RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2014-071 to ACCEPT the portion of a previously
rejected offer of dedication PR 11-42, ADOPT Resolution No. 2014-072 to APPROVE the
vacation a portion of a slope and landscape maintenance easement STV 11-02, and ADOPT
Resolution No. 2014-073 to APPROVE the final map for CT 06-15, Tabata Ranch.
ITEM EXPLANATION:
On August 5, 2009 the Planning Commission approved CT 06-15, Tabata Ranch. The approval was
conditioned subject to the acceptance by the City of Carlsbad of a portion of a previously rejected
Irrevocable Offer of Dedication (IOD) for a portion of Lemon Leaf Drive. The approval was also
conditioned subject to the vacation of a portion of a slope and landscape easement along Poinsettia
Lane by the City of Carlsbad.
When Lemon Leaf Drive was accepted for public street and utility purposes, the City rejected a
portion ofthe IOD between the cul de sac of Lemon Leaf Drive and this project. The property owner
has submitted PR 11-41 requesting the acceptance of a portion of the previously rejected IOD in
order to provide sufficient public street frontage for this project from Lemon Leaf Drive.
When Poinsettia Lane was constructed adjacent to the south boundary of CT 06-15, the City acquired
the necessary slope and landscape maintenance easement for its construction. The property owner
has submitted STV 11-02 to vacate a portion of this easement to allow the removal of a portion of the
existing slope and incorporate the area into the buildable portion of the residential lots. This
easement was acquired by the city via the eminent domain process. The property owner is therefore
required to reimburse the city for the fair market value ofthe easement being vacated. The current
fair market value of the easement rights to be vacated has been determined by a MAI real estate
appraiser. The property owner has submitted funds to the city for the current fair market value. The
property owner has also submitted landscape and irrigation plans for the reconfiguration of
landscape and irrigation plans necessary to accommodate the vacation and the property owner has
submitted evidence of an agreement with home owner's association responsible for maintenance of
the remaining easement area acknowledging the necessary reconfiguration of the landscape and
irrigation. The portion of the easement to be vacated does not provide access to any city facility or
any city-maintained facility. The portion ofthe easement to be vacated is not needed now nor will it
be needed in the future.

Land Development Engineering staff has completed checking the final map of CT 06-15, known as
Tabata Ranch. This subdivision is within Local Facilities Management Plan (LFMP) Zone 20 and is
generally located east of Lonicera Street, west of Lemon Leaf Drive and north of Poinsettia Lane. The
project proposes a total of eight lots comprised of five residential lots and three open space lots. No
further discretionary permits are required before building permits can be issued for this
development. The final map conforms substantially with the tentative map as approved by Planning
Commission on August 5, 2009 per PC Resolution No. 6619. The final map also conforms to the
General Plan, all the applicable requirements of the Municipal Code, City Standards, and Growth
Management Plan. The property owner. The Tabata Family Trust, is requesting the recordation of
said final map.
ENVIRONMENTAL IMPACT:
Approval of CT 06-15 was dependent on City Council approval of other applications, including a
General Plan Amendment. The Council approved these applications and adopted a Mitigated
Negative Declaration on October 6, 2009. Adoption ofthe MND indicated all potentially significant
environmental impacts could be mitigated to below a level of significance.
Approval of CT 06-15 included conditions directing the project developer to apply to the City for
acceptance of a portion of the IQD and for vacation of a portion of the slope and landscape
maintenance easement. The recommended actions are consistent with these conditions and, along
with the recommended approval of the final map, are post approval submittals in substantial
conformance with the approved project. Therefore, recommended actions are exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal
Code Section 19.04.070 A.l.a.
FISCAL IMPACT:
The property owner paid a plan check fee to cover the expense of plan checking and processing PR
11-41, the request for the acceptance of a portion of a previously rejected IOD.
The property owner paid a plan check fee to cover the expense of plan checking and processing STV
11-02, the request for a vacation of a portion of the slope and landscape maintenance easement.
Pending approval by council, the property owner has paid the city the current fair market value for
the portion ofthe slope and landscape maintenance easement being vacated.
The property owner paid a plan check fee to cover the expense of plan checking and processing the
final map for recording. All other processing and development impact fees required to be paid prior
to final map approval have been paid. Additional processing and development impact fees will be
paid, as required, if and when building permits are issued for this project.

WHEREAS, pursuant to the above named action, the City of Carlsbad, a Municipal
Corporation, as Plaintiff paid the sum of money due the Tabata Family Trust, Defendant; and
WHEREAS, the Tabata Family Trust, property owner of CT 06-15, has submitted
a request known as STV 11-02 Tabata Ranch, to the City of Carlsbad requesting that the City
vacate a portion of said easement; and
WHEREAS, the current market value ofthe easement rights of that portion ofthe
easement to be vacated have been determined in a manner consistent with the Carlsbad
Municipal Code; and
WHEREAS, the Tabata Family Trust, property owner of CT 06-15 has paid to the
City of Carlsbad the current market value of the easement rights of that portion of the easement
