CED INTRODUCING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CAUFORNIA, AMENDING CARLSBAD MUNICIPAL CODE, TITLE 17, CHAPTER 17.04 (FIRE CODE) CITY MANAGER RECOMMENDED ACTION: Introduce Ordinance No. CS-246 . amending the Carlsbad Municipal Code, Title 17, Chapter 17.04, Fire Prevention code. After Introduction the City clerk will commence the noticing period, per Government Code Section 6066, for a public heanng adopting Ordinance No. CS-246 . ITEM EXPLANATION: Staff is proposing to adopt the 2013 California Fire Code, as amended. The Fire Code is adopted by the California Building Standards Commission and was enforced statewide effective January 1, 2014. Local jurisdictions are required to enforce these regulations as the minimum standards for construction throughout the State. The adoption of this code as recommended will bring the city into compliance with the State requirements. Local amendments are also proposed with this adoption. Amendments to the California construction codes are necessary due to the city's unique local climatic, geological, or topographical conditions or infrastructure limitations. These local amendments include carry over code provisions adopted in previous years by City Council and new amendments deemed necessary due to local conditions and to provide uniformity between the Municipal, Fire and Building codes. A summary ofthe city's approach to this code adoption and the proposed significant changes or additions to the code are included in this agenda bill as Attachment 3. The Building and related construction codes are adopted and enforced as companion codes. The summary of changes is included for reference in this agenda bill and agenda bill (AB# 21,544 ) adopting the California Building and related construction codes. No fee increase to Fire Code is proposed by any of these actions. Fire permit fees will be adopted in a separate master fee resolution. FISCAL IMPACT: No fee modifications are proposed by these ordinances. Fire, building and other permit fees was reviewed as part of the Finance Departments 2013-2014 master fee schedule and was effective September 1, 2013. CS-246 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REPEALING EXISTING CHAPTER 3 17.04 OF THE CARLSBAD MUNICIPAL CODE, AND ADOPTING A NEW CHAPTER 17.04, FIRE PREVENTION CODE BASED ON 4 THE 2013 CALIFORNIA FIRE CODE. 5 WHEREAS, Health & Safety Code Section 17958 mandates that the CaHsbad 6 Fire Department shall adopt ordinances or regulations imposing the same requirements as are 7 contained in the regulations adopted by the State pursuant to Health & Safety Code, Section 8 17922; and 9 WHEREAS, the State of California is mandated by Health & Safety Code Section 17922 to impose the same requirements as are contained in the 2013 California Fire Code, 11 hereinafter referred to collectively as the Fire Code; and 12 WHEREAS, the State of California has adopted and published California Code of Regulations Title 24, Part 9 as the California Fire Code, effective January 1, 2014; and ^4 WHEREAS, on January 1, 2014, all existing fire code adoptions and amendments of local agencies automatically reverted to the new State code unless new local adoptions and local amendments are made; and WHEREAS, the State of California is mandated by Health & Safety Code section 17922 to impose the same requirements as are contained in the 2013 California Fire Code, and together with the CaHsbad Fire Department local amendments, these shall be the CaHsbad Fire Department Fire Code; and WHEREAS, code amendments adopted by the State of California shall take precedence over the 2013 California Fire Code language. The 2013 California Fire Code language shall be used for those code sections not adopted by the State; and WHEREAS, local amendments adopted by the CaHsbad Fire Department shall take precedence over the 2013 California Fire Code; and WHEREAS, Health & Safety Code Section 17958.5 permits the CaHsbad Fire Department to make local amendments to the Code as are reasonably necessary because of local conditions; and 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3 1 WHEREAS, Health & Safety Code Section 17958.7 requires that the CaHsbad 2 Fire Department before making any local amendments pursuant to Section 17958.5 make 3 express findings that such local amendments are needed due to climatic, geographic, or 4 topographic conditions; and 5 WHEREAS, the City Council of the City of CaHsbad, California does herewith find 6 that the City of CaHsbad has certain climatic, geologic, and topographical features that can have 7 a deleteHous effect on emergency services such as fire protection and emergency medical 8 services; and 9 WHEREAS, the CaHsbad Fire Department finds that the local amendments to the 10 2013 California Fire Code are reasonably necessary because of the local climatic, geological, 11 and topographical conditions; and 12 WHEREAS, this finding recognizes regional geologic conditions and the 13 likelihood of numerous structure fires following a greater magnitude seismic event. It also 14 considered the limited ability of local emergency services to provide fire protection due to extraordinary service demands following such events; and 1^ WHEREAS, further basis for the finding is concern for local topographic conditions and irregular elevations along pHmary travel routes throughout the City. The City amends the provisions of the 2013 California Fire Code to include the 6 requirements of the 2013 Edition of the International Fire Code including Appendix Chapters 4 and Appendices B (as amended), BB, C, D (as amended), F, G, H, 1, J and K (amended) as 7 published by the International Code Council for those occupancies not subject to the 2013 California Fire Code. As adopted and amended herein, the 2013 California Fire Code becomes 8 the Fire Code of the City of CaHsbad. 9 17.04.020 Chapter 1, Division il. Part 1, Section 101.5 Validity - Amended 10 Chapter 1, Division 11, Part 1, Section 101.5 of the California Fire Code is amended to read as follows: 11 The City Council of the City of CaHsbad hereby declares that should any section, paragraph, 12 sentence or word of this Ordinance or of the City of CaHsbad Municipal Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have 13 passed all other portions of this Ordinance independently of the elimination here from of any such portion as may be declared invalid. 14 17.04.030 Chapter 1, Division il. Part 1, Section 102.5 Application of California 15 Residentiai Code - Amended 16 Chapter 1, Division II, Part 1, Section 102.5 of the California Fire Code is amended to read as follows: 17 Where structures are designed and constructed in accordance with the California Residential 18 Code, the provisions of this code shall apply as follows: 19 1. Construction and designed provisions: Provisions of this code pertaining to the extenor of the structure shall apply including, but not limited to, premises identification, fire apparatus 20 access, water supplies, and Section 903.2. Where interior or exterior systems or devices are installed, construction permits required by Section 105.7 of this code shall also apply. 21 2. Administrative, operational, and maintenance provisions: all such provisions of this code 22 shall apply. 23 17.04.040 Chapter 1, Division il. Part 2, Section 109.3 Violation penalties - Amended 24 Chapter 1, Division 11, Section 109.3 ofthe California Fire Code is amended to read as follows: 25 Any person who violates any of the provisions of this code hereby adopted or fails to comply 26 therewith, or who violates or fails to comply with any order made there-under, or who builds in violation of any detailed statement or specification or plans submitted and approved there- 27 under, or any certificate or permit issued there-under, and from which no timely appeal has 28 1 been taken, or who fails to comply with such an order as affirmed or modified by the City Attorney of the City of Carisbad or by a court of competent jurisdiction within the time fixed 2 herein, shall severally for each and every violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine not exceeding $1,000 or by imprisonment in County Jail 3 not exceeding six months, or both. 4 The imposition of one penalty of any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects 5 within a reasonable time; and when not othenA/ise specified, each day that prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall 6 not be held to prevent the enforced removal of prohibited conditions. 7 17.04.050 Chapter 1, Division il. Part 2, Section 111.4 Failure to comply - Amended 8 Chapter 1, Division II, Section 111.4 ofthe California Fire Code is amended to read as follows: 9 Any person, who continues any work after having been served with a stop work order, except 10 such work as that the person is directed to perform to remove a violation or unsafe condition, shall be liable for a fine of not less than $250 or more than $1,000. 11 17.04.060 Chapter 1, Division il. Part 2, Section 113.3 Work commencing prior to 12 issuance of permit - Amended 13 Chapter 1, Division II, Section 113.3 ofthe California Fire Code is amended to read as follows: 14 Any person who commences any work, activity or operation regulated by this code prior to the 15 issuance or obtaining the required and necessary permits shall be subject to an additional fee that is equal to the original permit fee, which shall be in addition to the required permit fees. 16 17.04.070 Recovery of costs - Amended 17 The City shall be entitled to recover the cost of emergency services as described in subsections 18 1 through 5 below. Service costs shall be computed by the fire department under the direction of the city finance department and shall include the costs of personnel, equipment facilities, 19 materials and other external resources. 20 1. Any person or corporation who allows a hazard to exist on property under control of that person or corporation, after having been ordered by the fire department or other city 21 department to abate that hazard, is liable for the cost of services provided by the fire department should an emergency arise as a result of said unabated hazard. 22 2. Any person or corporation whose negligence causes an incident to occur on any public or 23 private street, driveway or highway, which, for the purposes of life, property or environmental protection, places a service demand on the city fire department resources beyond the scope 24 of routine service delivery, shall be liable for all costs associated with that service demand. 25 3. Any person or corporation responsible for property equipped with fire protection or detection devices which, due to malfunction, improper manipulation or negligent operation causes a 26 needless response by the fire department to the property shall, for a period of twelve months after written notification by the fire prevention bureau, be liable for all future costs associated 27 with each subsequent needless response caused by those devices. 28 1 4. Any person or corporation who conducts unlawful activity which results in fire, explosion, chemical release or any other incident to which the fire department responds for the purpose 2 of performing services necessary for the protection of life, property or the environment, shall be liable for the costs associated with the delivery of those services. 3 When, in the interest of public safety, the fire chief, pursuant to Section 2501.18 of this code, 4 assigns fire department employees as standby personnel at any event, or upon any premise, the person or corporation responsible for the event or premises shall reimburse the 5 fire department for all costs associated with the standby services. 6 17.04.080 Section 201.3 Terms defined in other codes - Amended 7 Section 201.3 of the California Fire Code is amended to read as follows: 8 Where terms are not defined in this code and are defined in the California Building Code, California Mechanical Code, California Plumbing Code, California Residential Code and the 9 International Urban-Wildland Interface Code, such terms shall have the meanings ascribed to them as in those codes. 27 28 17.04.090 Section 202 Definitions - Fire hazard - Amended Section 202 of the California Fire Code is amended to read as follows: 17.04.100 Section 202 Definitions - High Fire Hazard Severity Zone - Amended Section 202 of the California Fire Code is amended to read as follows: 10 11 12 "Fire hazard" is anything or act that increases or could cause an increase of the hazard or 13 menace of fire to a greater degree than customarily recognized as normal by persons in the public service regularly engaged in preventing, suppressing or extinguishing fire or anything or 14 act which could obstruct, delay, hinder or interfere with the operations of the fire department or the egress of occupants in the event of fire. 15 • 16 17 "High Fire Hazard Severity Zone" is any geographic area designated in accordance with 18 California Government Code § 51178, which contains the type and condition of vegetation, topography, weather and structure density which potentially increases the possibility of wildland 19 conflagrations. 20 17.04.110 Section 202 Definitions - High-rise building - Amended 21 Section 202 of the California Fire Code is amended to read as follows: 22 "High-rise building," as used in this code: "Existing high-rise building" means a high-rise building, the construction of which is commenced or completed prior to July 1, 1974. "High-rise 23 building" means every building of any type of construction or occupancy having floors used for human occupancy located more than 55-feet above the lowest floor level having building access 24 (see California Building Code, Section 403.1.2), except buildings used as hospitals as defined in Health and Safety Code Section 1250. "New high-rise building" means a high-rise building, the 25 construction of which is commenced on or after July 1, 1974, 26 17.04.120 Section 202 Definitions - Ignition-resistant material - Amended Section 202 of the California Fire Code is amended to read as follows: -7- 1 "Ignition-resistant material" is defined as any product which, when tested in accordance with ASTM E84 for a period of 30 minutes, shall have a flame spread of not over 25 feet, and show 2 no evidence of progressive combustion. In addition, the flame front shall not progress more than 10.5 feet (3,200 mm) beyond the centeriine ofthe burner at any time during the test. 3 Materials shall pass the accelerated weathering test and be identified as Exterior type, in 4 accordance with ASTM D 2898 and ASTM D 3201 5 Alt materials shall bear identification showing the fire performance rating thereof. That identification shall be issued by ICC—ES or a testing facility recognized by the State Fire 6 Marshal having a service for inspection of materials at the factory. 7 Fire-Retardant-Treated Wood or noncombustible materials as defined in Section 202 shall satisfy the intent of this section. 8 The enforcing agency may use other definitions of "ignition-resistant material" that reflect wildfire 9 exposure to building materials and/or their materials performance in resisting ignition. 10 17.04.130 Section 202 Definitions - Jurisdiction - Amended 11 Section 202 of the California Fire Code is amended to read as follows: 12 "Jurisdiction" shall mean the City of Carisbad. 13 17.04.140 Section 202 Definitions - Projections - Amended 14 Section 202 of the California Fire Code is amended to read as follows: 15 "Projections" are defined as cornices, eave overhangs, exterior balconies and similar projections extending beyond the floor area. Projections shall conform to the requirements of Section 704.2 16 and Section 1406 of the California Building Code. Exterior egress balconies and exterior exit staiRA/ays shall also comply with Section 1014.5 and 1023.1 of the California Building Code, 17 respectively. Projections shall not extend beyond the distance determined by the following two methods, whichever results in the lesser projection: i: 1. A point one4hird the distance to the lot line from an assumed vertical plane located where 19 protected openings are required in accordance with California Building Code Section 704.8, but not less than five feet from the lot line. 20 2. Group R-3, and Group U when used as accessory to Group R-3, shall be constructed not 21 less than five feet from any lot line without having a fire resistance rated exterior wall and openings that are protected as set forth in Table 5-A of the California Building Code. 17.04.150 Section 202 Definitions - Vegetation - Amended Section 202 of the California Fire Code is amended to read as follows: 22 23 24 "Vegetation" means weeds, grass, vines or other organic (cellulose) growth that is capable of 25 being ignited and endangering property, and such vegetation shall be cut down and removed by the owner or occupant of the premises. Vegetation clearance requirements in urban-wildland 26 interface areas shall be in accordance with City of Carisbad standards. 27 17.04.160 Section 304.1.2 Definitions - Vegetation - Amended 28 •8- 1 Chapter 3, Section 304.1.2 of the California Fire Code is amended to read as follows: 2 "Vegetation" means weeds, grass, vines or other organic (cellulose) growth that is capable of being ignited and endangering property, and such vegetation shall be cut down and removed by 3 the owner or occupant of the premises. Vegetation clearance requirements in urban-wildland interface areas shall be in accordance with City of Carisbad standards 4 5 6 follows: 17.04.170 Section 307.5.1 Adult supervision at open fires - Amended Chapter 3 of the California Fire Code is amended to add Section 307.5.1 to read as 7 An adult (as defined in Webster's New World Dictionary-Eleventh College Edition) must be present at all times to watch and tend outdoor fires. 17.04.180 Section 312.2 (5) Posts - Amended Chapter 3, Section 312.2(5) ofthe California Fire Code is amended to read as follows: Posts shall be located not less than 5-feet (152.5 mm) from the protected object. 17.04.190 316.3 Pitfalls - Amended Chapter 3, Section 316.3 of the California Fire Code is amended to read as follows: 8 9 10 11 12 13 .. When pitfalls are installed in violation of this code, the California Penal Code shall be used for 14 penalties, and violations of this section. 15 17.04.200 Section 318 General storage of firewood - Amended 16 Chapter 3, Section 318 ofthe California Fire Code is amended to read as follows: 17 Firewood shall not be stored in unenclosed spaces beneath buildings or structures, or on decks or under eaves, canopies or other projections or overhangs. When required by the fire code 18 official, storage of firewood material stored in the defensible space shall be located a minimum of 30 feet (9,144 mm) from structures and separated from the crown of trees by a minimum of 19 15 feet (4,572 mm), measured horizontally. Firewood and combustible materials not for consumption on the premises shall be stored so as to not pose a hazard. 21 22 23 24 25 26 27 28 17.04.210 Section 319 Maintenance of Fire Suppression Zones - Amended Chapter 3, Section 319 ofthe California Fire Code is amended to read as follows: Sec. 319.1 When required. An application for a development permit for any property located in a wildland-urban interface fire area shall be required to have a Fire Protection Plan (FPP) approved by the fire code official, as part ofthe approval process. Section 319.2 Content. The FPP shall consider location, topography, geology, aspect, combustible vegetation (fuel types), climatic conditions and fire history. The plan shall address the following in terms of compliance with applicable codes and regulations including but not limited to: water supply, primary access, secondary access, travel time to nearest serving fire station, structural ignitability, structure set back, ignition-resistive building features, fire 1 protection systems and equipment, impacts to existing emergency services, defensible space and vegetation management. 2 Section 319.4 Maintenance of defensible space. Any person owning, leasing, controlling, 3 operating or maintaining a building or structure required to establish a fuel modification zone pursuant to City of Carisbad development standards shall maintain the defensible space. The 4 Fire Authority Having Jurisdiction (FAHJ) may enter the property to determine if the person responsible is complying with this section. The FAHJ may issue an order to the person 5 responsible for maintaining the defensible space directing the person to modify or remove non- fire resistant vegetation from defensible space areas, remove leaves, needles and other dead 6 vegetative material from the roof of a building or structure, maintain trees as required by this section or to take other action the FAHJ determines is necessary to comply with the intent of 7 this section. 8 Section 319.5 Responsibility. Persons owning, leasing, controlling, operating or maintaining buildings or structures are responsible for maintenance of defensible spaces. Maintenance of 9 the defensible space shall be annually or as determined by the FAHJ and may include, but not be limited to, the modification or removal of non-fire resistive vegetation and keeping leaves, 10 needles and other dead vegetative material regulariy removed from roofs of buildings and structures. 11 Section 319.6 Trees. Crowns of trees located within defensible space shall maintain a minimum 12 horizontal clearance of 10 (3,048 mm) feet for fire resistant trees and 30 feet (9,144 mm) for non-fire resistive trees. Mature trees shall be pruned to remove limbs one4hird the height or six 13 feet, whichever is less, above the ground surface adjacent to the trees. Dead wood and litter shall be regulariy removed from trees. Ornamental trees shall be limited to groupings of two to 14 three trees with canopies for each grouping separated horizontally as described in the International Wildland Urban Interface Code (IWUIC). 15 16 17 19 20 21 22 24 25 26 27 28 17.04.220 Section 503.2.1 Dimensions - Amended Chapter 5, Section 503.2.1 ofthe California Fire Code is amended to read as follows: Fire apparatus access roads shall have an unobstructed width of not less than 24 feet (7,315 mm) exclusive of shoulders, except for approved security gates in accordance with section 503.6 and an unobstructed vertical clearance or "Clear-to-sky". 17.04.230 Section 503.2.1.1 Minimum street width in fire hazard zones - Amended Chapter 5, Section 503.2.1.1 ofthe California Fire Code is amended to read as follows: Public and private streets shall have a minimum unobstructed width of 28 foot (8,534 mm) clear travel way where adjacent lots are located within designated Fire Hazard Zones/Fire 2^ Suppression Zone. 17.04.240 Section 503.2.1.2 Measurement of street width - Amended Chapter 5, Section 503.2.1.2 ofthe California Fire Code is amended to read as follows: Street widths are to be measured from face-of-curb to face-of-curb on streets with curb and gutter, and from flow-line to flow-line on streets with rolled curbs. •10- 1 17.04.250 Section 503.2.1.3 Measurement of street width - Single Entry Development - Amended 2 Chapter 5, Section 503.2.1.3 ofthe California Fire Code is amended to read as follows: 3 Single entry developments may be permitted with special approval of the Fire Code Official. 4 A 36 foot (10,972 mm) curb-to-curb residential street may be provided for a street that serves 24 or less dwelling units. If adjacent lots contain any portion of a Fire Hazard 5 Zone/Fire Suppression Zone within the property line, a 42 foot (12,801 mm) curb-to-curb street is required. 6 With special approval of the Fire Code Official and the City Engineer, 40 foot (12,192 mm) 7 curb-to-curb residential street may serve 50 or less dwelling units. If adjacent lots contain any portion of a Fire Hazard Zone/Fire Suppression Zone, a 42 foot (12,801 mm) curb-to- 8 curb distance is required. 9 3. With approval of the Fire Code Official and the City Engineer, a four lane secondary arterial with a raised median or major arterial may be allowed when all of the following conditions 10 are met: 11 a. The length of street does not exceed one-half mile. b. Traffic volume at entrance does not exceed 3,000 ADT. 12 c. All buildings are equipped with automatic fire sprinkler systems. 13 4. With approval of the Fire Code Official and City Engineer, a 52 foot (15,849 mm) wide curb- j4 to-curb industrial street and may be allowed when all of the following conditions are met: j3 a. The length of street does not exceed one-half mile. b. Traffic volume at entrance does not exceed 3,000 ADT. c. All buildings are equipped with automatic fire sprinkler systems. 17.04.260 Section 503.2.3 Surface - Amended Section 503.2.3 ofthe California Fire Code is amended to read as follows: 16 17 18 19 Fire apparatus access roads shall be designed and maintained to support not less than 75,000 20 lbs. (unless authorized by the Fire Code Official) and shall be provided with an approved paved surface so as to provide all-weather driving capabilities. 21 " 22 23 The inside turning radius for an access road shall be 28 feet (8,534 mm) or greater with a 5-foot 24 (1,524 mm) back of curb clearance for bumper overhang. The outside turning radius for an access road shall be a minimum of 46 feet (14,021 mm). California Department of 25 Transportation Highway Design Manual, Figure 404.5F shall be utilized. 26 17.04.280 Section 503.2.7 Grade - Amended 27 Section 503.2.7 of the California Fire Code is amended to read as follows: 17.04.270 Section 503.2.4 Turning radius - Amended Section 503.2.4 ofthe California Fire Code is amended to read as follows: 28 •11- 24 25 26 28 17.04.290 Section 503.3.1 Marking of fire apparatus access roads - Amended. Section 503.1 ofthe California Fire Code is amended to read as follows: 1 The gradient for a fire apparatus access roadway shall not exceed 10 percent (5.7 degrees). The grade may be increased to a maximum of 15 percent (8.5 degrees) for approved lengths of 2 access roadways when all structures served by the access road are protected by automatic fire sprinkler systems. Cross slope shall not be greater than two percent for paved access 3 roadways. Grades exceeding 10 percent (incline or decline) shall not be permitted without mitigation. 4 Minimal mitigation shall be the installation of fire sprinkler systems and a surface of Portland 5 cement concrete (PCC), with a deep broom finish perpendicular to the direction of travel, or equivalent, to enhance traction. 6 The Fire Code Official may require additional mitigation measures where deemed appropriate. 7 The angle of departure and angle of approach of a fire access roadway shall not exceed 12 percent (7 degrees) or as approved by the Fire Code Official. 8 9 10 .. When required by the Fire Code Official, one or more of the following methods shall be used to 11 identify fire apparatus access roads and prohibit their obstruction: 12 1. The entire length of the road shall be marked by approved signs posted at intervals no greater than 100 feet (30,480 mm), which identify the road as a "Fire lane" and state the 13 prohibition of parking therein. The sign shall also warn that vehicles in violation are subject to citation or removal. Such signs shall be posted in a permanent manner at a height no 14 greater than nine feet and no less than seven feet; or, 15 2. Standard curbs bordering fire access roads shall have the words "NO PARKING FIRE LANE" painted upon their horizontal and vertical surfaces at intervals of not more than 25 16 feet (7,620 mm). Letters shall be of block style, minimum five inches in height with a stroke of not less than three-fourths inch, and shall be white on a red background. The background 1^ shall extend at least six inches beyond the first and last letters of the text; or, 18 3. A monument type sign may be placed at the entrance to a private street which provides information as stated in sub-section 1 above, with additional wording necessary to inform 19 approaching vehicles of parking restrictions. Such signs must be approved by the Police Department and the Fire Code Official prior to installation. 21 22 17.04.300 Section 503.4.1 Traffic calming devices - Amended Chapter 5, Section 503.4.1 ofthe California Fire Code is amended to read as follows: Roadway design features (speed bumps, speed humps, speed control dips, etc.) which may 23 interfere with emergency apparatus response times shall not be installed on fire access roadways, unless they meet design criteria approved by the Fire Code Official. 17.04.310 Section 503.6.1 Gates - Amended Chapter 5, Section 503.6.1 ofthe California Fire Code is amended to read as follows: All gates or other structures or devices which could obstruct fire access roadways or othenA/ise ' hinder emergency operations are prohibited unless they meet standards approved by the Fire 12- 1 Code Official, and receive plan approval by the Fire Code Official. All automatic gates across fire access roadways and driveways shall be equipped with an approved emergency key- 2 operated switch which overrides all command functions and opens the gate(s). Gates accessing more than four residences or residential lots, or gates accessing hazardous, institutional, 3 educational or assembly occupancy group structures, shall also be equipped with approved emergency traffic control-activating strobe light sensor(s), or other devices approved by the Fire 4 Code Official, which will activate the gate on the approach of emergency apparatus and shall be provided with a battery back-up or manual mechanical disconnect in case of power failure. 5 All automatic gates accessing more than four residences or residential lots must meet fire 6 department policies deemed necessary by the Fire Code Official for rapid, reliable access. All gates providing access from a road to a driveway shall be located a minimum of 30 feet (9,144 7 mm) from the nearest edge of the roadway and the driveway width shall be 36 feet (10,973 mm) wide at the entrance on roadways of 24 feet (7,315 mm) or less of the traffic lane(s) serving the 8 gate. 9 Automatic gates serving more than one dwelling or residential lot in existence at the time of adoption of this Ordinance are required to install an approved emergency key-operated switch, or other mechanism approved by the Fire Code Official, at an approved location, which overrides all command functions and opens the gate(s). Property owners must comply with this 11 requirement within 90 days of written notice to comply. 10 12 Where this section requires an approved key-operated switch, it shall be dual keyed or dual switches shall be provided to facilitate access by law enforcement personnel. Electric gate 13 openers, where provided, shall be listed in accordance with UL 325. Gates intended for automatic operation shall be designed, constructed and installed to comply with the 14 requirements of ASTM F2200. 15 School grounds may be fenced and gates therein may be equipped with locks, provided that safe dispersal areas, based on three square feet per occupant, are located between the school 1" and the fence. Such required safe dispersal areas shall be located at least 50 feet from school buildings. Every public and private school shall conform to Education Code section 32020, 1' which states: 18 The governing board of every public school district and the governing authority of every private . Q school, which maintains any building used for the instruction or housing of school pupils on land entirely enclosed (except for building walls) by fences or walls, shall, through the cooperation of local law enforcement and fire protection agencies having jurisdiction of the area, provide for the erection of gates in these fences or walls. 21 The gates shall be of sufficient size to permit the entrance of ambulances, police equipment and 22 fire-fighting apparatus used by law enforcement and fire protection agencies. There shall be no less than one access gate and there shall be as many of these gates as needed to ensure 23 access to all major buildings and ground areas. If these gates are equipped with locks, the locking devices shall be designed to permit ready entrance by the use of chain or bolt-cutting 24 devices. Electric gate openers, where provided, shall be listed in accordance with UL 325. Gates intended for automatic operation shall be designed, constructed and installed to comply 25 with the requirements of ASTM F2200. 2^ 17.04.320 Section 505.1 Street numbers - Amended 27 Section 505.1 of the California Fire Code is amended to read as follows: 28 13- 1 Approved numbers and/or addresses shall be placed on all new and existing buildings and at appropriate additional locations as to be plainly visible and legible from the street or roadway 2 fronting the property from either direction of approach. Said numbers shall contrast with their background, and shall meet the following minimum standards as to size: 3 Single family residences: four inches high with a three-eighths inch stroke; for unit identification 4 of multi-family residential buildings: six inches high with a one-half inch stroke; for commercial, industrial and multi-family residential buildings: minimum 12 inches high with a 1 Vz inch stroke. 5 Additional numbers shall be required where deemed necessary by the Fire Code Official, such 6 as rear access doors, building corners, and entrances to commercial centers. The Fire Code Official may establish different minimum sizes for numbers for various categories of projects. 7 Multi-unit buildings: suite/apartment numbers shall be placed on or adjacent to the primary 8 entrance for each suite/apartment, and any other door providing access to fire department personnel during an emergency. 9 Multiple residential and commercial units having entrance doors not visible from the street or 10 road shall, in addition to numbers placed adjacent to the entry door, shall have approved numbers grouped for all units within each structure and positioned to be plainly visible from the 11 street, road or access path. 12 Multi-building clusters: shall place approved numbers or addresses on the front elevation(s) of all buildings that form the cluster. 13 14 15 18 19 20 21 22 23 24 25 27 28 17.04.330 Section 505.3 Easement address signs - Amended Chapter 5, Section 505.3 ofthe California Fire Code is amended to read as follows: All easements which are not named differently from the roadway, from which they originate, 16 shall have an address sign installed and maintained, listing all street numbers occurring on that easement and shall be located where the easement intersects the named roadway. Minimum 1^ size of numbers on that sign shall be four inches in height with a minimum stroke of three- eighths inch, and shall contrast with the background. 17.04.340 Section 505.4 Map/directory - Amended Chapter 5, Section 505.4 of the California Fire Code is amended to read as follows: A lighted directory map, meeting current fire department standards, shall be installed at each driveway entrance to multiple unit residential projects and mobile home parks where the number of units in such projects exceeds 15 units. 17.04.350 Section 505.5 Response map updates - Amended Chapter 5, Section 505.5 ofthe California Fire Code is amended to read as follows: Any new development, which necessitates updating of emergency response maps by virtue of new structures, hydrants, roadways or similar features, shall be required to provide map updates in a format approved by the fire department. The responsible party shall be charged a reasonable fee for updating the City emergency response maps. 14- 1 For any new power plant to be developed in the City of CaHsbad located west of Interstate 5, north of Cannon Road, south of Agua Hedionda Lagoon and east ofthe NCTD right of way, that 2 does not conform to the requirements of the Carisbad Fire Chief pursuant to Title 24 California Code of Regulations, § 503.2.2, response to any emergency shall be provided primarily by the 3 California Energy Commission or the power plant applicant or landowner, as appropriate, and the CaHsbad Fire Department shall be in a secondary response position and shall provide 4 emergency responses as appropriate on an incident-by-incident basis. 5 The response maps for any emergency response to this location shall be modified to indicate that the California Energy Commission or the power plant applicant or landowner, as 6 appropriate, shall provide primary response in the event of an emergency. 8 9 10 7 The City Clerk shall give notice of this modification as required by Health & Safety Code § 17958.7 to the California Building Standards Commission. 13 14 15 16 17 18 19 20 23 17.04.360 Section 506 Fire Service Features - Amended Chapter 5, Section 506 of the California Fire Code is amended to read as follows: Section 506.1 Key Boxes. When access to or within a structure or an area is unduly difficult 11 because of secured openings or where immediate access is necessary for life saving or firefighting purposes, the Fire Code Official is authorized to require a key box to be installed in 12 an accessible location. The key box shall be a type approved by the Fire Code Official and shall contain keys to gain necessary access as required by the Fire Code Official. Section 506.2.1 Emergency Key Access. All central station-monitored fire detection systems and fire sprinkler systems shall have an approved emergency key access box on site in an approved location. The owner or occupant shall provide and maintain current keys for the structure(s) for fire department placement in the box, and shall notify the fire department in writing when the building is re-keyed. All appliances for all central station-monitored fire detection systems and fire sprinkler systems shall have an approved single access key at the direction ofthe Fire Code Official. 17.04.370 Section 507.3 Fire flow - Amended Section 507.3 of the California Fire Code is amended to read as follows: Fire flows shall be based on Appendix B (as amended) of the 2013 California Fire Code. 2j Consideration should be given to increasing the gallons per minute set forth in Appendix B (as amended) to protect structures of extremely large square footage and for such reasons as: poor 22 access roads; grade and canyon rims; hazardous brush; and response times greater than five minutes by a recognized fire department or fire suppression company. In hazardous fire areas as defined in Appendix B, the main capacity for new subdivisions shall 24 not be less than 2,500 gallons per minute, unless othenA/ise approved by the Fire Code Official 23 If fire flow increases are not feasible, the Fire Code Official may require alternative design standards such as: alternative types of construction providing a higher level of fire resistance; 26 fuel break requirements which could include required irrigation; modified access road requirements; specified setback distances for building sites addressing canyon rim 27 developments and hazardous brush areas; and other requirements authorized by the CaHsbad Municipal Code and as specified by the Fire Code Official. 28 15- 1 17.04.380 Chapter 6, Section 610.6.1 Testing and proof of compliance - Amended 2 Chapter 5, Section 510.6.1 of the California Fire Code is amended to read as follows: 3 5. At the conclusion of the testing, a report which shall verify compliance with Section 510.5.4 shall be submitted to the fire code official. The location of fire department hose connections and control valves shall be approved by the Fire Code Official. 15 16 17 18 19 17.04.400 Section 603.8 incinerators - Amended Section 603.8 of the California Fire Code is amended to read as follows: Incinerators shall be prohibited. 17.04.410 Section 901.4.7 Fire department connections - Amended Section 901.4.7 ofthe California Fire Code is amended to read as follows: 17.04.420 Section 903.2 Automatic fire extinguishing systems - Amended Section 903.2 ofthe California Fire Code is amended to read as follows: When required by any Title of the Carisbad Municipal Code, an approved automatic sprinkler system in new buildings and structures shall be provided in the locations described in this section. For the purpose of fire-sprinkler systems, buildings separated by less than 10 feet (3,048 mm) 20 from adjacent buildings shall be considered as one, this includes one- and two-family dwellings. 21 Barriers, partitions and walls, regardless of rating, shall not be considered as creating separate 22 buildings for purposes of determining fire sprinkler requirements. 23 24 OS Any building or occupancy that employees a medical gas system as defined in Section 3006, in ry. addition to complying with the items described in 3006.1 through 3006.4, shall comply with the latest edition of NFPA 99. These occupancies shall be required to have an automatic fire 27 sprinkler system deigned to NFPA 13 standards. 28 -16- All new Non-residential buildings constructed in which the aggregate floor area exceeds five- thousand (5,000) square feet (464 m^) shall be required to be protected throughout by an approved automatic fire sprinkler system at the discretion of the Fire Code Official. Mezzanines shall be included in the total square footage calculation. 1 Notation: Authority: Health and Safety Code Sections 13108, 13143, 17921, 18949.2 which shall be considered equivalent to NFPA 130. Section P2904.4 and R313.3 shall apply to stand- 2 alone and multipurpose wet-pipe sprinkler systems that do not include the use of antifreeze. A multipurpose fire sprinkler system shall supply domestic water to both fire sprinklers and 3 plumbing fixtures. A stand-alone sprinkler system shall be separate and independent from the water distribution system. A backflow flow preventer shall not be required to separate a multi- 4 purpose sprinkler system from the water distribution system. For Group L and H occupancies that utilize medical gas systems for research purposes, Section 5 3006 in its entirety and all applicable chapters and sections of the 2010 fire code and applicable nationally recognized standards shall apply. 6 All obstructions such as fences, planters, vegetation and other structures must be considered 7 when determining whether a building is accessible from a particular location on the fire access roadway. Topography may also affect the potential access route and any significant changes in 8 elevation must be accounted for when measuring hose-pull distances. When required by Secfion 318.9, fire alarm panel location, manual fire alarm boxes, and horn/strobe locations. 10. Portable fire extinguisher locations. 26 11- The location and fuel capacity of all generators. /// -24- 1 Section K102: Definitions 2 K102.1 Decorative Materiais. All materials used for decorative, acoustical or other effect (such as curtains, draperies, fabrics, streamers, and surface coverings) and all other materials utilized 3 for decorative effect (such as batting, cloth, cotton, hay stalks, straw, vines, leaves, trees, moss and similar items), including foam plasfics and other materials containing foam plasfics. 4 K102.2 Temporary Amusement Haunted House. A temporary or permanent building or 5 structure, or portion thereof, usually used during the Halloween season for amusement or entertainment purposes where decorative materials, theatrical props, visual effects or audio 6 effects are utilized to create theatrical environment. A Temporary Amusement Haunted House may be deemed a Special Amusement Building by the fire code official depending on the floor 7 plan layout, lighting or visual distractions used and the effects those elements have on the identifying and accessing the means of egress in the event of a fire or an emergency. 8 K102.3 Ghost Walks. Similar to Temporary Amusement Haunted Houses and may include 9 both indoor and outdoor areas used for amusement or entertainment purposes. 10 11 15 16 17 18 19 20 K102.4 Temporary. Temporary shall mean amusement or entertainment use of a building or a structure, or portion thereof, at one location for not more than 30 days. K102.5 Special Amusement Buiiding. Any temporary or permanent building or portion thereof 12 that is occupied for amusement, entertainment or educafional purposes, and that contains a device or system that conveys passengers or provides a walkway along, around or over a 13 course in any direction so arranged that the means of egress path is not readily apparent due to visual or audio distractions or is intentionally confounded or is not readily available because of 14 the nature of the attraction or mode of conveyance through the building or structure. See California Building Code Secfion 411.2. Section K103 - General Requirements Kl03.01 Jurisdictional buiiding and planning department approvai. Approval to operate a Temporary Amusement Haunted House, Ghost Walk or similar use or to change the approved of use of an existing building, or portion thereof, for temporary amusement haunted house or similar use shall be approved by the jurisdicfional Building Official and Planning Official prior to the Fire Department's issuance of an operational permit for the event. K103.1 Ailowable structures. Temporary Amusement Haunted Houses, Ghost Walks, and similar amusement uses which meet the definifion of a Special Amusement Building shall only 21 be located in structures that comply with the provisions for Special Amusement Buildings in accordance with the California Building Code. 22 K103.2 Tents or membrane structures. Tents and membrane structures may be used when 23 in compliance with all applicable requirements of this regulation and when the total fioor area of the tent is less than 1,000 square feet and the travel distance to an exit from any location is less 24 than 50 feet. 25 K103.3 Fire evacuation pians. A fire safety and evacuation plan that complies with Section 404 of the California Fire Code shall be submitted. 26 K103.4 Staffing. The event shall be adequately staffed by qualified person(s) to control the 27 occupant load and assist patrons in exiting should an evacuation become necessary. Staffing 28 -25- 1 level shall be determined upon review of plans and may be increased at the discretion of the Fire Code Official. 2 K103.5 Occupant load. Maximum occupant load shall be in accordance with Chapter 10 3 Table 1004.1.1. A sign stafing maximum occupancy shall be posted in a visible locafion near the entrance. The attendant(s) shall control the fiow of patrons so as not to exceed this limit. 4 5 18 19 25 26 27 28 K103.6 Exits. Exiting shall be in accordance with Chapter 10 and this Secfion. 1. Two exits shall be provided from each room with an occupant load of 50 or more. Required 6 exit doors shall swing in the direction of egress. 2. Illuminated exit signs shall be provided at each exit serving an occupant load of 50 or more. 7 3. Exit doors serving an occupant load of 50 or more shall not be provided with a latch or lock unless it is panic hardware. 8 4. When tents or membrane structures are approved for use, curtains shall not be allowed to cover the exits. 9 5. Emergency lighting shall be provided in exit pathways. 6. Exhibits and decorative materials shall not obstruct, confuse, or obscure exits, exit pathways, 10 exit signs, or emergency lights. 7. Additional exit pathway markings, such as low level exit signs and directional exit path 11 markings, may be required. 12 K103.7 Fire protection. Temporary Amusement Haunted houses and ghost walks which meet the definition of a Special Amusement Building shall be provided with fire protection systems in 13 accordance with Appendix Kl 03.7. 14 Exception: When the total floor area of Haunted Houses or indoor portions of Ghost Walks are J ^ less than 1,000 square feet and the travel distance to an exit is less than 50 feet. Kl 03.7.1 Fire sprinkler protection. An automatic flre sprinkler system shall be required for 16 Temporary Amusement Haunted Houses and indoor portions of Ghost Walks which meet the deflnition of a Special Amusement Building. Fire sprinkler systems shall be in accordance with 1" Secfion 903. Kl 03.7.2 Fire detection systems. An approved automatic fire detection system shall be provided in accordance with Secfion 907.2.12 as required for amusement buildings. „ Kl03.7.3 Alarm. Activafion of any single smoke detector, the fire sprinkler system, or other automatic fire detection device shall be in accordance with Section 907.2.12.1. 21 Kl03.7.4 Emergency voice alarm. Provide an emergency voice/alarm communication system 22 in accordance with the Section 907.2.12.3 as required for amusement buildings. 23 Kl03.7.6 Portable fire extinguishers. Fire extinguishers shall have a minimum 2A-10B:C rating. Fire exfinguishers shall be properly mounted and shall be visible and accessible at all 24 times. Cleariy identify locations with signs or reflective tape. Fire extinguishers shall be located within 50 feet travel distance from anywhere in the building. K103.8 Electrical. When required, a permit shall be obtained from the local Building Official. Kl03.8.1 Extension cords. Extension cords shall be UL listed and shall be appropriate for the intended use. -26- 1 Kl 03.8.2 Power strips. Only UL listed power strips with overcurrent protection shall be used when the number of outlets provided is inadequate. Power strips shall be plugged directly into 2 the oufiet, and shall not be plugged into one another in series. 3 Kl 03.8.3 String lighting. Manufacturer's installation guidelines shall be followed for the maximum allowable number of string lights that can be connected. When connecting string 4 lights together, the total amperage of all string lights shall be calculated to ensure they do not exceed the amperage for the extension cord and circuit. 5 Kl 03.8.4 Protection. All extension cords and power strips shall be adequately protected from 6 foot traffic. 7 Kl03.8.5 Portable generators. When portable generators are utilized, they shall be diesel fuel type and located a minimum of 20 feet away from all structures. 8 K103.9 Decorative materiais. Interior wall, ceiling, and floor finishes shall be Class A rated in 9 accordance with the California Building Code. 10 Kl 03.9.1 Flame retardant. All decorative materials shall be both inherently flame retardant and labeled as such, or shall be treated with a listed flame retardant material. If the material is 11 treated by the user, a container and receipt will serve as proof. 12 Kl 03.9.2 Flame test. Tesfing shall be done in accordance with Secfion 803.5 of the California Fire Code as referenced from the California Code of Regulafions, Tifie 19, Division 1, Article 3, 13 Section 3.21(a) and (b). Proof of tesfing shall be provided. 14 Kl 03.9.3 Placement of decorative materials. Decorative materials, props and/or performer platforms shall not obstruct, confuse, or obscure exits, exit signs, exit pathways, emergency 15 lighfing or any component of fire protecfion systems and equipment (i.e. fire extinguishers, fire alarm systems, fire sprinklers, etc.) inside or outside the building. 16 Kl 03.10 Smoke generators. Use of smoke-generafing equipment may be restricted if 1' determined to be incompatible with smoke alarm(s). Care and consideration shall be used with respect to smoke generator and smoke alarm locations. Smoke generator and smoke alarm locations shall be approved by the Fire Department. 18 19 20 Kl 03.11 Display of motor vehicles. Display of motor vehicles shall be in accordance with Section 2402.18 ofthe California Fire Code. ^. K103.12 Inspections. A fire and life safety inspecfion shall be conducted by the Fire Department prior to the start of the event. 22 K103.13 Signs. "NO SMOKING" signs shall be conspicuously posted at the main entrance and 23 throughout the exhibit. 24 K103.14 Prohibited areas. Inside storage or use of flammable and/or combustible liquids, gases, and solids shall be prohibited. Open flames shall be prohibited. 25 K103.15 Maintenance. Good housekeeping shall be maintained throughout exhibit and exit 26 pathways, at all times. The City of CaHsbad adopts by reference the 20103 Edition of the California Fire Code, two 7 copies of which are on file in the office of the City Clerk, known as California Code of Regulations, Title 24, Part 9, except for the following amendments thereto. The City amends the 8 provisions of the 2010 California Fire Code to include the requirements of the 2010 Edition of the International Fire Code including Appendix Chapters 4 and Appendices B (as amended), 9 BB, C, D (as amended), F, G, H, I artd-J and K (amended) as published by the Internafional Code Council for those occupancies not subject to the 20103 California Fire Code. As adopted 10 and amended herein, the 20103 California Fire Code becomes the fire code of the City of CaHsbad. 17.04.020 Chapter 1, Division II, Part 1, Section 101.5 Validity—Amended. Chapter 1, Division ll. Part 1, Secfion 101.5 of the 20103 California Fire Code is 13 amended to read as follows: 14 The City Council of the City of CaHsbad hereby declares that should any secfion, paragraph, sentence or word of this Ordinance or of the City of CaHsbad Municipal Code hereby adopted 15 be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this Ordinance independently of the eliminafion here from of any 16 such portion as may be declared invalid. 17 17.04.030 Chapter 1, Division II, Part 1, Section 102.5 Application of California Residential Code — Amended. 18 Chapter 1, Division 11, Part 1, Secfion 102.5 of the 20103 California Fire Code is 19 amended to read as follows: 20 Where structures are designed and constructed in accordance with the California Residential Code, the provisions of this code shall apply as follows: 21 1. Chapter 1, Division II, Section 109.3 of the 20103 California Fire Code is amended to read as 27 follows: -3- EXHIBIT 2 1 Any person who violates any of the provisions of this code hereby adopted or fails to comply therewith, or who violates or fails to comply with any order made there-under, or who builds in 2 violation of any detailed statement or specificafion or plans submitted and approved there- under, or any certificate or permit issued there-under, and from which no timely appeal has 3 been taken, or who fails to comply with such an order as affirmed or modified by the City Attorney of the City of CaHsbad or by a court of competent jurisdiction within the time fixed 4 herein, shall severally for each and every violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine not exceeding $1,000 or by imprisonment in County Jail 5 not exceeding six months, or both. 6 The imposition of one penalty of any violafion shall not excuse the violafion or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects 7 within a reasonable time; and when not othenA/ise specified, each day that prohibited conditions are maintained shall constitute a separate offense. The applicafion of the above penalty shall 8 not be held to prevent the enforced removal of prohibited conditions. 9 17.04.050 Chapter 1, Division II, Part 2, Section 111.4 Failure to comply—Amended. 10 I Chapter 1, Division 11, Section 111.4 of the 20103 California Fire Code is amended to read as follows: 11 Any person, who continues any work after having been served with a stop work order, except 12 such work as that the person is directed to perform to remove a violafion or unsafe condition, shall be liable for a fine of not less than $250 or more than $1,000. 13 17.04.060 Chapter 1. Division 11. Part 2. Secfion 113.3 Work commencing prior to issuance 14 of permit—Amended 15 Chapter 1. Division 11. Section 113.3 of the 2013 California Fire Code is amended to read as follows: 16 Any person who commences any work, activity or operation regulated by this code prior to the 17 issuance or obtaining the reguired and necessary permits shall be subiect to an additional fee that is egual to the original permit fee, which shall be in addition to the reguired permit fees. 18 17.04.0670 Recovery of costs - Amended. 19 The City shall be entitled to recover the cost of emergency services as described in subsections 20 1 through 5 below. Service costs shall be computed by the fire department under the direction of the city finance department and shall include the costs of personnel, equipment facilities, 21 materials and other external resources. 22 1. Any person or corporation who allows a hazard to exist on property under control of that person or corporation, after having been ordered by the fire department or other city 23 department to abate that hazard, is liable for the cost of services provided by the fire department should an emergency arise as a result of said unabated hazard. 24 2. Any person or corporation whose negligence causes an incident to occur on any public or 25 private street, driveway or highway, which, for the purposes of life, property or environmental protecfion, places a service demand on the city fire department resources beyond the scope 26 of routine service delivery, shall be liable for all costs associated with that service demand. 27 28 -4- EXHIBIT 2 1 3. Any person or corporation responsible for property equipped with fire protection or detection devices which, due to malfunction, improper manipulafion or negligent operafion causes a 2 needless response by the fire department to the property shall, for a period of twelve months after written notification by the fire prevention bureau, be liable for all future costs associated 3 with each subsequent needless response caused by those devices. 4 4. Any person or corporation who conducts unlawful acfivity which results in fire, explosion, chemical release or any other incident to which the fire department responds for the purpose of performing services necessary for the protection of life, property or the environment, shall be liable for the costs associated with the delivery of those services. 22 23 24 25 5. When, in the interest of public safety, the fire chief, pursuant to Section 2501.18 of this code, assigns fire department employees as standby personnel at any event, or upon any premise, the person or corporation responsible for the event or premises shall reimburse the fire department for all costs associated with the standby services. 17.04.0780 Section 201.3 Terms defined in other codes—Amended. Section 201.3 of the 20103 California Fire Code is amended to read as follows: Where terms are not defined in this code and are defined in the California Building Code, California Mechanical Code, California Plumbing Code, California Residential Code and the International Urban-Wildland Interface Code, such terms shall have the meanings ascribed to them as in those codes. 17.04.0890 Section 202 Definitions - Fire hazard—Amended. Secfion 202 ofthe 20103 California Fire Code is amended to read as follows: "Fire hazard" is any-thing or act that increases or could cause an increase of the hazard or menace of fire to a greater degree than customarily recognized as normal by persons in the public service regulariy engaged in preventing, suppressing or extinguishing fire or any thing or act which could obstruct, delay, hinder or interfere with the operations of the fire department or the egress of occupants in the event of fire. m 17.04.09100 Section 202 Definitions - High Fire Hazard Severity Zone —Amended. 91 "High Fire Hazard Severity Zone" is any geographic area designated in accordance with California Government Code § 51178, which contains the type and condition of vegetation, topography, weather and structure density which potenfially increases the possibility of wildland confiagrafions. 17.04.1010 Section 202 Definitions - High-rise building — Amended. Section 202 ofthe 20103 California Fire Code is amended to read as follows: "High-rise building," as used in this code: "Existing high-rise building" means a high-rise 26 building, the construcfion of which is commenced or completed prior to July 1, 1974. "High-rise building" means every building of any type of construcfion or occupancy having floors used for 27 human occupancy located more than 55 feet above the lowest floor level having building access 28 -5- EXHIBIT 2 1 (see California Building Code, Section 403.1.2), except buildings used as hospitals as defined in Health and Safety Code Secfion 1250. "New high-rise building" means a high-rise building, the 2 construction of which is commenced on or after July 1, 1974.- 3 17.04.1420 - Section 202 Definitions - Ignition-resistant material—Amended. 4 Section 202 of the 20103 California Fire Code is amended to read as follows: 5 "Ignition-resistant material" is defined as any product which, when tested in accordance with ASTM E84 for a period of 30 minutes, shall have a fiame spread of not over 25 feet, and show 6 no evidence of progressive combusfion. In addition, the fiame front shall not progress more than 10.5 feet (3,200 mm) beyond the centeriine of the burner at any time during the test. 7 Materials shall pass the accelerated weathering test and be identified as Exterior type, in 8 accordance with ASTM D 2898 and ASTM D 3201. 9 All materials shall bear identification showing the fire performance rating thereof. That identification shall be issued by ICC—ES or a testing facility recognized by the State Fire 10 Marshal having a service for inspection of materials at the factory. 11 Fire-Retardant-Treated Wood or noncombustible materials as defined in Section 202 shall satisfy the intent of this secfion. 12 The enforcing agency may use other definitions of "ignition-resistant material" that reflect wildfire 13 exposure to building materials and/or their materials performance in resisfing ignition. 14 17.04.1230 Section 202 Definitions - Jurisdiction—Amended. 15 Secfion 202 of the 20103 California Fire Code is amended to read as follows: 16 "Jurisdiction" shall mean the City of Carisbad. 17 17.04.1340 Section 202 Definitions - Projections—Amended. lg Section 202 ofthe 20103 California Fire Code is amended to read as follows: 19 "Projections" are defined as cornices, eave overhangs, exterior balconies and similar projecfions 20 extending beyond the fioor area. Projecfions shall conform to the requirements of Section 704.2 and Section 1406 of the California Building Code. Exterior egress balconies and exterior exit 21 stainA/ays shall also comply with Section 1014.5 and 1023.1 of the California Building Code, respectively. Projections shall not extend beyond the distance determined by the following two 22 methods, whichever results in the lesser projection: 23 1. A point one4hird the distance to the lot line from an assumed vertical plane located where protected openings are required in accordance with California Building Code Section 704.8, 24 but not less than five feet from the lot line. 25 2. Group R-3, and Group U when used as accessory to Group R-3, shall be constructed not less than five feet from any lot line without having a fire resistance rated exterior wall and 26 openings that are protected as set forth in Table 5-A of the California Building Code. 27 17.04.1450 Section 202 Definitions - Vegetation — Amended. 28 EXHIBIT 2 1 Secfion 202 of the 20103 California Fire Code is amended to read as follows: 2 "Vegetafion" means weeds, grass, vines or other organic (cellulose) growth that is capable of being ignited and endangering property, and such vegetafion shall be cut down and removed by 3 the owner or occupant of the premises. Chapter 3 of the 20103 California Fire Code is amended to add Section 307.5.1 to read 11 as follows: 12 An adult (as defined in Webster's New World Dictionary-Eleventh College Edition) must be present at all times to watch and tend outdoor fires. 13 14 15 follows: 16 Posts shall be located not less than five feet (152.5 mm) from the protected object 17 I 17.04.1890 316.3 Pitfalls—Amended. 18 I Chapter 3, Secfion 316.3 of the 20103 California Fire Code is amended to read as follows: 19 When pitfalls are installed in violation of this code, the California Penal Code shall be used for 20 penalties, and violafions of this section. 21 I 17.04.40200 Section 318 General storage of firewood—Amended. 22 Chapter 3, Section 318 ofthe 20103 California Fire Code is amended to read as follows: 23 Firewood shall not be stored in unenclosed spaces beneath buildings or structures, or on decks or under eaves, canopies or other projections or overhangs. When required by the fire code 24 official, storage of firewood material stored in the defensible space shall be located a minimum of 30 feet (9,144 mm) from structures and separated from the crown of trees by a minimum of 25 15 feet (4,572 mm), measured horizontally. Firewood and combustible materials not for consumption on the premises shall be stored so as to not pose a hazard. 26 17.04.2010 Section 319 Maintenance of Fire Suppression Zones —Amended. 27 • 28 EXHIBIT 2 1 I Chapter 3, Secfion 319 of the 20103 California Fire Code is amended to read as follows: 2 Sec. 319.1 When required. An applicafion for a development permit for any property located in a wildland-urban interface fire area shall be required to have a Fire Protection Plan (FPP) 3 approved by the fire code official, as part of the approval process. 4 Section 319.2 Content. The FPP shall consider location, topography, geology, aspect, combustible vegetation (fuel types), climatic conditions and fire history. The plan shall address 5 the following in terms of compliance with applicable codes and regulations including but not limited to: water supply, primary access, secondary access, travel time to nearest serving fire 6 station, structural ignitability, structure set back, ignition-resistive building features, fire protection systems and equipment, impacts to existing emergency services, defensible space 7 and vegetafion management. 8 Section 319.4 Maintenance of defensible space: Any person owning, leasing, controlling, operating or maintaining a building or structure required to establish a fuel modification zone 9 pursuant to City of Carisbad development standards shall maintain the defensible space. The Fire Authority Having Jurisdicfion (FAHJ) may enter the property to determine if the person 10 responsible is complying with this secfion. The FAHJ may issue an order to the person responsible for maintaining the defensible space directing the person to modify or remove non- 11 fire resistant vegetation from defensible space areas, remove leaves, needles and other dead vegetative material from the roof of a building or structure, maintain trees as required by this 12 section or to take other action the FAHJ determines is necessary to comply with the intent of this section. 13 Section 319.5 Responsibility: Persons owning, leasing, controlling, operating or maintaining 14 buildings or structures are responsible for maintenance of defensible spaces. Maintenance of the defensible space shall be annually or as determined by the FAHJ and may include, but not 15 be limited to, the modification or removal of non-fire resistive vegetation and keeping leaves, needles and other dead vegetative material regulariy removed from roofs of buildings and 16 structures. 1^ Section 319.6. Trees: Crowns of trees located within defensible space shall maintain a minimum horizontal clearance of 10 feet for fire resistant trees and 30 feet for non-fire resistive trees. 1^ Mature trees shall be pruned to remove limbs one-third the height or six feet, whichever is less, above the ground surface adjacent to the trees. Dead wood and litter shall be regulariy removed 1^ from trees. Ornamental trees shall be limited to groupings of two to three trees with canopies for each grouping separated horizontally as described in the International Wildland Urban Interface Code (IWUIC). 20 21 22 23 17.04.2420 Section 503.2.1 Dimensions—Amended. The outside turning radius for an access road shall be a 4 minimum of 46 feet. California Department of Transportation Highway Design Manual, Figure 404.5F shall be ufilized. 5 " 6 7 „ The gradient for a fire apparatus access roadway shall not exceed 10 percent (5.7 degrees). 8 The grade may be increased to a maximum of 15 percent (8.5 degrees) for approved lengths of access roadways when all structures served by the access road are protected by automatic fire 9 sprinkler systems. Cross slope shall not be greater than two percent for paved access roadways. Grades exceeding 10 percent (incline or decline) shall not be permitted without 10 mitigafion. 11 Minimal mitigation shall be the installation of fire sprinkler systems and a surface of Portland cement concrete (PCC), with a deep broom finish perpendicular to the direction of travel, or 12 equivalent, to enhance tracfion. 13 The Fire Code Official may require additional mitigation measures where deemed appropriate. The angle of departure and angle of approach of a fire access roadway shall not exceed 12 14 percent (7 degrees) or as approved by the Fire Code Official. 17.04.2890 Section 503.3.1 Marking of fire apparatus access roads — Amended. Section 503.1 ofthe 20103 California Fire Code is amended to read as follows: 1^ When required by the Fire Code Official, one or more of the following methods shall be used to identify fire apparatus access roads and prohibit their obstruction: 1. The entire length of the road shall be marked by approved signs posted at intervals no greater than 100 feet, which identify the road as a "Fire lane" and state the prohibifion of parking therein. The sign shall also warn that vehicles in violation are subject to citation or removal. Such signs shall be posted in a permanent manner at a height no greater than nine feet and no less than seven feet; or. 2. Standard curbs bordering fire access roads shall have the words "NO PARKING FIRE LANE" painted upon their horizontal and vertical surfaces at intervals of not more than 25 feet. Letters shall be of block style, minimum five inches in height with a stroke of not less than three-fourths inch, and shall be white on a red background. The background shall 2^ extend at least six inches beyond the first and last letters of the text; or. 3. A monument type sign may be placed at the entrance to a private street which provides information as stated in sub-section 1 above, with additional wording necessary to inform approaching vehicles of parking restrictions. All automatic gates across 10 fire access roadways and driveways shall be equipped with an approved emergency key- operated switch which overrides all command funcfions and opens the gate(s). Gates accessing 11 more than four residences or residential lots, or gates accessing hazardous, institutional, educational or assembly occupancy group structures, shall also be equipped with approved 12 emergency traffic control-activating strobe light sensor(s), or other devices approved by the Fire Code Official, which will activate the gate on the approach of emergency apparatus and shall be 13 provided with a battery back-up or manual mechanical disconnect in case of power failure. 14 All automatic gates accessing more than four residences or residential lots must meet fire department policies deemed necessary by the Fire Code Official for rapid, reliable access. All 15 gates providing access from a road to a driveway shall be located a minimum of 30 feet from the nearest edge of the roadway and the driveway width shall be 36 feet wide at the entrance on 16 roadways of 24 feet or less of the traffic lane(s) sen/ing the gate. 1^ Automatic gates serving more than one dwelling or residential lot in existence at the time of adoption of this Ordinance are required to install an approved emergency key-operated switch, or other mechanism approved by the Fire Code Official, at an approved location, which overrides all command functions and opens the gate(s). Property owners must comply with this requirement within 90 days of written notice to comply. 27 28 m 18 19 20 21 Where this section requires an approved key-operated switch, it shall be dual keyed or dual 22 switches shall be provided to facilitate access by law enforcement personnel. Electric gate openers, where provided, shall be listed in accordance with UL 325. Gates intended for 23 automatic operation shall be designed, constructed and installed to comply with the requirements of ASTM F2200. 24 School grounds may be fenced and gates therein may be equipped with locks, provided that 25 safe dispersal areas, based on three square feet per occupant, are located between the school and the fence. Such required safe dispersal areas shall be located at least 50 feet from school 26 buildings. There shall be no 5 less than one access gate and there shall be as many of these gates as needed to ensure access to all major buildings and ground areas. If these gates are equipped with locks, the 6 locking devices shall be designed to permit ready entrance by the use of chain or bolt-cutting devices. Electric gate openers, where provided, shall be listed in accordance with UL 325. 7 Gates intended for automafic operation shall be designed, constructed and installed to comply with the requirements of ASTM F2200. 8 9 10 28 17.04.3420 Section 505.1 Street numbers — Amended. Section 505.1 ofthe 20103 California Fire Code is amended to read as follows: Approved numbers and/or addresses shall be placed on all new and existing buildings and at 11 appropriate additional locations as to be plainly visible and legible from the street or roadway fronting the property from either direction of approach. Said numbers shall contrast with their 12 background, and shall meet the following minimum standards as to size: 13 Single family residences: four inches high with a three-eighths inch stroke; for unit identification of multi-family residenfial buildings: six inches high with a one-half inch stroke; for commercial, 14 industrial and multi-family residenfial buildings: minimum 12 inches high with a 1 Va inch stroke. 15 Additional numbers shall be required where deemed necessary by the Fire Code Official, such as rear access doors, building corners, and entrances to commercial centers. The responsible party shall be charged a 11 reasonable fee for updating the City emergency response maps. 12 For anv new power plant to be developed in the City of CaHsbad located west of Interstate 5. north of Cannon Road, south of Agua Hedionda Lagoon and east of the NCTD right of way, that does not 13 conform to the reguirements of the CaHsbad Fire Chief pursuant to Title 24 California Code of Regulations. j$ 503.2.2. response to any emergency shall be provided primarily by the California 14 Energy Commission or the power plant applicant or landowner, as appropriate, and the Carlsbad Fire Department shall be in a secondary response position and shall provide emergency responses 15 as appropnate on an incident-by-incident basis. 16 The response maps for any emergency response to this location shall be modified to indicate that the California Energy Commission or the power plant applicant or landowner, as appropriate, shall 17 provide primary response in the event of an emergency. 18 The City Clerk shall give notice of this modification as reguired by Health & Safety Code § 17958.7 to the California Building Standards Commission. 19 " 20 21 Secfion 506.1 Key Boxes: When access to or within a structure or an area is unduly difficult 22 because of secured openings or where immediate access is necessary for life saving or firefighting purposes, the Fire Code Official is authorized to require a key box to be installed in 23 an accessible location. The key box shall be a type approved by the Fire Code Official and shall contain keys to gain necessary access as required by the Fire Code Official. 24 Secfion 506.2.1 Emergency Key Access: All central station-monitored fire detection systems 25 and fire sprinkler systems shall have an approved emergency key access box on site in an approved location. The owner or occupant shall provide and maintain current keys for the 26 structure(s) for fire department placement in the box, and shall notify the fire department in wrifing when the building is re-keyed. 27 28 17.04.3660 Section 506 Fire Service Features - Amended. Section 603.8 ofthe 20103 California Fire Code is amended to read as follows: Residential Incinerators shall be prohibited. 17.04.390 Section—605.11—Building—Services and—Systems—Photovoltaic—Power 26 Systems Amended. -14- EXHIBIT 2 1 Chapter 6, Secfion 605.11 of the 2010 California Fire Code is amended to read as follows: 2 Sec. 605.11 Solar photovoltaic power systems: Solar photovoltaic power systems shall be 3 installed in accordance with this code, the Building Code and the Electrical Code. 4 Exception: Detached Group U non-habitable structures such as parking shade structures, carports, solar trellises and similar type structures are not subject to the requirements of this 5 section. 6 Sec. 605.11.1 Marking: Marking is required on all interior and exterior conduit, enclosures, raceways, cable assemblies, junction boxes, combiner boxes and disconnects. 7 Sec. 605.11.1.1 Materials: The materials used for marking shall be refiective, weather resistant 8 and suitable forthe environment. Marking as required in secfions 605.11.1.2 through 605.11.1.4 shall have all letters capitalized with a minimum height of three-eighths inch white on red 9 background. 10 Seo^—605.11.1.2 Marking content: The marking shall contain the words "WARNING: PHOTOVOLTAIC POWER SOURCE." 11 Sec. 605.11.1.3 Main service disconnect: The marking shall be placed adjacent to the main 12 sen/ice disconnect in a location cleariy visible from the location where the disconnect is operated. 13 Sec. 605.11.1.4 Locafion of marking: Marking shall be placed on all interior and exterior DC 14 conduit, raceways, enclosures and cable assemblies every 10 feet, within one foot of all turns or bends and within one foot above and below all penetrations of roof/ceiling assemblies and all 15 walls and barriers. 16 Sec. 605.11.2 Locations of DC conductors: Conduit, wiring systems and raceways for photovoltaic circuits shall be located as close as possible to the ridge, hip or valley and from the 17 hip or valley as directly as possible to an outside wall to reduce trip hazards and maximize ventilation opportunities. Conduit runs between sub arrays and to DC combiner boxes shall be 18 installed in a manner that minimizes the total amount of conduit on the roof by taking the shortest path from the array to the DC combiner box. The DC combiner boxes shall be located 19 such that conduit runs are minimized in the pathways between arrays. DC wiring shall be installed in metallic conduit or raceways when located within enclosed spaces within a building. 20 Conduit shall run along the bottom of load bearing members. 21 Sec. 605.11.3 Access and pathways: Roof access, pathways and spacing requirements shall be provided in order to ensure access to the roof, provide pathways to specific areas of the roof, 22 provide for smoke ventilation operafions, and to provide emergency egress from the roof 23 Exceptions: 24 1. Requirements to ridge, hips and valleys do not apply to roof slopes of two units vertical in 12 units horizontal (2:12) or less. 25 2. The Fire Code Official may allow modules to be located up to the ridge when an alternative ventilation method acceptable to the Fire Code Official has been provided or where the Fire 2 Code Official has determined vertical ventilation techniques will not be employed. 3 Sec. 605.11.3.1 Roof access points: Roof access points shall be defined as an area that does not place ground ladders over openings such as windows or doors, and are located at strong 4 points of building construction in locafions where the access point does not confiict with overhead obstructions such as tree limbs, wires or signs. 5 Sec. 605.11.3.2 Residential systems for one- and two-family residential dwellings: Access shall 6 be provided in accordance with Sections 605.11.3.2.1 through 605.11.3.2.^. 7 Sec 605.11.3.2.1 Residenfial buildings with hip roof layouts: Modules shall be located in a manner that provides a 3 foot wide clear access pathway from the eave to the ridge on each 8 roof slope where modules are located. The access pathway shall be located at a structurally strong location on the building capable of supporting the live load of fire fighters accessing the 9 fOOfr 10 m 11 Sec. 605.11.3.2.2 Residential buildings with a single ridge: Modules shall be located in a manner that provides two, three foot wide access pathways from the eave to the ridge on each 12 roof slope where the modules are located. 13 Sec. 605.11.3.2.3 Hips and valleys: Modules shall be located no closer than 18 inches to a hip or a valley if modules are to be placed on both sides of a hip or valley. If the modules are to be 14 located on only one side of a hip or valley that is of equal length then the modules shall be permitted to be placed directly adjacent to the hip or valley. 15 Sec. 605.11.3.2.4 Smoke ventilation: Modules shall be located no higher than three feet below 16 the ridge in order to allow for fire department smoke ventilation operafions. 17 Sec. 605.11.3.3 All other occupancies: Access shall be provided in accordance with Sections 605.11.3.3.1 through 605.11.3.3.3. 18 Exception: Where it is determined by the Fire Code Official that the roof configuration is similar 19 to a one or two family dwelling, the Fire Code Official may approve the residential access and ventilation requirements provided in Sections 605.11.3.2.1 through 605.11.3.2.4 20 Sec. 605.11.3.3.1 Access: There shall be a minimum six foot wide clear perimeter around the 21 edges of the roof 22 Exception: If either axis of the building is 250 feet or less, there shall be a minimum four foot wide clear perimeter around the edges of the roof 23 Sec. 605.11.3.3.2 Pathways: The solar photovoltaic installation shall be designed to provide 24 designated pathways. The pathways shall meet the following requirements: 25 1 • Pathways shall be over areas capable of supporting the live load of fire fighters accessing the roof. 26 27 28 16- Upr 4. Smoke ventilation options between array secfions shall be one of the following: 12 a. A pathway eight feet or greater in width; 13 b. A four feet or greater in width pathway and bordering roof skylights or smoke and heat vents 14 c. A four feet or greater in width pathway and bordering four foot by eight foot venting cutouts every 20 feet on alternating sides of the pathway. 15 Sec. 605.11.^ Ground mounted photovoltaic arrays: Ground mounted photovoltaic array 16 installations shall meet the requirements of Secfions 605.11.4.1. 17 Sec. 605.1 I.d. 1 Access: Access to ground mounted photovoltaic arrays, associated equipment structures and operations/maintenance buildings shall be per Section 503. 18 19 Sec. 605.11.^.1.1 Perimeter access roadway: Ground mounted photovoltaic arrays 10 acres 20 and larger in size shall be provided with an access roadway around the perimeter of the project. The perimeter access roadway shall be installed per Section 503. 21 Sec. 605.1 l.'i.2 Fuel modification: Combustible vegetation within the array and to a distance of 22 20 feet from the array and associated equipment shall be reduced to a height of no more than six inches. Operation/maintenance buildings shall be provided with a fuel modification 23 zone per Section 319. 24 17.04.4010 Section 901.4.67 Fire department connections — Amended. 25 I Section 901.4.57 of the 20103 California Fire Code is amended to read as follows: 26 Fire hose threads used in connection with fire-extinguishing systems shall be National Standard Thread or as approved by the Fire Code Official. The location of fire department hose 27 connections and control valves shall be approved by the Fire Code Official. Exception: Private residential systems where the energy generated is primarily for on-site use. 28 -17- 4f EXHIBIT 2 1 I 17.04.4420 Section 903.2 Automatic fire extinguishing systems — Amended. 2 I Section 903.2 of the 20103 California Fire Code is amended to read as follows: 3 When required by any Title of the Carisbad Municipal Code, an approved automatic sprinkler system in new buildings and structures shall be provided in the locations described in this 4 section. 5 For the purpose of fire-sprinkler systems, buildings separated by less than ten (10) feet from adjacent buildings shall be considered as one, this includes one- and two-family dwellings. 6 Barriers, partitions and walls, regardless of rating, shall not be considered as creating separate 7 buildings for purposes of determining fire sprinkler requirements. 8 All new Non-residential buildings constructed in which the aggregate floor area exceeds five- thousand (5,000) square feet shall be required to be protected throughout by an approved 9 automafic fire sprinkler system at the discretion of the Fire Code Official. Mezzanines shall be included in the total square footage calculation. 10 Any building or occupancy that employees a medical gas system as defined in Section 3006, in 11 addition to complying with the items described in 3006.1 through 3006.4, shall comply with the latest edition of NFPA 99. These occupancies shall be required to have an automatic fire 12 sprinkler system deigned to NFPA 13 standards. 13 m Notation: Authority: Health and Safety Code Sections 13108. 13143. 17921. 18949.2 which shall be considered eguivalent to NFPA 13D. Ghost Walks, and 8 similar amusement uses which meet the definition of a Special Amusement Building shall only be located in structures that comply with the provisions for Special Amusement Buildings in 9 accordance with the California Building Code. " ' K103.2 Tents or membrane structures. Tents and membrane structures mav be used when 11 in compliance with all applicable reguirements of this regulation and when the total fioor area of the tent is less than 1.000 sguare feet and the travel distance to an exit from any location is less 12 than 50 feet. K103.3 Fire evacuation plans. A fire safety and evacuation plan that complies with Section 404 of the California Fire Code shall be submitted. 15 K103.4 Staffing. The event shall be adeguately staffed by gualified person(s) to control the occupant load and assist patrons in exiting should an evacuation become necessary. Staffing 16 level shall be determined upon review of plans and may be increased at the discretion of the Fire Code Official. lg K103.5 Occupant load. Maximum occupant load shall be in accordance with Chapter 10 Table 1004.1.1. A sign stafing maximum occupancy shall be posted in a visible locafion near 19 the entrance. The attendant(s) shall control the flow of patrons so as not to exceed this limit. K103.6 Exits. Exifing shall be in accordance with Chapter 10 and this Section. 20 21 1. Two exits shall be provided from each room with an occupant load of 50 or more. 22 Reguired exit doors shall swing in the direction of egress. 2. Illuminated exit signs shall be provided at each exit serving an occupant load of 50 or more. 3. Exit doors serving an occupant load of 50 or more shall not be provided with a latch or lock unless it is panic hardware. 25 4. When tents or membrane structures are approved for use, curtains shall not be allowed to cover the exits. 26 5. Emergency lighting shall be provided in exit pathways. 6. An automatic fire sprinkler system shall be reguired for Temporary Amusement Haunted Houses and indoor portions of Ghost Walks which meet the 8 definition of a Special Amusement Building. Fire sprinkler systems shall be in accordance with Section 903. 24 Kl 03.7.2 Fire detection systems. An approved automatic fire detecfion system shall be provided in accordance with Secfion 907.2.12 as reguired for amusement buildings. 9 10 11 .. . Kl03.7.3 Alarm. Activation of any single smoke detector, the fire sprinkler system, or other 12 automatic fire detection device shall be in accordance with Section 907.2.12.1. 11 Kl 03.7.4 Emergency voice alarm. Provide an emergency voice/alarm communication system 14 in accordance with the Section 907.2.12.3 as reguired for amusement buildings. 15 Kl03.7.5 Portable fire extinguishers. Fire extinguishers shall have a minimum 2A-10B:C rating. Fire extinguishers shall be properiy mounted and shall be visible and accessible at all 16 times. Cleariy identify locations with signs or reflective tape. Fire extinguishers shall be located within 50 feet travel distance from anywhere in the building. lg K103.8 Electrical. When reguired. a permit shall be obtained from the local Building Official 19 Kl 03.8.1 Extension cords. Extension cords shall be UL listed and shall be appropriate for the intended use. 20 21 Kl 03.8.2 Power strips. Only UL listed power strips with overcurrent protection shall be used when the number of outlets provided is inadeguate. Power strips shall be plugged directly into 22 the outlet, and shall not be plugged into one another in series. 23 Kl 03.8.3 String lighting. Manufacturer's installation guidelines shall be followed for the maximum allowable number of string lights that can be connected. When connecting string lights together, the total amperage of all string lights shall be calculated to ensure they do not 25 exceed the amperage for the extension cord and circuit. 26 Kl 03.8.4 Protection. The following summary highlights the significant proposed changes to the city's construction codes. BUILDING AND FIRE CODE Every three years the State of California by order of the legislature publishes an updated version of construction regulations referred to as the California Building Standards Code. All new commercial and residential buildings must be built in compliance with these standards. The California Building Standards Commission is responsible for developing and publishing these revised standards in collaboration with other state agencies. Local city and county building departments have been delegated enforcement responsibility by California's legislature. Local jurisdictions may adopt findings for more restrictive building standards reasonably necessary due to specific local climatic, geological or topographical conditions. These are typically referred to as "local amendments". The local amendment findings must be filed with the Building Standards Commission in order to be effective. It should be noted that local jurisdictions may be more restrictive than the State Building Code, but may not be less restrictive. The California Residential Building Code, Part 2.5 of the Building Standards Code, published by the commission in July 2013, and effective in all California cities on January 1, 2014, continues to require all new homes to be protected with fire sprinklers regardless of size. The new California Residential code applies only to newly constructed homes or dwelling units and exempts all existing, remodeled, or expanded un-sprinklered homes from the requirement regardless of the proposed use of the new area. The CaHsbad Fire Marshal is recommending continuing the city's existing commercial fire sprinkler code requirements. As recommended, installation of auto-sprinkler systems will not be required for additions to existing unsprinkled commercial buildings unless the aggregate building exceeds the allowable area for unsprinklered buildings prescribed in the California Building Code. In all cases, new commercial buildings that exceed 5,000 square feet will be required to install automatic fire sprinkler systems. This approach is consistent with State law and recognizes the conflict between economic development and expansion of an existing business and the cost of providing additional fire protection. BUILDING DISABLED ACCESSIBILTY The disabled accessibility provisions of the California Building Code found in Chapter llA and IIB have been entirely reformatted to be consistent with the Americans with Disability Act and the ADA accessibility guidelines. This significant change will remove some of the difficulty experienced by architects, developers and builders in the past, when trying to comply with both federal and state accessibility standards. SWIMMING POOL BARRIERS To promote uniformity with other jurisdictions and state law, Chapter 18.28, Swimming Pool Enclosures and Use found in the municipal code will be deleted and replaced by the pool barrier provisions adopted by reference found in the California Building Code. CALGreen-California Energy Code The Governor of California, as a part of the Greenhouse Gas (GHG) emissions reduction policy referred to in AB32, directed the Building Standards Commission to develop standards that enhance the design and construction of buildings through the use of building concepts that have a reduced negative environmental impact. These sustainable construction practices include the following categories: Planning and Design, Energy Efficiency, Water Efficiency and Conservation, Material Conservation and Efficiency, and Environmental Quality. The CALGreen code is divided into residential and commercial sections and includes both mandatory and voluntary provisions. The 2013 edition of the CALGreen Code or Green Building Standards Code will now apply to additions to non-residential buildings 1000 square feet or greater and/or building alterations with a permit valuation of $200,000.00 or greater. Also, due to technical issues with energy compliance software, the enforcement of the energy provisions of Calgreen and the California Energy Code has been delayed until July 1, 2014. The Energy Code has been amended locally to require provisions to allow for more cost effective and convenient retrofitting of solar energy alternatives such as photovoltaic or solar water heating systems. The pnmary goal of the mandatory provisions and many of the voluntary or suggested provisions contained in the CALGreen Code is to establish in all California cities a baseline and consistent level of sustainability practices in the areas of environmental, energy, water, and material conservation. The focus of the CALGreen Code is to reduce the impact and the amount of energy used in the construction and operation of buildings. CaHsbad has been at the forefront in recognizing the need for sustainable development in all areas of building construction practices. In response to the city's policy approach to sustainability, programs have been previously added to the municipal code and are currently implemented by the appropriate agency within the city operational areas. The CaHsbad Building Official is recommending that the city not adopt any of the voluntary provisions of CALGreen as a part of the Building Code to avoid redundant implementation and enforcement of programs the city is already implementing. Attached to this memorandum, "APPENDIX A" is a summary of the City of Carisbad's existing sustainability programs arranged by CALGreen Code category with identification of the city agency responsible for implementation of each program. 'D CALGreen does contains new interior environmental air quality measures that will mandate limits on Volatile Organic Compounds (VOCs), considered pollutants, used in interior finishes, adhesives and other coatings found in residential and commercial buildings. The adoption of the latest CALGreen code is consistent with the city's vision of environmental sustainability and current practices and programs. The trend in California appears to be towards more restrictive mandates in the area of GHG reductions. In future iterations ofthe Green Building codes, voluntary measures may also become more restrictive than current CaHsbad adopted policies and programs. The City Council may, at a later date, choose to include these voluntary measures as a mandatory program in CaHsbad. Alternately, developers may analyze the rate of return on alternative energy sources including photovoltaics or other energy cogeneration systems and make a business decision to voluntarily include these systems in their product. The tHennial code adoption cycle will give the City Council the opportunity to re-evaluate this trend in a timely manner and balance the economic and environmental issues associated with the new technologies when adopting future building construction codes. Based on the current level of conservation and environmental programs in CaHsbad, the CaHsbad Building Official is recommending adoption ofthe CALGreen code as proposed by the State of California, without local amendments adopting additional voluntary measures. PLUMBING ELECTRICAL AND MECHANICAL CODE The Building Standards are the official compilation of amendments to the California Code of Regulations, Title 24 and are published in various parts. In addition to Fire, Building and Green Building Standards, there are provisions in the code that relate to the safety of the Electrical, Plumbing and Mechanical systems installed in buildings. These model codes are written by recognized leading code experts and other members of recognized professional organizations and amended by specific agencies of the State of California. The CaHsbad Building Official is recommending that these parts of the Building Standards be adopted as published without local amendments.
