revenues for Fiscal Years 2012-13 through 2016-17; and
WHEREAS, the City of Carlsbad has held a clearly noticed public hearing with an agenda
item that clearly identified the proposed list of projects prior to approval ofthe projects by its
authorized legislative body in accordance with Section 5(A) of the TransNet Extension
Ordinance and Rule 7 ofthe SANDAG Board Policy 31.

21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
22 California, as follows:

2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of
Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds

1 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
^ Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet
revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this
requirement permitted under the Ordinance and proposed shall be clearly noticed as part of
the City of Carlsbad's public hearing process.
7 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
8 Carlsbad certifies that the required minimum annual level of local discretionary funds to be
^ expended for street and road purposes will be met throughout the 5-year period consistent
with the most recent Maintenance of Effort Requirements adopted by SANDAG.
5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
Carlsbad certifies that it will extract $2,000, plus all applicable annual increases, from the
14 private sector for each newly constructed residential housing unit in the City of Carlsbad to
15 comply with the provisions of the Regional Transportation Congestion Improvement Program
(RTCIP).
6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of
Carlsbad certifies that is has established a separate Transportation Improvement Account for
TransNet Revenue with interest earned expended only for those purposes for which the funds

Carlsbad certifies that each project of $250,000 or more will be clearly designated during

1 8. That the City of Carlsbad does hereby certify that all other applicable provisions of
^ the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met.

9. That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG,

the San Diego County Regional Transportation Commission, and all officers and employees

thereof against all causes of action or claims related to local TransNet funded projects.

7 10. That the amendments to the Carlsbad TransNet Local Street Improvement Program
8 of Projects for Fiscal Years 2012-13 through 2016-17 attached to this Resolution as Exhibit A is
hereby approved.
